Genetic Use Restriction (Or Terminator) Technologies (Gurts) In Agricultural Biotechnology: The Limits Of Technological Alternatives To Intellectual Property, Chidi Oguamanam Jan 2005

Genetic Use Restriction (Or Terminator) Technologies (Gurts) In Agricultural Biotechnology: The Limits Of Technological Alternatives To Intellectual Property, Chidi Oguamanam

Canadian Journal of Law and Technology

This article examines the adequacy of terminator technology as a potential substitute for traditional intellectual property. It acknowledges that the technology provides a stronger protection and reward mechanism than that offered by the traditional intellectual property rights regime. However, terminator technology or any other technology for that matter, is outside the pantheon of intellectual property regimes. Fundamentally, terminator is a technological answer to the quest by private sector interests to improve appropriability of returns on investments in agrobiotech. It potentially represents a panacea to the long standing industry struggle over the profitability of private research in agrobiotech and the need …

Engagement With The Land: Redemption Of The Rural Residence Fantasy?, Kirsten Valentine Cadieux Jan 2005

Engagement With The Land: Redemption Of The Rural Residence Fantasy?, Kirsten Valentine Cadieux

College of Liberal Arts All Faculty Scholarship

Many assessments of the contribution of rural amenity migrants to rural sustainability have been rather bleak – or have considered the possible contributions of these migrants in terms of pessimistic opportunism. Although many who move to rural places to consume an amenitized rural lifestyle contribute significantly to the maintenance of these rural landscapes, the landscape that has resulted from their residential, rather than productive, use of rural areas poses some difficulties for environmental planners (Gertler, 1994; Troughton, 1995). For planners and residents interested in facilitating the negotiation of rural sustainability, it is important to identify ways in which rural in-migration …

Creating The Online Learning Community For Distributed Education Doctoral Programs, Miguel Ramlatchan Jan 2005

Creating The Online Learning Community For Distributed Education Doctoral Programs, Miguel Ramlatchan

Distance Learning Faculty & Staff Publications

Many colleges and universities now readily embrace the Internet as a viable distributed learning delivery model. As such, the Internet is a valuable tool to attract the highest quality students to an institution’s academic programs. However, while this may work well at the undergraduate or master’s level, many institutions maintain a required residential or internship requirement as part of a doctoral program. This interactive learning community is a vital aspect of a quality doctorate program. This paper presents a means to create an online learning community to replicate the residential graduate student experience. This goal is accomplished through the collaborative …

Reduced Macrophage Apoptosis Is Associated With Accelerated Atherosclerosis In Low-Denstiy Lipoprotein Receptor-Null Mice, Michael Sinensky, J. Liu, D. P. Thweke, Y. R. Su, M. F. Linton, S. Fazio

Faculty Publications, Biological Sciences

Objective— The majority of apoptotic cells in atherosclerotic lesions are macrophages. However, the pathogenic role of macrophage apoptosis in the development of atherosclerosis remains unclear. Elevated expression of Bax, one of the pivotal proapoptotic proteins of the Bcl-2 family, has been found in human atherosclerotic plaques. Activation of Bax also occurs in free cholesterol-loaded and oxysterol-treated mouse macrophages. In this study, we examined the effect of Bax deficiency in bone marrow-derived leukocytes on the development of atherosclerosis in low-density lipoprotein receptor-null (LDLR−/−) mice. Methods and Results— Fourteen 8-week-old male LDLR−/− mice were lethally irradiated and reconstituted with either wild-type (WT) …

Convergence Analysis Of Mcmc Method In The Study Of Genetic Linkage With Missing Data, Diana Fisher Jan 2005

Convergence Analysis Of Mcmc Method In The Study Of Genetic Linkage With Missing Data, Diana Fisher

Theses, Dissertations and Capstones

Computational infeasibility of exact methods for solving genetic linkage analysis problems has led to the development of a new collection of stochastic methods, all of which require the use of Markov chains. The purpose of this work is to investigate the complexities of missing data in pedigree analysis using the Monte Carlo Markov Chain (MCMC) method as compared to the exact results. Also, we attempt to determine an association between missing data in a familial pedigree and the convergence to stationarity of a descent graph Markov chain implemented in the stochastic method for parametric linkage analysis.

In particular, we will …

The Nebraska Natural Legacy Project, Rick Schneider, Mark Humpert, Kristal Stoner, Gerry Steinauer Jan 2005

The Nebraska Natural Legacy Project, Rick Schneider, Mark Humpert, Kristal Stoner, Gerry Steinauer

Nebraska Game and Parks Commission: Publications

When the Nebraska Game and Parks Commission began work on a comprehensive wildlife conservation strategy (Nebraska Natural Legacy Project) two and a half years ago, we had to decide on an approach that would ensure we developed the best plan possible. The agency could have drawn only from the expertise of professional biologists, or alternatively sought input from a wide diversity of stakeholders. We decided to utilize both and what resulted was one of the largest collaborative efforts ever undertaken on behalf of wildlife in the state’s history. Sixteen public input meetings, a conservation practitioners workshop, and dozens of meetings …

Is Prosecution "Medically Appropriate"?, Douglas Mossman Md Jan 2005

Is Prosecution "Medically Appropriate"?, Douglas Mossman Md

Faculty Articles and Other Publications

Each year, U.S. courts send thousands of incompetent defendants to hospitals for treatment, where psychiatrists frequently administer psychotropic medication that can alleviate symptoms and allow the defendants to proceed with criminal adjudication. Although defendants and their attorneys usually do not object to such treatment, treatment refusals in two recent, nationally prominent cases-those of Russell Eugene Weston, Jr., the accused Capitol shooter, and Charles T. Sell, a dentist charged with filing false insurance claims-have focused legal and media attention on whether and under what conditions competence restoration can be forced on an unwilling defendant.

In its June 2003 decision in Sell …

Evaluation Of A New Method For Measuring Salamanders, Leroy J. Walston, Stephen J. Mullin Jan 2005

Evaluation Of A New Method For Measuring Salamanders, Leroy J. Walston, Stephen J. Mullin

Faculty Publications

Collection of morphometric data is essential to many field studies of amphibian populations. One of the most common measurements obtained from salamanders is snout-to-vent length (SVL), a parameter useful in studies of sexual dimorphism (Bovero et al. 2003), demography (Semlitsch 1985), and systematics (Carlin 1997). Measuring salamander lengths in the field is challenging because of their small size, slimy texture, and propensity to maintain a nonlinear body position. Time expenditure is another concern, especially when researchers process large numbers of salamanders. Different measurement techniques vary in accuracy and precision, limiting the reliability of the data so that comparisons cannot be …

Allometry, Sexual Size Dimorphism, And Niche Partitioning In The Mediterranean Gecko (Hemidactylus Turcicus), James B. Johnson, Lance D. Mcbrayer, Daniel Saenz

Faculty Publications

Hemidactylus tucrius is a small gekkonid lizard native to the Middle East and Asia that is known to exhibit sexual dimorphism in head size. Several potential explanations exist for the evolution and maintenance of sexual dimorphism in lizards. We tested 2 of these competing hypotheses concerning diet partitioning and differential growth. We found no differences in Average meal size (volume) or in any single dimension of prey size for similarly sized males and females. allometric patterns of increases in head size also were measured in males and females. We found that males exhibited a mixture of isometric and positively allometric …

Collective Violence And Individual Punishment: The Criminality Of Mass Atrocity, Mark A. Drumbl Jan 2005

Collective Violence And Individual Punishment: The Criminality Of Mass Atrocity, Mark A. Drumbl

Scholarly Articles

There is a recent proliferation of courts and tribunals to prosecute perpetrators of genocide, war crimes, and crimes against humanity. The zenith of this institution-building is the permanent International Criminal Court, which came into force in 2002. Each of these new institutions rests on the foundational premise that it is appropriate to treat the perpetrator of mass atrocity in the same manner that domestic criminal law treats the common criminal. The modalities and rationales of international criminal law are directly borrowed from the domestic criminal law of those states that dominate the international order. In this Article, I challenge this …
