Deterrence And Crime Results, Marcelo Ferrante Mar 2005

Deterrence And Crime Results, Marcelo Ferrante

ExpressO

This article offers a comprehensive study of the merits of the legal practice of punishing accomplished crimes more severely than attempted crimes all other things being equal (Differential Punishment) vis-à-vis the alternative of punishing them with equal sanctions (Equal Punishment). Unlike the overwhelming majority of the literature on the issue—which focuses on which practice better mirrors the offenders’ relative moral deserts—the article evaluates both practices from a consequentialist, deterrence-based point of view. In particular, it shows first that traditional economic theories of the criminal law should yield the conclusion that differential punishment is not superior to equal punishment. The few …

The Deep Structure Of Law And Morality, Robin B. Kar Mar 2005

The Deep Structure Of Law And Morality, Robin B. Kar

ExpressO

This Article argues that morality and law share a deep and pervasive structure, an analogue of what Noam Chomsky calls the “deep structure” of language. This structure arises not to resolve linguistic problems of generativity, but rather from the fact that morality and law engage psychological adaptations with the same natural function: to allow us to resolve social contract problems flexibly. Drawing on and extending a number of contemporary insights from evolutionary psychology and evolutionary game theory, this Article argues that we resolve these problems by employing a particular class of psychological attitudes, which are neither simply belief-like states nor …

Endostatin Modulates Vegf-Mediated Barrier Dysfunction In The Retinal Microvascular Endothelium, Brenda B. Brankin, M. Campbell, P. Canning, T. Gardiner, A. Stitt Mar 2005

Endostatin Modulates Vegf-Mediated Barrier Dysfunction In The Retinal Microvascular Endothelium, Brenda B. Brankin, M. Campbell, P. Canning, T. Gardiner, A. Stitt

Articles

Recent evidence indicates that the anti-angiogenic peptide endostatin may modulate some of the vasomodulatory effects of vascular endothelial growth factor (VEGF) in the retina, including reduction of blood retinal barrier function although it remains uncertain how endostatin promotes endothelial barrier properties. The current study has sought to examine how physiological levels of endostatin alters VEGF-induced inner BRB function using an in vitro model system and evaluation of occludin and ZO-1 regulatory responses. In addition, the ability of exogenous endostatin to regulate VEGF-mediated retinal vascular permeability in vivo was investigated.

Retinal microvascular endothelial cells (RMEC's) were exposed to various concentrations of …

Family And Consumer Sciences In Higher Education: Common Elements In Undergraduate Curriculum, Susan Lovett

Doctoral Dissertations and Projects

This study of undergraduate programs was undertaken to create a current portrait of Family and Consumer Sciences programs and to determine whether common ground exists among the various academic units particularly in the area of curriculum content. The thirty four schools having accreditation with SACS and AAFCS were chosen as the population to be studied. Two lists of curricular element categories were created to evaluate the programs: a 28 item list derived from historical categorizations used in professional journals and educational reporting and a 16 item list taken from the national standards for FCS in secondary programs. The subject matter …

A Common Tragedy: The Breach Of Promises To Benefit The Public Commons And The Enforceability Problem, Irma S. Russell Mar 2005

A Common Tragedy: The Breach Of Promises To Benefit The Public Commons And The Enforceability Problem, Irma S. Russell

Texas Wesleyan Law Review

This Article begins an exploration of the possibility of using contract law as a supplement to statutory law that protects the commons. It examines contractual commitments created by governmental agencies as representatives of the public. Part II relates the economic analysis set forth by Garrett Hardin in his famous article, The Tragedy of the Commons, and applies this analysis of the cost-benefit ratio that applies to use of a public good (the commons).

Private Law And Public Interest; My Kingdom For A Horse: Reining In Runaway Legislation From Software To Spam, Courtney Lytle Perry

Texas Wesleyan Law Review

This Article considers three examples of failing to "look before you legislate." The first section addresses one of the first major statutory treatments of software, the 1980 amendment to the Copyright Act of 1976. The second section addresses the more recent, failed attempt to proactively draft commercial rules for software related transactions. The final statute examined is the 2003 CAN SPAM Act 3 that took effect January 1st of 2004.

The Surprisingly Strong Case For Tailoring Constitutional Principles, Mark D. Rosen Mar 2005

The Surprisingly Strong Case For Tailoring Constitutional Principles, Mark D. Rosen

All Faculty Scholarship

Many constitutional principles apply to more than one level of government. This is true not only of Bill of Rights guarantees that have been incorporated against the States, but of many constitutional principles whose source lies outside of the Bill of Rights. The conventional wisdom is that such multi-level constitutional principles apply identically to all levels of government. The Article's thesis is that this One-Size-Fits-All approach is problematic because the different levels of government - federal, state, and local - sometimes are sufficiently different that a given constitutional principle may apply differently to each level. This Article critically examines an …
