Distinctively Delineated Fictional Characters Who Constitute The Story Being Told: Who Are They And Do They Deserve Separate Copyright Protection?, Jasmina D. Zecevic

Literary characters are protected within the copyright of the original work in which they appear, but the law is less clear when a character is separated from the original work and leads an independent life. The two main tests articulated by courts to deal with the phenomenon of an independent character, the “distinctly delineated” and “story being told” tests have not been particularly helpful. The tests are mainly used after a decision has already been reached to give the decision additional validity by uttering the magic words “distinctly delineated” or “story being told”.

Use Of Track Plates To Quantify Predation Risk At Small Spatial Scales, Matthew J. Connors, Eric M. Schauber, Andrew Forbes, Clive G. Jones, Brett J. Goodwin, Richard S. Ostfeld

Publications

Spatial heterogeneity in risk is a critical component of predator-prey interactions. However, at small spatial scales, it is difficult to quantify predation risk without altering it. We used track plates to measure local predation risk created by white-footed mouse (Peromyscus leucopus) foraging activity on oak-forest plots in Millbrook, New York. Live gypsy moth pupae (Lymantria dispar) were placed at 2 heights on trees and monitored for predation. Pupae deployed on trees visited by mice were more likely to be eaten than those on trees not visited. Logistic regression indicated that predation rates on gypsy moth pupae were …

Reading For Character: Principles Of Bibliotherapy Applied To Children’S Literature., Karen L. Parker

In the past decade, interest has revived in character education, a facet of American education from the earliest days of the nation’s history. Bibliotherapy, the process of reading books with a therapeutic intent, is an effective means to implement character education within the curriculum. Bibliotherapy is a child-friendly and noninvasive technique that can be used in various groupings, settings, and ability levels. Book selection, active dialogue, and follow-up activities are critical elements in the successful classroom implementation of a bibliotherapy lesson.

The Dick Whittington Story: Theories Of Poor Relief, Social Ambition, And Possibilities For Class Transformation, Helen Hershkoff

Texas Wesleyan Law Review

The New Yorker cartoon, with its pessimistic emphasis on a child's economic prospects, provides a foil to the Whittington story and its optimistic attitude toward law and social possibility. I suggest in this talk that contemporary children's literature shares with the cartoon a similar lack of confidence in law's capacity to generate advancement and prosperity. My comments rely on Eleanor Updale's award-winning Montmorency series and Philip Pullman's widely acclaimed His Dark Materials trilogy to try to glean a better sense of cultural understandings of law and of law's contemporary relation to social mobility. Infertility is a devastating global malady triggering worldwide demand for a vast array of reproduction assisting technologies. Infertility is particularly devastating in "pronatalist" societies marked by high rates of infertility and large disparities in access to medical services. Poverty in particular impedes large segments of the population in pronatalist Third World countries from gaining access even to very basic techniques of infertility treatment and consigns them to ineffective traditional remedies. Although often dismissed as a myth, the image of the judge as a Herculean superhero whose mission is to apply the law in a straightforward way retains a tenacious grip on our understandings of the judge and judging. The relationship between Oscar Wilde's Happy Prince and Hercules is one of uncomfortable similarity and difference. This collection of essays about the law and Harry Potter explores the intersections between law, culture, and the Harry Potter stories. The collection begins with a group of essays, consistent with some of the previous legal literature, about the limitations of law and legal institutions as depicted in the Harry Potter narratives. The essays by James Charles Smith and Danaya Wright begin by considering the depiction of families in the narratives, and show the limited role of law for family relationships. Analysis Of Gaits For A Rotating Tripedal Robot, Damian M. Lyons, Kiran Pamnany

A goal of robotics has been to develop mechanisms that have the efficiency and speed of wheeled robots with the terrain flexibility of legged robots. In previous work, we have proposed a unique three-legged mechanism, the rotopod, designed to integrate these two useful approaches to locomotion. In this paper, we present an analysis of the variety of gaits that can be exhibited by the rotopod. We present examples of many of these gaits and discuss their potential use. A trajectory generation algorithm is presented that can be used to generate point to point trajectories using one of three different styles …

Weaning time can be stressful for cows and calves. Under traditional weaning systems, changes in environment, diet composition, and pathogen exposure can reduce animal performance and result in health problems. In response to these challenges, interest in fenceline weaning has grown in recent years. Fenceline weaning is a management system in which the calves are removed from their dams but are allowed to see, hear, and smell their dams. Depending on the fencing used, physical contact may also be possible. Fenceline weaning has the potential to reduce stress related to transport, changes in environment, and diet adaptation.
