This article deals with the application of Community competition law to sports rights acquisition markets in the light of their close relationship with retail television. Analysed is their impact on the development of Community competition law, and especially the fact that they illustrate the necessity to re-evaluate some of its fundamental concepts, as well as to expand the scope of this analysis to incorporate new economic models. Noted is also the influence that the necessity to analyse sports rights acquisition markets had on the state of competition found on television markets, which are increasingly affected by the Community competition law, …

The protection of individual investors stimulates economic development. It increases capital formation and enlarges the social basis of the investment process. Additionally, it ensures sufficient liquidity and plays a vital part in the market's absorption of newly invented products. The acquisition of the small investor has become an important goal for the main players on the capital market, therefore the protection of the small investor is getting support from the whole system. This does not mean that new regulations specially directed at small investors are in order, as it is far more important to promote grass-roots initiatives that aim to …

The article discusses the two main pro-competitive functions of public intervention into market economy, that is 'competition protection' and 'pro-competitive sector-specific regulation'. It aims in particular to illustrate the basic differences between these two functions. Competition protection is defined here as an intervention directed at the protection of existing competition. It has an ex post (re-active) and individually penalising character. On the other hand, pro-competitive sector-specific regulation is understood as intervention supporting the development of competition. It has an ex ante (pro-active), prescriptive and non-transitory character. The text also shows the fact that the fulfilment of both functions is entrusted …

Following the liberalisation of network industries, rapid development of regulatory bodies may be treated as a paradox if we take into account the fact that deep criticism of this form of regulation in US paved the way for market-oriented reforms in these industries. The author reviews the main lines of theoretical and empirical arguments against US institutionalised regulation, and then shows the key role of regulation in the liberalisation of these kinds of industries. The attention is focused on pro-competition and incentive regulation, as it explains why establishment of regulatory bodies is thought to be a necessary condition for their …

The regulation of access to essential facilities in network industries should first of all introduce competition in downstream markets. Thus, the main objectives of the regulation are: creation of competition, consumer protection, and fulfilment of national and social objectives. The European Commission has based the access regulation regime on the antitrust essential facilities doctrine and has developed the access rules to essential facilities according to non-discriminatory, transparent and reasonably priced terms.

This communiqué relates to the Decision of the European Commission of 24 March 2004 in Case Microsoft. In the Decision, the Commission concluded that Microsoft Corporation broke EC competition law by leveraging its near monopoly on the market of PC operating systems onto the markets of work group server operating systems and of media players. The Commission ordered Microsoft to disclose to competitors the interfaces required for their products to be interoperable with Windows. Microsoft is also required to offer to PC manufacturers a version of its Windows without Windows Media Player. Microsoft was fined € 497 million.

As of May 1, 2004, essential changes have taken place in competition law. Regulation (EC) 1/2003, which introduced new rules of proceeding in antitrust matters, entered into force on this date. The four pillars of the reform are as follows: discontinuation of the notification system, harmonisation of substantive law, decentralised application and reinforcement of investigative tools. National courts shall play a fundamental role in the effective enforcement of competition law. Regulation (EC) 139/2004 establishes a new EC merger control system. New Guidelines have also been adopted in order to increase effectiveness in this type of matters. National state aid provisions …

Ancillary restraints doctrine as linked with the implementation of the prohibition of agreements restraining competition (prohibition of cartels) constitutes the subject of the article. It is used to indicate the limits of implementation of the prohibition of cartels and simultaneously it allows to decide on the scope of the exemption from the prohibition. The concept has been developed through case law of the European Court of Justice, especially judgments on: Göttrup-Klim, European Night Services, Métropole. The concept of ancillary restraints serves as a method for rationalising the scope of implementing the prohibition of cartels. This means that the ancillary restraints …

The article contains economical reasons for the producers' demanding Resale Price Maintenance (RPM) from agents in light of the new EC regulation (1999) excluding vertical restraints from prohibition of restrictive agreements. While there are some variations as to the nature of the price restriction (advertised or recommended prices, price floors, price ceilings), RPM is generally viewed as a very controversial tool. The article shows - from a theoretical point of view - when RPM improves or harms economic efficiency and what the real motives for implementing RPM are. The influence of RPM on social welfare depends, inter alia, on the …

The institution of administrative fines is one of the key elements of the penalty system imposed for violation of the ban on competition restricting practices. To make the penalty system more effective under Polish, as well as Community law, there has been a Leniency Programme introduced, based on a collaboration between participants of anti-competition agreements with authorities protecting free competition. Within the framework of the Leniency Programme, there is a possibility to apply two legal instruments toward the co-operating entrepreneur, i.e. immunity from fines and reduction of fines. The subject of the publication is to present and analyse legal and …

Czy Możliwa Jest Demokratyczna Debata O Regulacji Rynku Mediów?, Przemysław Hensel
European Management Studies
The starting point for this text is the assumption that regulation of the mass media sector is a political problem and, therefore, a democratic debate is an indispensable prerequisite for settling it. The analysis of stakeholders' interests in this sector is conducted in order to answer the question formulated in the text's title. Next, two theories (the agenda-setting theory, the framing effect theory) are presented with the intention of explaining how the media outlets influence public debate on mass media sector regulation. Then, strategies of influence most often used on the Polish media market are described. Finally, the consequences of …

Polski Model Regulacji Na Tle Porównawczym, Waldemar Hoff
European Management Studies
Regulation as a form of state intervention first emerged in the United States after WW I with the rise of new sectors such as energy and telecommunications. Regulatory authorities were made independent, so that they would not strengthen the powers of the president. Regulation in Poland is the result of European integration. The fundamental feature of any regulator is independence. In Poland, the independence is being undermined by i.a. excessively detailed legislation. The Polish model is characterised by entrusting the regulatory powers to one person, assisted by an advisory collegiate body, and by one-tier of decision making. The Polish model …

Kontrola Koncentracji Mediów W Dobie Digitalizacji. Pomiędzy Regulacją A Konkurencją, Marcin Kolasiński
European Management Studies
The article concerns the problem of the control of media concentration. Due to the specific nature of this form of economic activity, there are various concepts of appropriate law mechanisms to regulate market structure. The main doubts are connected with the fact that the element protected by law in this case is not market competition in the pure economic sense, but, above all, media pluralism. A guarantee of the existence of this value, according to the supporters of detailed sector regulation, requires a definition of the admissible forms of administrative interference into the ownership structures of media entrepreneurs. Opponents of …

The sector of legal services (including liberal professions) has a significant role in contemporary EU communities and economies. Legal services are subject to broad and specific regulation in Member States. There is no regulation on liberal professions at this stage of European Law. The Institute for Advanced Studies in Vienna (on demand of European Commission) has prepared a report on regulation in the field of liberal professions in Member States. The study presents a comparison of the legislation, regulation and economic effectiveness. It indicates that there is a very high level of regulation and a large number of restrictions, which …
