Leslie Marmon Silko’s (mixed-blood Laguna Pueblo) Ceremony is a powerful novel that tells the story of Tayo, a mixed-blood Pueblo war veteran who returns to Laguna mentally crippled by his wartime experiences. As Tayo struggles to overcome the alienation his military service has created, he must also face the shame of his own mixed heritage. His suffering eventually leads him off the pueblo to a Navajo healer, Betonie, who helps Tayo create a new historical paradigm based on Navajo and Laguna mythology. Betonie’s fictional re-vision of history is, perhaps, the novel’s most important accomplishment. Through Betonie, Silko creates an alternative …

This paper argues that the gap between the theoretical utility and the practical utility of the resource-based view (RBV) may be narrowed by operationalizing the theory more consistently with Penrose's original framework. The operationalization proposed here is a twofold approach. First, the RBV may be enhanced by the explicit recognition of Penrose's two classes of resources, namely, administrative resources and productive resources. This distinction suggests a focus on the administrative decisions of managers that lead to economic performance. Second, we argue that the RBV is a theory about extraordinary performers or outliers—not averages. Therefore, the statistical methods used in applying …

Recent evidence from highly publicized frauds and from the Public Oversight Board’s Panel on Audit Effectiveness (2000) indicates that auditors sometimes over-rely on weak evidence supporting a clean audit opinion. In experiment 1 we examine whether a favorable outcome, together with insensitivity to factors relating to the strength of evidence, could lead to over-reliance on weak substantive procedures. In experiment 2 we examine whether an explicit ex ante prompt can sensitize auditors to the weaknesses of an unreliable substantive procedure. We assess the impact of 401(k) plan design on four different 401(k) savings outcomes: participation in the 401(k) plan, the distribution of employee contribution rates, asset allocation, and cash distributions. We show that plan design can have an important effect on all of these savings outcomes. This suggests an important role for both employers in determining how to structure their 401(k) plans and government regulators in creating institutions that encourage or discourage particular aspects of 401(k) plan design.

When using fMRI to study age-related cognitive changes, it is important to establish the integrity of the hemodynamic response because, potentially, it can be affected by age and disease. However, there have been few attempts to document such integrity and no attempts using higher cognitive rather than perceptual or motor tasks. We used fMRI with 28 healthy young and older adults on an inhibitory control task. Although older and young adults differed in task performance and activation patterns, they had comparable hemodynamic responses. We conclude that activation during cognitive inhibition, which was predominantly increased in elders, was not due to …

The Stroop interference effect, caused by difficulty inhibiting overlearned word reading, is often more pronounced in older adults. This has been proposed to be due to declines in inhibitory control and frontal lobe functions with aging. Initial neuroimaging studies of inhibitory control show that older adults have enhanced activation in multiple frontal areas, particularly in inferior frontal gyrus, indicative of recruitment to aid with performance of the task. The current study compared 13 younger and 13 older adults, all healthy and well educated, who completed a Stroop test during functional magnetic resonance imaging. In recent years, he has undertaken the ambitious task of exploring a significant topic at the boundary of contract law: liability for problems that arise out of efforts to form a contract. The standard contract that governs friendly mergers contains a material adverse change clause (a "MAC") and a material adverse effect clause (a "MAE"); these clauses permit a buyer costlessly to cancel the deal if such a change or effect occurs. In recent years, the application of the traditional standard-like MAC and MAE term has been restricted by a detailed set of exceptions that curtails the buyer's ability to exit. The term today engenders substantial litigation and occupies center stage in the negotiation of merger agreements. Back in the 1990s, Internet communications policy was easier. It was easy to agree that the network's growth ought not be impended by excessive government regulation. It was easy to hope that the Internet would solve all of its own problems. Yet it turned out that the success of the network was hiding strong differences of opinion. Today, the euphoria is gone, and the divide in Internet communications policy has become clear and unmistakable. It most clearly a divide between two distinct groups: the self-proclaimed "Openists" and "Deregulationists."

Providing comfort is a fundamental nursing responsibility. Unrelieved postoperative pain has adverse physiologic and psychologic effects that contribute to prolonged hospital admissions and significant discomfort to patients. Opioids are standard methods of postoperative analgesia for many surgical procedures. Unfortunately, the use of opioids is associated with side effects such as nausea and vomiting, urinary retention, ileus and respiratory depression. These side effects, with the added problem of inadequate pain control, result in patient dissatisfaction with surgical procedures.

Child abuse studies have measured physiological reactivity of parents in response to several child- and nonchild-related stimuli. Abusive parents have responded to aversive stimuli, including that which is child-related, with atypical physiological reactivity, suggesting a trait of hyperreactivity. The current study tested the hypothesis that variation in observed parenting behaviors is associated with physiological reactivity to childrelated stimuli. To explore this association, researchers measured fathers' skin conductance level, heart rate and respiration rate in reaction to video segments of a quiet, crying and happy infant, then scored observed father-child interactions for the use of parenting warmth and control across four …

Leading human-computer interaction (HCI) researchers recognize a fundamental difference exists between men and women. Some HCI research has been done regarding gender differences in hand-eye coordination for interactions with computer touch display interfaces, navigation through virtual environments (VE) and language in computer-mediated communication. In these previous studies, gender differences were found in the use of words and language in computer-mediated communication and in navigation strategies for VE but no gender-related differences were found for the hand-eye coordination needed to effectively use a touch display.

The United States is becoming more diverse; numerous immigrants and refugees enter every year. Among the newer groups are those practicing the Muslim religion.

This qualitative research focused on the identity formation process of six adolescent female Muslim refugees from Afghanistan. Based on Erikson's paradigm of psycho-social development and Marcia's modifications to that theory, I used semi-structured interviews to understand how the participants negotiated their identities in the context of their families, the public school, and the community.

This study examines issues of access to higher education in Florida and South Africa. On November 9, 1999, the Governor of the State of Florida issued Executive Order 99-281 to establish the One Florida Initiative (OFI), which barred the use of race as a factor in university admissions. In South Africa, the government in February 2001 issued its National Plan for Higher Education (SANPHE). This plan outlined a framework to redress past inequities in the higher education system perpetuated by the former government's apartheid ideology. This qualitative study examined how experienced African American teachers in predominantly African American schools perceived and conceptualized their worklives as classroom teachers, and, how they viewed their personal and professional identities in relationship to their lives as teachers. Architects: take a serious look at your demographics. While other professions are making strides to represent the diversity of America's population, yours lags markedly behind. Most U.S. architecture schools began admitting women and minorities between 1965 and 1972, but many who completed architecture degrees in the interim haven't yet received professional licensure. The ranks of licensed architects remain mainly white and mainly male, which denies society fair representation in shaping the built environment. In this Commentary, Professor Franke offers an account of the Supreme Court's decision in Lawrence v. Texas. She concludes that in overruling the earlier Bowers v. Hardwick decision, Justice Kennedy does not rely upon a robust form of freedom made available by the Court's earlier reproductive rights cases, but instead announces a kind of privatized liberty right that affords gay and lesbian couples the right to intimacy in the bedroom. In this sense, the rights-holders in Lawrence are people in relationships and the liberty right those couples enjoy does not extend beyond the domain of the private. Franke expresses …

James Madison is considered the "Father of the Constitution," but his progeny disappointed him. It had no effective defense against self-government's "mortal disease" – the oppression of minorities by local majorities. This Article explores Madison's writings in an effort to reclaim the deep conception of equal protection at the core of his constitutional aspirations. At the Convention, Madison passionately advocated a radical structural approach to equal protection under which the "extended republic's" broadly focused legislature would have monitored local laws and vetoed those that were parochial and "unjust."
