Judicial Review Of Agency Inaction: An Arbitrariness Approach, Lisa Schultz Bressman

Vanderbilt Law School Faculty Publications

This Article contends that the current law governing judicial review of agency inaction, though consistent with the prevailing theory of agency legitimacy, is inconsistent with the founding principles of the administrative state. The Supreme Court's reluctance to allow judicial review of agency inaction reflects the popular view that agency decision-making should be subject foremost to the scrutiny of politically accountable officials. The difficulty is that even scholars who generally support this view of agency decision-making reject the Court's treatment of agency inaction. 李晨風電影作品與「五四傳統」的關係, Hoi Yin Shum

愛國反帝運動和新文化運動所引起的批評傳統、關心社會、強調民主思想和科學精神的思潮,一直被認為是五四傳統的基調。發展到三、四十年代,由於抗戰的影響,有「救亡」壓倒「啟蒙」的趨勢,而在1949年後,在兩岸三地中,香港正因為特殊的政治位置,成為言論相對自由的地帶。在這個直接政治干預相對較少的背景下,李晨風在五、六十年代主動改編多部五四傳統 的文學作品,繼承五四精神,實在值得深入研究。李晨風在的改編中, 藉著周蕙和高淑英的對比, 強調五四時期「個人」與「家庭」間的對立,以突出反傳統、反家庭的望題。至於的改編,李晨風在原有的戰爭背景下, 加強了對戰爭的控訴,使戰爭成為所有不幸事情的原兇。另外,又一改曾發生的形象,把她改寫成完美的媳婦,讓白燕保持一貫正面形象之餘,為新式女性在「經濟自主」與「家庭倫理」之間得到協調的空間。李晨風的改編電影,改寫了小翠的悲劇命運,比曹禺原著中對「希望」的暗示表露得更清楚。 其他改編五四時間流行的外國翻譯作品如托爾斯泰的著作,更能看到他對關懷社會的有一種執著。甚至其他並非直接與五四主題有關的電影作品中,亦可以見到李晨風批評軍閥、讚揚革命、追求個性自由的思想。

Despite evidence on nursing’s contribution to the quality of care, much of what nurses “do” remains essentially invisible.

It is vital to recognize the need for a paradigm shift in nursing that utilizes new informatics tools required for optimum use of evidence related to the delivery of quality nursing care.

Embedding nursing language within informatics structures is essential to make the work of nurses visible, and articulate evidence about the quality and value of nursing in the care of patients, groups, and populations.

The Octofoil is the offical publication of the Ninth Infantry Division Association, Inc., an organization formed by the officers and men of the 9th Infantry Division in order to perpetuate the memory of fallen comrades, preserve the esprit de corps of the Division, promote peace and serve as an information bureau about the 9th Infantry Division. The Association is made up of 9th Infantry veterans from WWII and Vietnam, spouses, widows and lineal descendants.

Representational Roles And Cues In The 2004 Nebraska Legislature, Rhonda Saferstein

This research updates research done in 1972 on representational roles in the Nebraska Legislature. This research also examines one aspect of legislative decision-making based on previous studies regarding sources of cues used by legislators when deciding how to vote on bills. A survey of incumbent Nebraska Legislators reveals changes since 1972 in the predominant representational role orientation chosen by senators. They survey also sheds light on the sources of cues most relevant to these legislators and how cue-taking relates to representational roles.

Instructional Methods And Efficacy Of Teachers Trained In Differentiated Instruction, Patricia A. Crum

Student Work

This study examined the instructional methods and efficacy of teachers involved in a two-part district staff development project in differentiated instruction. Responses from 194 kindergarten through twelfth grade teachers on a self-perception survey were collected after an initial district staff training and implementation and again after involvement in a second teacher centered district staff development plan in differentiated instruction with implementation time. The data collected were analyzed to determine what instructional methods and efficacy the staff displayed and to determine whether a change in teachers' perceptions occurred during the 9-month period following the second district plan.

No other effort to reform American higher education is as attentive to the past as the civic engagement movement. The historical minded-ness of the movement is one of its strengths. Its explicit connection to the historical mission of American higher education makes it broadly appealing, and its base in John Dewey's progressive theories of education give it an intellectual heft missing in other reform movements. But the civic engagement movement's use of history is not always well-considered. As a result, the movement has not taken full advantage of the historical profession's insights into civic engagement. It is an open question whether the prohibition on employment discrimination in the Americans with Disabilities Act (ADA) protects plaintiffs who have not attempted to mitigate the effect of their disability on their ability to work. Suppose, for example, that a job applicant has severely impaired vision because of a corneal disease. He can have corneal transplant surgery that his doctors recommend and expect will allow him to see much more clearly, but he does not want to have the surgery because of the complications sometimes associated with the operation and the possibility that the surgery will not work. The Forgotten Constitutional Right To Present A Defense And Its Impact On The Acceptance Of Responsibility-Entrapment Debate, Katrice L. Bridges

Michigan Law Review

This Note argues that Section 3El.1 of the Federal Sentencing Guidelines must be interpreted to allow defendants who claim entrapment at trial to remain eligible for the acceptance-of-responsibility adjustment. To interpret Section 3El.1 in any other way would run afoul of defendants' constitutional right to present a defense. Part I argues that the entrapment defense does not put factual guilt at issue; instead the entrapment defense challenges whether the statute should apply to the defendant's conduct. Part II contends that the legislative intent in creating the sentencing guidelines in general and the acceptance-of-responsibility adjustment in particular are furthered by requiring …
