The loss of states’ sovereign immunity in the 1970’s opened the gates for highway-related tort liability suits against the states. Between January 2001 and September 2002, the State of Indiana investigated and settled hundreds of highwayrelated tort cases, involving several millions of dollars in taxpayers’ money. There is a need to assess the frequency of occurrence and financial impacts of such claims, and to examine how the growth of highway tort claims could be arrested. This study investigated many important issues associate with pavement surface friction testing, in particular using the smooth tire. This study utilized 3-D FEM program to investigate the fundamental friction phenomenon in light of energy dissipation during friction process. It was demonstrated that the pavement friction depends on many factors such as test tire, test speed, surrounding conditions, pavement surface texture, and pavement type. A great amount of friction data has been collected so as to investigate variations involved in pavement friction measurements. System variations depend on the feature of pavement surface. The closure of roadways for new pavement, overlays, or removal and replacement applications constantly causes traffic congestions. To minimize the effects of traffic congestions, the study is intended to assess the feasibility of using Precsat Concrete Pavement (PCP) method in INDOT pavement construction. The research investigated the state-of-the-art of the PCP methods lately developed in United States. This study reviewed the development of the Impediments to Change Scale: Educational Version and evaluated its use with children and adolescents identified as having an Emotional Disturbance (ED) according to the Individuals with Disabilities Education Act (IDEA). The investigator examined the scale's internal consistency and conducted a hierarchical cluster analysis to identify indices related to “impediments of change.” The objective for the Impediments to Change Scale: Educational Version is to offer a clinically useful instrument to assist in identifying risk factors that impede a student's progress in his or her educational program. Psychometric evaluation of the Mahan and DiTomasso Anger Survey (MAD-AS) analysis in an outpatient cardiac population is herein described. The MAD-AS is a newer instrument that measures the cognitive, affective, and behavioral components of anger and is beneficial in that it is brief. One hundred fifty cardiac outpatients and one hundred fifty non-cardiac dental patients were administered a demographic form that requested information about cardiac risk factors, the MAD-AS, and the STAXI-2, a widely used valid and reliable measure of state and trait constructs of anger. The importance of perceived control in people's lives is vast. Indeed, there is much research to support the notion that the perception of control is as important, if not more important, than actual control. This idea can be instrumental in therapy. Patients may have a sense of control in one area, but not in another, and this may cause problems for them. The purpose of this study was to develop and validate the Zahn-Given Recovery Beliefs Questionnaire (RBQ). The RBQ is a formal measure designed to assess specific underlying beliefs and expectations that relate to treatment non-adherence and recidivism in adult psychiatric patients. A total of 100 subjects were administered the RBQ, the Beck Hopelessness Scale (BHS), the Dysfunctional Attitudes Scale (DAS); included as well are self and clinician-rated compliance with treatment measures. Factor analysis of the RBQ reveals a factor structure that includes four factors: Embarrassment/ Stigma, Unrealistic Optimism, Hopelessness/ Pessimism and Concerns About Side Effects. The Early Intervention program in Pennsylvania has within its design, provision to provide a range of at least sixteen support services to eligible infants, toddlers and their families. State mandated early intervention programs in Pennsylvania offer services to premature, underweight, medically fragile or chronically ill babies, infants with identified disabilities or developmental delays, adolescent parents, depressed parents, parents who are unprepared or overwhelmed by the care of a baby, and parents at social or emotional risk in the caregiving role. Realism Or Distortion In Predicting And Evaluating Exam Performance Among Depressed And Nondepressed Students, Michael J. Kinney

Cognitive behavioral theories suggest that depressed people have negatively distorted and inaccurate perceptions and cognitions. The present study measures the accuracy of cognitions by comparing predictions made by depressed and by nondepressed students when they estimate the scores they will earn on an examination. It also compares depressed and nondepressed students on their levels of satisfaction with their exam scores. No difference was found between depressed and nondepressed students in either their predictions of their exam grades or their level of satisfaction with their exam grades. This study fails to support the notion that depression correlates with negative cognitive distortions. …

Evaluation of the Health Adherence Behavior Inventory (HABIT) is described with data pertaining to reliability and validity. The instrument was originally developed for use in a primary healthcare setting, to support the early identification of patients who are at risk for poor health outcomes and complications of chronic disease because of non-adherence to their healthcare provider’s instructions. The items were refined from the original HABIT (DiTomasso, 1997) and drawn from various sources, including health risk assessments, health screening questionnaires, and nationally accepted standards for disease treatment and prevention. This comment discusses the Supreme Court's recent decision in Hoffman-LaRoche v. Empagran, an action brought by foreign plaintiffs under U.S. antitrust law to recover damages caused by the activities of a global price-fixing cartel. It describes the jurisdictional issues raised by conduct that affects the global market for a particular good, and analyzes the Court's reliance on notions of comity to restrain the reach of U.S. antitrust law. It argues, however, that the decision does not in fact undermine the anti-comity approach adopted in the 1993 Hartford Fire case, as the Court here assumes that the cartel's effects in the …

Detection and inspection of metal surface corrosion in the ballast tanks of U.S. Navy ships has been a long time problem. The adverse climatic conditions to which the ballast tanks are exposed and the uneven geometry of ballast tanks makes the visual inspection process of surface coatings a difficult job. Thousands of tanks are inspected yearly, with the average cost of an individual tank inspection at approximately $8-15 thousand/each. Objectives: To quantify and compare fitness levels of middle aged practitioners of soo bahk do (SBD; a Korean martial art similar to karate) with those of sedentary subjects.
Methods: Eighteen volunteers, 14 men and four women (aged 40-60 years), participated. Nine sedentary subjects (mean age 46.7 years) and nine SBD practitioners (mean age 46.8 years) were matched for sex and age. All subjects participated in a one day battery of fitness tests. The following dependent variables were tested: body composition, balance, flexibility, quadriceps strength, grip strength, muscle endurance, and aerobic capacity.

This article addresses the issue of governmental immunity and mandatory duty liability in the context of foster child abuse. The article should be of interest to children's rights organizations, legal scholars, practitioners and judges who face governmental liability issues related to the California foster care system.
The California Tort Claims Act has, until recently, long served as an important means by which foster children may obtain recourse from the government for injuries caused by social worker negligence. In the late 1990s, however, the California courts of appeal retreat - without justification - from the dictates of the Tort Claims Act. …

This paper presents the first ice core measurements of methyl bromide (CH3Br). Samples from a shallow Antarctic ice core (Siple Dome, West Antarctica), ranging in mean gas dates from 1671 to 1942, had a mean CH3Br mixing ratio of 5.8 ppt. These results extend the existing historical record derived from air and Antarctic firn air to about 350 years before present. Model simulations illustrate that the ice core results are consistent with estimates of the impact of anthropogenic activity ( fumigation, combustion, and biomass burning) on the atmospheric CH3Br burden, given the large current uncertainties in the modern atmospheric CH3Br …

RR&K will provide studies to assess consumer awareness of businesses, evaluate consumer perceptions, and uncover preferences of target customers. We will begin by conducting a focus group with people who are employed downtown and residents of the surrounding downtown Provo area. With information taken from the focus groups and Provo Alliance, survey will be administered to members of the target audience. In analyzing these findings, RR&K will provide recommendations to assist The DBAP in reinventing the downtown Provo area. This project hypothesizes the relationship between collegiate basketball and trial law while focusing on proving that the process of preparing and participating in a collegiate basketball game directly parallels the preparation and process of competing in a legal trial. This student prepared the study through conducted interviews with lawyers and coaches and tested the following concepts: teamwork/team attributes, competitive attributes, performance attributes and commitment.
