Previous research has suggested that “victim” and “offender” are not mutually exclusive categories but rather represent a homogeneous pool in which offenders are victimized and victims also offend. Little is known, however, about the specifics of the victim and offender process. The current study formally addresses the following research questions: why are some individuals at higher risk for victimization compared to others; why do some young people offend while others do not; and finally, why are criminal victims likely to retaliate? Given that homeless young people generally have high rates of offending and are also exceedingly vulnerable to crime, they …

Dietary conjugated linoleic acid (CLA) reduces body fat in animals and some humans. Here we show that trans-10, cis-12 CLA, but not cis-9, trans-11 CLA, when added to cultures of stromal vascular cells containing newly differentiated human adipocytes, caused a time-dependent decrease in triglyceride content, insulin-stimulated glucose and fatty acid uptake, incorporation into lipid, and oxidation compared with controls. In parallel, gene expression of peroxisome proliferator-activated receptor-γ and many of its downstream targets were diminished by trans-10, cis-12 CLA, whereas leptin gene expression was increased. The Highway Travel Information System (HTIS) is a long-term pre-trip information system providing information about expected events, such as road construction. The HTIS can be beneficial to both highway travelers and roadway project schedulers. Project schedulers can use the HTIS to check the forecasted traffic impacts of a proposed construction project schedule. If the schedule would cause unacceptable delays, a scheduler can try new schedules to reduce the delay. Travelers who have flexible schedules and would like to do pre-trip planning can obtain knowledge of traffic conditions in the near future from HTIS to avoid unnecessary delays. An approach called …

An Analysis Of Seismic Hazards In Indiana, Jennifer Haase, Robert Nowack, Chi Hyun Park, Alison Hunyar, John Hill, Michael Hamburger

Current USGS probabilistic seismic hazard estimates (Frankel et al., 2002) show a higher seismic hazard in southwestern Indiana than for the rest of the state. This is expected based on past work documenting large pre-historic events in the Wabash Valley, and also based on isoseismal levels of shaking from the New Madrid 1811-1812 earthquakes. When assessing the hazard on a county by county basis, the local soil conditions produce amplification of shaking in regions with soft or unconsolidated sediments relative to firm-rock sites. We have reproduced the probabilistic seismic hazard calculation following the USGS methodology for the state of Indiana …

This study is a continuation and the final phase of the SPR-2338 project that involves monitoring the ambient air quality levels adjacent to the Borman Expressway. The purpose of this phase was to classify the traffic conditions along the Borman Expressway in terms of ambient air quality levels. The duration of the phase was from April 1, 2002 to April 30, 2004. The study has shown that, in a close proximity to the Borman Expressway, air quality levels mirror the dynamic nature of traffic along the Borman, despite being surrounded by major industrial stationary sources. The purpose of the study was to conduct research and prepare documents, data tables, reports and GIS maps to be included in the INDOT SWQMP that address each of the following Minimum Control Measures (MCMs) specified in the federal and state regulation: (1) public education and outreach; (2) public participation and involvement; (3) illicit discharge detection with elimination; (4) construction site runoff control; (5) post-construction runoff control and (6) pollution prevention and good housekeeping. The research involved evaluating three surface cracked pavements during 2002 and 2003. A 500m section of I-65 North of Lafayette was chosen as the first site (designated as Site 1), an I-65 section in downtown Indianapolis was the second site (Site 2), and US-421 in Madison was the third site (Site 3). Site 1 had 11-year old pavement, Site 2 had 12-year old pavement and Site 3 had 4.5-year old pavement. All these sites exhibited longitudinal wheel path cracking which was later identified as top-down cracking. The Utility Accommodation Policy (UAP) is a collection of the regulations and practices to control the utility occupancy of all public highway rights-of-way under jurisdiction of the different States. Currently, Indiana Department of Transportation (INDOT) is using the California Profilograph as the standard measuring device in its smoothness specifications. The output derived from the profilograph is called Profile Index (PI). PI represents the total accumulated deviations of the profilograph output traces beyond a tolerance zone (blanking band). At present, INDOT is using 0.2-inch blanking band to evaluate the profile traces, which has raised some concerns because some small unpleasant surface irregularities are covered by the blanking band. This purpose of this project was the design and construction of a testbed network for experimentation with spread spectrum communications in the 900 and 2400 MHz band. The current network consists of five fixed nodes and two portable nodes. Of the fixed nodes, three are located in the Purdue MSEE building, one is located in the Harold L. Michael Traffic Operations Laboratory, and one is located in the experimental traffic signal cabinet at the intersection of Stadium and Northwestern Avenues in West Lafayette. In this synthesis study, information related to full-depth precast deck systems has been collected and analyzed in order to facilitate implementation of full-depth precast deck systems in the state of Indiana. Nine full-depth precast deck systems were identified in the literature review. For girder bridges or similar, a full-depth precast, prestressed deck system (New England Region System) is recommended to be implemented. For bridges with decks spanning in the longitudinal direction, where no precast, prestress deck systems are available, the Exodermic™ Deck System is suggested to be implemented. It is becoming increasingly popular to utilize numerical simulation models to predict the long-term performance of concrete pavements and structures. The majority of these models have been developed using laboratory test data that considers concrete in an uncracked state. While uncracked concrete exists as the best case scenario, frequent cracking occurs in real structures that could have a profound impact on life cycle performance. Cracks from several sources may accumulate and interact thereby accelerating the deterioration of concrete. Traditionally, soil mechanics has focused on the behavior of two distinct types of geomaterials: clean sands and pure clays. Under the application of external loads, these two types of geomaterials represent and are conveniently associated with two extreme types of soil responses: drained and undrained behavior. Load and Resistance Factor Design (LRFD) shows promise as a viable alternative to the present working stress design (WSD) approach to foundation design. The key improvements of LRFD over the traditional Working Stress Design (WSD) are the ability to provide a more consistent level of reliability and the possibility of accounting for load and resistance uncertainties separately. Trucks represent the predominant form of domestic freight movement. Due to the substantial increase in freight truck traffic on the nation’s highways, its influence on traffic flow performance, safety, and quality of travel experience, is garnering increased attention. Several existing studies have addressed the impacts of trucks on highway traffic flow conditions and crashes. This research models the behavior of non-truck drivers vis-à-vis their interactions with trucks by associating a “discomfort level” with every non-truck driver. Highway asset management is a systematic process that aims to preserve, expand, and operate highway assets in the most cost-effective manner. It is an analytical tool that facilitates organized, logical, and integrated decision-making in asset management practice. There are people serving more than twenty years for nonviolent drug offenses. There are people serving more than thirty years for car theft, burglary, and unarmed robbery--crimes for which a harsh sentence used to be ten years. Organizational democracy is frequently associated with increased employee involvement and satisfaction, higher levels of innovation, increased stakeholder commitment, and, ultimately, enhanced organizational performance. However, democratic processes can also absorb significant time and other organizational resources and bog down decisions, which may lead to reduced efficiency. This article summarizes the pros and cons of organizational democracy. It also introduces and integrates ideas from the three other articles in this special forum. In the end, we conclude that although the economic arguments for organizational democracy may be mixed, increased stakeholder participation in value creation and organizational governance can benefit both society and …

This Article, in keeping with the theme of this Symposium, explores the possibility of promissory fraud liability where there is no breach of contract. It is well known that mere breach of contract is not sufficient to make out a claim of promissory fraud. This rule makes eminent sense, for a promisor who initially intended to perform may have later changed her mind. Here we pose the converse question: is it possible to have promissory fraud liability without a breach?

Once we open the corporate governance/human resources nexus to deeper inquiry, mutual scholarly interest in diversity and discrimination follows naturally. Firms have complex motives to take nondiscrimination and the promotion of diversity seriously. First, at least certain forms of discrimination are both unlawful and socially illegitimate and hence present threats of potential liability and injury to reputation. Second, human resources demands are such that attracting and motivating a diverse workforce is a competitive imperative. At the same time, however, offsetting economic forces may exist that favor subtle forms of discrimination and hostility to diversity, even if intentional and overt racial …

My claim is that the technology link to the recent disclosure scandals is no coincidence. To be sure, cheating tempts all who seek wealth, in whatever line of business they find themselves. I want to show, however, how the rapid pace of innovation at a number of levels offered motive, opportunity, and rationalization for a downshift in financial reporting norms, which in turn made outright fraud more probable.

The field of dispute resolution has benefited enormously from a great wave of enthusiasm during its first two decades. But "youth's a stuff will not endure," and the first flush of ardor is an uncertain basis for confidence in the long term. Now, there is reason to believe that our field, like its predecessor professional fields, is vulnerable to the incentive structures built in to both academic and practice careers. The Bipartisan Campaign Reform Act of 2002 ("BCRA") is the laboratory in campaign finance law. When analyzing BCRA, it is important to look at the Missouri state law that led to the Supreme Court case, Nixon v. Shrink Missouri Government PAC. In Shrink Missouri, five justices upheld Missouri's relatively low simple limit on contributions to candidates. The law in Missouri limited contributions by anyone to candidates, but there was no limit as to how much a person or entity could give to a political party committee or to a political action committee (PAC). Lawrence v. Texas creates a crisis for inclusive constitutionalism. Too often, advocates of inclusion and tolerance wish to include only those ideas and groups with which they agree. The test for true inclusion and tolerance, however, is whether we are willing to protect groups when they engage in conduct of which we disapprove. It follows that the boundaries of inclusion cannot be established simply by moral argument; yet, any plausible version of constitutional law must use some method to bound the people and activity that it protects. Interpreting Constitutions Comparatively: Some Cautionary Notes, With Reference To Affirmative Action, Mark V. Tushnet

It has now become the conventional wisdom that many justices on the United States Supreme Court are thinking about the relevance of comparative constitutional law to the interpretation of the United States Constitution. An emerging conservative critique of doing so questions the democratic legitimacy of the practice. I believe that those questions are badly formed, but that other questions are worth raising about the (perhaps) emerging practice. In this comment I identify some reasons for caution about the use of transnational comparative law in interpreting domestic constitutions.
