The Shag-A-Delic Supreme Court: "Anal Sex," "Mystery," "Destiny," And The "Transcendent" In Lawrence V. Texas, Richard D. Mohr Jan 2004

The Shag-A-Delic Supreme Court: "Anal Sex," "Mystery," "Destiny," And The "Transcendent" In Lawrence V. Texas, Richard D. Mohr

Cardozo Journal of Equal Rights & Social Justice

The article critiques Justice Anthony Kennedy's majority opinion in Lawrence v. Texas for its lack of clarity and robust constitutional framework. While the decision overturned Texas's sodomy law, the author argues that Kennedy's reasoning conflated liberty and equality rights, relied on vague language, and failed to establish a clear legal standard, undermining its potential to provide strong protection for LGBTQ+ rights.

The Missing Word In Lawrence V. Texas, Ruthann Robson Jan 2004

The Missing Word In Lawrence V. Texas, Ruthann Robson

Cardozo Journal of Equal Rights & Social Justice

The article critiques the Supreme Court's decision in Lawrence v. Texas for omitting a crucial acknowledgment: an apology for the harm caused by its previous ruling in Bowers v. Hardwick. While Lawrence overturned the unconstitutional sodomy law, the Court's opinion neglected to address the profound suffering and discrimination endured by LGBTQ+ individuals due to *Bowers*. The author argues that an apology is essential to acknowledge the pain inflicted and to provide closure for those affected.

A Prisoner's Right To Transsexual Therapies: A Look At Brooks V. Berg, Linda D. Chin Jan 2004

A Prisoner's Right To Transsexual Therapies: A Look At Brooks V. Berg, Linda D. Chin

Cardozo Journal of Equal Rights & Social Justice

The note examines the legal and ethical implications of providing medical treatment, particularly gender reassignment surgery (GRS), to transgender prisoners under the Eighth Amendment, which prohibits cruel and unusual punishment. It argues that while courts have recognized the necessity of addressing gender dysphoria, the financial and logistical challenges of providing such treatments raise concerns about equity and resource allocation. The ruling in Brooks v. Berg highlights the tension between constitutional rights and the practical limitations of prison systems in meeting these needs.

It's Not All In My Head: The Harm Of Rape And The Prison Litigation Reform Act, Deborah M. Golden Jan 2004

It's Not All In My Head: The Harm Of Rape And The Prison Litigation Reform Act, Deborah M. Golden

Cardozo Journal of Equal Rights & Social Justice

The article argues that the Prison Litigation Reform Act (PLRA)'s requirement of a physical injury for prisoners to seek damages for mental or emotional harm creates a significant barrier for rape victims, particularly women, in pursuing justice. The author advocates for amending the PLRA to explicitly recognize rape as a compensable injury, ensuring that victims can seek redress without unnecessary procedural hurdles.

Challenging Dissent: The Ontology And Logic Of Lawrence V. Texas, Jami Weinstein, Tobyn Demarco Jan 2004

Challenging Dissent: The Ontology And Logic Of Lawrence V. Texas, Jami Weinstein, Tobyn Demarco

Cardozo Journal of Equal Rights & Social Justice

The article examines the Supreme Court's decision in Lawrence v. Texas, which invalidated a Texas antisodomy statute criminalizing homosexual conduct. The Court held that the statute failed rational basis review and rejected the promotion of majoritarian sexual morality as a legitimate state interest. The decision reflects a broader recognition of the fundamental right to make autonomous, private, consensual, adult sexual choices. The analysis critiques Justice Scalia's dissent, arguing that his fears about the end of morals legislation are unfounded and that laws based solely on moral disapproval lack a rational basis.

Comparative Analysis Of Bragg Fibers, Shangping Guo, Sacharia Albin, Robert S. Rogowski Jan 2004

Comparative Analysis Of Bragg Fibers, Shangping Guo, Sacharia Albin, Robert S. Rogowski

Electrical & Computer Engineering Faculty Publications

In this paper, we compare three analysis methods for Bragg fibers, viz. the transfer matrix method, the asymptotic method and the Galerkin method. We also show that with minor modifications, the transfer matrix method is able to calculate exactly the leakage loss of Bragg fibers due to a finite number of H/L layers. This approach is more straightforward than the commonly used Chew’s method. It is shown that the asymptotic approximation condition should be satisfied in order to get accurate results. The TE and TM modes, and the band gap structures are analyzed using Galerkin method.

A Case Study Of A University-School Partnership: Impacting The Success Of Children, Teacher Candidates, And Inservice Teachers, Paula Summers Calderon Jan 2004

A Case Study Of A University-School Partnership: Impacting The Success Of Children, Teacher Candidates, And Inservice Teachers, Paula Summers Calderon

LSU Doctoral Dissertations

School reform is an often heard term within the Bush administration. Since the signing of his No Child Left Behind Act of 2001 (NCLB), President George W. Bush set out to make certain our teachers are highly qualified and that our children perform better in school. From the Holmes Group (1986) to present-day mandates from The National Council for Accreditation of Teacher Education (NCATE), university-school partnerships are becoming part of preservice teacher education as well as school reform. This study describes a pilot university-school partnership, focusing on teacher candidates, inservice teachers, and P-5 students. Employing qualitative and quantitative analysis (Gall, …

Improved Opportunity Cost Algorithm For Carrier Selection In Combinatorial Auctions, Viswanath Uma Gnanasekaran Jan 2004

Improved Opportunity Cost Algorithm For Carrier Selection In Combinatorial Auctions, Viswanath Uma Gnanasekaran

LSU Master's Theses

Transportation costs constitute up to thirty percent of the total costs involved in a supply chain. Outsourcing the transportation service requirements to third party logistics providers have been widely adopted, as they are economically more rational than owning and operating a service. Transportation service procurement has been traditionally done through an auctioning process where the auctioneer (shipper) auctions lanes (distinct delivery routes) to bidders (carriers). Individual lanes were being auctioned separately disallowing the carriers to express complements and substitutes. Using combinatorial auctions mechanism to auction all available lanes together would allow the carriers to take advantage of the lane bundles, …

Temperature Effects On Spawning And Fingerling Production Of Channel Catfish Ictalurus Punctatus, Patrice Arnold Pawiroredjo Jan 2004

Temperature Effects On Spawning And Fingerling Production Of Channel Catfish Ictalurus Punctatus, Patrice Arnold Pawiroredjo

LSU Master's Theses

The goal of this study was to develop several techniques that utilize the use of geothermal water that can contribute to increased profitability for commercial catfish producers. The primary objectives of this study were to: 1) determine the heating requirement using degree-days of channel catfish spawning 2) improve the efficiency of artificial spawning and, 3) evaluate the effectiveness of stocking outdoor ponds and pools with channel catfish fry. The heating requirement for channel catfish spawning was determined to be between 99 and 129 degree days at the peak of spawning. There was no difference in degree-day values between spawns collected …

Application Of Stochastic Downscaling Techniques To Global Climate Model Data For Regional Climate Prediction, Suchita Potta Jan 2004

Application Of Stochastic Downscaling Techniques To Global Climate Model Data For Regional Climate Prediction, Suchita Potta

LSU Master's Theses

Global warming is the most important issue of the present day that affects the climate drastically. This research was carried out to find out the effects of Global warming on Louisiana in future on a very finer spatial and temporal scale. For this purpose spatial downscaling technique is used, where finer resolution climate information is derived from a coarser resolution Global Climate Model (GCM) output. Empirical/statistical downscaling method is used in which sub grid scale changes are calculated as a function of large scale climate. For this purpose a stochastic weather generator and two Global models are considered. The two …
