The President's Power To Detain "Enemy Combatants": Modern Lessons From Mr. Madison's Forgotten War, Ingrid Wuerth

This article uses three sets of cases from the War of 1812 to illustrate three problems with how modern courts have approached the detention of "enemy combatants" in the United States. The War of 1812 cases show that modern courts have relied too heavily on deference-based reasoning, and have failed to adequately consider both international law and congressional authorization when upholding the detentions as constitutional. The War of 1812, termed "Mr. Madison's War" by contemporary opponents, was fought largely on our own territory against a powerful foreign enemy, making it an especially rich source for comparison to the modern war …

Anthrax, a fatal bacterial infection is caused by Bacillus anthracis, a gram-positive, spore forming, capsulated, rod shaped organism. Centers for Disease Control (CDC) lists anthrax as Category A biological agent due to its severity of impact on human health, high mortality rate, acuteness of the disease and potential for delivery as a biological weapon. For the past thirty years Africa has produced a more noticeably inferior reserve of human capital than other developing regions. This is puzzling because at the inception of independence, the future of Africa looked promising. However, during the 1970s both the political and economic situation in Africa began to deteriorate, and since 1980, the aggregate per capita GDP in sub-Saharan Africa has declined at almost one percent per fiscal year. Structural components machined from aluminum forgings can exhibit distortion and poor dimensional quality due to residual stresses formed primarily during heat treatment. To alleviate these problems, mechanically stress-relieved tempers are used in which a small amount of plastic strain is introduced after solution heat treatment and prior to aging. For hand-forged billets and die forgings, this strain is introduced by compression. Process specifications for compression stress relief typically allow a range of strains, and this process variability can in turn lead to inconsistent forging performance in machining. Much of the debates on the legality of strikes under the Indian Constitution has been on the issue of a right to strike. This paper argues that the constitutionality of strikes may be analysed through the prism of duties, i.e. fundamental duties under Part IVA of the Constitution. Strikes were an integral part of the ideals that inspired India's national struggle against imperialism. And, in this sense, when article 51A exhorts Indians to cherish and follow the noble ideals that inspired our freedom struggle, it includes a fundamental duty to strike. In the 1920s, John Dewey’s followers in China, led by his student HuShih, attempted to put his pragmatism into practice in their quest for democracy.This essay compares Hu Shih’s thought, especially his emphasis on pragmatism asmethod, with Dewey’s philosophical positions and evaluates Hu’s achievement asa pragmatist in the context of the tumultuous times he lived in. It assesses Hu’sclaim that the means to democracy lies in education rather than politics, sincedemocracy as a way of life requires a cultural renewal beyond institutionalchanges. A quality assurance testing of the ECLOX-M™, a rapid water quality indicator used in potential terrorist attacks, was evaluated for its adequacy in nine regional Louisiana water systems. The ECLOX-M™ system uses enhanced chemiluminescence to measure toxicity in water by integration of a mixture of luminol (C₈H₇O₃N₃), and an oxidant in the presence of a catalyst enzyme - horseradish peroxidase (HRP). Water samples were tested for chemiluminescence, chlorine content, pH, and arsenic and/or nerve agent/pesticide contamination. Performance and content analysis identifies and explores the difficulties and challenges in portraying multiple roles in this production, including the understudying of the leading role of Guenevere. A detailed historical analysis provides background into origin of the Arthurian legend and an examination of its historical development. While there is daily debate over the wisdom and consequences of that action, the question whether the federal government even possessed the power under the Constitution to wage preemptive war does not seem to have been raised. The purpose of this ethnographic study was to build understanding regarding the meaning and role of early literacy as a meaningful interaction in one inclusive preschool classroom. I was specifically interested in the idea of literacy as a social construction - as an interaction with one's environment for the purpose of making sense of it. Furthermore, I investigated the way this construction facilitated or denied one child's citizenship in the classroom community, which is located within an early childhood center in a mid-sized, Midwestern city. The goal of this dissertation is to better understand the complex relationship between the stresses encountered by US. service personnel during the Gulf War and eventual physical and psychological health outcomes among its veterans. By developing and validating a stress model using structural equation modeling techniques, it is hoped that knowledge regarding wartime stress and its potential impact on the health of veterans will be gained. The Federal Circuit is different from other federal courts in important ways. Professor Dreyfuss has done pioneering work on the Federal Circuit as an institution and her article in this Symposium extends that work. As a nonexpert on patent law, my contribution to this Symposium is not to offer a substantive critique of the Federal Circuit's patent law jurisprudence. Instead, I will apply the public choice perspective to this particular judicial institution. This perspective includes some background thinking about how the federal judiciary works as an institution and about how judicial background affects how judges decide things.
