Delimiting The Concept Of Income: The Taxation Of In-Kind Benefits, Kim Brooks

The issue of which in-kind benefits should be taxed and how these benefits should be valued have concerned tax legislators, administrators, and academics since the introduction of the personal income tax system. Building her theoretical analysis on the income concept advanced by Henry Simons and relying on traditional tax policy notions of equity, neutrality, and administrative practicality, the author asserts that employees must be fully taxed on employer-provided in-kind benefits. To this effect, the article offers guidelines for distinguishing between taxable in-kind benefits and non-taxable conditions of employment. The purpose of this study was to examine sight-singing requirements at junior and senior high school large-group ratings-based choral festivals throughout the United States. Responses to the following questions were sought from each state: (1) Are there ratings-based large-group choral festivals? (2) Is sight-singing a requirement? (3) Are there specific levels or classes of difficulty? (4) Is musical content specified for each level or class? (5) Is there an overall rating that includes both the performance and sight-singing ratings? Data revealed that less than half of all states require sight singing at large-group festivals at both the junior high and …

In this lecture, Professor Arthurs argues that we are currently in need of "constitutional courage"-the courage to say "no" to ambitious projects of constitutional reform and constitutional litigation as a way to solve our pressing social and political problems. Professor Arthurs first lays out why our current obsession with the constitution is problematic. He insists that we do not even know what the supposed "supreme law of Canada" actually is, what it says, or even what it does. Moreover, instead of transforming society, the current "cult of constitutionalism" has only served to transform legal practice and scholarship. ei then surmises …

Rehabilitate The Age Discrimination In Employment Act: Resusciate The "Reasonable Factors Other Than Age" Defense And The Disparate Impact Theory, Judith J. Johnson

UC Law Journal

Contrary to earlier interpretations of the Age Discrimination in Employment Act, courts are currently allowing an employer to use age-correlated factors, such as seniority and high salary, to make unfavorable employment decisions. Most courts now hold that age-correlated factors are no longer probative at all of disparate treatment and that the disparate impact theory does not apply to the ADEA. Courts are thus allowing employers to use age-correlated factors to cut older workers from the workforce with impunity.

The California Courts of Appeal are currently split over the issue of whether the California Hospital Lien Act allows "balance billing." The First District allows medical care providers to recover the difference between their customary rates and the negotiated discount rates paid by a patient's health insurance carrier. The Second District has held balance billing is prohibited by California law. This Note explains the conflict that exists within the California Appellate Courts and analyzes the effects of applying each District's interpretation of the Hospital Lien Act. Inventing Flight: The Centennial Celebration An Economic Impact Study On Tourism In Dayton, Ohio, Elina Blain

This paper quantifies the local economic impact of the 2003 Inventing Flight Celebration in Dayton, Ohio. Using information from the Wright State University (WSU) Inventing Flight Survey of 1,502 visitors to the events and RIMS II multipliers for the Dayton/Springfield Metropolitan Statistical Area (MSA), the local expenditures, income, and employment impacts are estimated. This paper includes a complete analysis of the WSU Inventing Flight Survey questions and responses in order to find out how this one-time Celebration affected the local economy. Both the short-term and long-term benefits of this regional tourism event are included in this study.

It has been said that Filártiga v. Pena-Irala is the Brown v. Board of Education of human rights litigation. Like Brown, Filártiga presents one of those rare “breakthrough moments” in law. In Filártiga, the Second Circuit confirmed that victims of human rights abuses abroad could seek legal redress in United States courts under the then-obscure Alien Tort Statute (ATS). Filártiga thus inaugurated a steady line of cases in U.S. courts invoking the ATS and related statutes to adjudicate international human rights claims. Chinese Glove Puppets demonstrate the traditional Chinese performing art. It introduces the history, creation, and primal figure types of Chinese Glove Puppetry to provide users a basic understanding. Puppet education and puppet performance demonstrate the puppet movements. Basic puppet manipulation videos demonstrate the basic movements teaching users how the puppeteers control puppets. Real puppet show clips are also available. In order to create more fun, a changeable classic background would be used to replace the original stage and enhance the delight of creating the user's own show. These newly arrived suburbanites exchange their multidimensional urban city views for those of a carefully constructed and intensely controlled pastoral view. This view from their windows is one that symbolizes their ownership of the land and their freedom from dense urban living conditions. Essays on consciousness and the contents of consciousness are generally written in conventional

prose. Academics and scholars tend to write that way and in the present tense or the past tense

and sometimes in subtle mixes of tenses. Literary styles may also be appropriate to such writings

and consciousness writing (in literary fiction) seems both relevant and appropriate. The two principal

forms and techniques of consciousness writing are interior monologue and free indirect

style. Interior monologue represents the thoughts of a character as if narrated by a character as

In 1941, the famously despondent Theodor Adorno worried about the detrimental effects of radio broadcast upon the symphony. He theorized that much of value was lost when listeners experienced an orchestral performance of a composition in symphonic form through its electronic transmission to their kitchens rather than in a concert hall.
