Bono, The Culture Wars, And A Profane Decision: The Fcc's Reversal Of Course On Indecency Determinations And Its New Path On Profanity, Clay Calvert

Seattle University Law Review

This article examines the FCC's vigorous new approach to indecency and profanity determinations, including both the legal issues and the greater cultural, political, economic, and social contexts in which that approach is developing. Part I describes the FCC's initial decision regarding the Golden Globes' 2003 broadcast and then compares it with the March 2004 reversal. In the process, Part I lays the historical framework for the FCC's power over indecent expression on the public airwaves. Part II then contextualizes the FCC's new course of action within the framework of the ongoing cultural wars and political battles in the United States …

Rehabilitate The Age Discrimination In Employment Act: Resusciate The "Reasonable Factors Other Than Age" Defense And The Disparate Impact Theory, Judith J. Johnson

UC Law Journal

Contrary to earlier interpretations of the Age Discrimination in Employment Act, courts are currently allowing an employer to use age-correlated factors, such as seniority and high salary, to make unfavorable employment decisions. Most courts now hold that age-correlated factors are no longer probative at all of disparate treatment and that the disparate impact theory does not apply to the ADEA. Courts are thus allowing employers to use age-correlated factors to cut older workers from the workforce with impunity.

In 1869, the Prussian House of Deputies passed a law that transformed theatre practice in Berlin and other Prussian cities. When the newly unified Germany came into being two years later, the 1869 law became the legal order of business for all theatres within the new Reich. That law, called the Gewerbefreiheit Gesetz (Freedom to Engage in Business Act), put an end to the way theatre had formerly been produced, dissolving the concession system that had been in operation for decades previous; it also terminated a tradition that had functioned for centuries, both in Prussia and in nearly all other …

Oskar Blumenthal (1852-1917) was Berlin’s most feared theatre critic in the early years of the new German Reich. He had the audacity of referring to Goethe as “an egghead” who had no understanding of what made plays effective for audiences, and in other critiques he ridiculed Kleist, Hebbel, and other “important” playwrights—prompting an adversary publicly to call him a “one-man lynch mob.” In the 1880s Blumenthal himself began writing plays, and he was so successful that many self-appointed cultural guardians accused him of damaging the German theatre beyond repair. His became the most frequently performed plays on any German stage …

On September 22, 1933 the National Socialist cabinet, under Chancellor Adolf Hitler, passed the Reich Cultural Chamber Law (the Reichskulturkammergesetz), giving Propaganda Minister Joseph Goebbels charge of an organization the new Law created, the Reich Cultural Chamber. Theatre Chamber reserved the right to license productions for any theatre performance; but like most bureaucracies, it expanded its domain of authority, increased its budgetary needs, and consolidated its power. The Reich Theater Act (Reichstheatergesetz) in 1934 sustained those efforts. When the National Socialist regime assumed power in Germany on January 30, 1933, it set about immediately to formulate regulations, edicts, and policies for a "renewal" of the German theatre. Adolf Hitler had an interest of long standing in the theatre, and Nazi strategies for controlling, supporting, and re-generating the theatre went into effect over a period of about eighteen months. On September 22, 1933 Hitler's cabinet passed the Reich Cultural Chamber Law (Reichskulturkammergesetz), giving Propaganda Minister Joseph Goebbels charge of an organization the new Law created, the Reich Cultural Chamber. Examination of scatological motifs in Théophile de Viau’s (1590-1626) libertine, or ‘cabaret’ poetry is important in terms of how the scatological contributes to the depiction of the Early Modern body in the French lyric.1 This essay does not examine Théophile’s portrait of the body strictly in terms of the ‘Baroque’ or the ‘neo-Classical.’ Rather, it argues that the scatological context in which he situates the body (either his, or those of others), reflects a keen sensibility of the body representative of the transition between these two eras. Théophile reinforces what Bernard Beugnot terms the body’s inherent ‘eloquence’ (17), or what …

Open Access Master's Theses

Jeanne Sacerdote, known as Madame Jenny, was one of many French women fashion designers in the first part of the twentieth century. After training at Pacquin and Bechoff-David, well-established French fashion houses, she opened House of Jenny in 1908. The French government in 1926 awarded the Chevalier, Legion of Honor to Jenny for her economic service. Her business weathered the First World War and the worst part of the world wide economic depression in the 1930s. It closed in 1940. Costume historians have mostly overlooked Jenny's success.

This research defined Jenny's contributions to the French and American fashion business. The …

The purpose of this research study is to examine the growth and development of the long-term community based Jazz Workshop Inc. program. Within the context of examining the Jazz Workshop Inc. program, the impact of the program on its participants will also be explored. The Jazz Workshop Inc. program is located in Homewood in the City of Pittsburgh. The study utilized interviews and focus groups, which were recorded (audio and video) under consent of all parties.
