A Guide For Standards-Based, Interdisciplinary, Elementary Art Activities For Cultural Institutions, Carolyn L. W. Carpenter

Dissertations and Theses @ UNI

The purpose of this research is to provide a guide for educators in cultural institutions to develop interdisciplinary programs that meet the national education standards, using meaningful objects from their collections and hands-on art experiences for grades K-5. A survey by the Iowa Museum Association (heretofore to be referred to as IMA) provides justification for this research. The survey was presented at the IMA/NMA (Nebraska Museum Association) Annual Conference in Omaha, Nebraska, in October 2002. The survey gives a synopsis of the educational programming and staffing in over 140 cultural institutions of Iowa. The results reveal a number of areas …

Protecting Us From Pictures: Gender And Support For Legal Restrictions On Pornography, Elizabeth Lynne Chivers Jan 2004

Protecting Us From Pictures: Gender And Support For Legal Restrictions On Pornography, Elizabeth Lynne Chivers

Dissertations and Theses @ UNI

Research and debate concerning pornography has been controversial, primarily focusing on the perceived harmful effects. The current study addresses support for legal restrictions and the effect of gender on this support. Based on the internalization of gender roles, perspectives, and identities through socialization, gender is constructed differently for men and women. Because this socialization is constructed around an oppositional male-female dichotomy, men and women experience the world differently. While there have been previous research addressing gender differences, the gendered nature of attitudes merits further study. The current study is based on data collected for 451 undergraduate students at the University …

Corporate Governance, Executive Compensation And Securities Litigation, Eric L. Talley, Gudrun Johnsen Jan 2004

Corporate Governance, Executive Compensation And Securities Litigation, Eric L. Talley, Gudrun Johnsen

Faculty Scholarship

It is generally accepted that good corporate governance, executive compensation and the threat of litigation are all important mechanisms for incentivizing managers of public corporations. While there are significant and robust literatures analyzing each of these policy instruments in isolation, their mutual relationship and interaction has received somewhat less attention. Such neglect is mildly surprising in light of a strong intuition that the three devices are structurally related to one another (either as complements or substitutes). In this paper, we construct an agency cost model of the firm in which corporate governance protections, executive compensation levels, and litigation incentives are …

Consistently Revealing The Inconsistencies: The Construction Of Fear In The Criminal Law, Camille Nelson Jan 2004

Consistently Revealing The Inconsistencies: The Construction Of Fear In The Criminal Law, Camille Nelson

Scholarly Articles in Law Reviews & Journals

This article focuses on the objective reasonable person standard in criminal law through the context of self defense and rape and their problematic construction. This article seeks to illustrate to law students the inconsistency of the aimed objective construction of the reasonable person standard because of its inherently subjective application. By examining People v. Goetz and State v. Alston, this article seeks to explore how societal norms reveal the undercurrent of negative associations of both gender and racial identity that lead to a subjective application of the reasonable person standard.

In Goetz, the defendant was able to successfully draw on …

The Human Right To Housing: Making The Case In U.S. Advocacy, Maria Foscarinis, Brad Paul, Bruce Porter, Andrew Scherer

Articles & Chapters

American anti-poverty advocates are increasingly focusing on expressing homelessness as a violation of fundamental human rights. Conceptualizing homelessness as a human rights violation can help add legal content to advocacy goals, and help build support for the housing resources, policy changes, and improved legal protective measures needed to ensure access to housing.

This article explores the right to housing in domestic and international law, how to evaluate compliance with the right in the United States, and how to employ legal strategies in support of claims to the right. Theauthors review the status of international law in U. S. law and …

Cancellation Of Debt And Other Incidential Items Of Income: Puritan Tax Rules In The U.S., Richard C.E. Beck

Articles & Chapters

This article examines some miscellaneous and incidental forms of income from a comparative point of view. It appears that U.S. law includes as income more types of incidental items than most other countries. The items briefly considered here are (in no particular order) found money and property, gambling gains, gains from a personal hobby, isolated criminal profits, prizes and awards for merit, damages from non-physical personal injury, and gains from sale of a personal residence. The article concludes with a more thorough examination of income from the cancellation of debts (COD income) of an individual. These items have in common …

Justice Still Fails: A Review Of Recent Efforts To Compensate Individuals Who Have Been Unjustly Convicted And Later Exonerated, Adele Bernhard Jan 2004

Justice Still Fails: A Review Of Recent Efforts To Compensate Individuals Who Have Been Unjustly Convicted And Later Exonerated, Adele Bernhard

Articles & Chapters

With this Article, I hope to motivate state legislators to enact responsible, practical compensation statutes and encourage courts to entertain state law and civil rights claims brought by those who have been unjustly convicted and later exonerated. I begin by looking at the reasons for enacting compensation statutes: uniformity, practicality, popular support, and fairness. Next, I dissect the arguments raised by opponents. Finally, I turn to recent judicial decisions hinting that courts may be stepping in where legislatures fear to tread.

Taxing Political Donations: The Case For Corrective Taxes In Campaign Finance, David Gamage Jan 2004

Taxing Political Donations: The Case For Corrective Taxes In Campaign Finance, David Gamage

Articles by Maurer Faculty

Command-and-control regulations are generally thought to be inferior to incentive-based alternatives. This essay proposes an incentive-based approach for regulating campaign finance. In place of our current regime of contribution ceilings, the essay calls for a graduated system of contribution taxes. Rather than capping the size of political donations at a specified dollar level, we should tax donations based on a schedule of graduated rates - the larger the size of a contribution, the higher the level of taxation.

Contribution taxes generate two primary advantages over contribution ceilings. First, contribution taxes preserve more total surplus. This surplus can be shared by …

Accepting Authoritative Decisions: Humans As Wary Cooperators, John R. Hibbing, John R. Alford Jan 2004

Accepting Authoritative Decisions: Humans As Wary Cooperators, John R. Hibbing, John R. Alford

Department of Political Science: Faculty Publications

Why are people more willing to accept some governmental decisions than others? In this article, we present results from a series of original experiments showing that people’s reactions to a given outcome are heavily influenced by the procedure employed to produce the outcome. We find that subjects reactmuch less favorably when a decision maker intentionally keeps a large payoff, thereby leaving the subject with a small payoff, than when that same payoff results from a procedure based on chance or on desert. Moreover, subjects react less favorably to outcomes rendered by decision makers who want to be decision makers than they …
