Justice Still Fails: A Review Of Recent Efforts To Compensate Individuals Who Have Been Unjustly Convicted And Later Exonerated, Adele Bernhard

With this Article, I hope to motivate state legislators to enact responsible, practical compensation statutes and encourage courts to entertain state law and civil rights claims brought by those who have been unjustly convicted and later exonerated. I begin by looking at the reasons for enacting compensation statutes: uniformity, practicality, popular support, and fairness. Next, I dissect the arguments raised by opponents. Finally, I turn to recent judicial decisions hinting that courts may be stepping in where legislatures fear to tread.

A Hands-On Approach To Calculus was a research study designed to examine the use of hands-on inquiry centered teaching strategies in a first semester calculus class and the ramifications of the hands-on strategies. The study used an experimental class, where activities were implemented into the teaching strategies, and a control class, where traditional teaching strategies of lecture of theory and drill were used. Students' learning in the two classes was examined by comparing exam scores in the two classes and by analyzing students' journals from the experimental class. The quantitative analysis of the exam scores did not indicate any significant …

Economics has long had its enemies. The question is, why? What, precisely, is it about economics that its critics oppose? William Coleman seeks to tell the story of «anti-economics», «to take its measure» (p. 3), and then finally to defend economics from these attacks. His is a broad, sweeping study that uses a wide lens, panoramically over time, to survey the opposition. The crisis in economics, edited by Edward Fullbrook, provides us instead with a detailed snapshot of a recent sort of anti-economics - the Post-Autistic Economics (PAE) movement that originated among French economics students in 2000. ....what I examine here is whether scientific-style peer review, depending on how it is dosed out, could be counterproductive for environmental law.The use of peer review as a component of regulatory procedure has not received much discrete attention in environmental law literature, but it is truly the sleeping dog of the "sound science" movement. Understanding this concept requires some background on science and administrative law. The "sound science" movement, as its name suggests, advocates that environmental law decisions be based principally on scientific information and conclusions that have been derived through the rigorous, unbiased practice of science. The prevalence of antibiotic resistant microorganisms in the environment is not well known but could represent a challenge to maintaining public health in the future. Fecal waste from livestock facilities, where antibiotics are routinely used, is recognized as a significant source of pollution to surface waters in the United States. We collected water from the Missouri River across a winter to spring seasonal change in order to survey the density of coliform bacteria. We tested bacterial isolates for resistance to penicillin, tetracycline, ampicillin, erythromycin, and ciprofloxacin. Se analizó la histología tegumentaria de la región cefálica en seis especies del género Melanophryniscus, pertenecientes a los grupos stelzneri (4) y tumifrons (2), con el objetivo de esclarecer la estructura de la tumefacción frontal y su posible función. Las características generales de la histología del grupo stelzneri, coincidieron con las descripciones tegumentarias existentes para el género. Sin embargo, la región cefálica frontal en las dos especies del grupo tumifrons muestran cambios histológicos correlacionados a la tumefacción frontal. Most species of the frog genus Leptodactylus occur in South America, and all authors who have treated the zoogeography of the genus have concluded that it originated somewhere in South America (e.g., Savage 1982). Savage (1982, 518) summarized the historical herpetofaunal units of the Neotropics as follows: "All evidence points to an ancient contiguity and essential similarity of a generalized tropical herpetofauna that ranged over tropical North, Middle, and most of South America in Cretaceous-Paleocene times. An evolutionary theory known as balanced polymorphism (Hutchinson, 1959), which accounts for the prevalence of the deadly hereditary disease called sickle cell anemia, may prove to be a possible solution to the evolutionary paradox of homosexuality. The evolutionary advantage supported by the theory may account for the current and future prevalence of homosexuality. The theory works on the basis of a heterozygotic advantage, which is simply the advantage gained by a combination of two extreme genotypes. In this case, the heterozygotic advantage is the personality of a homosexual and the sexual orientation of a heterosexual. To test this theory, forty-eight …

As apology advocates have previously emphasized, much of the civil litigation that clogs court dockets in America today could be avoided with a simple heartfelt apology. Although sometimes difficult to offer, these expressions of remorse are profoundly powerful and valuable for humans as social animals. Nevertheless, apologies can be problematic. This Article used evolutionary theory as a tool to explore the costs of apology in two areas-spouse abuse and medical malpractice-to suggest that excessive victim forgiveness can, in some contexts, cast doubt on the effectiveness of a purely private litigation system for creating appropriate behavioral incentives. The purpose of this study was to examine the means of scores on three forms of a standardized reading comprehension test taken by community college students in developmental reading classes. The three forms of the test were administered as a timed multiple-choice test, a constructed response test, and an un-timed multiple-choice test. Scores on the Group Embedded Figures Test (GEFT) were used to classify the students who participated in the study as having field dependent (LOW GEFT), mid-field dependent/independent (MID GEFT), or fieldindependent (HIGH GEFT) tendencies. Light scattering-based techniques are being developed for non-invasive diagnostics of inhomogeneous media in various fields, such as medicine, biology, and material characterization. However, as most media of interest are highly scattering and have a complex structure, it is difficult to obtain a full analytical solution of the scattering problem without introducing approximations and assumptions about the properties of the system under consideration. Water Quality Variations During Nitrification In Drinking Water Distribution Systems, David W. Webb

This thesis documents the relationship among the major water quality parameters during a nitrification episode. Nitrification unexpectedly occurred in a chloraminated pilot drinking water distribution system practicing with a 4.0 mg/L as Cl2 residual dosed at 4.5:1 Cl2:NH3-N. Surface, ground and sea water were treated and disinfected with monochloramines to produce finished water quality similar to regional utility water quality. PVC, galvanized, unlined cast iron and lined iron pipes were harvested from regional distribution systems and used to build eighteen pilot distribution systems (PDSs). The PDSs were operated at a 5-day hydraulic residence time (HRT) and ambient temperatures. As seasonal …

The establishment of a U.S. National Y-STR reference database from a variety of geographically and ethically diverse populations is essential to facilitate the generation of reliable estimates of Y-STR haplotype frequencies. Such multi-locus haplotype frequencies are required to provide a statistical estimate of the significance of a match. Y-STR loci, unlike traditional STR markers, are not independent of one another and are co-inherited as extended haplotypes of linked markers. The estimation of the frequency of occurrence of a particular haplotype therefore necessitates the use of a counting method, which means that the significance of many matches is dependent upon the …
