Iraq: One Year Later, Mary Ellen O'Connell Jan 2004

Iraq: One Year Later, Mary Ellen O'Connell

Journal Articles

Almost exactly one year ago, during her presidential speech at the 2003 Annual Meeting of the American Society of International Law, Anne-Marie Slaughter spoke of the use of force that began in Iraq shortly before that Annual Meeting. She concluded that the war was unlawful but nevertheless potentially legitimate. That conclusion provoked a great debate from the moment her speech ended. Our purpose today is to take up that debate.

On The Historical School Of Jurisprudence, Robert E. Rodes Jan 2004

On The Historical School Of Jurisprudence, Robert E. Rodes

Journal Articles

Legal theory has tended to treat the Historical School as a poor relation, but it has important contributions to make. Developed in opposition to the one-size-fits-all form of natural law that eventuated in the Code Napoleon, it attributes law to a Volksgeist, the spirit of a people, as developed in the peculiar historical experience of that people. The original German proponents of the school had trouble explaining the reception of Roman law in Germany, but despite the importation of technical elements from without, a people's laws are in fact part of their culture and of their spiritual heritage as these …

The Pros And Cons Of The Learned Helplessness Construct And The Battered Woman Syndrome: A Critical Analysis And Possible Reformulation, Lucille Andreozzi Stern Jan 2004

The Pros And Cons Of The Learned Helplessness Construct And The Battered Woman Syndrome: A Critical Analysis And Possible Reformulation, Lucille Andreozzi Stern

Open Access Dissertations

Two prevailing, contrasting theories, learned helplessness and health psychogenesis, have been proposed to describe and explain the battered woman's experience and response to domestic violence. This research examined the status (scientific adequacy) of each theory's database to determine where the preponderance of evidence lies.

The investigator articulated nine factors that differentiate the two theories. Trained independent raters then rated study outcomes as falling into one of three categories: pro-learned helplessness, pro-health psychogenesis, or supportive of both theories. Studies of two research samples (shelter and community) were identified and assessed (rated) along four methodological dimensions (sample, instrumentation, statistical analysis, and hypothesis …

Resilience In Ex-Refugees From Cambodia And Vietnam, Lynne Ee Lin Yong Jan 2004

Resilience In Ex-Refugees From Cambodia And Vietnam, Lynne Ee Lin Yong

Open Access Dissertations

The negative impacts of various forms of trauma on the physical and mental health of victims are well documented, including the experiences of the French Indo-Chinese, who suffered a range of traumatic experiences ranging from displacement to torture. However, a sizable percentage of French Indo-Chinese refugees living in the U.S. do not exhibit psychopathology. Very little is known about the Indo-Chinese refugees who are not seeking services and are doing well in their host country. This study focused on resilient Cambodian and Vietnamese ex-refugees, with the goal of identifying resiliency factors and their underlying processes, in order to inform the …

The Birth Of Bizdames: A Rupture In The Conversation, Engaging The Body In Decision-Making, Kathleen Mallon Jan 2004

The Birth Of Bizdames: A Rupture In The Conversation, Engaging The Body In Decision-Making, Kathleen Mallon

Open Access Dissertations

Organizational studies consistently find that managers spend more time talking than any other activity (Mintzberg, 1973; Simon, 1945), that strategic decisions are developed and enacted through interactive talk (Perlow, 2003; Shaw, 2002), and that a diversity of perspectives has a positive effect on decision-making and organizational performance (Agyris, 1977). Conversely, the evidence suggests that cultures that perpetuate silence are less effective (Bourgeois, 1985; Enz & Schwenk, 1991; Morrison & Milliken, 2000; Ryan & Oestreich, 1991). Thus, knowledge about the inter-relationship of the micro-mechanisms of silence and talk and their effect on organizational performance is critical to management theory and practice …

A Tri-Cultural Look At Legitimacy And Illegitimacy Using An Evolutionary Model, Mara D. Giles Jan 2004

A Tri-Cultural Look At Legitimacy And Illegitimacy Using An Evolutionary Model, Mara D. Giles

Nebraska Anthropologist

The rules for legitimacy and illegitimacy are not universal, yet every culture classifies its children into valid and invalid A review of the literature, including Teichman, Hendrix, and Davis, has indicated that legitimacy is a status of marriage. This status is determined by several factors including race, class, inheritance patterns, lineage systems, the role of fathers, and the position of women. European and subSaharan African cultures use these factors differently to validate the boundaries separating the legitimate from the illegitimate. Until as recently as thirty years ago, English culture asserted that a man had to be proven to be the …

Comparison Of The Traditional And Contemporary Extended Family Units Of The Hopi And Lakota (Sioux): A Study Of The Deterioration Of Kinship Structures And Functions, Benjamin Grant Purzycki Jan 2004

Comparison Of The Traditional And Contemporary Extended Family Units Of The Hopi And Lakota (Sioux): A Study Of The Deterioration Of Kinship Structures And Functions, Benjamin Grant Purzycki

Nebraska Anthropologist

Drawing on a body of classical and contemporary ethnographic resources, one finds a number of coriflicting conclusions and assumptions in not only the evolutionary role of the extended family and its functions, but also-in a post-colonial context-how these units as well as their roles and functions change. When comparing a number of sources, we find that extended families are explained in diametrically opposed terms (e.g. some say extended families result from hunter-gatherer societies while others attribute it to agricultural groups), creating conflicting theory obviously not considered together as often enoughhence the necessity of comparative study between traditionally agricultural Hopi and …

The Old Order Mennonites And Mass Media: Electronic Media And Socialization., Eunice I. Rohrer Jan 2004

The Old Order Mennonites And Mass Media: Electronic Media And Socialization., Eunice I. Rohrer

Graduate Theses, Dissertations, and Problem Reports (ETD)

This research project is a critique of both electronic media effects and socialization for the largely unstudied sect of Old Order Mennonites from the Weaverland Conference. In an initial pilot study, eight interviews were conducted to obtain reasons for rejection of electronic media. Next, the electronic media studied in this study’s survey analysis included cell phones, computers and attitudes toward the internet. The Lancaster Conference Mennonites are employed for group comparison. In a revival of McLuhan’s theory, it was hypothesized that the more different electronic media types are used and the greater the number of years they are used, the …

Testing The Efficacy Of Children's Health Insurance Program: A Study Of Enrollment History And Disenrollment In West Virginia Children's Health Insurance Program., Charles Walter

Graduate Theses, Dissertations, and Problem Reports (ETD)

In this paper, I am providing a descriptive analysis of the children on the rolls of the West Virginia Children’s Health Insurance Program (WV CHIP). The research was guided by four questions: (1) Who are the children from West Virginia that are on the rolls of WV CHIP? (2) What are the reasons why children disenroll from the program? (3) Where do the children come from before WV CHIP and where did the children go to after WV CHIP? (4) What does their enrollment history look like while on WV CHIP? The sample is a total number (N=55,876) of the …

The Influence Of Legal Language Upon Supreme Court Voting In Civil Liberties Cases., Sean Wilson Jan 2004

The Influence Of Legal Language Upon Supreme Court Voting In Civil Liberties Cases., Sean Wilson

Graduate Theses, Dissertations, and Problem Reports (ETD)

Scholars such as Jeffrey Segal and Harold Spaeth contend that U.S. Supreme Court decisions are based primarily upon the ideological beliefs of the justices. However, in this work I show that this conclusion is exaggerated. The aggregation of votes into a summary statistic (the percent liberal rating) and its use by Segal and Spaeth in a regression having only 21 cases creates misleading results. The truth is that political ideology is a fluctuating influence upon the Court. In some areas of civil liberties voting, ideology is a poor explanation of how cases are decided (e.g., core political speech). But in …

Leadership Development Of Community College Students: Does Participation In The Phi Theta Kappa Leadership Development Studies Course Have An Effect On The Development Of Leadership Behaviors?, Beverly Wilcox

Graduate Theses, Dissertations, and Problem Reports (ETD)

This study assessed whether participation in the Phi Theta Kappa Leadership Development Studies course had an effect on the leadership behaviors of students at four community colleges from urban and rural geographic locations within the tri-state area of Maryland, Pennsylvania, and West Virginia. The researcher visited the four community colleges and distributed the Kouzes and Posner (1998a) Student Leadership Practices Inventory-Self and a demographic questionnaire to a total population of 92 students. Descriptive statistics, t-tests, and an analysis of variance (ANOVA) were used to analyze the data according to the research questions guiding this study. The major findings indicated that …

Critical Thinking And Web-Based Education In Maryland Community Colleges: How The Medium Promotes Development., George E. Perry Jan 2004

Critical Thinking And Web-Based Education In Maryland Community Colleges: How The Medium Promotes Development., George E. Perry

Graduate Theses, Dissertations, and Problem Reports (ETD)

Surveys have found that employers want today's community college graduates to be able to work in teams, make decisions, and critically assess job situations. In short they want the students to think critically. Due to the changing demographics, web-based education has become a larger part of college curriculum in the past several years. This research project explored critical thinking in web-based courses offered at Maryland community colleges to determine what courses were being offered by the different academic disciplines, the methods used to promote critical thinking, and the types of critical thinking assessment used in these web-based courses. The content …

Surrogate Mothers Use Of Online Messaging: A Study Of Social Support., Shauna Lively Aurelio Jan 2004

Surrogate Mothers Use Of Online Messaging: A Study Of Social Support., Shauna Lively Aurelio

Graduate Theses, Dissertations, and Problem Reports (ETD)

People faced with challenging life events, such as pregnancy, need social support for well being. Traditionally, this support has been given via face-to-face contact in communities. It is known that online messaging promotes effective social support among people with disabilities or illnesses, and during life events such as pregnancy and parenting. It has been further suggested that surrogate mothers, women who contract with another person or a couple to bear a child, receive less social support from their families than other mothers. What is not known is how effective online social support is for surrogate mothers and how much they …

The Politics Of Space And Scale In The Brazilian Favela: A Case Study Of Sao Pedro., Eric K. Spears Jan 2004

The Politics Of Space And Scale In The Brazilian Favela: A Case Study Of Sao Pedro., Eric K. Spears

Graduate Theses, Dissertations, and Problem Reports (ETD)

The politics of local economic development in the Brazilian favela (urban slums) are contentious. This dissertation examines the politics of economic development in the urban slum of Sao Pedro, which is located in the city of Vitoria, Brazil. Space and scale are central to understanding the politics of economic development in this favela, and this research will make use of both concepts to shed light on this local struggle. The dissertation will examine the struggle over local economic development in Sao Pedro through an analysis of the residents' spatial practices. This dissertation will examine the role that scale plays in …

Kinship Migration To Northwestern Virginia, 1785-1815: The Myth Of The Southern Frontiersman, Philip W. Sturm Jan 2004

Kinship Migration To Northwestern Virginia, 1785-1815: The Myth Of The Southern Frontiersman, Philip W. Sturm

Graduate Theses, Dissertations, and Problem Reports (ETD)

For nearly 100 years American historians, with few exceptions, have maintained that migration of colonists to the trans-Appalachian frontier was a communal experience for those from New England and Northern regions but that the Southern frontiersman represented a non-communal, individualistic spirit of colonization. This dissertation traces the migration and settlement patterns of the earliest colonists along the northwestern Virginia frontier, the area organized as Wood County in 1799, from three Eastern regions, New England, the Middle Atlantic, and the Northern Neck of Virginia. It determines that emigrants from all regions migrated cohesively and sequentially in large kinship/neighbor groups and that …

Estimating The Economic Value Of Canaan Valley National Wildlife Refuge: A Contingent Valuation Approach., Christopher A. Klocek Jan 2004

Estimating The Economic Value Of Canaan Valley National Wildlife Refuge: A Contingent Valuation Approach., Christopher A. Klocek

Graduate Theses, Dissertations, and Problem Reports (ETD)

Canaan Valley National Wildlife Refuge protects a unique ecosystem in the Mid-Atlantic region. Because public goods such as ecosystem preservation are not sold in markets the value of this type of good is not always obvious. Policy makers need guidance on how society should allocate resources to preserve wildlife habitat and wilderness recreation opportunities. The goals of this study were to measure the economic benefits associated with providing a wildlife refuge in Tucker County, West Virginia; determine how value for the refuge is affected by distance of the respondents from the refuge; and determine the types of activities and amenities …

Same Place Yet Different Worlds: A Gis And Society Perspective On Kenyan Peri-Urbanization., Francis Tama Koti Jan 2004

Same Place Yet Different Worlds: A Gis And Society Perspective On Kenyan Peri-Urbanization., Francis Tama Koti

Graduate Theses, Dissertations, and Problem Reports (ETD)

This dissertation examines Kenyan peri-urbanization using a GIS and Society conceptual framework. The study integrates historical and cultural peri-urban experiences of local communities into a conventional GIS to enhance an analysis of uneven development of residential space in Athi River town, Kenya. The research is guided by three broad objectives: (1) understanding how GIS is impacting Kenyan urban geographic research; (2) building a GIS to study uneven development of residential space, and; (3) integrating community local knowledge into a GIS-based analysis of uneven residential development in a peri-urban setting. The research methodology combines a variety of culturally sensitive but complimentary …

Gender Moderation Of The Relationship Between Hours In Role And Work-Family Conflict: A Test Of Competing Theories, Lucas D. Gray Jan 2004

Gender Moderation Of The Relationship Between Hours In Role And Work-Family Conflict: A Test Of Competing Theories, Lucas D. Gray

Dissertations and Theses @ UNI

Americans' roles as family members and workers have been clashing in recent history. The past fifteen years have expanded the work-family conflict (WFC) literature considerably. Gutek, Searle, and Klepa (1991) proposed and tested two views of how WFC may be affected by sex. The rational view predicts that WFC originates in the role that the person spends more time in. However, the gender role view predicts that the more time a person spends outside traditional gender roles increases conflict. Thus, the two theories make incompatible predictions regarding the relationship between time spent in a role, gender and WFC. The current …

From Rethinking To Internationalizing Criminal Law, George P. Fletcher Jan 2004

From Rethinking To Internationalizing Criminal Law, George P. Fletcher

Faculty Scholarship

Writing Rethinking Criminal Law ("Rethinking") was a gamble. No one had ever written a serious book on comparative criminal law – in English or in any other language. No one had ever addressed English-speaking readers with the argument that some other system of legal thought – espoused by a nation defeated in a major war just thirty years before – had a superior literature on criminal law and a more refined way of thinking about the structure of criminal offenses. No one had tried to present the system of criminal law as though it were a species of …

Toyota Jurisprudence: Legal Theory And Rolling Rule Regimes, William H. Simon Jan 2004

Toyota Jurisprudence: Legal Theory And Rolling Rule Regimes, William H. Simon

Faculty Scholarship

The engineering ideas associated with the Toyota Production System form a model of social organization that departs from bedrock assumptions of mainstream legal thought in both its rights-and-principles and law-and-economics variants.

In contrast to mainstream thought, the Toyota system (1) emphasizes the goals of learning and innovation (rather than of dispute resolution and the vindication of established norms and preferences), (2) combines the normative explicitness associated with formal rules with the continuous adjustment to particularity associated with informal norms (no dialectic of rules and standards), (3) treats normative decisionmaking in hard cases as presumptively collective and interdisciplinary (rather than the …

Be Careful What You Wish For: Legal Sanctions And Public Safety Among Adolescent Offenders In Juvenile And Criminal Court, Jeffrey Fagan, Aaron Kupchik, Akiva Liberman Jan 2004

Be Careful What You Wish For: Legal Sanctions And Public Safety Among Adolescent Offenders In Juvenile And Criminal Court, Jeffrey Fagan, Aaron Kupchik, Akiva Liberman

Faculty Scholarship

Three decades of legislative activism have resulted in a broad expansion of states' authority to transfer adolescent offenders from juvenile to criminal (adult) courts. At the same time that legislatures have broadened the range of statutes and lowered the age thresholds for eligibility for transfer, states also have reallocated discretion away from judges and instituted simplified procedures that permit prosecutors to elect whether adolescents are prosecuted and sentenced in juvenile or criminal court. These developments reflect popular and political concerns that relatively lenient or attenuated punishment in juvenile court violates proportionality principles for serious crimes committed by adolescents, and is …

Publishing Aviation Research: A Literature Review Of Scholarly Journals, Robert W. Kaps, Ed Phillips Jan 2004

Publishing Aviation Research: A Literature Review Of Scholarly Journals, Robert W. Kaps, Ed Phillips

Journal of Aviation/Aerospace Education & Research

The importance of the aviation industry's socio-economic impact, domestically and globally, cannot be denied. In light of this and, as aviation continues to evolve as an academic field of study, post-secondary institutions with aviation specific curriculum have grown,in number and prominence. As a direct consequence of academic growth, the necessity to publish follows as a concomitant requirement. Through the diligence of those researchers actively conducting aviation related research a common theoretical and conceptual base for aviation specific research has been established. The void that once existed for aviation research has been filled, predominantly by three aviation specific journals and a …

The Impact Of The Iowa Children's Water Festival On The Children's Attitudes And Behaviors Toward The Environment, Sang-Min Kim Jan 2004

The Impact Of The Iowa Children's Water Festival On The Children's Attitudes And Behaviors Toward The Environment, Sang-Min Kim

Dissertations and Theses @ UNI

As a result of the growing concern about environmental issues, many countries have developed mechanisms and regulations directed at protection and conservation of the environment. As a part of this movement, many governmental and nongovernmental organizations (NGO) have launched a variety of environmental education programs, in an attempt to promote awareness of environmental issues. The Iowa Children’s Water Festival (ICWF) is an annual half-day environmental education program in Iowa. The goal of the ICWF is to provide educational opportunities throughout the state to K-5 children and to educate customers of tomorrow on the importance of safe, reliable drinking water (ICWF, …
