Governance Structures, Legal Systems, And The Concept Of Law, Lewis A. Kornhauser Jan 2004

Governance Structures, Legal Systems, And The Concept Of Law, Lewis A. Kornhauser

Faculty Articles

Debate over the concept of law currently contrasts conceptual and interpretive accounts. This Article begins to elaborate a social-scientific conception of law as a subset of a concept of a governance structure. To begin, it distinguishes institutional structures, realized institutions, and functioning institutions. Governance structures consist of institutional structures that perform central tasks of governance. Dworkin's interpretive conception of law extends over the domain of functioning institutions; positivist, conceptual accounts of law extend over the domain of institutional structures. From this perspective legal systems may be best understood as governance structures that satisfy the political value legality; different concepts of …

Can Treasury Overrule The Supreme Court?, Gregg Polsky Jan 2004

Can Treasury Overrule The Supreme Court?, Gregg Polsky

Faculty Articles

This article considers whether the Treasury's check-the-box regulations, which have been widely praised by tax practitioners, are valid. These regulations generally allow any unincorporated entity to elect whether it will be treated as a corporation or a partnership for tax purposes. When these regulations were first proposed, there was some debate as to whether such an elective regime was foreclosed by the statutory scheme, which requires that "associations" be taxed as corporations. This article argues that the focus of this debate was misplaced because, even assuming that the statutory scheme itself was sufficiently ambiguous as to permit an elective regime, …

Munazza’S Story: Shedding Light On A Science Teacher’S Conceptions Of The Nature Of Science Through A Life History Study, Nelofer Halai, Derek Hodson

Institute for Educational Development, Karachi

Life history research creates a broader understanding of teaching by providing illustration of the relationships among various aspects of teachers’ lives and their teaching practice, both inside and beyond the classroom. This article focuses on the life history of Munazza, a young science teacher at the Karachi Model Secondary School (KMSS), a private, co‐educational, English‐medium school for children from middle‐income families. Its purpose is to gain insight into a female science teacher's understanding of teaching science in a school in Pakistan, ascertain what aspects of this science teacher's conceptions of the nature of science are explicit in her practice, and …

Back To The Future: The Future Of Long-Term Care In Massachusetts, Deborah H. Thomson, John J. Ford Jan 2004

Back To The Future: The Future Of Long-Term Care In Massachusetts, Deborah H. Thomson, John J. Ford

Gerontology Institute Publications

The state of Massachusetts, like the rest of the United States, is facing an approaching crisis in long-term care. Over the next few decades the number of Massachusetts residents age 65 and older will soar. As these numbers increase, so will the need for long-term care.

Massachusetts is ill prepared to provide the services that will be needed. Our current system of health care benefits leaves many elders with gaps in coverage. Those individuals who need long-term services often impoverish themselves and their spouses before the state pays for their care. Others languish on waiting lists to receive services. Our …

Citizenship, Identity, And Transnational Migration: Arab Immigrants To The Us, Caroline R. Nagel, Lynn A. Staeheli Jan 2004

Citizenship, Identity, And Transnational Migration: Arab Immigrants To The Us, Caroline R. Nagel, Lynn A. Staeheli

Faculty Publications

The aim of this paper is to evaluate the changing relationships between identities, citizenship and the state in the context of globalisation. We first examine the ways in which scholars discuss changes in the ways in which citizenship and political identity are expressed in the context of international migration. We argue that much of the discussion of transnationalism and diaspora cling to an assumption that citizenship remains an important—though not defining—element of identity. Our position, by contrast, is that migration is one of a number of processes that transform the relationship between citizenship and identity. More specifically, we argue that …

A Study Of The Principle Of Subsidiarity In Catholic Social Thought: Implications For Social Justice And Civil Society In Nigeria, Simeon Iber Jan 2004

A Study Of The Principle Of Subsidiarity In Catholic Social Thought: Implications For Social Justice And Civil Society In Nigeria, Simeon Iber

Electronic Theses and Dissertations

This dissertation examined the centrality of the principle of subsidiarity in Catholic social teaching, in bringing about social and moral reconstruction of society and in particular the Nigerian social context. The origin of this principle has been traced to the natural human inclination to build a healthy relationship between the individual and society, such that, the society will provide generous help and support to individuals to help themselves. Subsidiarity is a way of organizing individuals and social groups in community to help each other in pursuing their interests with common goals, the ultimate purpose being to assist one another and …

Searching For Mother: Chicana Writers Revise And Renew Malinche And Guadalupe, Diane L. Maldonado Jan 2004

Searching For Mother: Chicana Writers Revise And Renew Malinche And Guadalupe, Diane L. Maldonado

Electronic Theses and Dissertations

Chicana writers currently assume the role of border culturalists in order to present alternative views of female figures perpetuated by histories, chronicles, myths, and other narrations motivated by imperial ideology and patriarchy. Two such female figures in Mexican-American culture are La Virgen de Guadalupe and La Malinche, archetypes that emerged in Mexico during the Spanish conquest period and that traditionally became dichotomous constructions of virgin and whore, Virgin Mary and Eve, and protector and traitor, respectively. However, contemporary Chicana feminist writers, such as Gloria Anzaldúa, Ana Castillo, Sandra Cisneros and Pat Mora, not only revise traditional images of Malinche and …

The Baby Out With The Bathwater! Securitization Of Corruption And Its Impact On Human Security, Shabnam Mallick Jan 2004

The Baby Out With The Bathwater! Securitization Of Corruption And Its Impact On Human Security, Shabnam Mallick

Electronic Theses and Dissertations

In the context of the president's rule in India in 1975, this paper looks at the intersection of political corruption and human security through the lens of the theory of securitization and desecuritization. In this, I study the deeper politics--i.e., the frame of reference of actors--behind the distortions in the civic and political institutions of India. I argue that the securitization of development led to its de-politicization, which in turn negatively impacted human security. In doing so, I arrive at some moral, social-psychological, and cognitive understanding of how not to securitize. The policy implications are towards employing securitization only as …

Examining The Perspectives Of An Interdisciplinary Treatment Team Regarding The Implementation Of A Sensory Motor Group Trauma Curriculum In A Child And Adolescent Partial Hospitalization Program, Barbara Peck

Electronic Theses and Dissertations

A trauma curriculum was introduced at a child and adolescent partial hospitalization program. This study examined (a) the impact of the trauma curriculum on the partial hospitalization program; (b) the perspectives of the multi-disciplinary treatment team--teachers, teacher aides, trauma clinicians for the children and adolescents in the partial program, parents/caregivers, the facility's psychiatric nurse, the facility's medical director, and county program specialists--and a panel of expert practitioners toward the curriculum, and (c) any changes in the perspectives of the multi-disciplinary treatment team concerning the concept of trauma and its effects. To answer the research questions of this qualitative study, an …

The researcher also examined gender interactions between the two groups. The study was conducted in two elementary schools in western Pennsylvania. Participants in the study included 10 first-grade teachers. Participants completed a total of ninety-three behavioral questionnaires. Student's t-tests and analysis of variance were used to analyze the data. Results of the study showed no statistically significant difference in overall behavioral adjustment, impulsive acting out behaviors, passive-aggressive behaviors, impulsive overactive behaviors, repressed …

From Virtue To Sympathy: Perspectives In Eighteenth And Nineteenth Century British Literature On The Disintegration Of The Social Bond, Andrea Beranek Jan 2004

From Virtue To Sympathy: Perspectives In Eighteenth And Nineteenth Century British Literature On The Disintegration Of The Social Bond, Andrea Beranek

Electronic Theses and Dissertations

In general, developments in English literature of the mid-eighteenth century to the early nineteenth century tend to place increasing attention on individual experience and greater variety in characters' aims, motives, and desires. Along with this tendency, the literature reflects alterations in the conceptual understanding of benevolence and sympathy that coincide with other significant changes in perspective, particularly a shift in the general understanding of the construction of the world and society. That is, works of the earlier period reflect perspectives and values of a society motivated by similar goals and desires, while those later works tend to portray characters at …

The Role Of Political Behavior And Socio-Economic Development In The Transition And Consolidation Of Liberal Democracy In Sub Saharan Africa, Godfrey Wachira Jan 2004

The Role Of Political Behavior And Socio-Economic Development In The Transition And Consolidation Of Liberal Democracy In Sub Saharan Africa, Godfrey Wachira

Electronic Theses and Dissertations

The study utilizes the multivariate regression techniques to investigate the role of political behavior; power structure (at the micro level) and socio economic development (macro level) in the transition and consolidation of democracy in Sub Saharan Africa. In the analysis, political behavior, defined as the acceptance of political elites to accommodate divergent views, is the most significant predictor of democracy in the region. Socio economic development is a necessary but not sufficient condition for the consolidation of democracy in the region. In conclusion, I argue that Sub Saharan African nations must pursue both political and economic liberalization which entails the …

The Catholic Church And Political Mediation In The Dominican Republic: A Comparative Perspective, Emelio Betances Jan 2004

The Catholic Church And Political Mediation In The Dominican Republic: A Comparative Perspective, Emelio Betances

Sociology Faculty Publications

This essay looks at the Catholic Church and political mediation in the Dominican Republic during the 1980's and 1990's. It opens with a review of the Latin American context regarding the transition to democracy, the debt crisis, and the church's response to the new political reality. It draws some comparisons from Bolivia, Nicaragua, El Salvador, and Guatemala, where the church played an important role mediating political conflicts. The core of the article concentrates on three parts: the Dominican transition to democracy, the church mediation in the Tripartite Dialogue of the 1980's and early 1990's, and in the general elections of …

Aging, Health, And Public Policy: Demographic And Economic Perspectives, Linda J. Waite Jan 2004

Aging, Health, And Public Policy: Demographic And Economic Perspectives, Linda J. Waite

Population Policy and Demographic Analysis

In this supplement to Population and Development Review, distinguished social scientists bring a variety of disciplinary perspectives—economic, demographic, epidemiological—to bear on the subject of population aging, looking particularly to likely future trends and their economic consequences. Among the questions investigated: What can be said about the future course of longevity, given that research on both historical and contemporary populations belies the existence of a biologically fixed maximum for the human life span? To what extent do genetic factors contribute to the development of major chronic diseases of later life, such as Alzheimer’s? How can we unravel the strong positive …

An Investigation Of Meaning In Clinical Music Improvisation With Troubled Adolescents, Susan Gardstrom Jan 2004

An Investigation Of Meaning In Clinical Music Improvisation With Troubled Adolescents, Susan Gardstrom

Department of Music Faculty Publications

The purpose of this qualitative study was to investigate meaning-making in clinical music improvisation with troubled adolescents. Participants were six youth from two partial hospitalization programs. These individuals, ranging in age from 12 to 17, had severe behavioral and emotional disturbances. Each participant was involved in approximately five improvisation sessions with the researcher. The adolescents were asked to create nonreferential and referential instrumental improvisations, both alone and with the researcher. After each improvisation, the participants and the researcher listened to and/or talked about the piece. Selected improvisations were then analyzed using Bruscia’s (1987) Improvisation Assessment Profiles (IAPs), in order to …
