"[N]Ot A Story To Pass On": Constructing Mothers Who Kill, Susan Ayres Jan 2004

"[N]Ot A Story To Pass On": Constructing Mothers Who Kill, Susan Ayres

UC Law SF Journal on Gender and Justice

Society is horrified and shocked when mothers kill their children. While this reaction may be justified, the reasons behind infanticide are never fully explored. Motherhood has very specific definitions in our society which makes it difficult to understand the motivations behind infanticide. Social institutions, such as the legal system and the media, are responsible for constructing motherhood in such a way that we view mothers who kill their children as simply insane and deficient. This article asserts another possible viewpoint regarding infanticide. Instead of specularizing women, the author urges people to view mothers who kill their children within the context …

Counting The Dragon's Teeth And Claws: The Definition Of Hard Paternalism, Thaddeus Mason Pope Jan 2004

Counting The Dragon's Teeth And Claws: The Definition Of Hard Paternalism, Thaddeus Mason Pope

Faculty Scholarship

n his classic 1897 essay, The Path of the Law, Oliver Wendell Holmes Jr. warned against blind imitation of the past and called for "enlightened skepticism" toward the law. He described the first step of this critical examination as getting "the dragon out of his cave and on to the plain and in the daylight" so that "you can count his teeth and claws and see just what is his strength." Over the past thirty years, disagreements over the appropriate definition of "paternalism" have often masked further disputes over the circumstances under which the restriction of substantially autonomous self-regarding conduct …

Toward An Understanding Of Judicial Diversity In American Courts, Barbara L. Graham Jan 2004

Toward An Understanding Of Judicial Diversity In American Courts, Barbara L. Graham

Michigan Journal of Race and Law

Part I of this Article explores the utility of descriptive representation as an important concept in understanding why judicial diversity matters from a political perspective. Part II begins an empirical examination of judicial diversity at the federal level while Part III presents an analysis of state court diversity. The data presented in Parts II and III indicate that judges of color are underrepresented at all levels of the federal and state court systems and that particular racial and ethnic groups are virtually excluded from federal and state benches. The conclusion argues that the data presented in this Article support a …

Recently Incarcerated Homeless Men's Opinions On Rehabilitation Programs, Heather Eleanor Mooney Jan 2004

Recently Incarcerated Homeless Men's Opinions On Rehabilitation Programs, Heather Eleanor Mooney

Senior Honors Theses and Projects

Homelessness and incarceration have been recognized as national social problems that affect millions every year. Currently, about one-third of homeless men have also been incarcerated. The existence the population of doubly marginalized homeless felons indicates a very serious deficit within the status quo. This study utilizes a grassroots qualitative approach to further understanding aspects of this social problem. A snowball sample was conducted in a medium sized city in a Great Lakes state homeless shelter. Research was collected through in-depth qualitative interviews with the recently incarcerated homeless men about their opinions and experiences of rehabilitation programs in prison. This study …

Knowledge Management In A Research & Development Environment - The Integration Of Company Culture And Technology, Duncan Y. Kemp Jan 2004

Knowledge Management In A Research & Development Environment - The Integration Of Company Culture And Technology, Duncan Y. Kemp

Theses

This thesis will show that understanding company structure and company culture are significantly more important than the actual technological tools an organization uses to implement successful knowledge management. An examination of company structure and cultural enablers will be followed by a review of some of the most widespread knowledge management tools to illustrate how knowledge management can be successfully put into practice.

The Battle For The University: The Vietnam-Era Student Movement At Universities In Central Illinois, David Bell Jan 2004

The Battle For The University: The Vietnam-Era Student Movement At Universities In Central Illinois, David Bell

Masters Theses

America in the 1960s ran the gamut of social, economic, and political changes, from the assassination of political leaders to the apocalyptic potential of the Cuban Missile Crisis; from President Lyndon B. Johnson's promises of a Great Society, to the paralyzing effects of the Vietnam War. At the center of these domestic and international battles lay the "baby boomers," the largest-ever generation of Americans, and, not coincidentally, the largest generation of college students to enter the "ivory towers" of higher education. Raised in an era defined by cries for civil rights and "participatory democracy," these youths entered higher education determined …

Do Caucasian And African American Students Have Different Learning Styles?, Robin J. Black-Vannoy Jan 2004

Do Caucasian And African American Students Have Different Learning Styles?, Robin J. Black-Vannoy

Masters Theses

This study explored whether African American and Caucasian students have different learning styles. It specifically examined differences in preferred modes of information processing and instruction. Participants in the study completed the Dunn and Dunn Learning Style Inventory and the Kolb Learning Style Inventory. Subsequent analyses revealed that there were no significant differences in how African American and Caucasian students choose to process information for learning. However, there were some significant differences in preferred modes of instruction. African American students were more likely to prefer noisier and warmer learning environments, to snack while learning, and to learn in the late morning. …

Sibling Interaction: Sisters' Use Of Advice Episodes In The Construction Of Relational Identities, Melissa R. Gornick Jan 2004

Sibling Interaction: Sisters' Use Of Advice Episodes In The Construction Of Relational Identities, Melissa R. Gornick

Masters Theses

The purpose of this study was to examine how sisters collaboratively construct advice episodes in naturally-occurring conversation and how they used these advice episodes in their negotiation of relational identities. Thus, two research questions were addressed: 1) How do sisters collaboratively construct advice episodes in naturally occurring conversation, and 2) How do sisters use advice episodes in their negotiation of relational identities. The database for the study consisted of four sister sets who audio taped naturally occurring conversation. Jefferson's (1984b) transcript notation system was used to transcribe sibling conversations which contained advice episodes and the transcripts were analyzed using the …

Culture, Hybridity And The Dialogical Self: Cases From The South Asian-American Diaspora, Sunil Bhatia, Anjali Ram Jan 2004

Culture, Hybridity And The Dialogical Self: Cases From The South Asian-American Diaspora, Sunil Bhatia, Anjali Ram

Arts & Sciences Faculty Publications

This article outlines a dialogical approach to understanding how South Asian-American women living in diasporic locations negotiate their multiple and often conflicting cultural identities. We specifically use the concept of voice to articulate the different forms of dialogicality--polyphonization, expropriation, and ventriloquation--that are involved in the acculturation experiences of two 2nd-generation South Asian-American women. In particular, we argue that it is important to think of acculturation of the South Asian-American women as essentially a contested, dynamic, and dialogical process. We demonstrate that such a dialogical process involves a constant moving back and forth between various cultural voices that are connected to …

Religious Freedom And The Undoing Of The Westphalian State, Daniel Philpott Jan 2004

Religious Freedom And The Undoing Of The Westphalian State, Daniel Philpott

Michigan Journal of International Law

Not so long ago, in 1998, the world acknowledged both the fiftieth anniversary of the Universal Declaration of Human Rights and the 350th anniversary of the Peace of Westphalia. The Universal Declaration was celebrated in the popular press, by thousands of activists, and at well attended open forums at schools and universities. Westphalia was noted almost exclusively at academic conferences. But public obscurity is an undeserved fate for Westphalia, for its legacy in organizing our political world vies with that of the American and French revolutions. What Westphalia inaugurated was a system of sovereign states where a single authority resided …

Arbitral Law-Making, Thomas E. Carbonneau Jan 2004

Arbitral Law-Making, Thomas E. Carbonneau

Michigan Journal of International Law

Diversity--of a cultural, economic, religious, and political kind—exists not only among nation-states and in the sources and interpretation of international law, but also among the group of commentators who study the interactions of transborder actors and institutions. For example, sociologists interested in the global community seek to identify emerging entities and activities and to elaborate conceptual models that explain the new differentiations within the traditional pattern. Some of them have a mounting interest in the fashioning of transborder commercial justice by international arbitrators and private arbitral institutions. Who are these new players? How did they acquire their mandate? Further, how …

Nations Without States: Political Communities In The Global Age, Montserrat Guibernau Jan 2004

Nations Without States: Political Communities In The Global Age, Montserrat Guibernau

Michigan Journal of International Law

The nation has become one of the most contested concepts of our times. The multifarious definitions of the nation focus on cultural, political, psychological, territorial, ethnic, and sociological principles according to different scholars, politicians, and political activists willing to shed some light into such a disputed term. Their lack of agreement suggests a major difficulty in dealing with such a complex phenomenon. The crux of the matter probably resides close to the link which has been established between nation and State, and to the common practice of using the nation as a source of political legitimacy. To be or not …

What Can The Rule Of Law Variable Tell Us About Rule Of Law Reforms?, Kevin E. Davis Jan 2004

What Can The Rule Of Law Variable Tell Us About Rule Of Law Reforms?, Kevin E. Davis

Michigan Journal of International Law

In 2001 per capita income in Haiti was $480, the infant mortality rate was seventy-nine per 1000 live births and the illiteracy rate (age fifteen and over) hovered around fifty percent. By comparison, in the United States, less than two hours flying time away, the per capita income was $34,280, the infant mortality rate was seven per 1000 live births, and the illiteracy rate was negligible. Understanding the reasons why these sorts of disparities in important measures of development arise and persist is one of the greatest challenges in all of the social sciences.

Methods Of Power For Development: Weapons Of The Weak, Weapons Of The Strong, John Braithwaite Jan 2004

Methods Of Power For Development: Weapons Of The Weak, Weapons Of The Strong, John Braithwaite

Michigan Journal of International Law

Peter Drahos and John Braithwaite conducted a study during the 1990s on global business regulation, interviewing more than five hundred key players in approximately twenty globalizing business regulatory regimes. Results from that study are used in this paper to inform the identification of seven elements of American power in global governance. The paper then poses the question whether those elements can be acquired by developing countries.

Regime-Collisions: The Vain Search For Legal Unity In The Fragmentation Of Global Law, Andreas Fischer-Lescano, Gunther Teubner Jan 2004

Regime-Collisions: The Vain Search For Legal Unity In The Fragmentation Of Global Law, Andreas Fischer-Lescano, Gunther Teubner

Michigan Journal of International Law

Predictions of future events tend to be a rarity within the social sciences. It is an even more rare occurrence when predicted events come to pass. Niklas Luhmann's prediction on the future of global law is a memorable exception. In 1971, while theorizing on the concept of world society, Luhmann allowed himself the "speculative hypothesis" that global law would experience a radical fragmentation, not along territorial, but along social sectoral lines. The reason for this would be a transformation from normative (politics, morality, law) to cognitive expectations (economy, science, technology); a transformation that would be effected during the transition from …

The State And Globalization: Denationalized Participation, Saskia Sassen Jan 2004

The State And Globalization: Denationalized Participation, Saskia Sassen

Michigan Journal of International Law

The effort in this paper is to recover the ways in which the state participates in governing the global economy in a context increasingly dominated by deregulation, privatization, and the growing authority of non-state actors. A key organizing proposition, derived from my previous work on global cities' is the embeddedness of much of globalization in national territory, that is to say, in a geographic terrain that has been encased in an elaborate set of national laws and administrative capacities. The embeddedness of the global requires at least a partial lifting of these national encasements and hence signals a necessary participation …

Using Spki/Sdsi For Distributed Maintenance Of Attribute Release Policies In Shibboleth, Sidharth Nazareth, Sean W. Smith Jan 2004

Using Spki/Sdsi For Distributed Maintenance Of Attribute Release Policies In Shibboleth, Sidharth Nazareth, Sean W. Smith

Computer Science Technical Reports

The Shibboleth middleware from Internet2 provides a way for users at higher-education institutions to access remote electronic content in compliance with the inter-institutional license agreements that govern such access. To protect end-user privacy, Shibboleth permits users to construct attribute release policies that control what user credentials a given content provider can obtain. However, Shibboleth leaves unspecified how to construct these policies. To be effective, a solution needs to accommodate the typical nature of a university: a set of decentralized fiefdoms. This need argues for a public-key infrastructure (PKI) approach---since public-key cryptography does not require parties to agree on a secret …
