Burdens Of Persuasion In Civil Cases: Algorithms V. Explanations, Ronald Jay Allen, Sarah Lively Jan 2004

Burdens Of Persuasion In Civil Cases: Algorithms V. Explanations, Ronald Jay Allen, Sarah Lively

Public Law and Legal Theory Papers

The conjunction paradox has fascinated generations of scholars, primarily because it brings into focus the apparent incompatibility of equally well accepted conventions. On the one hand, trials should be structured to reduce the total number, or optimize the allocation, of errors. On the other hand, burdens of persuasion are allocated to elements by the standard jury instruction rather than to a case as a whole. Because an error in finding to be true any element of the plaintiff's cause of action will result in an error if liability is found, errors on the overall case accumulate with errors on discrete …

The Effect Of Tourist Theft On Future Travel Decisions, Judith Lynn Holcomb Jan 2004

The Effect Of Tourist Theft On Future Travel Decisions, Judith Lynn Holcomb

Electronic Theses and Dissertations

Past research has shown that theft is a prevalent crime against tourists. This study's purpose was to determine the effects of past incidents of personal theft on tourists' future decisions to travel by analyzing and comparing those who have experienced personal theft to those who heard of such incidents through personal accounts of friends or family. The findings, which were taken from a survey of 215 respondents, revealed that that experiencing personal theft, or knowing of someone who has, is not a deterrent for visiting a destination where the theft occurred. Results also showed that one aspect of theft that …

“Untiring Joys And Sorrows”: Yeats And The Sidhe, Kathleen A. Heininge

Faculty Publications - Department of English

Excerpt: "In popular culture, the idea of Irishness has long been associated with the idea of fairies and leprechauns. This association has been explored by scholars who treat the Sidhe—also known as the daoine maithe, or the “good people”—as either a sociological or a literary construct. Most often, the sociological con- struct is somewhat insidious and the literary construct tends to be romantic. Recently, Angela Bourke has explored how the folkloric understanding of the fairies may be used to explain the otherwise inexplicable—for instance, when hormonal changes that come about through puberty or menopause were explained by saying that …
