Musical Musings: The Case For Rethinking Music Copyright Protection, J. Michael Keyes
Musical Musings: The Case For Rethinking Music Copyright Protection, J. Michael Keyes
Michigan Telecommunications & Technology Law Review
This Article focuses on the topic of music copyright, but addresses this legal issue from a different vantage point than that of the industry insiders, insightful scholars, and policy makers that have weighed in on the debate. Instead of focusing on the issues regarding wholesale digital reproduction and dissemination of music protected by copyright, this Article focuses on music copyright infringement when the claim is that a given piece of music is "substantially similar" to another piece of music protected by copyright. Part I of this Article touches on the history of the music industry and copyright in this country, …

Marketable Features Of The Adapted Physical Education Career In Higher Education, Jiabei Zhang
Marketable Features Of The Adapted Physical Education Career In Higher Education, Jiabei Zhang
Human Performance and Health Education Faculty Research
The purpose was to investigate marketable features of the adapted physical education (APE) career in higher education. A total of 560 APE job openings (297 APE first priority and 263 APE second priority were identified from the Chronicle of Higher Education between 1975-1976 and 1997-1998. These data were analyzed by regression, chi-square, and descriptive statistics. The results indicate that the APE career is a growing employment market demanding candidates who specialize in APE to prepare in one or more other areas and encouraging candidates who specialize in other areas to minor in APE. The market shows that APE second priority …

The Influence Of Situational Organization, Age Gender, And Peer Group Interaction On The Emergence Of The Early Social Self, Phillip Williams
The Influence Of Situational Organization, Age Gender, And Peer Group Interaction On The Emergence Of The Early Social Self, Phillip Williams
Masters Theses & Specialist Projects
The objective of the present study was to investigate the influence of preschool learning environments on the frequency of prosocial behaviors. The analyses were conducted according to gender, age, and whether the activity was child-chosen or teacher-imposed. The behaviors for analysis included responding prosocially to verbal massages from other children, engaging in cooperative play, attending to cries and pleas of others, and commenting on behavior of others when potentially dangerous. The data were gathered through nonparticipant observations, teacher interviews, and a behavior checklist. Nonparametric statistical analyses were used to analyze the data. Results indicated that older girls were more likely …
Women And Development In Postsocialism: Theory And Power East And West, Sarah D. Phillips
Women And Development In Postsocialism: Theory And Power East And West, Sarah D. Phillips
Southern Anthropologist
To date, ethnographic research in Kyiv, Ukraine since 1998 has analyzed popular, political, and academic engagement of the “civil society” construct in the postsocialist context by examining ten nongovernmental organizations (NGOs) led by women. Further goals of this research have been to outline the challenges facing women in the post-Soviet period, and to examine the long-term effects of the Soviet gender contract. I argue that, in many cases, leadership roles in social organizations are a form of alternative employment for women, who have been forced out of their jobs in the context of postsocialist economic crisis and a revived nationalism …

On Protecting Children—From Censorship: A Reply To Amitai Etzioni, Marjorie Heins
On Protecting Children—From Censorship: A Reply To Amitai Etzioni, Marjorie Heins
Chicago-Kent Law Review
Etzioni's argument for censorship of minors ignores the fundamental problem with Internet filters, misstates the results of media-effects research, and uses emotional terms like "protection" and "harm" to mask moral judgments about what is appropriate for youth.
Given the size and constantly changing character of the Internet, filters necessarily rely on key words and phrases. As a result, thousands of valuable Web pages are mistakenly blocked by filters, even at their narrowest settings. The problem is inherent in the system.
Most media-effects studies do not show a causal link between violent content and violent (or "aggressive") behavior. The studies that …

On Protecting Children From Speech, Amitai Etzioni
On Protecting Children From Speech, Amitai Etzioni
Chicago-Kent Law Review
Are children entitled to the same First Amendment rights as adults? This Article explores the constitutionality of limiting children's access to objectionable materials assuming that both free speech rights and the protection of children are two core values that, like all other social values, must be balanced. When used to assess specific court cases and public policies, the balancing principle is a helpful guide in determining whether voluntary or incentives-based programs are sufficient to remedy the problems at hand or whether government regulation of free speech is necessary. The Article analyzes five court cases involving Internet filters in libraries, the …

Papers in Ecology
There are few well-documented, general ecological principles that can be applied to pressing environmental issues. When they discuss them at all, ecologists often disagree about the relative importance of different aspects of the science’s original and still important issues. It may be that the sum of ecological science is not open to universal statements because of the wide range of organizational, spatial, and temporal phenomena, as well as the sheer number of possible interactions. We believe, however, that the search for general principles has been inadequate to establish the extent to which generalities are possible. We suggest that ecologists may need to …
Assessing Community Participation In Development Planning: A Case Study Of Participants' Perceptions From A Small Rural Community In St. Lucia, Augustine Dominique
Assessing Community Participation In Development Planning: A Case Study Of Participants' Perceptions From A Small Rural Community In St. Lucia, Augustine Dominique
Capstone Collection
This research paper is a case study of participants' perceptions of their involvement in a process of development planning undertaken by the community of Laborie on the island of St. Lucia in the Eastern Caribbean. Participants are drawn from an overall sample determined by case design theory and the boundaries of the case under investigation. During in-depth interviews participants provide responses to questions on the authenticity of the participatory process. Data from participants is validated through triangulation with evidence from a focus group meeting and other documents and artifacts from the 3-year development planning process. The research also investigates how …
