Two Wrongs Make A Right: Hybrid Claims Of Discrimination, Ming Hsu Chen Jan 2004

Two Wrongs Make A Right: Hybrid Claims Of Discrimination, Ming Hsu Chen

Faculty Scholarship

This Note reinterprets and recontextualizes the pronouncement in Employment Division v. Smith (Smith II) that exemptions from generally applicable laws will not be granted unless claims of free exercise are accompanied by the assertion of another constitutional right. It argues that when Arab American Muslims, and others who are of minority race and religion, bring claims for exemption from gen erally applicable laws on the basis of free exercise and equal protection principles, they ought to be able to invoke Smith Il's hybridity exception, thus meriting height ened judicial scrutiny and increased solicitude from courts.

Prostitution As Legitimate Work: An Analysis Of Sex Work In America, Nicholas J. Osborne Jan 2004

Prostitution As Legitimate Work: An Analysis Of Sex Work In America, Nicholas J. Osborne

Cal Poly Humboldt theses and projects

This thesis investigates the proposition that prostitution should be viewed as legitimate work in order to minimize the abuse and exploitation directed at sex workers by clients, pimps, and those engaged in trafficking. This thesis argues that paid sex work should be viewed as a public health and social welfare problem, not a criminal act that is socially constructed along rigid moral boundaries. Evaluation of the effectiveness of legal sex work in promoting safer sex practices is included in the thesis. Additionally, a legal analysis of various policies and legislation proposed and developed in relation to prostitution and the different …

Evaluation Of The Training Program For Beginning Teachers At University School, Tara Ellsley

Abraham S. Fischler College of Education ETD Archive

This applied dissertation was designed to improve the support of beginning teachers at University School of Nova Southeastern University, a private high school. Veteran teachers, administrators, and support staff were not adequately prepared to integrate the beginning teachers who were rapidly leaving for employment elsewhere. There had been no attempt to identify their needs or evaluate their support system. Therefore, school leaders did not have the information necessary to address the retention problem.

The project identified beginning teacher needs and determined if the school was meeting those needs by answering the following questions: (a) What do beginning upper school teachers …

Preparing Preservice Teachers To Understand, Adapt, And Apply The Reggio Emilia Philosophy, Nkechy Marie Ezeh Jan 2004

Preparing Preservice Teachers To Understand, Adapt, And Apply The Reggio Emilia Philosophy, Nkechy Marie Ezeh

Abraham S. Fischler College of Education ETD Archive

This applied dissertation was designed to gain better understanding for the integration of the Reggio Emilia philosophy into the Early Childhood Education Endorsement program at a teacher preparation institution.

The methodology that was used included class discussion, observation, deconstruction of the Reggio Emilia principles, reflective practice, collaboration meetings, interviews, and field trips. The findings confirmed the findings in reviewed literature that the image and role of the preservice teachers should be that of an active apprentice not as an object of instruction.

Generalization of the findings to other teacher preparation programs must be done with caution because of the limitations …

Improving African American Males’ Academic And Social Success Through Implementation Of An Alternative Classroom Setting, Kenneth E. Daniels Jr Jan 2004

Improving African American Males’ Academic And Social Success Through Implementation Of An Alternative Classroom Setting, Kenneth E. Daniels Jr

Abraham S. Fischler College of Education ETD Archive

In school year 2001, African American males at Swainsboro Elementary School in Swainsboro, Georgia, comprised 51% of total discipline referrals. Numbers were even higher in 2002 and 2003, those being 58% and 70%, respectively. Studies suggested that African American males are the most at-risk group in modern society because of lack of role models, lack of cultural identity, and lack of appropriate social skill development that would reduce social conflicts.

The intervention model contained in this applied dissertation addressed the areas of conflict resolution and social skills development, cultural awareness, and mentoring. Participating students were placed in an alternative setting …

Professional Development And Turnover In Early Care And Education: Working Toward Solutions By Increasing Enrollment In A Professional Development Program, Sandra L. Duncan Jan 2004

Professional Development And Turnover In Early Care And Education: Working Toward Solutions By Increasing Enrollment In A Professional Development Program, Sandra L. Duncan

Abraham S. Fischler College of Education ETD Archive

Teachers’ educational backgrounds and professional development are positive predictors of program quality while teacher turnover is a negative predictor of program quality. Recent research suggests a significant link between teacher turnover and opportunities for professional development. The supposition is that, if the early childhood field could increase the quality of professional development training, then the level of teacher turnover could be reduced. Therefore, nonparticipation in professional development training opportunities is a critical issue in the early childhood industry.

This research study examined why early childhood practitioners are not enrolling in the professional development program opportunity that was published in a …

Evaluation Of The Cooperative Education And Internships Program At Prince George’S Community College, Diana Y. Doman Wilkins Jan 2004

Evaluation Of The Cooperative Education And Internships Program At Prince George’S Community College, Diana Y. Doman Wilkins

Abraham S. Fischler College of Education ETD Archive

The Cooperative Education and Internships program is charged with placing students in positions that will allow them to gain experience in a work environment related to their major area of study. Job development specialists receive no type of written feedback from the employer, the faculty advisor, or the student on whether or not the placement was successful. The problem is that Cooperative Education and Internships has not demonstrated its effectiveness; therefore, there is reluctance from students, faculty advisors, and job development specialists to continue participating and/or promoting the program.

The purpose of this project was to evaluate the effectiveness of …

Increasing The Active Participation Of Caregivers In The Implementation Of The Individualized Family Service Plan In An Early Intervention Program, Jennifer Cave Jan 2004

Increasing The Active Participation Of Caregivers In The Implementation Of The Individualized Family Service Plan In An Early Intervention Program, Jennifer Cave

Abraham S. Fischler College of Education ETD Archive

This applied dissertation was designed to improve the implementation of early intervention therapy services in natural environments. Active caregiver participation during therapy is vital to the success of early intervention. However, the caregivers of infants and toddlers with developmental delays who were receiving early intervention therapy from an agency that served three counties in the southeastern United States were not actively participating in the implementation of the Individualized Family Service Plans (IFSPs).

In order to increase the level of active caregiver participation during therapy sessions, six solution strategies were implemented. The researcher provided information to the caregivers by creating a …

Integrating Technology In The Academic Classrooms Of An Independent School, Kim R. Crockard Jan 2004

Integrating Technology In The Academic Classrooms Of An Independent School, Kim R. Crockard

Abraham S. Fischler College of Education ETD Archive

This applied dissertation was designed to increase the integration of technology in the academic classrooms of an independent college preparatory school. Technology had been introduced to the faculty in a random manner. Some teachers embraced technology, some were accepting but unknowing, and some were vocally resistant. There was no plan to present an administrative vision to the faculty in order to support a framework for technology integration, to provide a professional development program, to establish standards for teacher competency, or to determine an assessment process. These are necessary components of a successful technology integration effort as defined by the research. …

Affect Of Increasing Team-Planning Time And Improving Team Classroom Proximity On Student Achievement, John Deuber John Deuber Jan 2004

Affect Of Increasing Team-Planning Time And Improving Team Classroom Proximity On Student Achievement, John Deuber John Deuber

Abraham S. Fischler College of Education ETD Archive

This applied dissertation was designed to increase the amount of team-planning time and classroom proximity provided to teaching teams at 1 middle school. The amount of time provided within the school day to each team for team planning was inadequate to meet the needs of effective teams. Additionally, teachers had been assigned to classrooms with little concern for team member proximity.

Student achievement as measured by the Comprehensive Test of Basic Skills 5, a nationally recognized standardized test, had shown a slight downward trend for 3 preceding years. The interventions were meant to address and correct this problem. Teachers completed …

Moving Toward A Strength Perspective: A Case Study Of Counselor Change, Candis Carr Jan 2004

Moving Toward A Strength Perspective: A Case Study Of Counselor Change, Candis Carr

Abraham S. Fischler College of Education ETD Archive

According to their mission statement, employees of the Family and Youth Counseling Agency, Inc., (FYCA) operated on the assumption that all individuals possessed the ability to solve their own challenges and live full and healthy lives when support was available. In practice, however, agency counseling reflected a deficit-based, hierarchical framework, wherein counselors expanded on clients’ deficits and failings, defined the goals of counseling, and regarded counselors as more knowing than clients about how best to change. By discrediting the client’s voice, counselors failed to put into action the agency’s guiding principle.

To develop a strength-based practice, counselors met on a …

Reducing Discipline Referrals At State Bridge Crossing Elementary School In Alpharetta, Georgia, Renay R. Dixon Jan 2004

Reducing Discipline Referrals At State Bridge Crossing Elementary School In Alpharetta, Georgia, Renay R. Dixon

Abraham S. Fischler College of Education ETD Archive

The major purpose of this study was to reduce the number of student discipline referrals in a suburban elementary school with a student population of approximately 830 in 2003. An analysis of the annual School Administrative Student Information System Discipline Report indicated that over the past two years (2000-2002), discipline referrals had increased by 44%.

The design most conducive for this applied research was a descriptive design. Pre- and postdata were compared to determine if there was a decrease in student discipline referrals. Data were gathered from students, parents of the 133 representative fifth-grade students, and teachers regarding the school …

A National Survey Of Civil Rights Training Programs For Development, Implementation, And Evaluation Of Civil Rights Training For Wic Employees, Beverley Demetrius

Abraham S. Fischler College of Education ETD Archive

The problem was that the state of Georgia Women, Infants, and Children (WIC) Program was noncompliant with antidiscrimination laws and therefore, risked the loss of federal funds to operate the WIC Program. The purpose of this applied dissertation was to conduct a national survey of civil rights training programs with plans for development, implementation, and evaluation of training for Georgia WIC Program employees.

A combination of the development and evaluation methodologies was used to complete this study. The development methodology was used to develop the civil rights training program for Georgia WIC employees. The evaluation methodology that included process and …

Development Of A Training Program For Postsecondary Allied Health Career School Practitioners, Evelyn Elliott Presley

Abraham S. Fischler College of Education ETD Archive

This applied dissertation was developed to provide a training program for practitioners in postsecondary, for-profit allied health schools. The project was created to provide solutions to challenges that schools face when they hire individuals with technical work experience to teach adults. Too often, new hires are put in class without experience in teaching, an understanding of adult learners, and knowledge of the policies and procedures of the school.

The research questions that guided the developmental process were as follows:

1. What areas of concern currently exist in post-secondary, for-profit schools regarding the need for a training program for practitioners?

2. …
