Individual And Landscape-Level Effects Of Selective Herbicides, Mowing, And Prescribed Fire On Habitat Quality For Northern Bobwhite (Colinus Virginianus), Charles Lynn Kitts Jan 2004

Individual And Landscape-Level Effects Of Selective Herbicides, Mowing, And Prescribed Fire On Habitat Quality For Northern Bobwhite (Colinus Virginianus), Charles Lynn Kitts

LSU Master's Theses

Northern bobwhite (Colinus virginianus) populations have been declining throughout their range during the past 30 years primarily because of a result of loss of early successional habitat. Specifically, intensive silviculture practices and reduction in the use of prescribed fire has led to this loss. I studied effects of management practices (selective herbicides, mowing, and prescribed fire) on male and covey distribution, and brood-rearing habitats on Jackson-Bienville Wildlife Management Area (JBWMA). Specifically, I used calling surveys to assess landscape characteristics associated bobwhite distribution. I also measured vegetation and arthropod response, using imprinted bobwhite chicks, pitfalls, and sweep nets, to different habitat …

Chemical Production Complex Optimization, Pollution Reduction And Sustainable Development, Aimin Xu Jan 2004

Chemical Production Complex Optimization, Pollution Reduction And Sustainable Development, Aimin Xu

LSU Doctoral Dissertations

The objective of this research is to propose, develop and demonstrate chemical production complex optimization to determine the optimal configuration of chemical plants in a superstructure of possible plants. The Chemical Complex Analysis System is a new methodology that has been developed to determine the best configuration of plants in a chemical production complex based on the AIChE Total Cost Assessment (TCA) for economic, energy, environmental and sustainable costs. All new, energy-efficient, and environmentally acceptable plants using greenhouse gases that can produce potentially commercial products designed with HYSYS were integrated into the chemical complex using the System. The optimum configuration …

Integration Of Management Tactics For The Rice Water Weevil Lissorhoptrus Oryzophilus Kuschel With Particular Emphasis On Use Of Plant Resistance (Tolerance), Li Zou Jan 2004

Integration Of Management Tactics For The Rice Water Weevil Lissorhoptrus Oryzophilus Kuschel With Particular Emphasis On Use Of Plant Resistance (Tolerance), Li Zou

LSU Doctoral Dissertations

Studies were conducted to test the hypothesis, significant benefits can be achieved for the management of rice water weevil, Lissorhoptrus oryzophilus Kuschel, by the use of rice varieties with low levels of host plant resistance coupled with the judicious use of cultural practices and insecticides. Tolerant traits of a current commercial variety of rice, "Bengal", was manifested consistently over multiple years. Study on rice growth as effected by weevil injury showed that pruning of root systems by larvae of weevil resulted in a decrease in tiller number and shoot biomass of rice plants in the vegetative stage of growth. Yield …

Musical Play Across Ethnic Boundaries In Western Jamaica, Ronald Eric Dickerson Jan 2004

Musical Play Across Ethnic Boundaries In Western Jamaica, Ronald Eric Dickerson

LSU Master's Theses

An ethnography of music, ritual, and festival in western Jamaica, this thesis reports on fieldwork performed in St. Elizabeth and St. James Parishes between June 2002 and January 2003. Featured field sites include rural dancehall events, Kumina performances, Accompong Town's Maroon Heritage Festival, and a Rastafarian music and nutrition festival called "The Supper of Rastafari." Building an account of these and other sites of cultural performance, this study focuses on social connections between groups of participants, traced through poetic, historical, and personal relationships among performers, especially across boundaries of ethnic, stylistic, or religious difference within Jamaica's national cultural identity.

Insect Pest Management Approaches Among Currently Recommended Sugarcane Varieties In Louisiana, Frederick R. Posey Jan 2004

Insect Pest Management Approaches Among Currently Recommended Sugarcane Varieties In Louisiana, Frederick R. Posey

LSU Master's Theses

The sugarcane borer, Diatraea saccharalis (F.), (Lepidoptera: Crambidae), is responsible for more than 90% of the total insect damage to sugarcane in Louisiana. The decision to apply insecticides is complex and influenced by numerous variables. Included among these variables are insect infestation levels, varieties, weather conditions, production input levels, and environmental concerns. Predicting damage that may result from infestations occurring at a particular time of the crop production season is also important. The objective of this research was to evaluate the impact of these variables on sugarcane borer populations and subsequent yield loss. Results from a two-year survey indicated a …

The Medici, Verrocchio, And San Lorenzo, Evelyn Diane Pell Jan 2004

The Medici, Verrocchio, And San Lorenzo, Evelyn Diane Pell

LSU Master's Theses

This thesis addresses the subject of two Medici family tombs designed by Andrea del Verrocchio for the church of San Lorenzo in Florence. One is the tomb of Cosimo de’ Medici and the other a dual tomb for his sons, Piero and Giovanni de’ Medici. In dealing with this subject, the paper discusses the Medici’s rise to power in Florence, Verrocchio’s career leading up to the tombs, and the important relationship between the Medici and San Lorenzo. The family donated lavishly to the rebuilding of the church and received in return spiritual aid and extraordinary burial sites. Upon first looking …

The Politics Of Judicial Decision-Making In Educational Policy Reform Litigation, William S. Koski Jan 2004

The Politics Of Judicial Decision-Making In Educational Policy Reform Litigation, William S. Koski

UC Law Journal

Over the past thirty years, many state supreme courts have inserted themselves into state educational policy-making by striking down their states' school funding schemes pursuant to charges that the state had not provided a constitutionally equitable or adequate distribution of educational resources to schoolchildren. To date, there has been much scholarly discussion of the legal bases for these state supreme court decisions and there exists a growing body of literature studying the effects of such judicial intervention. Despite the vast legal literature and growing judicial impact research regarding educational policy reform litigation, little is known about why state supreme courts …

Development Of Dynamic Travel Demand Models For Hurricane Evacuation, Haoqiang Fu Jan 2004

Development Of Dynamic Travel Demand Models For Hurricane Evacuation, Haoqiang Fu

LSU Doctoral Dissertations

Little attention has been given to estimating dynamic travel demand in transportation planning in the past. However, when factors influencing travel are changing significantly over time – such as with an approaching hurricane - dynamic demand and the resulting variation in traffic flow on the network become important. In this study, dynamic travel demand models for hurricane evacuation were developed with two methodologies: survival analysis and sequential choice model. Using survival analysis, the time before evacuation from a pending hurricane is modeled with those that do not evacuate considered as censored observations. A Cox proportional hazards regression model with time-dependent …

Constraining Modern Mercenarism, James R. Coleman Jan 2004

Constraining Modern Mercenarism, James R. Coleman

UC Law Journal

Mercenarism's metamorphosis during the final decades of the twentieth century from the profession of soldiers of fortune into the work of publicly traded private military assistance corporations has enabled modern mercenaries to evade a burgeoning international legal movement toward their eradication. Despite persistent efforts to recognize private military corporations as mercenary companies, the evolution of legal definitions of mercenarism has failed to keep pace with the strong international consensus against mercenaries, thereby causing the letter of international law to diverge from its spirit. Hiding mercenarism behind a corporate veil flouts the spirit of international law and serves to eviscerate the …

Facilitating Auditing's New Early Warning System: Control Disclosure, Auditor Liability, And Safe Harbors, Lawrence A. Cunningham Jan 2004

Facilitating Auditing's New Early Warning System: Control Disclosure, Auditor Liability, And Safe Harbors, Lawrence A. Cunningham

UC Law Journal

This Article considers the interplay between new auditing standards governing audits of internal control over financial reporting and pre-existing legal standards governing auditor liability for audit failure. The interplay produces skewed liability incentives that, if unadjusted, threaten to impair the objective of this new control-audit regime. The regime's objective is, in part, to provide an early warning to financial statement users when current financial statements are reliable but control weaknesses indicate material risk of a company's future inability to produce reliable financial statements. To be meaningful, auditor disclosure of material weaknesses in control and their potential effects on financial statements …

The Effect Of The Implicit Theory Of Integrity On An Internal Auditor's Asessment Of Management Fraud Risk, Stephanie F. Watson Jan 2004

The Effect Of The Implicit Theory Of Integrity On An Internal Auditor's Asessment Of Management Fraud Risk, Stephanie F. Watson

LSU Doctoral Dissertations

The purpose of this research project is to determine whether the implicit theory of integrity, a theory from the social psychology literature that predicts how social judgments and decisions are made, can explain internal auditors’ decisions. The implicit theory (Dweck and Leggett 1988) states that there are two types of people: (1) entity theorists and (2) incremental theorists. Entity theorists form strong inferences from observed behavior that are used to predict future behavior. Incremental theorists, on the other hand, do not infer characteristics from behavior, and therefore, do not attempt to predict future behavior. In an internal auditing context, the …

Debunking Dilution Doctrine: Toward A Coherent Theory Of The Anti-Free-Rider Principle In American Trademark Law, David J. Franklyn Jan 2004

Debunking Dilution Doctrine: Toward A Coherent Theory Of The Anti-Free-Rider Principle In American Trademark Law, David J. Franklyn

UC Law Journal

This article argues for a fundamental shift in the way famous trademarks are protected under American trademark law. Currently, famous trademarks are protected by dilution law, which purports to prevent a particular kind of harm (i.e., the gradual whittling away of the commercial magnetism of a famous mark). The article argues that this is the wrong focus of famous mark protection, because dilution is an illusory concept; it either does not exist, or it is so difficult to prove, that it is an ineffective and misleading doctrinal tool.

The article contends that American trademark law should move from the harm-based …

Taxing The New Intellectual Property Right, Xuan-Thao N. Nguyen, Jeffrey A. Maine Jan 2004

Taxing The New Intellectual Property Right, Xuan-Thao N. Nguyen, Jeffrey A. Maine

UC Law Journal

Domain names, particularly generic domain names such as men.com, loan.com, beauty.com, cool.com, and car.com, have become the new valuable intellectual property right in recent years, commanding high monetary value in the marketplace. How should the acquisition costs of such domain names be treated under the current tax regime for intellectual property? Addressing this complex question requires an examination of the character of domain names through numerous doctrines ranging from traditional intellectual property right to government contract. In addition, the question dictates a critique of whether domain names are similar to existing rights to which the current intellectual property tax regime …

"Captive Audience" Meetings In Union Organizing Campaigns: Free Speech Or Unfair Advantage?, Elizabeth J. Masson Jan 2004

"Captive Audience" Meetings In Union Organizing Campaigns: Free Speech Or Unfair Advantage?, Elizabeth J. Masson

UC Law Journal

Union density in the private sector in the United States is less than ten percent. Yet studies have shown millions of nonunionized U.S. workers would like to be represented by a union. Employer resistance to unionization is a key factor in whether employees are able to successfully elect a union as their bargaining representative. Although some tactics employers use in antiunion campaigns are unlawful under the National Labor Relations Act, "captive audience meetings" are not. Employers may lawfully hold mandatory captive audience meetings, assembling employees to listen to anti-union speeches, during an organizing campaign. The sole restriction on such meetings …

Defining Democracy: The Supreme Court's Campaign Finance Dilemma, Lori Ringhand Jan 2004

Defining Democracy: The Supreme Court's Campaign Finance Dilemma, Lori Ringhand

UC Law Journal

In deciding campaign finance cases, the Supreme Court often has stressed that its role is limited to protecting First Amendment rights and does not include promoting any particular vision of democracy. This paper questions whether these tasks are in fact divisible in campaign finance cases. It concludes that they are not. The interest asserted by the government in campaign finance cases is, inevitably, the need to improve or protect the government's vision of democracy. Evaluating the relative importance of that interest requires judges to rely on some background theory of democracy: judges simply cannot determine what constitutional weight to give …

Effects Of Spinning-Wing Decoys On Flock Behavior And Hunting Vulnerability Of Local And Migrant Mallards And Other Ducks In Minnesota, Michael L. Szymanski Jan 2004

Effects Of Spinning-Wing Decoys On Flock Behavior And Hunting Vulnerability Of Local And Migrant Mallards And Other Ducks In Minnesota, Michael L. Szymanski

LSU Master's Theses

Waterfowl managers in Minnesota and other states are concerned that increased kill rates associated with the use of spinning-wing decoys (SWDs) may negatively affect local breeding populations of mallards (Anas platyrhynchos). I conducted 219 experimental hunts to evaluate hunting vulnerability of mallards to SWDs during the 2002 duck-hunting season in Minnesota. Following experimental hunts, I asked volunteer hunters to complete post-hunt questionnaires to document their hunting experience, and their use and opinions of SWDs. Finally, I used stable isotope methodology to determine natal origins of HY mallards killed during experimental hunts. I found that mallard flocks (≥1 duck) were 2.91 …

The California Hospital Lien Act And "Balance Billing": Protecting Innocent Patients' Right To Limit A Medical Care Provider's Recovery By Statutory Lien, Darien J. Covelens Jan 2004

The California Hospital Lien Act And "Balance Billing": Protecting Innocent Patients' Right To Limit A Medical Care Provider's Recovery By Statutory Lien, Darien J. Covelens

UC Law Journal

The California Courts of Appeal are currently split over the issue of whether the California Hospital Lien Act allows "balance billing." The First District allows medical care providers to recover the difference between their customary rates and the negotiated discount rates paid by a patient's health insurance carrier. The Second District has held balance billing is prohibited by California law. This Note explains the conflict that exists within the California Appellate Courts and analyzes the effects of applying each District's interpretation of the Hospital Lien Act. The legislative history to the Hospital Lien Act, similar federal statutes, and public policy …

Isolation Of Aflatoxin-Free Lutein From Aflatoxin-Contaminated Corn, Evdokia Menelaou Jan 2004

Isolation Of Aflatoxin-Free Lutein From Aflatoxin-Contaminated Corn, Evdokia Menelaou

LSU Master's Theses

Lutein (3,3’-dihydroxy-alpha-carotene) has been identified by the Age-Related Eye Disease Study (AREDS) of the National Institute of Health (NIH) as a dietary compound with the ability to delay the onset and/or progression of age-related and/or diabetes-related vision loss. Lutein can also be useful in the prevention of other angiogenic diseases such as breast and colon cancer. Although marigold (Tagetes erecta) flowers are an excellent source of lutein, corn (Zea mays) has been identified as a very economical source of lutein because more value-added products, such as lutein, oil, and zein (known for its anti-microbial and anti-hypertensive activities) can be isolated …

Evaluation Of The Usda Shafter Cotton (Gossypium Spp.) Collection For Agronomic And Fiber Traits, Jimmy Xavier Zumba

LSU Master's Theses

Many recent additions to the US Cotton Germplasm collection are uncharacterized for common germplasm descriptors. Our objective was to evaluate a subset of this germplasm for their potential to contribute to future plant improvement efforts. One hundred fifty four cotton germplasm lines from the former USDA cotton breeding program at Shafter, California were evaluated in the field (LSU AgCenter Northeast Research Station, Saint Joseph, LA) in 2003 along with three modern commercial varieties (Delta and Pine Land Deltapearl, Fibermax 958, and Phytogen 355). Due to limited seed availability, an unreplicated modified augmented statistical design-2 was used, with single row plots …

Soils Of Regeneration: Exploring Conceptualizations Of The Natural World As A Context For An Ecologically-Sensitive Curriculum, Emily A. Demoor Jan 2004

Soils Of Regeneration: Exploring Conceptualizations Of The Natural World As A Context For An Ecologically-Sensitive Curriculum, Emily A. Demoor

LSU Doctoral Dissertations

David Orr (1994) asserts that the ecological crisis is a crisis of education. This study explores the relationship between the ecological crisis and education by examining the role that language plays in shaping perceptions of the natural world. Toward this end it analyzes narratives of science, literature and other disciplines that conceptualize the natural world as object and as subject. It evaluates how particular metaphors used in reference to the natural world enhance or impede ecological understanding and the cultivation of responsibility and stewardship and considers ways in which these conceptualizations might be used as a basis for new curriculum …
