Susie Van Kirk Papers

Augustus William Ericson was born on April 26, 1848 in Orebro, Sweden, the third child of six born to Eric and Elsa Ericson. At age eleven, he was apprenticed to a printer and followed that trade until 1866 when he came to the United States. After a first stop in New York, he traveled to Chicago, where, unable to speak English, he found employment as a laborer. In 1868 he left Chicago for Michigan and worked in a lumber camp before heading west by rail to San Francisco. In her 22 page report, Susie Van Kirks details the life of …

Protecting Us From Pictures : Gender And Support For Legal Restrictions On Pornography, Elizabeth Lynne Chivers Jan 2004

Protecting Us From Pictures : Gender And Support For Legal Restrictions On Pornography, Elizabeth Lynne Chivers

Dissertations and Theses @ UNI

Research and debate concerning pornography has been controversial, primarily focusing on the perceived harmful effects. The current study addresses support for legal restrictions and the effect of gender on this support. Based on the internalization of gender roles, perspectives, and identities through socialization, gender is constructed differently for men and women. Because this socialization is constructed around an oppositional male-female dichotomy, men and women experience the world differently. While there have been previous research addressing gender differences, the gendered nature of attitudes merits further study.

The current study is based on data collected for 451 undergraduate students at the University …

Using Interactive Multimedia (Imm) To Help Year Four And Five Students Identified As Experiencing Reading Difficulties: A Formative Approach, Grace Oakley Jan 2004

Using Interactive Multimedia (Imm) To Help Year Four And Five Students Identified As Experiencing Reading Difficulties: A Formative Approach, Grace Oakley

Theses: Doctorates and Masters

This study involved four formative experiments, each of which investigated ways in which IMM (Interactive Multimedia) could be used to help children who experienced reading difficulties. In each of the four contexts, classroom teachers identified a number of students with reading difficulties, selected pedagogical goals for them and worked with the researcher to plan IMM-based activities that targeted the selected goals. The implementations were evaluated formatively and modifications were made accordingly, with the intention of 'fine-tuning' them to facilitate achievement of the pedagogical goals. Facilitative and inhibitive factors were identified during and after each formative experiment, as were unplanned outcomes. …

Natural Regeneration Of Native Vegetation On Abandoned Agricultural Land In The Fitzgerald Biosphere, Nerilee Boshammer Jan 2004

Natural Regeneration Of Native Vegetation On Abandoned Agricultural Land In The Fitzgerald Biosphere, Nerilee Boshammer

Theses : Honours

Much of the natural landscape in the south-west of Western Australia has been severely modified as a result of past and current agricultural activity. One of the most conspicuous changes has been the large scale clearing of native vegetation, The evidence of the negative impacts of this vegetation removal on the natural environment is now extensive, particularly in the south-west region of the State. In order to prevent further degradation of the landscape of the south-west and subsequent loss of endemic species, strategic revegetation within the agricultural landscape is required. Native vegetation corridors can be established, linking areas of remnant …

Child Custody Disputes: Bridging The Gap Between Psychologists And Family Court, Kate Pratsides Jan 2004

Child Custody Disputes: Bridging The Gap Between Psychologists And Family Court, Kate Pratsides

Theses : Honours

The number of divorce cases that come before judges and registrars within the Family Court system is steadily increasing, and so is the use of psychologists as expert witnesses. However, little is known about what the judges and registrars think of the psychologist's use of psychometric test results when writing their forensic report, this study attempts to answer that. This thesis is presented in two sections. The first is a literature review of guidelines that are available to psychologists when writing a forensic report. These guidelines include (1) broad guidelines provided by professional associations, such as the American Psychological Association; …

Seeking Consistency In Relating Capital To Current Expenditures, Henry Ordower Jan 2004

Seeking Consistency In Relating Capital To Current Expenditures, Henry Ordower

All Faculty Scholarship

Identifies relational duration as the key factor that distinguishes capital from current expenditures for tax purposes and argues that inventory cost is fundamentally identical to capitalization. Barriers to deductibility such as illegal payment prohibitions should also be barriers to capitalization or inventory absorption.

An Analysis Of Pascal Lamy's Proposal On Collective Preferences, Steve Charnovitz Jan 2004

An Analysis Of Pascal Lamy's Proposal On Collective Preferences, Steve Charnovitz

GW Law Faculty Publications & Other Works

In September 2004, then-European Commissioner for Trade Pascal Lamy released his study on the political challenge of 'collective preferences' for the world trading system. Lamy defines 'collective preferences' as 'the end result of choices made by human communities that apply to the community as a whole'. The adoption of collective preferences by governments can complicate international trade when a good or service from an exporting country is not acceptable in an importing country. Collective preferences cause a problem for the WTO if the resulting measure violates WTO rules and yet the measure is too popular in the regulating country for …

Demonstrations, Security Zones, And First Amendment Protection Of Special Places, Mary M. Cheh Jan 2004

Demonstrations, Security Zones, And First Amendment Protection Of Special Places, Mary M. Cheh

GW Law Faculty Publications & Other Works

There has been a marked increase in government suppression of public protests and demonstrations. Certain areas, such as public space near the White House, have been effectively placed off limits to demonstrators. Protestors are put out of sight, down the road, or otherwise away from the object of their protest. The Secret Service has created security zones insulating the President and his entourage from the sights and sounds of opposition marches and demonstrations. And police are using sophisticated tactics, such as surveillance, infiltration, disinformation, and pre-emptive arrests to undermine and frustrate the ability of protestors to conduct their marches and …

Brown And The Contemporary Brazilian Struggle Against Racial Inequality: Some Preliminary Comparative Thoughts, Robert J. Cottrol Jan 2004

Brown And The Contemporary Brazilian Struggle Against Racial Inequality: Some Preliminary Comparative Thoughts, Robert J. Cottrol

GW Law Faculty Publications & Other Works

Brown v. Board of Education, the Supreme Court's celebrated 1954 decision that ended segregation in the United States, did not end a caste based inequality among the races. One of the nations currently struggling with such a legacy of discrimination is Brazil. Brazil's path to overcome structural inequality has some interesting parallels and differences with the American experience.

Writings by Brazilian legal scholars such as Joaquim B. Barbosa Gomes and Hedio Silva Jr. had bolstered the thought that the American civil rights experience has lessons for Brazil. This experience, which was greatly shaped by Brown, contributed to the growth of …

Justice Advanced: Comments On William Nelson's Brown V. Board Of Education And The Jurisprudence Of Legal Realism, Robert J. Cottrol

GW Law Faculty Publications & Other Works

The Supreme Court’s landmark school desegregation decision in Brown v. Board of Educationbrings us face-to-face with how the world of race, law, caste, and the Supreme Court has changed since that time. Brown has contributed to a view that the courts are perhaps best equipped to handle the difficult issues. Whether that view will prove to be good law or good policy in the long run remains to be seen. Nonetheless, it does reflect the jurisprudential journey that took the Court from its previously indifferent position on minority rights towards that a protector of such rights. The evolution in …

The Appeal And Limits Of Internal Controls To Fight Fraud, Terrorism, Other Ills, Lawrence A. Cunningham Jan 2004

The Appeal And Limits Of Internal Controls To Fight Fraud, Terrorism, Other Ills, Lawrence A. Cunningham

GW Law Faculty Publications & Other Works

Congress responded in similar ways to 2001's major national crises: bolstering internal controls in corporate America under the Sarbanes-Oxley Act in response to Enron's debacle and imposing internal controls on its financial services industry under the USA PATRIOT Act in response to 9/11's terrorism. These reflexive legislative responses to national crisis fit a pattern of proliferating controls as a first-order policy option dating to the mid-1970s. Documenting this proliferation and untangling the definition of internal controls, this Article attributes the appeal of internal controls as a policy option to systemic forces including the movements for deregulation and cooperative compliance, resistance …

Choosing Gatekeepers: The Financial Statement Insurance Alternative To Auditor Liability, Lawrence A. Cunningham Jan 2004

Choosing Gatekeepers: The Financial Statement Insurance Alternative To Auditor Liability, Lawrence A. Cunningham

GW Law Faculty Publications & Other Works

Positioned in a lively current debate concerning how to design auditor incentives to optimize financial statement auditing, this Article presents the more ambitious financial statement insurance alternative. This breaks from the existing securities regulation framework to draw directly on insurance markets and law. Based on upon an evaluation of major structural and policy-related features of the concept, the assessment prescribes a framework to permit companies, on an experimental-basis and with investor approval, to use financial statement insurance as an optional alternative to the existing model of financial statement auditing backed by auditor liability.

The financial statement insurance concept, pioneered by …

Facilitating Auditing's New Early Warning System: Control Disclosure, Auditor Liability And Safe Harbors, Lawrence A. Cunningham Jan 2004

Facilitating Auditing's New Early Warning System: Control Disclosure, Auditor Liability And Safe Harbors, Lawrence A. Cunningham

GW Law Faculty Publications & Other Works

This Article considers the interplay between new auditing standards governing audits of internal control over financial reporting and pre-existing legal standards governing auditor liability for audit failure. The interplay produces skewed liability incentives that, if unadjusted, threaten to impair the objective of this new control-audit regime. The regime's objective is, in part, to provide an early warning to financial statement users when current financial statements are reliable but control weaknesses indicate material risk of a company's future inability to produce reliable financial statements. To be meaningful, auditor disclosure of material weaknesses and potential effects is necessary.

While liability rules under …

A New Product For The State Corporation Law Market: Audit Committee Certifications, Lawrence A. Cunningham Jan 2004

A New Product For The State Corporation Law Market: Audit Committee Certifications, Lawrence A. Cunningham

GW Law Faculty Publications & Other Works

Audit committees of corporate boards of directors are central to corporate governance for many corporations. Their effectiveness in supervising financial managers and overseeing the financial reporting process is important to promote reliable financial statements. This centrality suggests that it is likewise important for investors and others to have a basis for justifiable confidence in audit committee effectiveness. At present, there is no such mechanism. This Article explains why, considers a way states can provide it and assesses as low the likelihood that states will do so. In the swirling corporate governance reforms led by SOX, the SEC, SROs and PCAOB, …

The Basics Matter: At The Periphery Of Intellectual Property, F. Scott Kieff, Troy A. Paredes Jan 2004

The Basics Matter: At The Periphery Of Intellectual Property, F. Scott Kieff, Troy A. Paredes

GW Law Faculty Publications & Other Works

Controversies often arise at the interfaces where intellectual property ("IP") law meets other topics in law and economics, such as property law, contract law, and antitrust law. Participants in the debates over how to mediate these interfaces often view each interface as a special case deserving unique treatment under the law. The doctrines of copyright and patent misuse are cases in point: they graft select antitrust principles onto copyright or patent law, even though there is an entirely distinct body of law - antitrust law - designed to deal with the putative concerns about competition that allegedly give rise to …

The Case Against Copyright: A Comparative Institutional Analysis Of Intellectual Property Regimes, F. Scott Kieff Jan 2004

The Case Against Copyright: A Comparative Institutional Analysis Of Intellectual Property Regimes, F. Scott Kieff

GW Law Faculty Publications & Other Works

Contemporary debates over intellectual property ("IP") generally evidence positions that appear to line up at opposite ends of the same axis, with one side arguing for more rights for IP owners under each major regime - patent, trademark, and copyright - and the other side arguing for fewer. Approaching from what some may see as a "more" IP view, this paper offers the counterintuitive suggestion to consider abolishing one of these IP regimes - copyright, at least with respect to the entertainment industry, which represents one of that regime's most commercially significant users. This realization is in fact consistent with …

The Case For Registering Patents And The Law And Economics Of Present Patent-Obtaining Rules, F. Scott Kieff Jan 2004

The Case For Registering Patents And The Law And Economics Of Present Patent-Obtaining Rules, F. Scott Kieff

GW Law Faculty Publications & Other Works

(Note: this is a substantially revised version of Harvard Olin Working Paper No. 415 of May 2003, SSRN Abstract ID No. 392202 (http://ssrn.com/abstract=392202) and includes more detailed discussion of issues including the DOE, willfulness and the Knorr decision, and the FTC Report on patents and antitrust.)

Critics of the patent system suggest the rules for determining patentability should be stricter, subjecting patents to more scrutiny during Patent Office examination. This Article offers a counterintuitive model system under which patent applications are registered, not examined, to elucidate a new normative view that sees present positive law rules for obtaining patents as …

Contrived Conflicts: The Supreme Court Versus The Basics Of Intellectual Property Law, F. Scott Kieff Jan 2004

Contrived Conflicts: The Supreme Court Versus The Basics Of Intellectual Property Law, F. Scott Kieff

GW Law Faculty Publications & Other Works

Asked by conference organizers to consider the impact of the Supreme Court on intellectual property this millennium, this essay offers the view that the Supreme Court's intellectual property decisions by its present members generally are premised upon what may be viewed as contrived conflicts among bodies of law. Proceeding from this faulty foundation, the Court's efforts to resolve those conflicts subsequently have generated bodies of judge-made law that frustrate in important ways the basic statutory framework of intellectual property law. Examples of cases employing this problematic approach include Bonito Boats, Dastar, Warner-Jenkinson, Festo, TrafFix, and Holmes. Avoiding the contrivances not …

Civic Renewal And The Regulation Of Non-Profits, Miriam Galston Jan 2004

Civic Renewal And The Regulation Of Non-Profits, Miriam Galston

GW Law Faculty Publications & Other Works

Civic Renewal and the Regulation of Non-profits analyzes four understandings of civic renewal, elaborated in the wake of Robert Putnam's book Bowling Alone, in light of the federal regulatory scheme imposed upon voluntary associations that qualify as "exempt organizations" under the Internal Revenue Code. These perspectives emphasize the primacy of one or more of the following as indispensable elements of civic health: (1) cooperation and effective collective action, (2) self-governance (3) equality and representative institutions, and (4) the moral character of the community or the public spiritedness of citizens. The study analyzes how the different assumptions and purposes of these …

Evolution Of Golpazari-Huyuk Karst System (Bilecik-Turkey): Indications Of Morpho-Tectonic Controls, Mehmet Ekmekci, Lütfü Nazik Jan 2004

Evolution Of Golpazari-Huyuk Karst System (Bilecik-Turkey): Indications Of Morpho-Tectonic Controls, Mehmet Ekmekci, Lütfü Nazik

International Journal of Speleology

The Golpazari-Huyuk karst system is located in the Central Sakarya Basin whose geomorphologic evolution is mainly controlled by the Post-Miocene epirogenic continental rise. Drastic change in the drainage pattern and dissection of the carbonate platform were the major consequences of this tectonic movement. Rapid incision of the Sakarya river changed the position of the erosion base which consequently distorted the direction of surface and subsurface flow. The Golpazari and Huyuk plains are two topographically distinct, flat bottomed geomorphic features separated by a carbonate rock relief. The difference in elevation between these 10 km distant plains is 350 m. Morphological, geological …

Paleocollapse Structures As Geological Record For Reconstruction Of Past Karst Processes During The Upper Miocene Of Mallorca Island, P. A. Robledo Ardila, J. J. Durán, L. Pomar Jan 2004

Paleocollapse Structures As Geological Record For Reconstruction Of Past Karst Processes During The Upper Miocene Of Mallorca Island, P. A. Robledo Ardila, J. J. Durán, L. Pomar

International Journal of Speleology

Paleocollapse structures and collapse breccias are one of the major features for paleokarst analysis and paleoclimate record. These are affecting the Llucmajor and Santanyí carbonate platforms. These platforms, of southern and eastern Mallorca respectively, are a good example of progradation reef platform in the western Mediterranean. The Santanyí platform is constituted of two sedimentary units, both affected by paleocollapse structures: (1) The Reef Complex attributed to the upper Tortonian-lower Messinian; (2) Santanyí Limestone attributed to the Messinian. There are abundant paleocollapse outcropping in the Reef Complex and Santanyí Limestone units. These structures have been produced by roof collapse of caverns …
