Reconceptualizing Mathematics Education, Melinda Ann Smith Jan 2004

Reconceptualizing Mathematics Education, Melinda Ann Smith

College of Graduate Studies: Theses & Dissertations (1964–2006)

This dissertation is to explore theoretically mathematics education in the United States and the need for reconcepualizing mathematics education. Mathematics education needs reconceptualizing because students know very little mathematics by the time they graduate from high school. Mathematics has become a subject to be feared and dreaded for centuries. High school teachers blame middle school teachers, middle school teachers blame elementary teachers, and elementary teachers blame parents for their students' lack of preparedness in mathematics. Elementary teachers express frustration in teaching mathematics because of their own lack of content knowledge and lack of preparation for the mathematics component of their …

The Special Purpose Local Option Sales Tax Referendum And The Financing Of Public School Capital Projects In Georgia, Kathy Cox Peavy Jan 2004

The Special Purpose Local Option Sales Tax Referendum And The Financing Of Public School Capital Projects In Georgia, Kathy Cox Peavy

College of Graduate Studies: Theses & Dissertations (1964–2006)

Although taxes have risen across the nation, funding for public school capital projects still remains a critical need in education. The public outcry for no new taxes has given arise to various types of creative funding for capital projects. The use of a 1-cent sales tax for educational purposes is one type of new funding for capital projects. This study was a mixed-method, descriptive design study gathering quantitative and qualitative data on the Special Purpose Local Option Sales Tax referendum in Georgia. Fifty-seven school districts in Georgia, with an approved SPLSOT referendum on March 18. 1997, along with four school …

Creatress: A Woman's Hand, Susan Isherwood Gibbs Jan 2004

Creatress: A Woman's Hand, Susan Isherwood Gibbs

College of Graduate Studies: Theses & Dissertations (1964–2006)

Using stylized and abstracted sculptural interpretations of She—Great Mother, Mother Nature, Earth Goddess, Creatress, Gaia, female sexuality, and the feminine aspects of nature; a wide range of differing chemicals and temperatures for the development of various clay bodies; and a vivid color palette to reflect ideas, feelings, and moods, I present a story of woman as metaphor for Earth and nature, an immense organic, ecological, and conscious whole. Incorporating found objects (natural and manmade) and fibers (organic and synthetic) with my clay imagery, I offer an awareness of the roles ofwomen from around the world in the spiritual and psychological …

Ergodic Capacity Of Doubly Selective Rayleigh Fading Mimo Channels, Chengshan Xiao, Y. Rosa Zheng Jan 2004

Ergodic Capacity Of Doubly Selective Rayleigh Fading Mimo Channels, Chengshan Xiao, Y. Rosa Zheng

Electrical and Computer Engineering Faculty Research & Creative Works

The ergodic capacity is investigated for doubly selective (frequency selective and time varying) MIMO Rayleigh fading channels. A closed form formula is derived that quantifies the effect of the ISI fading on the ergodic capacity into an ISI degradation factor. It is discovered that, in general frequency selective MIMO channels, the inter-tap correlations of the ISI fading will reduce the ergodic capacity comparing to the frequency flat fading channel. Only in the special case when the ISI fading does not have inter-tap correlations will the ergodic capacity be the same as that of the frequency flat channel. This new formula …

Curriculum, Foundations & Reading: Faculty Publications

The Greatest Generation, Band of Brothers, We Were Soldiers, Nick at Night, and the confederate battle flag. We are looking backward, because looking forward is too problematic. We are living within a global conservative restoration, which has gained intensity since 9/11 and gained further solidification since the most recent elections. Ira Shor elaborated the concept of the conservative restoration in his text, Culture Wars: School and Society in the Conservative Restoration 1969-1984 (1986).

Getting Spending: How To Replace Clear Statement Rules With Clear Thinking About Conditional Grants Of Federal Funds, Brian Galle Jan 2004

Getting Spending: How To Replace Clear Statement Rules With Clear Thinking About Conditional Grants Of Federal Funds, Brian Galle

Georgetown Law Faculty Publications and Other Works

How much federalism is too much? The answer, of course, depends on whom you ask. It is no surprise, then, that in both judicial and academic debates about the proper balance between national and local power, the fiercest arguments have been fought not over "how much?" (perhaps an impossible question in any event) but "who?" Thus, for each key aspect of national power-for example, the scope of the Commerce and Treaty powers, the Tenth and Fourteenth Amendments, and Congress's ability to subject states to suits for damages by private individuals -- there is an accompanying literature considering who best to …

Quality In Airline Safety: Quality Methods And Tools Are Needed To Manage New Directions, Alan Stolzer, Carl Halford Jan 2004

Quality In Airline Safety: Quality Methods And Tools Are Needed To Manage New Directions, Alan Stolzer, Carl Halford

Journal of Aviation/Aerospace Education & Research

Approximately 650 million people fly on U.S. certificated air carriers annually (Department of Transportation: Federal Aviation Administration, 2003). Although statistically air transportation is one of the safest modes of travel, the few airline accidents that occur never fail to garner substantial media attention and concern of the public. The responsibility to seek ways to improve air transportation safety falls on all involved in aviation - practitioners and educators alike. The purpose of this article is to provide, through a review of literature, a brief examination of the past, present, and future state of efforts to address airline safety, and to …

Collision Avoidance In Traffic Patterns - Time, Flying Tasks And Visual Scanning, Thomas Kirton Jan 2004

Collision Avoidance In Traffic Patterns - Time, Flying Tasks And Visual Scanning, Thomas Kirton

Journal of Aviation/Aerospace Education & Research

Conducting traffic pattern and landing training at non-towered airports presents an instructor and student a challenging environment. The training must be effective in all aspects of the maneuvering and landing and at the same time safety is an overriding concern. Some flight training organizations conduct training in "traffic saturated" environments. The potential for mid-air collisions at these airports is a major concern.

Publishing Aviation Research: A Literature Review Of Scholarly Journals, Robert W. Kaps, Ed Phillips Jan 2004

Publishing Aviation Research: A Literature Review Of Scholarly Journals, Robert W. Kaps, Ed Phillips

Journal of Aviation/Aerospace Education & Research

The importance of the aviation industry's socio-economic impact, domestically and globally, cannot be denied. In light of this and, as aviation continues to evolve as an academic field of study, post-secondary institutions with aviation specific curriculum have grown,in number and prominence. As a direct consequence of academic growth, the necessity to publish follows as a concomitant requirement. Through the diligence of those researchers actively conducting aviation related research a common theoretical and conceptual base for aviation specific research has been established. The void that once existed for aviation research has been filled, predominantly by three aviation specific journals and a …

In-Situ Apparent Conductivity Measurements And Microbial Population Distribution At A Hydrocarbon-Contaminated Site, Estella A. Atekwana, D. Dale Werkema, Joseph W. Duris, Silvia Rossbach, Eliot A. Atekwana, William A. Sauck, Daniel P. Cassidy, Jay Means, Franklyn D. Legall

Geosciences and Geological and Petroleum Engineering Faculty Research & Creative Works

We investigated the bulk electrical conductivity and microbial population distribution in sediments at a site contaminated with light nonaqueous-phase liquid (LNAPL). The bulk conductivity was measured using in-situ vertical resistivity probes; the most probable number method was used to characterize the spatial distribution of aerobic heterotrophic and oil-degrading microbial populations. The purpose of this study was to assess if high conductivity observed at aged LNAPL-impacted sites may be related to microbial degradation of LNAPL. The results show higher bulk conductivity coincident with LNAPL-impacted zones, in contrast to geoelectrical models that predict lower conductivity in such zones. The highest bulk conductivity …

Clients As Teachers, Jane H. Aiken

I am deeply honored to have been selected to hold the William Van Cleve Chair. After the announcement several months ago, I have had the pleasure of having people tell me just how wonderful a man Bill Van Cleve was and how lucky I am to have this chair in honor of him. The picture that I have gotten of this man is truly that of the lawyer statesman. He took his profession very seriously. He approached his work with dedication and passion but, more significantly, he loved his profession in the broadest sense. He understood that the practice of …

Gaming Delaware, William W. Bratton Jan 2004

Gaming Delaware, William W. Bratton

Georgetown Law Faculty Publications and Other Works

Back in 2000, at the World Trade Center in Portland, Oregon, Time Belden and other Enron electricity traders carefully studied the regulations governing California's new electricity market. Belden thought that the complex rules were "prone to gaming." And game them he did. Under one strategy, Enron filed imaginary transmission schedules, creating nonexistent congestion, so as to draw on the rules' provision of payment to alleviate congestion. They called it "Death Star." Then there was "Ricochet," or megawatt laundering, under which Enron circumvented price caps by exporting power out of California, only to bring the power back later, when the State, …

Constitutional Hardball, Mark V. Tushnet Jan 2004

Constitutional Hardball, Mark V. Tushnet

Georgetown Law Faculty Publications and Other Works

For the past several years I have been noticing a phenomenon that seems to me new in my lifetime as a scholar of constitutional law. I call the phenomenon constitutional hardball. This Essay develops the idea that there is such a practice, that there is a sense in which it is new, and that its emergence (or re-emergence) is interesting because it signals that political actors understand that they are in a position to put in place a new set of deep institutional arrangements of a sort I call a constitutional order. A shorthand sketch of constitutional hardball is this: …

Copy This Essay: How Fair Use Doctrine Harms Free Speech And How Copying Serves It, Rebecca Tushnet Jan 2004

Copy This Essay: How Fair Use Doctrine Harms Free Speech And How Copying Serves It, Rebecca Tushnet

Georgetown Law Faculty Publications and Other Works

Defenders of transformative uses have invoked the First Amendment to bolster claims that such uses should not be subject to the copyright owner’s permission. But this focus on transformation is critically incomplete, leaving unchallenged much of copyright’s scope, despite the large number of nontransformative copying activities that are also instances of free speech. The current debate leaves the way open for expansions of copyright that, while not targeted at dissenting viewpoints, nonetheless may have a profoundly negative effect on freedom of speech. In other words, transformation has limited our thinking about the free speech interests implicated by copying. This essay …

The Moral Foundations Of Modern Libertarianism, Randy E. Barnett Jan 2004

The Moral Foundations Of Modern Libertarianism, Randy E. Barnett

Georgetown Law Faculty Publications and Other Works

Libertarians no longer argue, as they once did in the 1970s, about whether libertarianism must be grounded on moral rights or on consequences; they no longer act as though they must choose between these two moral views. In this paper, the author contends that libertarians need not choose between moral rights and consequences because theirs is a political, not a moral, philosophy, one that can be shown to be compatible with various moral theories, which is one source of its appeal.

Moral theories based on either moral rights or on consequentialism purport to be comprehensive, insofar as they apply to …

Was The Right To Keep And Bear Arms Conditioned On Service In An Organized Militia?, Randy E. Barnett Jan 2004

Was The Right To Keep And Bear Arms Conditioned On Service In An Organized Militia?, Randy E. Barnett

Georgetown Law Faculty Publications and Other Works

This essay is a review of The Militia and the Right to Arms, or, How the Second Amendment Fell Silent by H. Richard Uviller & William G. Merkel (2002).

Those who deny that the original meaning of the Second Amendment protected an individual right to keep and bear arms on a par with the rights of freedom of speech, press and assembly no longer claim that the amendment refers only to a collective right of states to maintain their militias. Instead, they now claim that the right, although belonging to individuals, was conditioned on service in an organized militia. With …

Procedural Justice, Lawrence B. Solum Jan 2004

Procedural Justice, Lawrence B. Solum

Georgetown Law Faculty Publications and Other Works

This article begins in part I, Introduction, with two observations. First, the function of procedure is to particularize general substantive norms so that they can guide action. Second, the hard problem of procedural justice corresponds to the following question: How can we regard ourselves as obligated by legitimate authority to comply with a judgment that we believe (or even know) to be in error with respect to the substantive merits?

The theory of procedural justice is developed in several stages, beginning with some preliminary questions and problems. The first question--what is procedure?--is the most difficult and requires an extensive …

Upending Status: A Comment On Switching, Inequality, And The Idea Of The Reasonable Person, Victoria Nourse Jan 2004

Upending Status: A Comment On Switching, Inequality, And The Idea Of The Reasonable Person, Victoria Nourse

Georgetown Law Faculty Publications and Other Works

This article reviews Murder and the Reasonable Man: Passion and Fear in the Criminal Courtroom, by Cynthia Lee (2003).

Cynthia Lee has written a hard-hitting and insightful book on bias and the law of homicide. Her purpose is to document how murder law’s “reasonable person” may absorb the unreason of prejudice in its various forms (from biases of race to gender to sexual orientation). Doctrinally, Lee’s book is wide-ranging and ambitious, covering a variety of standard defenses, such as provocation (chs. 1–3) and self-defense (chs. 5–7), in contexts ranging from excessive use of force to intimate homicide, from hate …

Executive Compensation Reform And The Limits Of Tax Policy, Michael Doran Jan 2004

Executive Compensation Reform And The Limits Of Tax Policy, Michael Doran

Georgetown Law Faculty Publications and Other Works

The American Jobs Creation Act of 2004 includes a major attempt to reform the tax rules for deferred compensation arrangements covering corporate managers. This paper examines the tax policy and corporate-governance policy objectives of the reform effort, explores the shortcomings of the legislation, and outlines a different approach for future executive compensation reform.
