Why The World Radiocommunication Conference Continues To Be Relevant Today, Kathleen Q. Abernathy

Federal Communications Law Journal

This Article by FCC Commissioner Kathleen Q. Abernathy critiques the continued importance of the World Radiocommunication Conference ("WRC"), and its role in international communications affairs. The Article analyzes the most recent WRC in Geneva, Switzerland from a critical modem perspective. Abernathy explores the accomplishments of the most recent WRCs, while addressing concerns that the WRC process is slow and outdated. Strategic Information Systems Planning In U.S. County Governments: Will The Real Sisp Model Please Stand Up?, Lyn M. Holley, Donna Dufner, B. J. Reed

Gerontology Faculty Publications

This paper is the second in a series of studies examining strategic information systems planning (SISP) in U.S. governments based on information technology performance data and ratings generated for the Government Performance Project (2000 re states and 2001 re counties). The first study examined SISP at the state level (PPMR, June 2002). This study investigates SISP in county government using data from the 40 largest U.S. counties in terms of revenue within regions. Findings suggest that structural features of county government inhibit translation to counties of successful business models for strategic use of information systems, and they support the conclusion …

Elections On Guam, 1970-2002, Donald R. Shuster Mar 2004

Elections On Guam, 1970-2002, Donald R. Shuster

Pacific Studies

Guam, taken as a spoil of the 1898 Spanish-American War, has since been an unincorporated U.S. territory in the western Pacific. Although U.S. citizenship was conferred on the island people by the 1950 Organic Act, the chief executive was not popularly elected until 1970. This article describes electoral politics and parties on Guam: candidates, campaigns, results, and analyses. The first seven gubernatorial elections are surveyed, and the contests of 1998,2000, and 2002 are described in detail. The 1998 race, an especially contentious one, was finally settled by a U.S. Supreme Court decision. The 2002 governorship contest pitted media power and …

The Fourth Amendment And New Technologies: Constitutional Myths And The Case For Caution, Orin S. Kerr

Michigan Law Review

To one who values federalism, federal preemption of state law may significantly threaten the autonomy and core regulatory authority of The Supreme Court recently considered whether a1mmg an infrared thermal imaging device at a suspect's home can violate the Fourth Amendment. Kyllo v. United States announced a new and comprehensive rule: the government's warrantless use of senseenhancing technology that is "not in general use" violates the Fourth Amendment when it yields "details of the home that would previously have been unknowable without physical intrusion." Justice Scalia's majority opinion acknowledged that the Court's rule was not needed to resolve the case …

Katz Is Dead. Long Live Katz, Peter P. Swire Mar 2004

Katz Is Dead. Long Live Katz, Peter P. Swire

Michigan Law Review

Katz v. United States is the king of Supreme Court surveillance cases. Written in 1967, it struck down the earlier regime of property rules, declaring that "the Fourth Amendment protects people, not places." The concurrence by Justice Harlan announced the new regime - court-issued warrants are required where there is an infringement on a person's "reasonable expectation of privacy." Together with the companion case Berger v. New York, Katz has stood for a grand conception of the Fourth Amendment as a bulwark against wiretaps and other emerging forms of surveillance. Professor Orin Kerr, in his excellent article, shows that …

Modeling And Analysis Of Post-Conflict Reconstruction, Damon B. Richardson Mar 2004

Modeling And Analysis Of Post-Conflict Reconstruction, Damon B. Richardson

Theses and Dissertations

The forces at play in reconstruction operations are a complex system of time phased interlocking cause and effect relationships that are not thoroughly understood. A model capable of capturing the general dynamics involved in post-conflict reconstruction would provide insight to decision makers regarding potential policy alternatives. This research effort demonstrates the viability of using systems dynamics modeling techniques to simulate the establishment of public order and safety in a post-conflict reconstruction operation (Phase IV operations). A high level generic framework is developed that can be used as a general template for modeling post-conflict reconstruction. It is then demonstrated with a …

Evaluation Of Needle Exchange Programs, Cheryl Delgado Feb 2004

Evaluation Of Needle Exchange Programs, Cheryl Delgado

Nursing Faculty Publications

Needle exchange programs exist in every major population area in the United States and in many other countries. Some operate legally under emergency health decrees issued by local departments of health, with the stated intention of risk reduction through the removal of used injection equipment from use by injection drug users. It is theorized that this results in a reduced transmission of human immunodeficiency virus, hepatitis, and, possibly, other blood-borne diseases. Needle exchange programs also offer access to drug treatment programs for the participants. It is a difficult but necessary task to evaluate these programs. This article examines examples of …
