This Article surveys the Georgia Supreme Court and Georgia Court of Appeals administrative law cases from June 1, 2003 through May 31, 2004. Over two dozen pertinent cases were decided during the survey period, many of them containing highly novel elements. The novelty of certain facets of the cases only stands to reason, as all levels of government continue to increase reliance upon administrative agencies to perform necessary functions. The regulatory framework imposed by these agencies never fills in all the blanks regarding those functions. The unanswered questions invariably invite appellate court decisionmaking.

Do Policy-Makers Earmark To Constrain Their Successors? The Case Of Environmental Earmarking, Neva Novarro
Economics Department Working Papers
This paper examines whether legislators earmark funds in order to constrain the spending of future legislators with different preferences. Specifically, panel data is used to estimate the probability a new environmental earmarking law is passed as a function of Democrats holding and subsequently losing majority control of the government. The results of this study do not support this hypothesis. In fact, Democrats with a large majority who subsequently lose this majority power following the next election are found to be less likely to earmark funds for the environment. College campus police administrators operate in a complex administrative environment that produces difficult leadership challenges. In order to manage these challenges, police administrators need to possess certain leadership competencies. This study fills a gap in the academic literature by examining the perceptions of campus law enforcement administrators in the United States as to the kinds of leadership challenges they face, and the nature of the leadership competencies needed to manage these challenges. Stress Corrosion Cracking And Hydrogen Embrittlement Of Martensitic Alloy Ep-823, Mohammad K. Hossain

This investigation is focused on the evaluation of stress corrosion cracking (SCC), localized corrosion, and hydrogen embrittlement (HE) susceptibility of martensitic Alloy EP-823 in neutral and acidic solutions at ambient and elevated temperatures. While no failures were observed in smooth specimens in the neutral solution, failures were noticed in the 90°C acidic solution at constant-load (CL) leading to a threshold stress (O'th) of 102 ksi. The presence of a notch reduced the O'th value to 91 ksi in a similar environment. The ductility (%El and %RA), time-to-failure (TTF), and true failure stress (O'r) were gradually …

The study presented in this paper is that of Universal Mobile Telecommunications Systems (UMTS) Turbo Codes across Space Time Spreading channel with one transmitter antenna, one receiver (m = 1) and two transmitter antennas and one receiver (m = 2) to see to what extent the bit error rate (BER) can be improved. Using the Max-log decoding algorithm and 12 iterations it is shown in the simulation results that an extra 5 dB is achievable.

The United States is first among industrialized nations in the rate at which we imprison offenders. With ever-increasing numbers of incarcerated offenders and continued high recidivism rates, many institutions have begun implementing treatment programs in attempts to combat crime and reduce recidivism rates. With high costs to all of society (including victim losses and costs to prevent, convict, and imprison offenders), it is important for correctional officials to know the extent to which programs are facilitating or inhibiting offender change. Patient medical errors cause thousands of individual injuries and deaths each year. Avoidable medical errors occur every day, thus creating serious concern as to the safety, ethical and legal implications in healthcare delivery. A literature review of scholarly work indicates medical errors are underreported both at the institutional level and on the individual level. This paper attempts to explain why medical errors are underreported. It considers reporting practices from other industries that are applicable to the medical industry, the importance of reporting medical errors along with those incidents that have the potential to improve patient safety and patient quality of …

E-government is a way for governments to use new technologies such as the Internet to provide citizens with more convenient access to government information and services, to improve the quality of services, and to provide greater opportunities for citizens to participate in democratic institutions and processes. This research investigates factors impacting e-government development. Based on the growth theory and human capital theory from the economics literature, we hypothesize that information and computer technology, and human development are two factors impacting e-government development. The hypotheses were empirically tested using secondary data from the United Nations and the United Nations Development Programme. …

Marital Satisfaction And Depression In A Study Of Brazilian Women: A Cross-Cultural Test Of The Marital Discord Model Of Depression, Cody S. Hollist

Depression is a major societal health problem with individual, familial, social, and economic costs. Cross sectional research has linked depression and marital discord, with women frequently having a higher association between variables. Several longitudinal research studies have linked marital satisfaction to subsequent depression. The Marital Discord Model of Depression states that marital discord is an important antecedent in the development of depression. While some empirical evidence exists supporting this premise, no research has been done with Latinos. The purpose of this study was to test the longitudinal relationship between marital satisfaction and depression among Latina women.
