Missouri Supreme Court Rules: Despite Change In Statute, Sleeping It Off Behind The Wheel Is Still Not An Option, Amanda Allen Miller Jun 2004

Missouri Supreme Court Rules: Despite Change In Statute, Sleeping It Off Behind The Wheel Is Still Not An Option, Amanda Allen Miller

Missouri Law Review

When one thinks of drunk driving, one usually imagines a person careening down the road, putting the lives of other motorists in danger. However, an intoxicated person may be subject to the same drunk driving sanctions simply by sitting, sleeping, or passing out in the driver’s seat after turning on the motor. In Cox v. Director of Revenue, the Missouri Supreme Court upheld a driver’s license revocation on just those facts, holding that when a driver is in a vehicle and the motor is running, there is probable cause to believe that he is “operating” the vehicle even if he …

South Park Blocks Area Development Strategy: Priorities And Actions To Strengthen Neighborhood Identity, Lisa Abuaf, Natasha Detweiler, Steve Faust, Jennifer Mannhard, Dan Zalkow

Master of Urban and Regional Planning Workshop Projects

Past and current planning efforts by the City of Portland, such as the South Park Blocks Urban Renewal Area and the West End plan, have sought to promote new mixed-use development through increasing the residential density and investment in the area. The West End plan focused primarily on the area north of SW Salmon Street and the urban renewal area currently does not have a standing advisory committee to represent the Downtown neighborhood’s interests. This project consists of a neighborhood analysis to distill the identity of the area, an identification of the opportunities and challenges to development, and a strategy …

Turbulent Transition In Iraq: Can It Succeed?, Judith S. Yaphe Jun 2004

Turbulent Transition In Iraq: Can It Succeed?, Judith S. Yaphe

Strategic Forums

This Strategic Forum policy brief analyzes Iraq’s fragile political transition following the June 2004 transfer of sovereignty from the Coalition Provisional Authority to the Iraqi Interim Government. It assesses three interrelated challenges: the risk of civil war, the legitimacy of transitional governance, and the long-term development of political institutions. While sectarian and ethnic tensions among Sunni Arabs, Shi’a Arabs, and Kurds are pronounced, the brief argues that large-scale civil war is not inevitable. Instead, instability is more likely to stem from extremist movements, militia power, and disputes over federalism and control of territory, particularly Kirkuk. The author contends that the …

Small Cities Blues: Looking For Growth Factors In Small And Medium-Sized Cities, George A. Erickcek, Hannah J. Mckinney

Upjohn Institute Working Papers

The purpose of this exploratory study is to attempt to identify particular public policies which have the potential to increase the economic viability of smaller metropolitan areas and cities. We identify characteristics associated with smaller metro areas that performed better-than-expected (winners) and worse-than-expected (losers) during the 1990s, given their resources, industrial mix, and location as of 1990. Once these characteristics have been identified, we look for evidence that public policy choices may have promoted and enhanced a metro area's ability to succeed and to regain control of its own economic destiny. Methodologically, we construct a regression model which identifies the …

An Evaluation Of City Hall Departmental Complaints In Kalamazoo, Michigan, 1993 And 1994, Monique R. Moore

Masters Theses

My research will evaluate the citizen complaints made to various departments in the Kalamazoo, Michigan's City Hall for the years of 1993 and 1994. The complaints were compiled on a monthly basis by the Citizen Action Center for the various departments. The number and types of complaints received and significant differences in the frequency and content of complaints or patterns of change from one year to the other were analyzed.

There was a consistent pattern in the content or types of complaints concerning the Public Works department from 1993 to 1994, but no consistent pattern for any of the other …

Lawrence V. Texas And Judicial Hubris, Nelson Lund, John O. Mcginnis Jun 2004

Lawrence V. Texas And Judicial Hubris, Nelson Lund, John O. Mcginnis

Michigan Law Review

The republic will no doubt survive the Supreme Court's decision, in Lawrence v. Texas, to invalidate laws against private, consensual sodomy, including those limited to homosexual behavior. Such laws are almost never enforced, and the rare prosecutions for such acts are necessarily capricious. So the principal direct effect of the Court's decision is likely to be extremely limited, and largely salutary: a few individuals will be spared the bad luck of getting a criminal conviction for violating laws that are manifestly out of step with prevailing sexual mores. Nor are we likely to see anything like the intense political …

Work-Based Welfare As A Ritual: Understanding Marginalization In Post-Independence Lithuania, Arunas Juska, Richard Pozzuto Jun 2004

Work-Based Welfare As A Ritual: Understanding Marginalization In Post-Independence Lithuania, Arunas Juska, Richard Pozzuto

The Journal of Sociology & Social Welfare

The paper analyzes the functioning of the newly created labor exchange in post-Soviet Lithuania. It is argued that the labor exchange in post-Soviet Lithuania operates under the conditions of a structural contradiction: welfare services are designed to reintegrate unemployed into the labor force under the conditions of (a) increasing competitiveness of the labor markets and (b) a rapid decline of employment within the Lithuanian economy. As a result, labor redundancy is produced which consists predominantly of low skill/education individuals. Because the economy is unable to generate employment, job searches for this segment of the population are transformed into a highly …

The Multiple Roles Of Low Income, Minority Women In The Family And Community: A Qualitative Investigation, Avery E. Goldstein, Wendy Reiboldt Jun 2004

The Multiple Roles Of Low Income, Minority Women In The Family And Community: A Qualitative Investigation, Avery E. Goldstein, Wendy Reiboldt

The Qualitative Report

This longitudinal, ethnographic research study was incepted to investigate service use among families living in poor urban communities. Themes that emerged during data collection focus on the variety of roles played by women, in the home, and in the neighborhood. We identified numerous strengths exhibited by women, that is, roles that help families adapt and survive. Over a two-year period, we spent time with families, in their homes, and in their communities. Not only did the women fulfill multiple roles in the family, but they performed care taking functions within the community as well. A more complete understanding of family …

The Unknown Past Of Lawrence V. Texas, Dale Carpenter Jun 2004

The Unknown Past Of Lawrence V. Texas, Dale Carpenter

Michigan Law Review

On the night of September 17, 1998, someone called the police to report that a man was going crazy with a gun inside a Houston apartment. When Harris County sheriff's deputies entered the apartment they found no person with a gun but did witness John Lawrence and Tyron Gamer having anal sex. This violated the Texas Homosexual Conduct law, and the deputies hauled them off to jail for the night. Lawyers took the men's case to the Supreme Court and won a huge victory for gay rights. So goes the legend of Lawrence v. Texas. Do not believe it. …

Ultra-Wideband Technology For Short-Range Wireless Communication, Li Zhao May 2004

Ultra-Wideband Technology For Short-Range Wireless Communication, Li Zhao

Dissertations

The ultra-wideband (UWB) radio core idea is to open large amounts of spectrum to a variety of users with little mutual interference between them. While ultra-wideband is being championed by several commercial companies, this technology has not followed the conventional path where commercial interest is preceded by years of academic research. This work attempts to fill in some of the gap by studying fundamental properties of communications with impulse-based radio UWB signals. We study jam resistance and capacity of UWB. Jam resistance is analyzed for binary pulse position modulation (PPM) with the interference being modeled as correlated Gaussian. Closed-form expressions …

Osha Laboratory Safety Standard 29 Cfr 1910.1450 And Achieving Compliance In The Microelectronic Laboratory, Danielle M. Digironimo May 2004

Osha Laboratory Safety Standard 29 Cfr 1910.1450 And Achieving Compliance In The Microelectronic Laboratory, Danielle M. Digironimo

Theses

This thesis is a practical application of occupational exposures to hazardous substances in a microelectronics laboratory. The Occupational Safety and Health Administration (OSHA) standard for the safety in laboratories is (29 CFR 1910.1450). The application is a demonstration of the implementation of the standard in a university setting. Hazards that exist in laboratory settings are very complex and the task of providing a safe workplace can become increasingly complicated. A laboratory can and does impose different health and safety concerns that a standard industrial workplace setting might not have. The need for a laboratory safety standard program to be implemented …

Particle Size Dependence On Immobilized Molecular Sensors : Assay Of Nucleic Acid Probes Attached To Paramagnetic Particles, Celin Sunny May 2004

Particle Size Dependence On Immobilized Molecular Sensors : Assay Of Nucleic Acid Probes Attached To Paramagnetic Particles, Celin Sunny

Theses

Nanotechnology is concerned with materials and systems whose structure and components exhibit novel and significantly improved physical, chemical and biological properties, phenomena and processes due to their nano scale size.

The transition from micro scale to nano scale leads to a number of changes in physical properties, possibly including new physical principles, some of which may be yet to be discovered. One of the major factors in this is the increase in ratio of surface area to volume.

This thesis research uses the increase in ratio of surface area to volume property of going from macro to micro to nano …

The Roadmap For Failure: Israeli And Palestinian Discountenance And Misunderstanding, John J. Marciano May 2004

The Roadmap For Failure: Israeli And Palestinian Discountenance And Misunderstanding, John J. Marciano

ExpressO

As tensions rise with the assassination of key Hamas figures, the situation in Israel and the Occupied Territories call out for committed, reasoned action. In the past, the peace process has consisted of half-hearted attempts to pacify both the Israeli and Palestinian populaces. This is exemplified by the recent Roadmap for peace, which was supported by the United States.

However, the lack of true dedication among the players has arguably resulted in crimes against humanity on both sides. The previous peace plans fail to recognize this, and have perpetuated the violence with cookie-cutter approaches that are not closely tailored to …

The Right To Family Life And Civil Marriage Under International Law And Its Implementation In The State Of Israel, Yuval Merin May 2004

The Right To Family Life And Civil Marriage Under International Law And Its Implementation In The State Of Israel, Yuval Merin

ExpressO

The article deals with the protection of the right to family life under international law and its implementation in the State of Israel on three levels: protection of the family cell as a single unit; protection of the individuals comprising the family unit; and protection of the family in special circumstances (e.g., immigration rights).

The article begins by analyzing the characteristics of the right to family life and examining various definitions of the “family” under international and Israeli law. It also examines what it is that the right to family life encompasses and how it should be classified within the …
