Destabilization Rights: How Public Law Litigation Succeeds, Charles F. Sabel, William H. Simon Jan 2004

Destabilization Rights: How Public Law Litigation Succeeds, Charles F. Sabel, William H. Simon

Faculty Scholarship

"Public law litigation" – civil rights advocacy seeking to restructure public agencies - has changed course over the last three decades. It has moved away from remedial intervention modeled on command-and-control bureaucracy toward a kind of intervention that can be called "experimentalist." Instead of top-down, fixed-rule regimes, the experimentalist approach emphasizes ongoing stakeholder negotiation, continuously revised performance measures, and transparency. Experimentalism is evident in all the principal areas of public law intervention – schools, mental health institutions, prisons, police, and public housing. This development has been substantially unanticipated and unnoticed by both advocates and critics of public law litigation. In …

Monogamy's Law: Compulsory Monogamy And Polyamorous Existence, Elizabeth F. Emens Jan 2004

Monogamy's Law: Compulsory Monogamy And Polyamorous Existence, Elizabeth F. Emens

Faculty Scholarship

Right now, marriage and monogamy feature prominently on the public stage. Efforts to lift prohibitions on same-sex marriage in this country and abroad have inspired people on all sides of the political spectrum to speak about the virtues of monogamy's core institution and to express views on who should be included within it. The focus of this article is different. Like an "unmannerly wedding guest," this article invites the reader to pause amidst the whirlwind of marriage talk and to think critically about monogamy and its alternatives.

What Caused Enron? A Capsule Social And Economic History Of The 1990s, John C. Coffee Jr. Jan 2004

What Caused Enron? A Capsule Social And Economic History Of The 1990s, John C. Coffee Jr.

Faculty Scholarship

The sudden explosion of corporate accounting scandals and related financial irregularities that burst over the financial markets between late 2001 and the first half of 2002 – Enron, WorldCom, Tyco, Adelphia and others – raises an obvious question: Why now? What explains the concentration of financial scandals at this moment in time? Much commentary has rounded up the usual suspects and placed the blame on a decline in business morality, an increase in "infectious greed," or other similarly subjective trends that cannot be reliably measured. Although none of these possibilities can be dismissed out of hand, approaches that simply reason …

Beyond The Book: Promoting Effective Research, Jana M. Borchardt Jan 2004

Beyond The Book: Promoting Effective Research, Jana M. Borchardt

The Christian Librarian

In the past library professionals have primarily collected and provided access to materials; however, this paper will argue that we must now go beyond access or "Beyond the Book. " One way to do this is to learn about the information search process and then assume a new and more assertive role as a "research advisor. " We need to change our patrons 'expectations so that they see us as knowledgeable about sources, yes, but also as experts on effective research as a process of discovery. Three relevant information search process models are covered, as well as the way people …

Training Levels And Methodologies For Glass Cockpit Training In Collegiate Aviation, Richard O. Fanjoy, John P. Young Jan 2004

Training Levels And Methodologies For Glass Cockpit Training In Collegiate Aviation, Richard O. Fanjoy, John P. Young

Journal of Aviation/Aerospace Education & Research

Modern commercial aircraft use extremely complex and sophisticated flight instrumentation systems that present training concerns for the aviation industry and collegiate aviation programs. The authors sampled 42 four-year collegiate flight-training programs to determine their current program emphasis on "glass cockpit" training and plans for curriculum enhancements in that area. Although nearly fifty percent of sampled program administrators believe instruction in flight automation is critical to the success of their graduates, most cite cost of materials and competing curriculum priorities as reasons to defer such instruction to future employers. The authors suggest that program enhancements are within the reach of modern …

Adaption And Innovation In Flight Training - The Benefits Of Cognitive Diversity, Kurt Barnhart Jan 2004

Adaption And Innovation In Flight Training - The Benefits Of Cognitive Diversity, Kurt Barnhart

Journal of Aviation/Aerospace Education & Research

This article highlights how differences in cognitive style paradigms, according to Adaption-Innovation (A-I) Theory, can have a positive impact in a flight training environment. This study examined twenty-four pairs of flight instructors and primary flight students who retained this relationship throughout the student's entire primary flight training experience; through to their initial U.S. civilian pilot certification, the private pilot's certificate. Dr. Michael Kirton's Adaption-Innovation Theory of cognitive style was used as the cognitive style paradigm. The instrument associated with A-I theory measures an individual's cognitive style preference on a numeric horizontal scale ranging from highly adaptive on the left to …

A Comparative Study Of Collegiate Aviation Students And Business Students Related To Myers-Briggs Type Indicator Preferences, Mary N. Kutz, David B. Carmichael, Mahmood Shandiz, Dovie M. Brown Jan 2004

A Comparative Study Of Collegiate Aviation Students And Business Students Related To Myers-Briggs Type Indicator Preferences, Mary N. Kutz, David B. Carmichael, Mahmood Shandiz, Dovie M. Brown

Journal of Aviation/Aerospace Education & Research

There has been limited research to date that addresses the difference, if any, between students who choose the various fields of aviation as a major, and those who choose other majors, particularly business. This study utilizes the Myers-Briggs Type Indicator (MBTI) to compare preferences of aviation majors to business majors because of its unique characteristics and its noted lack of use in the aviation arena. The findings of the study revealed that there are no significant differences between business and aviation students in the Myers-Briggs Type Indicators except in the way they orient themselves in the environment (Judging and Perceiving). …

Error And Threat Detection: A Review And Evaluation Of Current Literature, Christina Frederick-Recascino, Michael Gosiewski Jan 2004

Error And Threat Detection: A Review And Evaluation Of Current Literature, Christina Frederick-Recascino, Michael Gosiewski

Journal of Aviation/Aerospace Education & Research

The present project provides a comprehensive review of the literature related to threat and error detection. Although there are current models for understanding the concepts of error and threat, little is known about how individuals detect errors and threats when they occur. Awareness of error and threat is crucial for advancement of safety in the aviation domain. Four areas were discussed related to error and threat detection. First, the general error and threat detection literature was reviewed. Second, the physiological foundations for error and threat detection were discussed. Third, the paper examined cognitive aspects of error and threat detection. Last, …

Publishing Aviation Research: A Literature Review Of Scholarly Journals, Robert W. Kaps, Ed Phillips Jan 2004

Publishing Aviation Research: A Literature Review Of Scholarly Journals, Robert W. Kaps, Ed Phillips

Journal of Aviation/Aerospace Education & Research

The importance of the aviation industry's socio-economic impact, domestically and globally, cannot be denied. In light of this and, as aviation continues to evolve as an academic field of study, post-secondary institutions with aviation specific curriculum have grown,in number and prominence. As a direct consequence of academic growth, the necessity to publish follows as a concomitant requirement. Through the diligence of those researchers actively conducting aviation related research a common theoretical and conceptual base for aviation specific research has been established. The void that once existed for aviation research has been filled, predominantly by three aviation specific journals and a …

Regulating Teenage Abortion In The United States: Politics And Policy, Carol Sanger Jan 2004

Regulating Teenage Abortion In The United States: Politics And Policy, Carol Sanger

Faculty Scholarship

Thirty-four US states currently require pregnant minors either to notify their parents or get their consent before having a legal abortion. The Supreme Court has upheld the constitutionality of theses statutes provided that minors are also given an alternative mechanism for abortion approval that does not involve parents. The mechanism used is the 'judicial bypass hearing' at which minors persuade judges that they are mature and informed enough to make the abortion decision themselves. While most minors receive judicial approval, the hearings intrude into the most personal aspects of a young woman's life. The hearings, while formally civil in nature, …

The Role Of Well-Being, Joseph Raz Jan 2004

The Role Of Well-Being, Joseph Raz

Faculty Scholarship

"Well-being" signifies the good life, the life which is good for the person whose life it is. I have argued that well-being consists in a wholehearted and successful pursuit of valuable relationships and goals. This view, a little modified, is defended , but the main aim of the article is to consider the role of well-being in practical thought. In particular I will examine a suggestion which says that when we care about people, and when we ought to care about people, what we do, or ought to, care about is their well-being. The suggestion is indifferent to who cares …

A Case Study Of Senior Students' Perceptions Of Factors That Shape Aspirations In One Low-Income Rural Iowa High School, Louise Elizabeth Esveld Jan 2004

A Case Study Of Senior Students' Perceptions Of Factors That Shape Aspirations In One Low-Income Rural Iowa High School, Louise Elizabeth Esveld

Dissertations and Theses @ UNI

Rural Iowa high school graduates from districts enrolling fewer than 600 students are more likely than their more urban peers to be economically disadvantaged as measured by eligibility for free and reduced cost meals. They are also less likely to aspire to high levels of educational attainment. Over the last decade, the percentage of graduates from small, rural schools intending to pursue any postsecondary education or training has approached or exceeded the percentage in more urban districts. However, among rural graduates with postsecondary intentions, the ranks of those students planning to pursue a four-year degree or higher remain disproportionately thin. …

Teachers' Receptions Of Facilitators And Barriers To Inclusion: A Regional Survey, Hillary Kretz-Harvey Jan 2004

Teachers' Receptions Of Facilitators And Barriers To Inclusion: A Regional Survey, Hillary Kretz-Harvey

Theses

This study examined teachers' perceptions of facilitators needed to include students with special needs. The Teachers' Opinions of Inclusive Education Needs Survey (TOIENS) was developed for this study in order to examine teachers' perceptions of facilitators to inclusion. Results found that teachers identified material and personnel supports, preservice and inservice training, and environmental/classroom features as all similarly necessary. Discrepancies were found, however, between identified facilitators and the availability of them. Personnel supports were generally considered to be available in the school districts, but several necessary material supports, training, and environmental/classroom features were considered to be unavailable.

An Analysis Of The Consistency Of Brand Color Reproduction In Print Packaging And Magazine Advertising, Seunga Kang Ha Jan 2004

An Analysis Of The Consistency Of Brand Color Reproduction In Print Packaging And Magazine Advertising, Seunga Kang Ha

Theses

Brand color is one way to represent the identity of the corporation and for the company to advertise itself. The purpose of brand color is to make customers perceive the color, recognize the brand, and ultimately buy products manufactured by the corporation. However, it is not easy to produce the same color through different print media applications because of different processes of color reproduction technology. In the print industry, corporations have controlled brand color tolerance to insure its consistency. However, there is some question as to how the print industry actually performs in maintaining this tolerance through reproduction. The goal …

Manifestation Determinations: How Do Iowa's Aea Adopted Procedures Compare To Federal And State Requirements And Expert Guidelines?, Keely J. Beam

Dissertations and Theses @ UNI

Due to the qualitative nature of manifestation determinations there is variation is how manifestation determinations are applied across situations and settings. In addition, IEP teams remain uncertain and uniformed regarding conducting manifestation determinations. This study investigate how Iowa's Area Education Agencies (AEAs) adopted procedures compare with federal and state requirements and expert guidelines. The reliability of manifestation determinations may be improved when AEA's adopt procedures are consistent with federal and state requirements, and expert guidelines. Tue information gleaned from this document review may also be of value to AEA's in establishing their own procedures for manifestation determinations. The study utilizes …

Students' Views Of Classroom Management Strategies In Assertive Discipline And Constructivist Classroom Settings, Joan Carolyn Gerbo Jan 2004

Students' Views Of Classroom Management Strategies In Assertive Discipline And Constructivist Classroom Settings, Joan Carolyn Gerbo

Dissertations and Theses @ UNI

The present case study was designed to investigate third grade students' views of their teachers' behavior management strategies in two contrasting classroom types at the third grade level: an Assertive Discipline classroom that represents the behaviorist paradigm, and a constructivist classroom that emphasizes the social cognitive paradigm. Understanding students' views at this age is important because these views become the lenses through which children interpret subsequent school experiences and may provide insight into how to reduce student misbehavior in schools (Valeski & Stipek, 2001). However, limited research exists to compare third grade students' views in classrooms of teachers with different …

The Impact Of The Iowa Children's Water Festival On The Children's Attitudes And Behaviors Toward The Environment, Sang-Min Kim Jan 2004

The Impact Of The Iowa Children's Water Festival On The Children's Attitudes And Behaviors Toward The Environment, Sang-Min Kim

Dissertations and Theses @ UNI

As a result of the growing concern about environmental issues, many countries have developed mechanisms and regulations directed at protection and conservation of the environment. As a part of this movement, many governmental and nongovernmental organizations (NGO) have launched a variety of environmental education programs, in an attempt to promote awareness of environmental issues. The Iowa Children’s Water Festival (ICWF) is an annual half-day environmental education program in Iowa. The goal of the ICWF is to provide educational opportunities throughout the state to K-5 children and to educate customers of tomorrow on the importance of safe, reliable drinking water (ICWF, …

Ancient Promises, Mohamad Rozi Mohd Nor Jan 2004

Ancient Promises, Mohamad Rozi Mohd Nor

Theses

The story is about a girl who achieves her mythological destiny through her metamorphosis from a human form to that of a sea turtle which symbolizes universal love, fertility and desire. During preproduction the original concept (see Thesis Proposal in Appendix A) took a dramatic shift, becoming less of a traditional narrative work and evolving more into a visual lyrical form. Ancient Promises begins with the female lead character appearing restless during her strangely frantic investigations on a beach. She hears voices which surprise and intrigue her. Her discovery of a turtle and the loss of her ring increases the …

Art Tales: Art As A Communicator Of New York State Folklore, Erin Claire Tobin Jan 2004

Art Tales: Art As A Communicator Of New York State Folklore, Erin Claire Tobin

Theses

This thesis project focuses on the use of folktales as a starting point to explore texture and pattern. The artist was striving to create a visual communication of folktales. Using physical layers in the paintings to create spatial depth as well as to express the idea of the building of layers as a metaphor for the story of life, the artist engages the viewer to relate this to the idea that culture is built from many different layers of stories over time.

Fashioning Afrocuba: Fernando Ortiz And The Advent Of Afrocuban Studies, 1906-1957, Jeremy Leeds Cass Jan 2004

Fashioning Afrocuba: Fernando Ortiz And The Advent Of Afrocuban Studies, 1906-1957, Jeremy Leeds Cass

University of Kentucky Doctoral Dissertations

This study attempts to organize the conglomerate of writing on Africans within Republican Cuba. Starting with an examination of the scientific stages of such writing, we will trace the assorted work of Fernando Ortiz (1881-1969), whose anthropological study of Afrocuba produced myriad readings of the heritage. The multiplicity of renderings of Cuba s Africans from the scientific arena including condemning, racially charged treatises and spiritual conceptualizations of the richness of Cuba s African heritage generated an air of inconstancy. Indeed, the contradictions generated by the discipline s scientific course were incredibly polarized, representative of an ambiguity that became emblematic of …

Global Change, Domestic Policy, And Life Course Influences On Perceptions Of Health Equity Among Older Cubans, James Lester Schwar Jan 2004

Global Change, Domestic Policy, And Life Course Influences On Perceptions Of Health Equity Among Older Cubans, James Lester Schwar

University of Kentucky Doctoral Dissertations

Cubas provision of free health services to the entire population via neighborhood-based family doctors produced dramatic health gains and achieved a relative state of health equality. Since 1989, however, the termination of Soviet trade, a grave economic crisis, intensification of the US embargo, welfare reductions, and population aging have placed Cubas health successes and elder care services in jeopardy. Little independent research, though, has focused on the influence of post-Cold War circumstances on citizen attitudes about health programs and resources targeting Cubas older population. This research examined global and domestic factors since 1989 that have most influenced perceptions of the …
