Lay Participation In The Japanese Justice System, Kent Anderson, Mark Nolan Jan 2004

Lay Participation In The Japanese Justice System, Kent Anderson, Mark Nolan

Vanderbilt Journal of Transnational Law

The Authors introduce and critique Japan's proposed quasi-jury or lay assessor system (saiban-in seido). The proposed mixed-court will have judges and lay people deciding together both guilt and sentences in serious criminal cases. Its proponents have promised that the lay assessor system will produce better justice in the courts and a more democratic society for Japan. The Authors first expose the competing interests in the lay assessor drafting process, examining their subtly but importantly varied proposals. Second, the Authors historically review lay participation in Japan, arguing that it has failed to deliver better justice and more democracy because the existing …

The Trial Court's Gatekeeper Role Under Frye, Daubert, And Kumho: A Special Look At Children's Cases, John Eric Smithburn

Journal Articles

The typical requisites for receiving testimony from an expert witness are that the expert be qualified in a particular subject or area of expertise, that the expert testify in opinion form or otherwise, which will help the fact finder, and that there be a proper basis for the expert's testimony. This article examines the changing meaning in the law of evidence of the expert's subject area in cases involving children. During most of the last century, where the expert witness proposed to testify concerning a new or novel scientific system, process or technique, the court applied the rule of Frye …

Hope And Guidance For Parents Of Children With Ocd: A Review Of Freeing Your Child From Obsessive-Compulsive Disorder [Book Review Section], Richard J. Cowan, Susan M. Swearer Napolitano Jan 2004

Hope And Guidance For Parents Of Children With Ocd: A Review Of Freeing Your Child From Obsessive-Compulsive Disorder [Book Review Section], Richard J. Cowan, Susan M. Swearer Napolitano

Department of Educational Psychology: Faculty Publications

A favorable review of Freeing Your Child from Obsessive-Compulsive Disorder by T.E. Chansky (Crown Publishers, 2004). From the review: "Closely following March and Mulle's (1998) treatment protocol, this book is guided by the philosophy that an individual with OCD must “boss back” symptoms in order to break the symptom cycle. With this approach OCD is objectified (and externalized) as a “brain bully” or enemy that can be overcome with knowledge, determination, and support. Separating the child from his/her OCD symptoms is an effective, concrete technique that children and adolescents will readily comprehend. Such a tactic reminds parents that their child …

Designing A Mixed Methods Study In Primary Care, John W. Crewell, Michael D. Fetters, Nataliya V. Ivankova Jan 2004

Designing A Mixed Methods Study In Primary Care, John W. Crewell, Michael D. Fetters, Nataliya V. Ivankova

Department of Educational Psychology: Faculty Publications

BACKGROUND Mixed methods or multimethod research holds potential for rigorous, methodologically sound investigations in primary care. The objective of this study was to use criteria from the literature to evaluate 5 mixed methods studies in primary care and to advance 3 models useful for designing such investigations.

METHODS We first identified criteria from the social and behavioral sciences to analyze mixed methods studies in primary care research. We then used the criteria to evaluate 5 mixed methods investigations published in primary care research journals.

RESULTS Of the 5 studies analyzed, 3 included a rationale for mixing based on the need …

Using Transcendental Phenomenology To Explore The “Ripple Effect” In A Leadership Mentoring Program, Tammy Moerer-Urdahl, John W. Creswell Jan 2004

Using Transcendental Phenomenology To Explore The “Ripple Effect” In A Leadership Mentoring Program, Tammy Moerer-Urdahl, John W. Creswell

Department of Educational Psychology: Faculty Publications

Several approaches exist for organizing and analyzing data in a phenomenological qualitative study. Transcendental phenomenology, based on principles identified by Husserl (1931) and translated into a qualitative method by Moustakas (1994), holds promise as a viable procedure for phenomenological research. However, to best understand the approach to transcendental phenomenology, the procedures need to be illustrated by a qualitative study that employs this approach. This article first discusses the procedures for organizing and analyzing data according to Moustakas (1994). Then it illustrates each step in the data analysis procedure of transcendental phenomenology using a study of reinvestment or the “ripple effect” …

Pissing Glass And The Body Crass: Adaptations Of The Scatological In Théophile, Russell J. Ganim Jan 2004

Pissing Glass And The Body Crass: Adaptations Of The Scatological In Théophile, Russell J. Ganim

Department of Modern Languages and Literatures: Faculty Publications

Examination of scatological motifs in Théophile de Viau’s (1590-1626) libertine, or ‘cabaret’ poetry is important in terms of how the scatological contributes to the depiction of the Early Modern body in the French lyric.1 This essay does not examine Théophile’s portrait of the body strictly in terms of the ‘Baroque’ or the ‘neo-Classical.’ Rather, it argues that the scatological context in which he situates the body (either his, or those of others), reflects a keen sensibility of the body representative of the transition between these two eras. Théophile reinforces what Bernard Beugnot terms the body’s inherent ‘eloquence’ (17), or what …

The Selfish Nature Of Generosity: Harassment And Food Sharing In Primates, Jeffrey R. Stevens Jan 2004

The Selfish Nature Of Generosity: Harassment And Food Sharing In Primates, Jeffrey R. Stevens

Jeffrey Stevens Publications

Animals may share food to gain immediate or delayed fitness benefits. Previous studies of sharing have concentrated on delayed benefits such as reciprocity, trade and punishment. This study tests an alternative model (the harassment or sharing–under–pressure hypothesis) in which a food owner immediately benefits because sharing avoids costly harassment from a beggar. I present an experiment that varies the potential ability of the beggar to harass, and of the owner to defend the food, to examine the effects of harassment on food sharing in two primate species: chimpanzees (Pan troglodytes) and squirrel monkeys (Saimiri boliviensis). For …

A Conceptual Framework For Non-Kin Food Sharing: Timing And Currency Of Benefits, Jeffrey R. Stevens, Ian C. Gilby Jan 2004

A Conceptual Framework For Non-Kin Food Sharing: Timing And Currency Of Benefits, Jeffrey R. Stevens, Ian C. Gilby

Jeffrey Stevens Publications

Many animal species, from arthropods to apes, share food. This paper presents a new framework that categorizes nonkin food sharing according to two axes: (1) the interval between sharing and receiving the benefits of sharing, and (2) the currency units in which benefits accrue to the sharer (especially food versus nonfood). Sharers can obtain immediate benefits from increased foraging efficiency, predation avoidance, mate provisioning, or manipulative mutualism. Reciprocity, trade, status enhancement and group augmentation can delay benefits. When benefits are delayed or when food is exchanged for nonfood benefits, maintaining sharing can become more difficult because animals face discounting and …

"Oskar Blumenthal And The Lessing Theater In Berlin, 1888-1904", William Grange Prof. Dr. Jan 2004

"Oskar Blumenthal And The Lessing Theater In Berlin, 1888-1904", William Grange Prof. Dr.

Johnny Carson School of Theatre and Film: Faculty Publications and Creative Activity

Oskar Blumenthal (1852-1917) was Berlin’s most feared theatre critic in the early years of the new German Reich. He had the audacity of referring to Goethe as “an egghead” who had no understanding of what made plays effective for audiences, and in other critiques he ridiculed Kleist, Hebbel, and other “important” playwrights—prompting an adversary publicly to call him a “one-man lynch mob.” In the 1880s Blumenthal himself began writing plays, and he was so successful that many self-appointed cultural guardians accused him of damaging the German theatre beyond repair. His became the most frequently performed plays on any German stage …

The State Department Of Education's Role In Creating Safe Schools, Marilyn Grady, Jean Haar, Mary Ann Losh Jan 2004

The State Department Of Education's Role In Creating Safe Schools, Marilyn Grady, Jean Haar, Mary Ann Losh

Department of Educational Administration: Faculty Publications

The authority for public education in the United States does not stem from the Constitution, but rather is a "reserved" power remaining with the states. It originates from the Tenth Amendment, which reserves to the states those powers neither expressly given to the national govennnent nor denied to the state governments. However, most states have not exercised their authority for public education directly until recent decades. Education is a state function that is largely locally administered (Aikin, Linden, Noel, & Ray, 1992). Each state exercises its education function completely or in part through a state department of education that has …

Clark’S Nutcrackers (Nucifraga Columbiana) And The Effects Of Goal-Landmark Distance On Overshadowing, Aleida J. Goodyear, Alan Kamil Jan 2004

Clark’S Nutcrackers (Nucifraga Columbiana) And The Effects Of Goal-Landmark Distance On Overshadowing, Aleida J. Goodyear, Alan Kamil

Papers in Behavior in Biological Sciences

Three groups of Clark’s nutcrackers (Nucifraga columbiana) were trained to find a goal location defined by an array of 4 landmarks that varied in goal–landmark distance. The arrays for each group differed in the distance of the closest landmark and contained goal–landmark distances that were common across groups, allowing for the examination of the effects of both relative and absolute goal–landmark distance on encoding of a landmark array. All 3 groups readily learned the task and were subsequently tested in probe tests with only single landmarks from the array available. Search error in tests with single landmarks was …

Sociality And The Evolution Of Intelligence, Alan Kamil Jan 2004

Sociality And The Evolution Of Intelligence, Alan Kamil

Papers in Behavior in Biological Sciences

Two recently published studies provide important new data relevant to the evolution of human intelligence. Both studies of social behavior in baboons, Bergman et al. demonstrated that baboons use two criteria simultaneously to classify other troop members, and Silk et al. showed that highly social female baboons have higher reproductive success than less social females. Taken together, these studies provide strong evidence for the importance of social context in cognitive evolution.

The Geometry Of Foraging Patterns: Components Of Thoroughness In Random Searching, Alan B. Bond Jan 2004

The Geometry Of Foraging Patterns: Components Of Thoroughness In Random Searching, Alan B. Bond

Papers in Behavior in Biological Sciences

A Monte Carlo simulation of the movements of a randomly-searching predator was used to develop a novel geometrical measure, the "thoroughness" of the search, and to investigate the effects of meander, turn asymmetry, and path length. Thoroughness varied directly with the meander and the square of the asymmetry measure and remained relatively invariant with path length. The regularity of its relationship to the generating parameters of the search and the ease with which it may be estimated from field data recommend thoroughness for use in characterizing empirical search patterns and in testing for the occurrence of systematic searching.

A Defense Of The Causal Efficacy Of Dispositions, Jennifer Mckitrick Jan 2004

A Defense Of The Causal Efficacy Of Dispositions, Jennifer Mckitrick

Department of Philosophy: Faculty Publications

Disposition terms, such as 'cowardice,' 'fragility' and 'reactivity,' often appear in explanations. Sometimes we explain why a man ran away by saying that he was cowardly, or we explain why something broke by saying it was fragile. Scientific explanations of certain phenomena feature dispositional properties like instability, reactivity, and conductivity. And these look like causal explanations - they seem to provide information about the causal history of various events.

Philosophers such as Ned Block, Jaegwon Kim, Elizabeth Prior, Robert Pargetter, and Frank Jacksonl have suggested reasons for thinking that dispositions are causally inert. I call this the "Inert Dispositions View." …

Review Of The Opnet It Guru Software, Jeng-Chung Victor Chen Jan 2004

Review Of The Opnet It Guru Software, Jeng-Chung Victor Chen

Journal of International Technology and Information Management

The OPNET IT GURU has been in existence for years and designed to be used for the industry and the academics. The simulation software is now in version 10.0 and equipped with abundant features such as: modeling network topology and traffic, application impact assessment, and server capacity planning. The features of modeling network topology and traffic are ideal for network engineers to experiment different kinds of scenarios before implementation of any networks, which in turn could cost the organizations less on the IT budget. The application impact assessment is useful when measuring the end-to-end time of the deployed or to-be-deployed …

Recognition And Development Of Hope For South African Organizational Leaders, Fred Luthans, René Van Wyk, Fred Walumbwa Jan 2004

Recognition And Development Of Hope For South African Organizational Leaders, Fred Luthans, René Van Wyk, Fred Walumbwa

Department of Management: Faculty Publications

The significant challenges faced by South Africa at present are well known. How to deal with the problems from a political and economic perspective abound, but taking a psychological approach has been neglected. This paper proposes a positive approach to South African organizational leadership based on the psychological capacity of hope. After giving a brief background on the context surrounding South African organizations, the theory, research, and application of hope relevant to organizational leadership in the “Rainbow Nation” are presented and analyzed. Such an overlooked positive approach represented by hopeful organizational leaders seems needed at this juncture of South Africa’s …

Human, Social, And Now Positive Psychological Capital Management: Investing In People For Competitive Advantage, Fred Luthans, Carolyn M. Youssef Jan 2004

Human, Social, And Now Positive Psychological Capital Management: Investing In People For Competitive Advantage, Fred Luthans, Carolyn M. Youssef

Department of Management: Faculty Publications

There is growing evidence that human resources are crucial to organizational success, and may offer the best return on investment for sustainable competitive advantage. Jeffery Pfeffer’s extensive work, summarized in his book The Human Equation, discusses substantially supported but unfortunate findings that only about half of today’s organizations and their managers believe that human resources really do matter. Moreover, only half of those organizations act upon their beliefs beyond paying lip service to this vital resource. Few organizations have adopted high performance work practices, such as 360-degree feedback, pay-for-performance, self-managed teams, employee empowerment, and other human-oriented initiatives. Furthermore, Pfeffer shows …

Unlocking The Mask: A Look At The Process By Which Authentic Leaders Impact Follower Attitudes And Behaviors, Bruce Avolio, William L. Gardner, Fred Walumbwa, Fred Luthans, Douglas R. May Jan 2004

Unlocking The Mask: A Look At The Process By Which Authentic Leaders Impact Follower Attitudes And Behaviors, Bruce Avolio, William L. Gardner, Fred Walumbwa, Fred Luthans, Douglas R. May

Department of Management: Faculty Publications

The conceptual and empirical links between authentic leadership and follower attitudes, behaviors, and performance outcomes have not been fully developed. Although we have a number of articles developing the theory of authentic leadership and testing propositions that will appear in a forthcoming special issue of The Leadership Quarterly (Vol. 16, Issue 3, 2005), the focus of this article is to provide some of the initial foundation work for the broader theoretical framework of how authentic leaders influence follower attitudes, behaviors, and performance. Here, we draw from positive organizational behavior, trust, hope, emotion, identification, and identity theories to describe the processes …

Free Speech And Valuable Speech: Silence, Dante, And The 'Marketplace Of Ideas', James Boyd White Jan 2004

Free Speech And Valuable Speech: Silence, Dante, And The 'Marketplace Of Ideas', James Boyd White

Articles

This Essay is a slightly expanded version of the inaugural Mellinkoff Lecture in Law and Humanities, presented at the UCLA School of Law last April in honor of the memory of Professor David Mellinkoff, the distinguished author of ground-breaking work on the nature of legal language. It addresses four related questions. What is the nature of the kind of speech and expression that realizes most completely the human capacity for finding and expressing meaning? How does our own world of public speech measure up to that standard? How, indeed, does our own talk in the law measure up, especially our …

Threatening An Irrational Breach Of Contract, Oren Bar-Gill, Omri Ben-Shahar Jan 2004

Threatening An Irrational Breach Of Contract, Oren Bar-Gill, Omri Ben-Shahar

Articles

When circumstances surrounding the contract change, a party might consider breach a more attractive option than performance. Threatening breach, this party may induce the other party to modify the original agreement. The contract law doctrine of modification determines whether and when these modifications are enforceable. To promote social welfare as well as the interests of the threatened party, the law should enforce modifications if and only if the modification demand is backed by a credible threat to breach. This paper argues that credibility is not a function of pecuniary interests alone. A decision to breach can be motivated also by …
