Toward Mythos And Mythology: Applying A Feminist Critique To Legal Education To Effectuate A Socialization Of Both Sexes In Law School Classrooms, Pollybeth Proctor Jan 2004

Toward Mythos And Mythology: Applying A Feminist Critique To Legal Education To Effectuate A Socialization Of Both Sexes In Law School Classrooms, Pollybeth Proctor

Cardozo Journal of Equal Rights & Social Justice

The article critiques the current state of legal education and the legal profession, arguing that they suffer from a decline in ethical standards, public service, and empathy. It proposes a feminist-inspired reform agenda to address these issues by incorporating values such as collaboration, context, emotions, ethics, and empathy into legal training. The analysis highlights the limitations of traditional teaching methods, particularly the Socratic method, which fosters an adversarial and narrow approach to legal reasoning. The article advocates for a balanced approach that integrates both rational and emotional intelligence to prepare holistic practitioners who prioritize justice and service.

Supreme Court Narratives On Equality And Gender Discrimination In Employment: 1971-2002, Vicki Lens Jan 2004

Supreme Court Narratives On Equality And Gender Discrimination In Employment: 1971-2002, Vicki Lens

Cardozo Journal of Equal Rights & Social Justice

The article examines the Supreme Court's evolving approach to gender discrimination in the workplace, particularly during the 1970s and 1980s, as it grappled with the intersection of formal and substantive equality. The Court's decisions reflected the influence of the feminist movement and broader societal shifts, addressing issues such as pregnancy-related discrimination, sexual harassment, and workplace stereotypes. While the Court often invalidated discriminatory practices, its rulings also revealed tensions in balancing equal treatment with competing interests, such as military preparedness or employer liability. The analysis highlights how the Court's narrative on gender equality was shaped by legal doctrines, cultural values, and …

Women's Rights And Children's Rights: A Partnership With Benefits For Both, Jonathan Todres Jan 2004

Women's Rights And Children's Rights: A Partnership With Benefits For Both, Jonathan Todres

Cardozo Journal of Equal Rights & Social Justice

The article "Women's Rights and Children's Rights: A Partnership with Benefits for Both" by Jonathan Todres explores the interconnectedness of women's and children's rights, arguing that while separate treaties like CEDAW and CRC are beneficial, a holistic approach combining both frameworks is essential for effective protection. It emphasizes that addressing issues like child prostitution in Thailand requires leveraging both women's and children's rights to create comprehensive solutions.

The Myth Of Habitual Residence: Why American Courts Should Adopt The Delvoye Standard For Habitual Residence Under The Hague Convention On The Civil Aspects Of International Child Abduction, Stephen E. Schwartz Jan 2004

The Myth Of Habitual Residence: Why American Courts Should Adopt The Delvoye Standard For Habitual Residence Under The Hague Convention On The Civil Aspects Of International Child Abduction, Stephen E. Schwartz

Cardozo Journal of Equal Rights & Social Justice

The article critiques the challenges in determining "habitual residence" under the Hague Convention on the Civil Aspects of International Child Abduction (HCCAICA), particularly for neonates. It argues that existing standards, such as the settled purpose and Friedrich standards, are overly rigid and unsuitable for infants who cannot form intent. The Delvoye standard is proposed as a more flexible and age-appropriate solution, emphasizing mutual parental intent and adapting to the child's maturity. By adopting this standard, the article contends that courts can better align with HCCAICA's goals of preventing abduction, ensuring prompt returns, and reducing inconsistent rulings.

Loose Not The Floodgates, Benjamin J. Cooper Jan 2004

Loose Not The Floodgates, Benjamin J. Cooper

Cardozo Journal of Equal Rights & Social Justice

The article examines the implications of the Supreme Court's decision in Lawrence v. Texas, which struck down sodomy laws, arguing that while the ruling was necessary, it raises concerns about the broader regulation of sexual conduct outside marriage. The author contends that such laws, despite rare enforcement, serve societal functions, including protecting marriage and providing moral boundaries that deter harmful behavior, particularly among young people.

A Prisoner's Right To Transsexual Therapies: A Look At Brooks V. Berg, Linda D. Chin Jan 2004

A Prisoner's Right To Transsexual Therapies: A Look At Brooks V. Berg, Linda D. Chin

Cardozo Journal of Equal Rights & Social Justice

The note examines the legal and ethical implications of providing medical treatment, particularly gender reassignment surgery (GRS), to transgender prisoners under the Eighth Amendment, which prohibits cruel and unusual punishment. It argues that while courts have recognized the necessity of addressing gender dysphoria, the financial and logistical challenges of providing such treatments raise concerns about equity and resource allocation. The ruling in Brooks v. Berg highlights the tension between constitutional rights and the practical limitations of prison systems in meeting these needs.

It's Not All In My Head: The Harm Of Rape And The Prison Litigation Reform Act, Deborah M. Golden Jan 2004

It's Not All In My Head: The Harm Of Rape And The Prison Litigation Reform Act, Deborah M. Golden

Cardozo Journal of Equal Rights & Social Justice

The article argues that the Prison Litigation Reform Act (PLRA)'s requirement of a physical injury for prisoners to seek damages for mental or emotional harm creates a significant barrier for rape victims, particularly women, in pursuing justice. The author advocates for amending the PLRA to explicitly recognize rape as a compensable injury, ensuring that victims can seek redress without unnecessary procedural hurdles.

Challenging Dissent: The Ontology And Logic Of Lawrence V. Texas, Jami Weinstein, Tobyn Demarco Jan 2004

Challenging Dissent: The Ontology And Logic Of Lawrence V. Texas, Jami Weinstein, Tobyn Demarco

Cardozo Journal of Equal Rights & Social Justice

The article examines the Supreme Court's decision in Lawrence v. Texas, which invalidated a Texas antisodomy statute criminalizing homosexual conduct. The Court held that the statute failed rational basis review and rejected the promotion of majoritarian sexual morality as a legitimate state interest. The decision reflects a broader recognition of the fundamental right to make autonomous, private, consensual, adult sexual choices. The analysis critiques Justice Scalia's dissent, arguing that his fears about the end of morals legislation are unfounded and that laws based solely on moral disapproval lack a rational basis.

The Effectiveness Of Videotape Feedback In Sport: Examining Cognitions In A Self-Controlled Learning Environment, Justin Menickelli Jan 2004

The Effectiveness Of Videotape Feedback In Sport: Examining Cognitions In A Self-Controlled Learning Environment, Justin Menickelli

LSU Doctoral Dissertations

Providing videotape feedback (VTFB) as a form of knowledge of performance (KP) to learners is a common instructional tool in teaching and coaching. VTFB has attracted renewed attention and various “laundry lists” of recommendations (e.g., provide VTFB immediately following performance, use frequently, vary camera angles) on VTFB implementation (e.g., Franks & Maile, 1991; Trinity & Annesi, 1996). Furthermore, researchers have begun exploring the cognitive variables which serve to mediate the impact of VTFB (e.g., Hebert, Landin, & Menickelli, 1998; Menickelli, Landin, Grisham, & Hebert, 2000). Recent research has focused on two key issues: VTFB provided in a self-controlled learning environment …

Utilizing The Strengths Of Our Cultures: Therapy With Biracial Women And Girls, Lisa M. Edwards, Jennifer Teramoto Pedrotti Jan 2004

Utilizing The Strengths Of Our Cultures: Therapy With Biracial Women And Girls, Lisa M. Edwards, Jennifer Teramoto Pedrotti

College of Education Faculty Research and Publications

Historically, psychology has operated from a pathology-based perspective. In the last several years, however, efforts have been made to balance this view with an acknowledgement of individual strengths and assets. For biracial women and girls, this approach may be particularly useful. Through the utilization of several techniques, including solution-focused interventions and narrative approaches to treatment, therapists can empower their female biracial clients through development of their strengths.

Challenging Behaviors In Young Children: The Father's Role, Ann D. Burbach, Robert A. Fox, Bonnie C. Nicholson Jan 2004

Challenging Behaviors In Young Children: The Father's Role, Ann D. Burbach, Robert A. Fox, Bonnie C. Nicholson

College of Education Faculty Research and Publications

In this study, the authors examined the parenting practices, developmental expectations, and stress levels of 136 fathers and the challenging and prosocial behaviors of their 1- to 5-year-old children. In addition, the authors systematically addressed fathers' qualitative concerns about their parenting. The authors divided the participants into 4 groups and controlled for family socioeconomic status (SES) and the focus child's gender. Results showed a significantly higher use of corporal and verbal punishment and parenting stress among lower income fathers. Secondary analyses demonstrated a significant effect of paternal disciplinary practices that emphasized the frequent use of corporal and verbal punishment on …

Inter-An Evolving Installation, Lyman Landreth Edwards Jan 2004

Inter-An Evolving Installation, Lyman Landreth Edwards

LSU Master's Theses

Inter- An Evolving Installation is an interactive site specific installation designed and constructed in the School of Art Gallery at Louisiana State University. This installation explores the interplay between the ideas of order and change by presenting the visitor with a very structured environment that by nature of its design and materials changes with each footstep. Sand, granulated carbon, and clay cover the floor of the gallery in a geometric pattern inspired by the Fibonacci Sequence and Buddhist sand paintings. As a person enters the installation it immediately changes from its original design simply through disturbance by the visitor's footsteps …

On Becoming Women: Adolescent Female Muslim Refugees Negotiating Their Identities In The United States, Kathleen Bell Mckenzie Jan 2004

On Becoming Women: Adolescent Female Muslim Refugees Negotiating Their Identities In The United States, Kathleen Bell Mckenzie

UNF Graduate Theses and Dissertations

The United States is becoming more diverse; numerous immigrants and refugees enter every year. Among the newer groups are those practicing the Muslim religion.

This qualitative research focused on the identity formation process of six adolescent female Muslim refugees from Afghanistan. Based on Erikson's paradigm of psycho-social development and Marcia's modifications to that theory, I used semi-structured interviews to understand how the participants negotiated their identities in the context of their families, the public school, and the community.

This cohort appeared to exist within a circumscribed Afghan community, retaining significant parts of their culture, traditions, and roles. The exception to …

Paravertebral Nerve Block For Pain Management Of Nissen Fundoplication Surgery, Shelly M. Brock Jan 2004

Paravertebral Nerve Block For Pain Management Of Nissen Fundoplication Surgery, Shelly M. Brock

UNF Graduate Theses and Dissertations

Providing comfort is a fundamental nursing responsibility. Unrelieved postoperative pain has adverse physiologic and psychologic effects that contribute to prolonged hospital admissions and significant discomfort to patients. Opioids are standard methods of postoperative analgesia for many surgical procedures. Unfortunately, the use of opioids is associated with side effects such as nausea and vomiting, urinary retention, ileus and respiratory depression. These side effects, with the added problem of inadequate pain control, result in patient dissatisfaction with surgical procedures.

Paravertebral nerve block (PVB) is a regional anesthetic technique that has been shown to result in opioid sparing in many procedures including breast …

Firm Growth As A Research Issue, Thomas Cooney, Pasi Malinen Jan 2004

Firm Growth As A Research Issue, Thomas Cooney, Pasi Malinen

Articles

A key issue of debate regarding small firms over the past two decades has focused on the ability of small firms to engender growth, particularly fast-growth firms. Many commentators believe that it is a minimal group of enterprises germinating rapidly that provide the real jobs and therefore, that it is these firms which policy makers should be converging upon. But how can small businesses be transformed into fast-growth firms? As Tuck and Hamilton (1993) noted, despite the magnitude of research on small firms, especially regarding growth, researchers are still uncertain why some firms grow and others do not when originating …

Traumatic Brain Injury: Cognitive Rehabilitation And Supported Employment, Randon Mckibbin

Occupational Therapy Capstones

A traumatic brain injury (TBI) is an injury to the brain, which results in dysfunction in an individual’s physical, cognitive, and pychosocial functioning. Currently, information on the effectiveness of therapeutic interventions for clients post- TBI is limited. Research has been conducted to develop overall recommendations for clinical practice with this population. It is of interest to the occupational therapy community and the clients that they serve to have a description of effective occupationbased activities, based on current literature, that also consider the functional gains made by clients overtime. This protocol considers the functional gains of the TBI client with a …
