Is Anne Frank At Last Taken Seriously As A Writer?, Laureen Nussbaum Jan 2004

Is Anne Frank At Last Taken Seriously As A Writer?, Laureen Nussbaum

World Languages and Literatures Faculty Publications and Presentations

In 1998, the emergence of five unknown pages written by Anne Frank once again focused attention on her diary. Despite the fact that the Netherlands Institute for War Documentation had unravelled the history of Anne's diary in "The Critical Edition" (Dutch 1986, 2001; English 1989, 2003) and had printed all available texts in parallel, readers were confused. This was partly due to Mirjam Pressler’s so-called ‘Definitive Edition’ of 1995 in which the strands, that had been so carefully separated in the Critical Edition, were once again tangled. A brief review of the different versions of Anne Frank's journal may be …

An Investigation Of Meaning In Clinical Music Improvisation With Troubled Adolescents, Susan Gardstrom Jan 2004

An Investigation Of Meaning In Clinical Music Improvisation With Troubled Adolescents, Susan Gardstrom

Department of Music Faculty Publications

The purpose of this qualitative study was to investigate meaning-making in clinical music improvisation with troubled adolescents. Participants were six youth from two partial hospitalization programs. These individuals, ranging in age from 12 to 17, had severe behavioral and emotional disturbances. Each participant was involved in approximately five improvisation sessions with the researcher. The adolescents were asked to create nonreferential and referential instrumental improvisations, both alone and with the researcher. After each improvisation, the participants and the researcher listened to and/or talked about the piece. Selected improvisations were then analyzed using Bruscia’s (1987) Improvisation Assessment Profiles (IAPs), in order to …

The Tangled Web Of Diversity And Democracy, George J. Sanchez Jan 2004

The Tangled Web Of Diversity And Democracy, George J. Sanchez

Imagining America

George J. Sanchez, professor of History and American Studies and Ethnicity, University of Southern California, sets forth an important argument about the two pathways to democracy in U.S. higher education: first, engagement by the university through connections of faculty, staff, and students with specific communities and publics; and second, access to the university for members of all communities and publics through inclusive admissions and hiring policies. He challenges our understanding of how engagement and diversity are connected—and how, increasingly, they are becoming disconnected.

The responses of Maria Eugenia Cotera, assistant professor of Latino Studies, Program in American Culture and assistant …

Revisioning The Oversight Of Research Involving Humans In Canada, Jocelyn Downie, Fiona Mcdonald Jan 2004

Revisioning The Oversight Of Research Involving Humans In Canada, Jocelyn Downie, Fiona Mcdonald

Articles, Book Chapters, & Popular Press

When individuals are asked to participate in research they should be able to assume that the research "is well designed and well executed, that the investigator is competent to undertake the study, that the study will be run efficiently, safely, and ethically and that the deviations from good practice will be identified and corrected." The central question that we focus on in this paper is whether the governance mechanisms that are currently in place to regulate the conduct of research involving humans are adequate to enable those who are approached to participate in research to make these assumptions. This review …

Cognitive Impact Of Interactive Multimedia, Yanko F. Michea, Jan 2004

Cognitive Impact Of Interactive Multimedia, Yanko F. Michea,

Technology has been gradually introduced in heath education. One of the most attractive features of this technology-based education is the use of multimedia. In this article we explore the research evidence about the role that multimedia is playing in education. From that analysis we describe the most relevant features of this technology to prepare a common ground of discussion about the evaluation of its impact on educational outcomes. As part of this analysis, we organize current research evidence on the use of technology in medical education, distinguishing diverse variables involved in the process, like knowledge (declarative, procedural), learner characteristics, curricular …

They also examine the role of, and choices presented to, an attorney working in a community and for a local community group.

Catholic Clergy Sexual Abuse Meets The Civil Law, Thomas P. Doyle, Stephen C. Rubino Jan 2004

Catholic Clergy Sexual Abuse Meets The Civil Law, Thomas P. Doyle, Stephen C. Rubino

Fordham Urban Law Journal

This article examines the sexual abuse scandal that has racked the Roman Catholic Church since 1984, focusing in particular on how the Church's authority structure has responded and how the American civil court system has been used by victims to seek redress. It gives an overview of the Church's legal system, Canon Law, and the way that system and the Church leadership have dealt (or failed to deal) with the problem of sexual abuse. Part II takes a "long look back" to the history of sexual abuse and Canon Law before 1984. Part III details how the Church has dealt …

Casey And Its Impact On Abortion Regulation, Michael F. Moses Jan 2004

Casey And Its Impact On Abortion Regulation, Michael F. Moses

Fordham Urban Law Journal

Given the Supreme Court's shift from a strict scrutiny standard to an "undue burden" standard in Planned Parenthood v. Casey, this article advocates for application of the standard in a way that is deferential to state legislatures. The author finds a number of problems with the holding in Casey for which it seeks judicial and legislative action: the undue burden standard is vague; it is unclear whether the burden should be upon everyone or "some people"; and the holding allows court to strike laws that have not gone into effect, therefore evidence of their impact is "speculative."

Broadening The Holistic Mindset: Incorporating Collateral Consequences And Reenty Into Criminal Defense Lawyering, Michael Pinard Jan 2004

Broadening The Holistic Mindset: Incorporating Collateral Consequences And Reenty Into Criminal Defense Lawyering, Michael Pinard

Fordham Urban Law Journal

Over the past two decades, public defender offices across the country have broadened the range of defense services provided to indigent clients. These expanded services, some of which involve representing clients on related non-criminal matters such as housing and public benefits, are included in what is now commonly referred to as "holistic representation."' This form of representation strives to encompass the various underlying issues that often lead to clients’ experiences with the criminal justice system, with the aim of addressing those circumstances and preventing future criminal involvement. Holistic representation signals a paradigmatic shift in defense philosophy and ideology and has …

The Adjudication Of Minor Offenses In New York City, Ian Weinstein Jan 2004

The Adjudication Of Minor Offenses In New York City, Ian Weinstein

Fordham Urban Law Journal

American criminal justice is founded on overcriminalization and discretion. Our legislatures have long criminalized much more conduct than can be effectively sanctioned. American police and prosecutors have been granted virtually unreviewable authority (discretion) to allocate investigative and prosecutorial resources. Minor crimes absorb the bulk of our ordinary, local enforcement efforts and there is an endless supply of minor crime, which may be pursued. With minor offenses, discretion is critical at all phases. This article argues that criminal courts, where ninety percent of all cases are heard, could benefit from reform. The author argues for the development of the record so …

Gender, Class And Generational Contexts For Consumption In Contemporary Chile, Joel Stillerman Jan 2004

Gender, Class And Generational Contexts For Consumption In Contemporary Chile, Joel Stillerman

Peer Reviewed Articles

In contrast to common perceptions that individuals’ consumption choices are primarily motivated by their search for status or personal gratification, this article contends that gender, family and class significantly shape these decisions. The study integrates discussions of class and consumption with analyses of family monetary allocation and adaptive strategies to analyze interviews with working-class couples in Santiago, Chile. I found that men exercised overt and subtle forms of control over family monetary allocation, spending choices and earning strategies; adults’ perceived obligations towards children and elderly parents shaped their consumption decisions; and couples’ class-based perceptions of their limited financial resources led …
