Personality Characteristics Of Bulimic Behavior In College Women Analyzed With The Myers-Briggs Type Indicator, Lori Lyn Anderson
Personality Characteristics Of Bulimic Behavior In College Women Analyzed With The Myers-Briggs Type Indicator, Lori Lyn Anderson
Doctoral Dissertations and Projects
Eating disorders are a growing phenomenon in today's society, and adolescent women are prime candidates for this disorder. The present research study is designed to analyze bulimic behavior in college age women by administrating the Eating Disorder Inventory- 2 (Gamer, 1991), specifically focusing on the bulimia sub scale of this self-reported inventory. The purpose of the study is to measure specialized temperamental characteristics of persons demonstrating bulimic behavior as analyzed using the Myers Briggs Type Indicator (Myers-Briggs & McCaulley, 1986). The researcher surveyed 221 women from psychology classes at a private Midwest university, and each woman completed both the Eating …
Resolving Automatic Prepositional Phrase Attachments By Non-Statistical Means, Deryle W. Lonsdale, Michael B. Manookin
Resolving Automatic Prepositional Phrase Attachments By Non-Statistical Means, Deryle W. Lonsdale, Michael B. Manookin
Faculty Publications
Prepositional-phrase attachment is a topic of active research in the field of computational linguistics. Properly attaching prepositional phrases to their pertinent constituent proves straightforward for humans, but inferring these attachments in a cognitive modeling system becomes difficult. For example, in the sentence, ‘Ralph threw the frisbee to John,’ the prepositional phrase ‘to John’ will attach to the verb phrase ‘threw’. In another example, ‘Joe saw the dog with fur,’ the prepositional phrase ‘with fur’ will attach directly to the noun phrase ‘the dog.’ Humans would have little difficulty resolving these examples, but for computers this would be difficult.

Teaching Problem-Solving Lawyering: An Exchange Of Ideas, Mark Neal Aaronson, Stefan H. Krieger
Hofstra Law Faculty Scholarship
In the last issue of the Clinical Law Review, StefanKrieger argues that clinical law teachers who emphasize problem-solving approaches to lawyering incorrectly downplay as a necessary prerequisite to learning effective legal practice the significance of domain knowledge, which he mainly identifies as knowledge about legal doctrine(FN1) Among the writings on clinical law teaching criticized by Krieger are those of Mark Aaronson, who has articulated as a teaching goal helping students learn how to improve their practical judgment in lawyering, which he describes as a process of deliberation whose most prominent features are a contextual tailoring of knowledge, a dialogic form …
Domain Knowledge And The Teaching Of Creative Legal Problem Solving, Stefan H. Krieger
Domain Knowledge And The Teaching Of Creative Legal Problem Solving, Stefan H. Krieger
Hofstra Law Faculty Scholarship
This article explores the relationship between students' knowledge of underlying legal doctrine and their ability to learn effective methods of practice in law school skills courses. One of the primary goals of skills training in law school, especially clinical legal education, is to teach students how to apply what they have learned in doctrinal courses in the “real world.” While much has been written about training students in proper methods of practice and problem solving in skills courses, little attention has been paid to the significance of doctrinal knowledge to this training. Reviewing recent cognitive psychology research on the development …

Better Foreground Segmentation Through Graph Cuts, Nicholas Howe, Alexandra Deschamps
Better Foreground Segmentation Through Graph Cuts, Nicholas Howe, Alexandra Deschamps
Computer Science: Faculty Publications
For many tracking and surveillance applications, background subtraction provides an effective means of segmenting objects moving in front of a static background. Researchers have traditionally used combinations of morphological operations to remove the noise inherent in the background-subtracted result. Such techniques can effectively isolate foreground objects, but tend to lose fidelity around the borders of the segmentation, especially for noisy input. This paper explores the use of a minimum graph cut algorithm to segment the foreground, resulting in qualitatively and quantitiatively cleaner segmentations. Experiments on both artificial and real data show that the graphbased method reduces the error around segmented …

This Essay is a slightly expanded version of the inaugural Mellinkoff Lecture in Law and Humanities, presented at the UCLA School of Law last April in honor of the memory of Professor David Mellinkoff, the distinguished author of ground-breaking work on the nature of legal language. It addresses four related questions. What is the nature of the kind of speech and expression that realizes most completely the human capacity for finding and expressing meaning? How does our own world of public speech measure up to that standard? How, indeed, does our own talk in the law measure up, especially our …
What Do You Mean, Rhetoric Is Epistemic?, William D. Harpine
What Do You Mean, Rhetoric Is Epistemic?, William D. Harpine
Faculty Publications
The thesis that rhetoric is epistemic has gained widespread acceptance and has influenced rhetorical theory. The thesis suggests that argumentative justification in rhetorical contexts is fundamentally epistemic. Unfortunately, however, much of the literature developing the thesis has employed vague or inconsistent definitions of key terms, resulting in theoretical errors and needless complications. This essay clarifies the definitions of “rhetoric,” “knowledge,” and “certainty,” showing how the notion that rhetoric is epistemic might be developed in a clearer and more useful way.

Genung’S Theory Of Persuasion: A Literary Theory Of Oratory Of Late Nineteenth-Century America, William D. Harpine

John Genung’s late nineteenth century rhetoric textbooks, although founded on an eighteenth century model of Scottish composition, present an original conception of oratory. Genung’s theory breaks free of the classical models and lays out the path to be followed during the development of speech studies among American rhetoricians of the early twentieth century.

Labor And Employment Law In Two Transitional Decades, Theodore J. St. Antoine
Labor And Employment Law In Two Transitional Decades, Theodore J. St. Antoine
Articles
Labor law became labor and employment law during the past several decades. The connotation of "labor law" is the regulation of union-management relations and that was the focus from the 1930s through the 1950s. In turn, voluntary collective bargaining was supposed to be the method best suited for setting the terms and conditions of employment for the nation's work force. Since the 1960s, however, the trend has been toward more governmental intervention to ensure nondiscrimination, safety and health, pensions and other fringe benefits, and so on. "Employment law" is now the term for the direct federal or state regulation of …

As my colleague James Boyd White has observed, It may look as though we are all doing the same thing, as we huddle over our typewriters or computers, producing work called articles or books, but we are in fact often doing very different things, and I think it is important to recognize and value these differences, in ourselves and in others. There are not only differences in what we write but in whom it is that we write for. Unlike Professor White,2 I usually write as professional to professional. Again, unlike Professor White,3 I am fairly comfortable with "the voice …
'Agreeing To Disagree': Filling Gaps In Deliberately Incomplete Contracts, Omri Ben-Shahar
'Agreeing To Disagree': Filling Gaps In Deliberately Incomplete Contracts, Omri Ben-Shahar
Articles
Incomplete contracts have always been viewed as raising the following challenge for contract law: does the incompleteness-or, "indefiniteness," as it is usually called-rise to such a level that renders the agreement legally unenforceable? When the indefiniteness concerns important terms, it is presumed that the parties have not reached an agreement to which they intend to be bound. This "fundamental policy" is the upshot of the view that "contracts should be made by the parties, not by the courts."' When, in contrast, the indefiniteness concerns less important terms, courts supplement the agreement with gap fillers and enforce the supplemented contract.

Threatening An Irrational Breach Of Contract, Oren Bar-Gill, Omri Ben-Shahar
Articles
When circumstances surrounding the contract change, a party might consider breach a more attractive option than performance. Threatening breach, this party may induce the other party to modify the original agreement. The contract law doctrine of modification determines whether and when these modifications are enforceable. To promote social welfare as well as the interests of the threatened party, the law should enforce modifications if and only if the modification demand is backed by a credible threat to breach. This paper argues that credibility is not a function of pecuniary interests alone. A decision to breach can be motivated also by …

Obvious To Whom? Evaluating Inventions From The Perspective Of Phosita, Rebecca S. Eisenberg
Articles
In this Article, I consider the possibility of giving the USPTO input from currently active technological practitioners in evaluating the obviousness of claimed inventions. Such input could potentially serve three useful functions. First, it could improve the accuracy of USPTO decisionmaking by providing access to the perspective of actual practitioners as to the obviousness of inventions from the perspective of the hypothetical PHOSITA. Second, it could help the USPTO document the evidentiary basis for rejections that rest in part upon tacit knowledge within technological communities. Third, it could provide a quality control mechanism that would improve the credibility of USPTO …

Copyright And Information Theory: Toward An Alternative Model Of Authorship, Alan L. Durham

Both literary scholars and students of copyright law have challenged the romantic model of authorship a model emphasizing individual genius and creation ex nihilo Authorship they argue is actually a collaborative effort Authors assemble their works from the fragments of their cultural environment transforming as much as creating Copyright law however still champions the rights of authors and it requires a coherent theory of what authorship is An alternative to the romantic model of authorship can be found in information theory a branch of mathematics dealing at a very fundamental level with all forms of communication Authorship could be defined …

Shophouse: A Mixed Use Building Type, Tung Vy Tran
Master's Projects
For the last half of the century, it has been obvious that the most popular building type built in America is the single-family house. Effectively ingrained in many as the preferred habitat style, this building type is the main appeal in the idealized American dream of a suburban house with white picket fence. Architects, urban planners, designers. writers and even some citizens understand this dream is also the epitome of sprawl. Driven by capitalistic policies and the apathetic media that often encourage wasteful consumptions and wanton disregard for the environment, sprawl is undoubtedly a complex problem to solve. In city …

This qualitative study participates in this ongoing scholarly conversation regarding the value of Catholic schools in the life ministry of the Catholic Church. By examining the understanding that lay teachers have of their responsibility to the Catholic identity and the faith formation of students in Catholic schools as articulated in the literature of leadership of the Catholic Church, this study examines some of the ways that lay teachers help maintain the Catholic identity of the school and how these teachers engage in the religious mission of Catholic schools. This qualitative study was purposely designed to engage and invite the 58 …

Do Recent Data From The Seychelles Islands Alter The Conclusions Of The Nrc Report On The Toxicological Effects Of Methylmercury?, Alan H. Stern, Joseph L. Jacobson, Louise Ryan, Thomas A. Burke
Wayne State University Associated BioMed Central Scholarship
Abstract
In 2000, the National Research Council (NRC), an arm of the National Academy of Sciences, released a report entitled, "Toxicological Effects of Methylmercury." The overall conclusion of that report was that, at levels of exposure in some fish- and marine mammal-consuming communities (including those in the Faroe Islands and New Zealand), subtle but significant adverse effects on neuropsychological development were occurring as a result of in utero exposure. Since the release of that report, there has been continuing discussion of the public health relevance of current levels of exposure to Methylmercury. Much of this discussion has been linked to …
