Multiple International Judicial Forums: A Reflection Of The Growing Strength Of International Law Or Its Fragmentation?, Pemmaraju Sreenivasa Rao Jan 2004

Multiple International Judicial Forums: A Reflection Of The Growing Strength Of International Law Or Its Fragmentation?, Pemmaraju Sreenivasa Rao

Michigan Journal of International Law

The main thrust of this presentation is to suggest that the creation of multiple international judicial tribunals is a function of the ever-expanding nature of international law and that the creation of such tribunals is a sign of the growing maturity of international law. While it is admitted that these tribunals have to be sensitive to the needs of promoting the unity and integrity of international law, a brief look at the available evidence of their functioning so far has revealed no cause for concern of fragmentation. The author will look specifically at the working of the International Tribunal for …

Frazier Polymetis: Cold Mountain And The Odyssey, Emily A. Mcdermott Jan 2004

Frazier Polymetis: Cold Mountain And The Odyssey, Emily A. Mcdermott

Classics & Religious Studies Faculty Publication Series

Ever since its appearance in 1997, Charles Frazier’s novel, Cold Mountain, has been billed as a latter-day Odyssey. Separate unattributed book notes on the world wide web speak of its protagonist’s “dangerous odyssey” and his “odyssey through the devastated landscape of the soon-to-be-defeated South.” One reviewer styles the novel "a Confederate deserter's homeward odyssey"; another characterizes it as having “reset much of the 'Odyssey' in 19th-century America.” While such assertion of parallelism between the novel and Homer’s epic is widespread, it also tends to remain general and relatively unadorned. It evidently rests on such typically odyssean plot elements …

The Changing Character Of Sovereignty In International Law And International Relations, Winston P. Nagan, Craig Hammer Jan 2004

The Changing Character Of Sovereignty In International Law And International Relations, Winston P. Nagan, Craig Hammer

UF Law Faculty Publications

This Article makes observations on the concept of sovereignty; we suggest that the concept be studied using the contextual mapping method articulated by the New Haven School of jurisprudence. We observe tension in applying the concept to developing and developed states, and explore the possibility that sovereignty can be abused. We propose state typologies to explore the concept further and to scrutinize the accommodations of authority and control.

Racism, Genocide, And Mass Murder: Toward A Legal Theory About Group Deprivations, Winston P. Nagan, Vivile F. Rodin Jan 2004

Racism, Genocide, And Mass Murder: Toward A Legal Theory About Group Deprivations, Winston P. Nagan, Vivile F. Rodin

UF Law Faculty Publications

This Article is focused on a specific and important issue: the relationship of law to the social reality of group deprivations. From this primary issue, several important sub-issues are generated having a real and substantial impact upon the role of law in the management of group deprivations at every level of social organization (local, national, regional, and international). To focus on the social reality of group deprivations requires a critical starting point. This starting point is determining whether we are adequately describing or assaying the etiology of the human personality types and self-systems that are normally characterized by feelings, sentiments, …

Race, Gender, And Work/Family Policy, Nancy E. Dowd Jan 2004

Race, Gender, And Work/Family Policy, Nancy E. Dowd

UF Law Faculty Publications

Family leave is not an end in itself, but rather is part of a much bigger picture: work/family policy. The goal of work/family policy is to achieve a good society by supporting families. Ideally, families enable children to develop to their fullest capacity and to contribute to their communities and society. Public rhetoric in the United States has always strongly supported families. Our policies, however, have not. In the area of work/family policy, the United States continues to lag behind every other advanced industrialized country, as well as many developing countries, in the degree to which we provide affirmative support …

Piercing The Prison Uniform Of Invisibility For Black Female Inmates, Michelle S. Jacobs Jan 2004

Piercing The Prison Uniform Of Invisibility For Black Female Inmates, Michelle S. Jacobs

UF Law Faculty Publications

In Inner Lives: Voices of African American Women In Prison, Professor Paula Johnson has written about the most invisible of incarcerated women — incarcerated African American women. The number of women incarcerated in the United States increased by seventy-five percent between 1986 and 1991. Of these women, a disproportionate number are black women. The percentages vary by region and by the nature of institution (county jail, state prison or federal facility), but the bottom line remains the same. In every instance, black women are incarcerated at rates disproportionate to their percentage in the general population. In Inner Lives, …

A Good Old Habit, Or Just An Old One? Preferential Tax Treatment For Reorganizations, Yariv Brauner Jan 2004

A Good Old Habit, Or Just An Old One? Preferential Tax Treatment For Reorganizations, Yariv Brauner

UF Law Faculty Publications

This article proposes to repeal the preferential tax treatment of certain merger and acquisition transactions known as "reorganizations," and tax them like all other sales or exchanges. In the last 80 years this preference has been a cornerstone of our tax system. It is also one of the most stable rules in the tax code. Nevertheless, its normative justification is weak, and has never been rigorously debated in the legal literature. This article rejects the stated rationale for this rules - that such transactions trigger insufficient realization and therefore it is both unfair and impractical to currently tax them. It …

Writing Checks Or Righting Wrongs: Election Funding And The Tort Decisions Of The Ohio Supreme Court, James T. O'Reilly Jan 2004

Writing Checks Or Righting Wrongs: Election Funding And The Tort Decisions Of The Ohio Supreme Court, James T. O'Reilly

Cleveland State Law Review

This paper will try to address the court's present and future course in tort law, with particular focus on products liability, malpractice, and employer tort liability. These are the most intriguing segments of modern tort law in Ohio. The paper concludes that stare decisis and the precedential accretion of the common law no longer seem to matter to the Ohio Supreme Court. Instead, the cacophony of a fractured court has imperiled predictability and imperiled the court's national reputation. Instead, the topic of a prospective justice's view of the tort system is unfortunately an early and frequent conversation in recruitment, selection, …

Lingering Questions Of A Supreme Court Decision: The Confines Of The Psychotherapist-Patient Privilege, Jennifer L. Odrobina Jan 2004

Lingering Questions Of A Supreme Court Decision: The Confines Of The Psychotherapist-Patient Privilege, Jennifer L. Odrobina

Cleveland State Law Review

The United States Supreme Court "in light of [its] reason and experience"' has recognized a psychotherapist-patient privilege. The Court has, however, left lingering questions for the lower courts to determine regarding possible exceptions to the privilege. The lower courts have used their own reason and experience to develop exceptions to the privilege. Such exceptions include the crime-fraud exception, waiver exception, and the dangerous-patient exception. Inevitably other exceptions will follow. The Supreme Court should recognize a dangerous patient exception to the psychotherapist-patient privilege to allow a psychotherapist to testify in court when there is "a serious threat of harm to the …

Editorial: Silence Under Erasure—The Silence Of Silence, Jan Jagodzinski, Bill Wightman Jan 2004

Editorial: Silence Under Erasure—The Silence Of Silence, Jan Jagodzinski, Bill Wightman

Journal of Social Theory in Art Education

Author Guagtiumi's cover design speaks eloquently to the theme of this year's journal: silence. The fractal spaces of a complex topological landscape with various intensities of lines that compress and depress throughout are cut and interpenetrated by blank spaces whose sinuous curves stake out a depthless territory that we know nothing about. The "spine" of the cover becomes an artificial divide where the two sides butt together, as if some giant fault tine had been intentionally created. Occasionally a translucent film grows over the force and intensity of these tines, both masking and holding them together to neutralize their force. …

African Art: What And To Whom? Anxieties, Certainties, Mythologies, David Gall Jan 2004

African Art: What And To Whom? Anxieties, Certainties, Mythologies, David Gall

Journal of Social Theory in Art Education

It has taken nearly a whole century to publish two books on African art that recognize the continent as a complex cultural unit within which there is diversity, A History of Art in Africa (Blackmun Visona, M et al, 2001) and Africa, The Art of a Continent (Phillips, T. 1995). Why it taken so long far North and East Africa past and present to be included in texts labeled African art? Why were they not recognized as African? India, also a place of diversity of race and ethnicity, has not similarly treated. The assumptions underlying the norms a representation of …

Imaged Voices—Envisioned Landscapes: Storylines Of Information-Age Girls And Young Women, Marjorie Manifold Jan 2004

Imaged Voices—Envisioned Landscapes: Storylines Of Information-Age Girls And Young Women, Marjorie Manifold

Journal of Social Theory in Art Education

In Information Age societies around the world, adolescents are storylining-that is, creating and sharing their own stories and images of who they are and how they would like to be in the world. The youth meet in real or cyber spaces to plan, write, and illustrate stories that incorporate either originally conceived characters or adapt characters from published sources. Insofar as these young people intimately identify with the characters of their stories, story lining may be understood as a kind of socio-aesthetic play. By projecting pieces of themselves into the fictive characters of the collaborative story, they are practicing, correcting, …

Questioning Fantasies Of Popular ‘Resistance:’ Democratice Populism And Radical Politics In Visual Cultural Studies, Jan Jagodzinski Jan 2004

Questioning Fantasies Of Popular ‘Resistance:’ Democratice Populism And Radical Politics In Visual Cultural Studies, Jan Jagodzinski

Journal of Social Theory in Art Education

This is the second part to a complementary essay that appeared in JSTAE (jagodzinski 2003). It was also written in 1998 and is being revisited some six years latter given that the cultural landscape in art education is slowly turning its sights towards visual cultural studies, a position JSTAE has been exploring for almost a quarter of a century if we take into account our earlier "Bulletin" publication, which began in 1980. The theme of silence arises, for me, a question of what is a radical politics at the tum of the century? It seems that the only game in …

Attitudinal Changes That Occur As A Result Of High School Transition Classes, K. K. Bradshaw Jan 2004

Attitudinal Changes That Occur As A Result Of High School Transition Classes, K. K. Bradshaw

Theses and Dissertations

The purpose of this study was to determine if high school transition classes alter student attitudes toward school, their peers, teachers/administrators or level of parental involvement. A large suburban high school class was administered a Likert Scale pre and posttest at the beginning of the course and at its conclusion. In addition to the pretest/posttest survey, students were grouped into six categories depending on their entering high school grade point averages. This delineation sought to ascertain if academic achievement either exacerbated or enhanced student perceptual indices on the survey. The data analyzed used an ANCOVA technique. Students were divided into …

A Comparative Study Of Parental Demographics For Students In Open-Enrollment Charter Schools And Public Schools In Arkansas, Deborah Yeldell Mcafee Jan 2004

A Comparative Study Of Parental Demographics For Students In Open-Enrollment Charter Schools And Public Schools In Arkansas, Deborah Yeldell Mcafee

Theses and Dissertations

The purpose of this study was designed to determine if there was a statistically significant difference based on parental demographics, and parental factors, of students enrolled in Arkansas public schools and Arkansas open-enrollment charter schools. Four Arkansas open-enrollment charter schools, chartered prior to the 2004-2005 school year, and four public schools, within close proximity, were surveyed. The information was disaggregated into parent demographics of age, gender, income, number of children attending school in the home, educational level, marital status and distance between the home and school. Forty parental factors were categorized into four headings: policy and procedures, career, academics and …

Student Perceptions Of Concomitant Learnings Of East Lab In A Small, Rural Arkansas School District, Judith Lane Bynum

Theses and Dissertations

The purpose of this research was to study the evidence of concomitant learnings that are a result of a technology-rich, project-based learning environment; the empowerment of the student by these learnings; and their worth in better preparing high school students for college success. This qualitative, phenomenological study used interviews of present and past EAST Lab students from a small, rural Arkansas school district as its data. The interview questions focused on comparison and contrast of the learning environments of the students' classes, affective and cognitive knowledge gained from these environments; and student opinions concerning the influence of the EAST experience …

Robotics Technologies For K-8 Educators: A Semiotic Approach For Instructional Design, Antoinette P. Bruciati Jan 2004

Robotics Technologies For K-8 Educators: A Semiotic Approach For Instructional Design, Antoinette P. Bruciati

Education Faculty Publications

Robotics engineering courses have provided undergraduate computer science students with opportunities for designing and programming simulations of robotic tasks. In contrast, many teacher preparation programs have lacked courses in this area. Educators who have not gained a conceptual understanding of computer programming may not possess the skills that would have enabled them to successfully integrate robotics technologies into their K-8 curriculum.

Recent technological advances have provided a viable means of approaching this problem. Several icon-orientated robotics technologies have been identified that allow educators to master computer programming concepts through a simplified graphical user interface (GUI) design.

This investigation addressed the …
