An Examination Of The Role Of Local Authorities In Local Sport Provision And The Implications For Their Role In The Local Sports Partnership Initiative, Dara Sugrue

Theses

The broad aim of this study is to analyse the current role of Irish local authorities in relation to the provision of local sport. Particular emphasis is placed on the potential contribution of Irish local authorities to the Local Sports Partnership initiative. The research considers how the local authorities need to evolve if their role within such a partnership arrangement is to be optimised.

A variety of methods were employed to analyse the prevailing and future role of the local authorities in relation to local sports development. These included a questionnaire, semi-structured interviews, analysis of certain local authority documentation and …

Assessing The Constitutionality Of Laws That Are Both Content Based And Content Neutral, Wilson R. Huhn Jan 2004

Assessing The Constitutionality Of Laws That Are Both Content Based And Content Neutral, Wilson R. Huhn

Akron Law Faculty Publications

Such a multi-faceted analysis cannot be conflated into two dimensions. Whatever the allure of absolute doctrines, it is just too simple to declare expression "protected" or "unprotected" or to proclaim a regulation "content-based" or "content-neutral." John Paul Stevens (1992)

American legal doctrine evolved from a formalistic categorical approach that dominated legal thinking during the nineteenth century to a realistic balancing approach that developed over the course of the twentieth century. A similar process is now occurring in the constitutional doctrine governing freedom of expression-a process that may culminate in the adoption of what United States Supreme Court Justice John Paul …

A Characterization Of Hybridized Mixed Methods For Second Order Elliptic Problems, Bernardo Cockburn, Jay Gopalakrishnan Jan 2004

A Characterization Of Hybridized Mixed Methods For Second Order Elliptic Problems, Bernardo Cockburn, Jay Gopalakrishnan

Mathematics and Statistics Faculty Publications and Presentations

In this paper, we give a new characterization of the approximate solution given by hybridized mixed methods for second order self-adjoint elliptic problems. We apply this characterization to obtain an explicit formula for the entries of the matrix equation for the Lagrange multiplier unknowns resulting from hybridization. We also obtain necessary and sufficient conditions under which the multipliers of the Raviart–Thomas and the Brezzi–Douglas–Marini methods of similar order are identical.

A Survey Of Antibiotic Resistance Among Coliform Bacteria Isolated From The Missouri River, Sara E. Mcdonnell, Amy M. Treonis Jan 2004

A Survey Of Antibiotic Resistance Among Coliform Bacteria Isolated From The Missouri River, Sara E. Mcdonnell, Amy M. Treonis

Transactions of the Nebraska Academy of Sciences and Affiliated Societies

The prevalence of antibiotic resistant microorganisms in the environment is not well known but could represent a challenge to maintaining public health in the future. Fecal waste from livestock facilities, where antibiotics are routinely used, is recognized as a significant source of pollution to surface waters in the United States. We collected water from the Missouri River across a winter to spring seasonal change in order to survey the density of coliform bacteria. We tested bacterial isolates for resistance to penicillin, tetracycline, ampicillin, erythromycin, and ciprofloxacin. Coliform density in Missouri River water generally was high throughout the study (0-405 cfu …

Modeling Of River Hydrodynamics And Active Cap Effectiveness In The Anacostia River, Keegan L. Roberts Jan 2004

Modeling Of River Hydrodynamics And Active Cap Effectiveness In The Anacostia River, Keegan L. Roberts

LSU Master's Theses

The Anacostia Active Capping Project (AACP) is a United States Environmental Protection Agency (EPA) funded initiative to develop and implement, on a field scale, active capping barrier technologies. Overseen by the Hazardous Substance Research Center, South and Southwest (HSRC), the AACP plans to demonstrate the ability of active capping barrier technologies to prevent the migration of contaminants from the sediment bed to the overlying water column of the Anacostia River. The demonstration project will involve the placement and monitoring of four individual types of capping materials (apatite, Aquablok, coke breeze, and sand) and the monitoring of one control (i.e. uncapped) …

"Honduran Memories": Identity, Race, Place And Memory In New Orleans, Louisiana, Samantha Euraque

LSU Master's Theses

During the decade preceding the height of the civil rights movement, a small population of Hondurans established residence in the New Orleans area. This Honduran migration was largely due to the trade relationship that existed between Honduras and New Orleans. Honduras was also experiencing political unrest and economic instability due to military coups, fruit company strikes and floods during the late 1950s. In response, the advent of the 1960s brought with it the first wave of Hondurans. According to the 2000 Census there were 64,340 people of Hispanic origin in the four parishes included in the New Orleans metropolitan area, …

Taking Back The Law School Classroom: Using Technology To Foster Active Student Learning , Rafael Gely, Paul L. Caron

Faculty Publications

Law schools (and indeed all of higher education) have witnessed an explosive growth in the use of technology in the classroom. Many law teachers now deploy a wide array of technological bells and whistles, including PowerPoint slides, Web-based course platforms, in-class Internet access, and the like. Students, in turn, increasingly come to class armed with laptop computers to harvest the fruits of the classroom experience. Yet in recent years there has been something of a backlash, with various law teachers arguing that this technology is interfering with, rather than improving, pedagogy in the classroom. According to the critics, the technology …

Experimental And Computational Modeling Of Granular Materials, Orlando Boscan Jan 2004

Experimental And Computational Modeling Of Granular Materials, Orlando Boscan

LSU Master's Theses

4-inch cubical sand specimens were been tested under drained conditions using a wide range of stress paths. The testing was performed by means of a true (cubical) triaxial device that has been conditioned for this study. This testing set-up consisted of a servo-controlled, single-boundary type apparatus, with six flexible membranes that create a center cavity surrounding the soil specimens. This thesis illustrates the functioning of the triaxial device, including detailed descriptions of the device components, sample preparation, and a practical application related to the mechanical characterization of granular materials using critical state soil mechanics. An experimental program, based on the …

Evaluation Of Indot Hyperfix Project, Kumares C. Sinha, Bob G. Mccullouch, Darcy M. Bullock, Sravanthi Konduri, Jon D. Fricker, Samuel Labi

JTRP Technical Reports

In 2003 the Indiana Department of Transportation executed an ambitious interstate reconstruction project in Indianapolis, named Hyperfix. This project completely closed the I-65/70 section during reconstruction, on which approximately 250,000 vehicles travel daily. Due to the scope and risk involved, an extensive amount of planning, coordination, and cooperation occurred. The main section was rebuilt during the total closure phase, which lasted 55 days. The total closure approach had never been performed before by INDOT on such a high volume artery in a downtown metropolitan area. This present study analyzed the project and its impact on the Indianapolis area. The report …

Hormesis, Hotspots And Emissions Trading, Jonathan B. Wiener Jan 2004

Hormesis, Hotspots And Emissions Trading, Jonathan B. Wiener

Faculty Scholarship

Instrument choice -- the comparison of technology standards, performance standards, taxes and tradable permits -- has been a major topic in environmental law and environmental economics. Most analyses assume that emissions and health effects are positively and linearly related. If they are not, this complicates the instrument choice analysis. This article analyses the effects of a nonlinear dose/response function on instrument choice. In particular, it examines the effects of hormesis (highdose harm but low-dose benefit) on the choice between fixed performance standards and tradable emissions permits. First, the article distinguishes the effects of hormesis from the effects of local emissions. …

The Globalization Of Human Rights: Consciousness, Law And Reality, Douglass Cassel Jan 2004

The Globalization Of Human Rights: Consciousness, Law And Reality, Douglass Cassel

Journal Articles

Human rights have suffered sharp setbacks in the four years since the paper that follows was delivered in London in the summer of 2000. The terrorist attacks on the United States on September 11, 2001, and the Bush Administration’s ensuing “war on terrorism,” have led not only to a demotion of human rights on the list of American foreign policy priorities, but also to gross violations of human rights by Washington. Among other recent assaults on the rule of law are the prolonged detentions of hundreds of prisoners without trial or due process of law at the United States Naval …

Surveillance Law Through Cyberlaw's Lens, Patricia L. Bellia Jan 2004

Surveillance Law Through Cyberlaw's Lens, Patricia L. Bellia

Journal Articles

The continuing controversy over the surveillance-related provisions of the USA Patriot Act highlights the depth of Americans' concern about internet privacy. Although calls to limit the government's surveillance powers strike a chord with the public, the legal framework governing surveillance activities is highly technical and poorly understood. The Patriot Act's sunset date provides Congress with an opportunity to revisit that framework.

Oceans Apart Over Sunken Ships: Is The Underwater Cultural Heritage Convention Really Wrecking Admiralty Law?, Liza J. Bowman Jan 2004

Oceans Apart Over Sunken Ships: Is The Underwater Cultural Heritage Convention Really Wrecking Admiralty Law?, Liza J. Bowman

Osgoode Hall Law Journal

This article examines the impact of the UNESCO Convention on the Protection of the Underwater Cultural Heritage on admiralty law, particularly the law of treasure salvage as applied to shipwrecks in international waters. Despite its many proponents, the Convention has numerous detractors who believe that if it enters into force, it will nullify treasure salvage, a prosperous industry in many areas of the world. Although much tension exists between salvage and the preservation of the underwater cultural heritage as proposed by the Convention, the author concludes that the two are not completely incompatible with one another. Rather, salvors and cultural …

Creation Of Non-Human Primate Neurogenetic Disease Models By Gene Targeting And Nuclear Transfer, Robert B. Norgren Jan 2004

Creation Of Non-Human Primate Neurogenetic Disease Models By Gene Targeting And Nuclear Transfer, Robert B. Norgren

Journal Articles: Genetics, Cell Biology & Anatomy

Genetically modified rhesus macaques are necessary because mouse models are not suitable for a number of important neurogenetic disorders; for example, Kallmann's syndrome, Lesch-Nyhan's disease and Ataxia-Telangiectasia. Mouse models may not be suitable because there may be no mouse ortholog of the human gene of interest, as is the case for Kallmann's syndrome, or because mutant mice do not exhibit the same phenotype observed in humans, as is the the case for Lesch-Nyhan's disease and Ataxia-Telangiectasia. Non-human primate models of neurogenetic diseases are expected to more closely resemble human diseases than existing mouse models. Genetically modified rhesus macaques can be …

Radical Tax Reform, Municipal Finance, And The Conservative Agenda, Eric J. Gouvin Jan 2004

Radical Tax Reform, Municipal Finance, And The Conservative Agenda, Eric J. Gouvin

Faculty Scholarship

Proponents of a consumption tax system to replace the federal income tax typically couch their support for radical tax reform in the language of traditional tax policy goals. They claim that their reform plans promote the goals of simplicity, economic efficiency, stability, and equity. This Article examines how well the proposed tax reforms will achieve those goals in the context of their anticipated impact on state and local finance. The effects on state and local governments of a flattened-rate income tax, flat tax, or a broad federal consumption tax could be enormous and devastating. The Article finds that all of …
