Extreme Sports And Assumption Of Risk: A Blueprint, David Horton
Extreme Sports And Assumption Of Risk: A Blueprint, David Horton
University of San Francisco Law Review
A GROWING NUMBER of personal injury litigants stand outside the contours of tort law. Plaintiffs who are hurt while engaging in high risk recreational activities do not fit within a doctrine that uses "reasonableness" as its central criterion. Reasonableness hinges on whether the cost of an untaken precaution outweighs that of a particular harm. In many risky sports, the only way to avoid getting hurt is to forego the activity altogether. For most people, this is not a burden. Even if it is, the lost opportunity value is dwarfed by the omnipresent specter of grave injury. For example, consider the …
But I Thought He Had A Gun - Race And Police Use Of A Deadly Force, Cynthia Lee
But I Thought He Had A Gun - Race And Police Use Of A Deadly Force, Cynthia Lee
UC Law Journal of Race and Economic Justice
While widespread consensus exists that racial minorities are disproportionately represented as victims of police shootings, the reason for this disproportion is hotly disputed. This paper argues that in claimed self-defense cases, race norms or racial stereotypes often operate at a subconscious level to alter police officers' perceptions of threat and corresponding decisions to use deadly force. Nevertheless, society can help encourage police officers to overcome the inevitable influence of racial stereotypes on their decisions to use deadly force in the field. Internally, police departments can work on at least three fronts to control the use of force: recruitment, training, and …

A Civil Rights Task: Removing Barriers To Employment Of Ex-Convicts, Leroy D. Clark
A Civil Rights Task: Removing Barriers To Employment Of Ex-Convicts, Leroy D. Clark
University of San Francisco Law Review
OUR NATION FACES a growing problem that cries out for careful, rational reforms. As of June 2002, the prison and jail population exceeded two million inmates for the first time. State prisons operated between 1% and 16% above capacity and federal prisons operated 31% above capacity. The inmate population grew an average of 3.8% each year from 1995 to 2002.
Deferred Entry Of Judgment: An Overlooked And Undervalued Benefit Of Proposition 21, Laron Hogg Haught
Deferred Entry Of Judgment: An Overlooked And Undervalued Benefit Of Proposition 21, Laron Hogg Haught
University of San Francisco Law Review
IN MARCH OF 2000, the voters of California passed Proposition 21, the "Gang Violence and Juvenile Crime Prevention Act of 1998," which altered sections of the Welfare and Institution and Penal Codes as well as created new sections that delineate a supervision program for certain minors brought before the courts. Proponents hailed the initiative as a "get tough on juvenile crime and gangs" measure, while opponents argued it was a draconian attempt to incarcerate more children for longer periods of time, and was too sweeping in its effect.
Abstinence-Only Adolescent Education: Ineffective, Unpopular, And Unconstitutional, James Mcgrath
Abstinence-Only Adolescent Education: Ineffective, Unpopular, And Unconstitutional, James Mcgrath
University of San Francisco Law Review
ABSTINENCE-ONLY AND abstinence-only-until-marriage education programs, ostensibly designed to prevent unwanted pregnancy and sexually transmitted disease ("STD") infection, are a waste of valuable public health resources of both time and money.' These ideologically based interventions interfere with serious, effective public health education and must be dismantled. Not only are abstinence-only programs ineffective for their intended purpose, they are dangerous in that they fail to protect our nation's youth against serious and potentially deadly diseases. Furthermore, these programs unconstitutionally violate both the Establishment Clause and the unconstitutional conditions doctrine.

Facts And Fantasies About Uc Berkeley Admissions: A Critical Evaluation Of Regent John Moores' Reports, Asian Law Caucus
Facts And Fantasies About Uc Berkeley Admissions: A Critical Evaluation Of Regent John Moores' Reports, Asian Law Caucus
UC Law Journal of Race and Economic Justice
UC Regent John Moores recently authored a confidential draft report that purports to analyze admissions at the University of California's flagship Berkeley campus. The Moores Report is largely focused on SAT scores, particularly the admission of some applicants with SAT scores below 1000. Unfortunately, the Moores Report contributed to widespread misconceptions about comprehensive review at Berkeley, particularly regarding the admission of a small number of students with relatively low SAT scores. In reality, the data show that students admitted with relatively low SAT scores can be highly qualified for admission to Berkeley and that Berkeley admits virtually all in-state applicants …

Bluetooth Enabled Ad-Hoc Networks: Performance Evaluation Of A Self-Healing Scatternet Formation Protocol, Rade Trimceski
Dissertations, Master's Theses and Master's Reports - Open
Bluetooth wireless technology is a robust short-range communications system designed for low power (10 meter range) and low cost. It operates in the 2.4 GHz Industrial Scientific Medical (ISM) band and it employs two techniques for minimizing interference: a frequency hopping scheme which nominally splits the 2.400 - 2.485 GHz band in 79 frequency channels and a time division duplex (TDD) scheme which is used to switch to a new frequency channel on 625 μs boundaries. During normal operation a Bluetooth device will be active on a different frequency channel every 625 μs, thus minimizing the chances of continuous interference …

Regulation Through Intimidation: Congressional Hearings And Political Pressure On America's Entertainment Media, Kenneth A. Paulson
Vanderbilt Journal of Entertainment & Technology Law
This paper explores how Congress has shaped and limited the content of films, comic books, popular music, and television over the past century. Specifically, this report focuses on the path to "self-regulation" and industry-wide codes for these four media, and how government used pressure and influence to spur the adoption of standards.

"The Impact of China's Accession to the WTO" 中國入世後的初步分析
This paper will first review the early concerns about China's entry to the WTO. Then we will evaluate the preliminary impact of the WTO membership on the Chinese economy, which turned out to be better than expected. We also discuss the current international debate on the Chinese currency renminbi revaluation and suggest that a gradual improvement of the current Chinese rigid exchange rate system will be inevitable.
Finally we will explore the potential problems and challenges to both economies of mainland China and Hong Kong in the future. We argue that …

Chinese Environmental Attitudes And Climate Change : Survey Findings On Precursors Of China's Domestic And International Policies On Global Warming, Paul G. Harris
CAPS Working Paper Series
Attitudes toward the environment in China are ambiguous at best and anti-environment at worst. These attitudes are indicators of how the Chinese view the natural environment and how they are likely to behave toward it and respond to efforts to protect it—whether they will practice "green" development and preservation of nature, or instead contribute to practices that are turning China's air, land and water brown (or even black) with pollution. These attitudes are also important precursors to individual Chinese behaviours and the policies and actions of the Chinese government to combat global warming and climate change. As such, attitudes toward …

Perceptions From A University Field Supervisor's Perch, Barbara A. Phillips
Northwest Journal of Teacher Education
The face of teacher supervision has changed tremendously in the past decades. That, of course, has impacted the supervision of student teachers as well. Supervision has evolved from a relatively unimportant role to a major one that assists in the school improvement process. A veteran student teacher supervisor chronicles stu{fent teacher assignments that have been amended, created, or deleted to meet changing needs. 1hese changes have been fashioned by multiple sources: the needs of student teachers, the teacher education program, district and state requirements, as well as a sh(ft in educational paradigms. Supervision is crucial to the improvement of teaching …
