Iraq And The Future Of United States Foreign Policy : Failures Of Legitmacy, Henry H. Perritt Jr. Jan 2004

Iraq And The Future Of United States Foreign Policy : Failures Of Legitmacy, Henry H. Perritt Jr.

Syracuse Journal of International Law and Commerce

This article evaluates the political trusteeship in Iraq, and concludes that the United States failed to apply many lessons that the international community learned from preceding political trusteeships, and that the result is likely to be a serious unraveling of important, though intangible, sources of leverage for U. S. foreign policy and national security. The Iraq intervention has distracted attention from more important foreign policy objectives, including the urgent effort to understand the genesis of terrorism and to mobilize American resources to reduce the terrorist threat, while working through multilateral frameworks. Accomplishment of these is necessary for achieving important foreign …

The Legal Implications Of Living With Hiv/Aids In A Developing Country: The Afican Story, Florence Shu-Acquaye

Syracuse Journal of International Law and Commerce

This article looks at customary and statutory laws, such as polygamy, widow inheritance, and other cultural practices that have contributed to the entrenchment of the disease in Africa, particularly sub-Saharan Africa. 7 It also provides a discussion of the African dilemma with recommendations. The article further looks at how weak human rights laws are and how the stigmatization associated with HIV/AIDS has contributed to the multi-faceted and complex nature of this disease in Africa. Additionally, it evaluates the possibility of changing or amending some of the related existing laws by offering a checklist for policy makers and legislators. Finally, the …

The Evolving Law On The Eurobank-Customer Relationship And The Common Law : The Need For Clarity, Edmund M. Kwaw

Syracuse Journal of International Law and Commerce

This article discusses the nature and operation of the euro-currency market and how the legal consequences of the euro-bank customer relationship are different from the domestic banker-customer relationship. It argues that there is a need for a redefinition of the common law on the banker-customer relationship.

Design And Implementation Of A Collaboration Web-Services System, Wenjun Wu, Geoffrey C. Fox, Hasan Bulut, Ahmet Uyar, Harun Altay

Electrical Engineering and Computer Science - All Scholarship

Conference control has been studied for years but most researches focus on homogenous collaboration. There is no conference control framework for integration of multiple collaboration systems such as H.323, SIP and AccessGrid. In this paper we present a web-services based scalable conference control framework for such a heterogeneous collaboration system. Based on this framework, we implemented a prototype system to verify and refine our framework. This system can support various conferencing endpoints and communities.

Gulf and Caribbean Research

Fishes are important hosts of helminths with aquatic life stages, yet little information is available on host-parasite relationships in tropical low salinity ecosystems. In this paper we report helminth parasites of the fat sleeper, Dormitator maculatus, in the Alvarado lagoon system, Veracruz. Mexico. Four parasite species were recorded from D. maculatus, including trematode metacercariae of Clinostomum complanatum, as well as nematode larvae of Spyroxis sp. and Camallanus sp. and adults of Neochinorhynchus golvani. In addition, we obtained adult C. complanatum from the esophagus of the little blue heron, Egretta caerulea. Dormitator maculatus is a new …

Age-Related Differences In Susceptibility To Carcinogenesis: A Quantitative Analysis Of Empirical Animal Bioassay Data, Dale Hattis, Robert Goble, Abel Russ, Margaret Chu, Jen Ericson Jan 2004

Age-Related Differences In Susceptibility To Carcinogenesis: A Quantitative Analysis Of Empirical Animal Bioassay Data, Dale Hattis, Robert Goble, Abel Russ, Margaret Chu, Jen Ericson

Sustainability and Social Justice

In revising cancer risk assessment guidelines, the U.S. Environmental Protection Agency (EPA) analyzed animal cancer bioassay data over different periods of life. In this article, we report an improved analysis of these data (supplemented with some chemical carcinogenesis observations not included in the U.S. EPA's original analysis) and animal bioassay studies of ionizing radiation. We use likelihood methods to avoid excluding cases where no tumors were observed in specific groups. We express dosage for animals of different weights on a metabolically consistent basis (concentration in air or food, or per unit body weight to the three-quarters power). Finally, we use …

Congressional Leadership, Daniel J. Palazzolo Jan 2004

Congressional Leadership, Daniel J. Palazzolo

Political Science Faculty Publications

Congressional leadership takes place within an institution that serves two primary functions: making laws and representing citizens. Leaders play essential roles organizing the United States House of Representatives and the United States Senatethey set the schedule for debating bills and resolutions; formulate proposals to address public problems; represent their party's priorities through the media and in relations with leaders of the opposing party; support or oppose the president's initiatives in the legislative process; and build coalitions to pass legislation. The main challenge of congressional leadership is to advance the collective interests of the nation or of the leader's political party, …

Shooting Ourselves In The Foot: Why Mandatory Reporting Of Gunshot Wounds Is A Bad Idea, Merril Pauls, Jocelyn Downie Jan 2004

Shooting Ourselves In The Foot: Why Mandatory Reporting Of Gunshot Wounds Is A Bad Idea, Merril Pauls, Jocelyn Downie

Articles, Book Chapters, & Popular Press

A recent position statement by the Ontario Medical Association’s Section on Emergency Medicine called on the Ontario government to pass a law requiring physicians to report gunshot wounds to police. The Ontario government quickly passed a motion to “introduce legislation to require hospitals and physicians to report gunshot wounds and knife injuries to their local police service.” The goals behind the position statement are laudable: “to assess and reduce immediate public risk and to collect data to inform future prevention strategies.” However, mandating that physicians report gunshot wounds is an ill-conceived response to the problem of gun-related violence. It will …

Revisioning The Oversight Of Research Involving Humans In Canada, Jocelyn Downie, Fiona Mcdonald Jan 2004

Revisioning The Oversight Of Research Involving Humans In Canada, Jocelyn Downie, Fiona Mcdonald

Articles, Book Chapters, & Popular Press

When individuals are asked to participate in research they should be able to assume that the research "is well designed and well executed, that the investigator is competent to undertake the study, that the study will be run efficiently, safely, and ethically and that the deviations from good practice will be identified and corrected." The central question that we focus on in this paper is whether the governance mechanisms that are currently in place to regulate the conduct of research involving humans are adequate to enable those who are approached to participate in research to make these assumptions. This review …

Arbitral Law-Making, Thomas E. Carbonneau Jan 2004

Arbitral Law-Making, Thomas E. Carbonneau

Faculty Scholarship

Diversity--of a cultural, economic, religious, and political kind—exists not only among nation-states and in the sources and interpretation of international law, but also among the group of commentators who study the interactions of transborder actors and institutions. For example, sociologists interested in the global community seek to identify emerging entities and activities and to elaborate conceptual models that explain the new differentiations within the traditional pattern. Some of them have a mounting interest in the fashioning of transborder commercial justice by international arbitrators and private arbitral institutions. Who are these new players? How did they acquire their mandate? Further, how …

Managing Black Guys: Representation, Corporate Culture, And The Nba, Glyn Hughes Jan 2004

Managing Black Guys: Representation, Corporate Culture, And The Nba, Glyn Hughes

Sociology and Anthropology Faculty Publications

This article explores the intersection of representation, management, and race in the National Basketball Association (NBA) through a larger question on the relationship between corporate strategies for managing racialized subjects and popular representations of race. The NBA “brand” is situated in terms of recent developments in corporate and popular culture and then analyzed as an example of diversity management. Relying on original interviews with NBA corporate employees, as well as business and marketing industry reporting, the article analyzes the NBA as simultaneously an organization and a brand. As such, the NBA helps to “articulate” the corporate with the popular, largely …

Catholic Clergy Sexual Abuse Meets The Civil Law, Thomas P. Doyle, Stephen C. Rubino Jan 2004

Catholic Clergy Sexual Abuse Meets The Civil Law, Thomas P. Doyle, Stephen C. Rubino

Fordham Urban Law Journal

This article examines the sexual abuse scandal that has racked the Roman Catholic Church since 1984, focusing in particular on how the Church's authority structure has responded and how the American civil court system has been used by victims to seek redress. It gives an overview of the Church's legal system, Canon Law, and the way that system and the Church leadership have dealt (or failed to deal) with the problem of sexual abuse. Part II takes a "long look back" to the history of sexual abuse and Canon Law before 1984. Part III details how the Church has dealt …

The Collision Of Church And State: A Primer To Beth Din Arbitrarion And The New York Secular Courts, Ginnine Fried Jan 2004

The Collision Of Church And State: A Primer To Beth Din Arbitrarion And The New York Secular Courts, Ginnine Fried

Fordham Urban Law Journal

This Comment analyzes the interaction between secular courts and beth din proceedings (arbitration panels made up of specialists in halacha, or Jewish law). Part I examines the reasons why an independent Jewish religious court system is required and utilized despite the existence of a fair and equitable secular court system. It describes the Jewish legal principles involved, and how they impact both Jewish litigants and lawyers. Part II describes the mechanics of transforming a religious tribunal into a legally binding arbitration panel in New York State. Part III discusses the limited grounds upon which a beth din award may be …

Econometric Analyses Of U.S. Abortion Policy: A Critical View, Jonathan Klick Jan 2004

Econometric Analyses Of U.S. Abortion Policy: A Critical View, Jonathan Klick

Fordham Urban Law Journal

This article surveys, in non-technical language, various econometric studies on the correlation between changes in access to abortion (whether through legalization, increased public funding, increased safety, etc.) and social phenomena such as sexual activity, crime, and opportunities for women. It argues that many econometrics-based abortion studies are contentious, often yielding varying results depending on the stakes of those commissioning the studies, and often too technical to be useful to policy-makers. As a result of these shortcomings, the author calls for methodological soundness and publication for a more general audience for those social scientists who want to enter the reproductive rights …

Public Service In A Time Of Crisis: A Report And Retrospective On The Legal Community's Response To The Events Of September 11, 2001

Fordham Urban Law Journal

The attacks on September 11, 2001 were unprecedented in scope, and the legal needs that grew out of the attacks were varied and far-reaching. This report summarizes the response of the legal community to these needs. The response was fast, thoughtful, comprehensive, and creative. And as a result, thousands of people were helped and thousands of lawyers were able to use their professional talents and skills in a manner that both led to important services being provided to people in need and resulted in great personal satisfaction. In response to 9/11, the institutions that make up the New York area …

Broadening The Holistic Mindset: Incorporating Collateral Consequences And Reenty Into Criminal Defense Lawyering, Michael Pinard Jan 2004

Broadening The Holistic Mindset: Incorporating Collateral Consequences And Reenty Into Criminal Defense Lawyering, Michael Pinard

Fordham Urban Law Journal

Over the past two decades, public defender offices across the country have broadened the range of defense services provided to indigent clients. These expanded services, some of which involve representing clients on related non-criminal matters such as housing and public benefits, are included in what is now commonly referred to as "holistic representation."' This form of representation strives to encompass the various underlying issues that often lead to clients’ experiences with the criminal justice system, with the aim of addressing those circumstances and preventing future criminal involvement. Holistic representation signals a paradigmatic shift in defense philosophy and ideology and has …

Are Talebearers Really As Bad As Talemakers?: Rethinking Republisher Liability In An Information Age , Jennifer L. Del Medico Jan 2004

Are Talebearers Really As Bad As Talemakers?: Rethinking Republisher Liability In An Information Age , Jennifer L. Del Medico

Fordham Urban Law Journal

This Comment critiques the legal landscape surrounding republisher liability for defamation and ultimately calls for a more reaching approach to protect against such liability. Historically at common law republishers could be held liable for defamation regardless of whether they attributed the source of the material. However, starting in 1933 courts articulated the “wire service defense” that sought to eliminate liability for republishers when they “republished a wire story from a generally recognized reliable source of daily news.” Subsequent to the 1933 Florida court’s articulation of the defense many jurisdictions have adopted it. New York stands out as one of the …

Christian Conservatives Go To Court: Religion And Legal Mobilization In The United States And Canada, Dennis R. Hoover, Kevin R. Den Dulk Jan 2004

Christian Conservatives Go To Court: Religion And Legal Mobilization In The United States And Canada, Dennis R. Hoover, Kevin R. Den Dulk

Peer Reviewed Articles

The American exceptionalism thesis holds that American political culture produces an unusually litigious society. The US Christian right has participated in litigation, especially in constitutional rights cases dealing with issues such as religious schools and abortion. However, since 1982 Canada has had a constitutional Charter of Rights and an increasingly active Christian right of its own. We compare data on Christian right involvement in education, abortion, and “right to die” (euthanasia, assisted suicide or mercy killing) cases at the Supreme Court level in both countries. Among North America’s Christian conservatives, exceptionalism has eroded, but not disappeared. We employ interviews and …

Gender, Class And Generational Contexts For Consumption In Contemporary Chile, Joel Stillerman Jan 2004

Gender, Class And Generational Contexts For Consumption In Contemporary Chile, Joel Stillerman

Peer Reviewed Articles

In contrast to common perceptions that individuals’ consumption choices are primarily motivated by their search for status or personal gratification, this article contends that gender, family and class significantly shape these decisions. The study integrates discussions of class and consumption with analyses of family monetary allocation and adaptive strategies to analyze interviews with working-class couples in Santiago, Chile. I found that men exercised overt and subtle forms of control over family monetary allocation, spending choices and earning strategies; adults’ perceived obligations towards children and elderly parents shaped their consumption decisions; and couples’ class-based perceptions of their limited financial resources led …

Constitutional Courage, Harry W. Arthurs Jan 2004

Constitutional Courage, Harry W. Arthurs

Articles & Book Chapters

In this lecture, Professor Arthurs argues that we are currently in need of "constitutional courage"-the courage to say "no" to ambitious projects of constitutional reform and constitutional litigation as a way to solve our pressing social and political problems. Professor Arthurs first lays out why our current obsession with the constitution is problematic. He insists that we do not even know what the supposed "supreme law of Canada" actually is, what it says, or even what it does. Moreover, instead of transforming society, the current "cult of constitutionalism" has only served to transform legal practice and scholarship. ei then surmises …

The Mapping Of Velocity Profiles In A Three Generation Lung Model Using Particle Image Velocimetry Flow Analysis Techniques, Adam D. Pruyne Jan 2004

The Mapping Of Velocity Profiles In A Three Generation Lung Model Using Particle Image Velocimetry Flow Analysis Techniques, Adam D. Pruyne

Theses

The intent of this thesis was to develop an understanding for the particle flow characteristics in the human lung by examining particle flow profiles in a three generation lung model. To develop this understanding, experimentally derived flow profiles were compared to analytical solutions, where applicable, and Computational Fluid Dynamics (CFD) generated models for validation of both the CFD model and the experimental set-up. Validation of flow velocities in a three generation model could contribute significantly to the medical industry as a better understanding of particle behavior in the lung could lead to more accurate treatment of certain diseases and better …
