“Shamnesty” Vs. Amnesty: Can The Riaa Grant Immunity To File-Sharers From Copyright Infringement Lawsuits?, 3 J. Marshall Rev. Intell. Prop. L. 279 (2004), Natosha Cuyler-Sherman

UIC Review of Intellectual Property Law

The Recording Industry Association of America (RIAA) is the industry trade association for sound and music recordings and represents various music companies, songwriters, and music artists. One of the main functions of the RIAA is to enforce its members’ copyrights. The RIAA is currently representing members in copyright infringement lawsuits. As an alternative to being sued, the RIAA announced that it would grant amnesty to file sharers who voluntarily identified themselves and promised to stop illegally sharing music. In reality, non-RIAA members and even RIAA members themselves can still sue file sharers because the organization itself does not have the …

Football's Intellectual Side: The Nfl Versus Super Bowl Parties And The Story Of The Fifty-Five Inch Television, 4 J. Marshall Rev. Intell. Prop. L. 125 (2004), Michael M. Fenwick

UIC Review of Intellectual Property Law

The increasing popularity of the National Football League’s Super Bowl Championship has spawned an increasing number of private parties, some that employ projection-screen televisions measuring up to twenty feet diagonally. Only days before the 2004 Super Bowl, the NFL sent cease-and-desist letters to a number of business proprietors claiming display of the broadcast on televisions larger than fifty-five inches diagonally violated the NFL’s rights under 17 U.S.C. § 110(5). This Comment will show that because 17 U.S.C. § 110(5) was written to protect authors within the music industry, its application to broadcast television fails because of television’s fundamentally different business …

Developments In Patent Law 2004, 4 J. Marshall Rev. Intell. Prop. L. 1 (2004), Harold C. Wegner

UIC Review of Intellectual Property Law

There are a great number of patent law doctrines that are currently under reconsideration by the Federal Circuit. These doctrines include patent claim construction under the 2006 Phillips case, the problem of foreign activity being used as patent-defeating prior art as shown in the recent Elsner case, the growing challenge of extraterritorial acts as patent infringement as presented in the 2004 expected cases of Blackberry and Eolas, the “Rule 105” implications for patent office practice in Sta Fruits, the change in willful infringement law set forth in the recent KnorrBremse case, the continuing problem of co-inventorship recurring in Xechem, the …

Reducing The Need For Markman Determinations, 4 J. Marshall Rev. Intell. Prop. L. 53 (2004), Robert H. Resis

UIC Review of Intellectual Property Law

The uncertainty as to whether claim interpretation decisions will survive appeal is an ever growing concern as the Federal Circuit’s reversal rate of lower court claim interpretations averages fifty percent. At a minimum, uncertainty in claim construction prolongs patent infringement disputes. Moreover, the reality is that many times it is the uncertainty of a claim’s scope and meaning that leads to litigation in the first place. In order to alleviate this stress on patentees, competitors and the federal court system, most if not all questions regarding the scope and meaning of claim terms should be clarified by the applicant during …

Banning Books, Burning Bridges: Recognizing Student Freedom Of Expression Rights In Canadian Classrooms, Devon Peavoy Jan 2004

Banning Books, Burning Bridges: Recognizing Student Freedom Of Expression Rights In Canadian Classrooms, Devon Peavoy

Dalhousie Journal of Legal Studies

In Canada, books and magazines are regularly intercepted at the border and are consistently removed from libraries, schools and bookstores. The banning of books is a controversial topic that involves issues of censorship and freedom of expression rights. The Supreme Court of Canada recently examined the issue in Chamberlain v. Surrey School District No. 36, where it was found that the School Board acted unreasonably in banning several books depicting same sex couples. The Court, however, did not consider the freedom of expression rights of students in reaching their decision. Despite this recent opportunity to comment on a student’s right …

Boys Will Be Girls: Sex Reassignment Surgery And The Ethics Of State Funding, Megan Leslie Jan 2004

Boys Will Be Girls: Sex Reassignment Surgery And The Ethics Of State Funding, Megan Leslie

Dalhousie Journal of Legal Studies

This paper was developed as a result of the author’s involvement with the Nova Scotia Rainbow Action Project in Halifax, Nova Scotia, who are planning an action whereby a member of the group will submit a complaint of discrimination to the provincial Human Rights Commission, contrary to the Nova Scotia Human Rights Act, on the ground of sex. The complaint will be based on a memberʼs denial of Nova Scotia Medical Services Insurance coverage for sex reassignment surgery, which is prohibited in Nova Scotia. This paper outlines the players and decision-making involved in determining whether or not sex reassignment surgery …

The Constitution At The Threshold Of Life And Death: A Suggested Approach To Accommodate An Interest In Life And A Right To Die, Michael P. Allen Jan 2004

The Constitution At The Threshold Of Life And Death: A Suggested Approach To Accommodate An Interest In Life And A Right To Die, Michael P. Allen

American University Law Review

In the past fifteen years, the United States Supreme Court has decided three cases in which it tentatively began to explore what the United States Constitution has to say about issues that are popularly described as the "right to die." In this article, I suggest that the current state of constitutional analysis does not provide for an effective mechanism for securing an individual's "right to die," at least not without undervaluing a state's interest in the preservation of human life should a state choose to take such a position. In the article, I suggest that it is possible to adopt …

Access Denied: The Problem Of Abused Men In Washington, Melody M. Crick Jan 2004

Access Denied: The Problem Of Abused Men In Washington, Melody M. Crick

Seattle University Law Review

This Comment explains how the Washington legislature and court system have failed to provide abused men with much needed protection, despite a law that is facially gender neutral. Following this Introduction, Part II explores the wording of Washington's domestic violence statutes and analyzes the current implementing regulations. Part III demonstrates that the problem of abused men is legitimate by examining increasing social awareness and the results of current studies. By examining the prevailing national viewpoint embodied in the Violence Against Women Act, Part IV discusses how such a viewpoint adversely affects the availability of resources for abused men. Part V …

School Board Control Over Education And A Teacher's Right To Privacy, Ralph Mawdsley Jan 2004

School Board Control Over Education And A Teacher's Right To Privacy, Ralph Mawdsley

Law Faculty Articles and Essays

Privacy as a protected right for employees in the United States is grounded in several constitutional provisions. Most generally, the notion of privacy is associated with confidentiality of information , which is protected under both the Liberty Clause of the Constitution's Fourteenth Amendment and the Fourth Amendment's protection from unreasonable searches and seizures. However, an expanded understanding of privacy can find protection under the concepts of the right of association protected under the Liberty Clause and the First Amendment, expression of ideas under the Free Speech Clause of the First Amendment, and practice of one's religious beliefs under the Free …

Pslra, Slusa, And Defrauded Retirement Investors: Overlooked Side Effects Of A Potent Legislative Medicine, Michael J. Borden

Law Faculty Articles and Essays

This Article highlights a harmful and far-reaching unintended consequence of two major pieces of securities litigation reform legislation that were passed as part of the Republican party's Contract with America in the mid-1990s. These reforms were justified, in part, on the grounds that they would benefit investors by improving disclosure of financial information by corporations. However, for many aggrieved investors, the effect of the legislation was just the opposite. Because of inadequate and misleading disclosures made by life insurance companies and their registered representatives, consumers were induced to purchase inappropriate investments carrying excessive fees that reduced the value of their …

Program Contents Influence On Effectiveness Of Advertising, Sonja Bliss, Doug Boe Jan 2004

Program Contents Influence On Effectiveness Of Advertising, Sonja Bliss, Doug Boe

The Journal of Undergraduate Research

The hypothesis for this study was that program content would have an effect on a person's ability to recall commercials contained in that program. One hundred and seventy-six college students viewed one of three types of programs: a neutral program, a sexually explicit program, or a program that contained vulgarity. All three programs contained the same commercials. Free recall of commercials and cued recall of commercials was assessed. Program content was shown to have a significant effect on the number of commercials freely recalled and the total number of commercials recalled, thus supporting the hypothesis. Today, advertising is a huge …

Life After Civil Death: Felony And Mormon Disenfranchisement In The U.S. West (1880-1890), Winston A. Bowman

Psi Sigma Siren

Pomeroy’s understanding of the nature of the franchise may seem foreign to many present-day Americans, but this vision is the one to which most nineteenth-century jurists, scholars, and politicians subscribed. It is worth noting that Pomeroy wrote these words in the aftermath of the post-Civil War rights revolution and half a century after the expansion of the franchise under the auspices of Jacksonian democracy. This attitude toward voting rights was not abandoned following the passage of the reconstruction amendments. Instead, the idea of a limited franchise was affirmed time and again in the post-bellum era. Pomeroy’s franchise (one in which …

Investigation Of Optical Spectroscopy Techniques For On-Line Materials Accountability In The Solvent Extraction Process, Gary Cerefice, Kenneth Czerwinski Jan 2004

Investigation Of Optical Spectroscopy Techniques For On-Line Materials Accountability In The Solvent Extraction Process, Gary Cerefice, Kenneth Czerwinski

Safeguards Campaign (TRP)

The goal of this project is to examine the potential for using optical spectroscopy techniques, such as UV-Visible Spectroscopy and Laser Fluorescence Spectroscopy, for special nuclear materials accountability applications for the UREX+ and other solvent extraction processes. To increase the inherent proliferation resistance of the solvent extraction process, it is necessary to develop on-line techniques to directly measure the concentrations of special nuclear materials in-process. By providing on-line materials accountability for the processes, the potential for covert diversion of the materials streams becomes much more difficult to implement. On-line monitoring of material streams will also allow for improved plant operation, …
