"[N]Ot A Story To Pass On": Constructing Mothers Who Kill, Susan Ayres Jan 2004

"[N]Ot A Story To Pass On": Constructing Mothers Who Kill, Susan Ayres

UC Law SF Journal on Gender and Justice

Society is horrified and shocked when mothers kill their children. While this reaction may be justified, the reasons behind infanticide are never fully explored. Motherhood has very specific definitions in our society which makes it difficult to understand the motivations behind infanticide. Social institutions, such as the legal system and the media, are responsible for constructing motherhood in such a way that we view mothers who kill their children as simply insane and deficient. This article asserts another possible viewpoint regarding infanticide. Instead of specularizing women, the author urges people to view mothers who kill their children within the context …

Lighting The Lantern: Visions Of A Virtual All-Women's Law School, Nancy E. Shurtz Jan 2004

Lighting The Lantern: Visions Of A Virtual All-Women's Law School, Nancy E. Shurtz

UC Law SF Journal on Gender and Justice

"Lighting the Lantern: Visions of a Virtual All-Women's Law School" is a fictional narrative of a hypothetical all women's law school. It is written in non-traditional form in the hope that it will prompt the reader to view the law, academic institutions and societal constructs in ways more consistent with an evolving society that should embrace all differences, whether those differences are gender or racially based.

The mission of the All Women's Law School is threefold: "First, to teach specific lawyering skills and disseminate knowledge in a context designed to help students function effectively in the existing culture while working …

A Hometown Dilemma: Addressing Th E Sexual Harassment Of Undocumented Women In Meatpacking Plants In Iowa And Nebraska, Amanda Clark Jan 2004

A Hometown Dilemma: Addressing Th E Sexual Harassment Of Undocumented Women In Meatpacking Plants In Iowa And Nebraska, Amanda Clark

UC Law SF Journal on Gender and Justice

Sexual harassment of undocumented women workers continues to be a systemic problem within the meatpacking industry. In Iowa and Nebraska, the state legislature, the Equal Employment Opportunity Commission, labor unions, and local advocacy organizations are working to address the problem of sexual harassment within the meatpacking industry. This note addresses the ongoing issues facing women in the meatpacking industry in Iowa and Nebraska, in particular the unique concerns facing undocumented and immigrant women workers. It also looks to the Supreme Court holding in Hoffman Plastic Compounds, Inc. v. NLRB to determine the applicability of that case to Title VII sexual …

Gollum, Meet Smeagol: A Schizophrenic Rumination On Mediator Values Beyond Self Determination And Neutrality, James Coben Jan 2004

Gollum, Meet Smeagol: A Schizophrenic Rumination On Mediator Values Beyond Self Determination And Neutrality, James Coben

Faculty Scholarship

The author asserts that the exclusive reliance on the "Two Towers" of self-determination and neutrality as the foundation for mediation practice has inevitably left us with a process routinely characterized by mediator manipulation and deception. The "tricks" are tolerated by sophisticated repeat players, and absent transparency in practice, disturbingly not known to others. The evolution of mediation, from empowerment/community roots to corporate/court sustenance, is no surprise given the nation's journey through the Reagan revolution, the ideology of free markets, and the Supreme Court's unbridled support for freedom to contract in disputing. In short, mediation is at a crossroads needing to …

Colonization And The Rule Of Law: Comparing The Effectiveness Of Common Law And Civil Law Countries, Sandra F. Joireman Jan 2004

Colonization And The Rule Of Law: Comparing The Effectiveness Of Common Law And Civil Law Countries, Sandra F. Joireman

Political Science Faculty Publications

The rule of law is one of the most important components of any explanation of cross-national differences in economic well-being. But what leads to better rule of law in a country? Using an institutional approach this paper probes the effect of legal systems in influencing the rule of law. There has long been speculation that the countries adopting English common law are better at providing legal dispute resolution than those adopting the continental forms of civil law. That speculative assessment is found to be true only in those countries that have been colonized, further analysis demonstrates that it is the …

Retributive Justice: The Gacaca Process In Rwanda, Sandra F. Joireman, Allison Corey Jan 2004

Retributive Justice: The Gacaca Process In Rwanda, Sandra F. Joireman, Allison Corey

Political Science Faculty Publications

After decades of cycling violence between Hutu and Tutsi groups in Rwanda and Burundi, violence peaked in 1994 with a genocide of Tutsis in Rwanda, during which the Hutu majority slaughtered 800,000 Tutsi and moderate Hutus, leaving the country with 120,000 accused génocidaires awaiting trial. Rwanda's gacaca courts were established as a response to the backlog of untried genocide cases. These courts disturbingly distinguish between genocide and war crimes committed during the same era, trying only those accused of genocide. This article argues that the gacaca process will contribute to the insecurity of all Rwandan citizens in the future, since …

A Question Of (Anti)Trust:Flood V. Kuhn And The Viability Of Major League Baseball's Antitrust Exemption, William Basil Tsimpris Jan 2004

A Question Of (Anti)Trust:Flood V. Kuhn And The Viability Of Major League Baseball's Antitrust Exemption, William Basil Tsimpris

Richmond Public Interest Law Review

Jacques Barzun once commented that "[w]hoever wants to know the heart and mind of America had better learn baseball., Taken literally, this assertion is shortsighted, 3 and in today's society "the national pastime" has long ceded its status as America's dominant team sport. In one area, though, baseball still holds a distinction other sports cannot claim: Throughout much of its history, Major League Baseball (hereinfter "MLB") has enjoyed a judicially-created exemption from federal antitrust laws, an exemption not afforded to other sports. This casenote will examine the history and strength of the MLB antitrust exemption from the perspective of Flood …

Control Of Peroxisome Proliferator-Activated Receptor Γ2 Stability And Activity By Sumoylation, Z. Elizabeth Floyd, Jacqueline M. Stephens

Faculty Publications

Objective: To determine whether small ubiquitin-related modifier (SUMO)ylation of lysine 107 plays a role in regulating the activity of peroxisome proliferator-activated receptor γ (PPARγ). Research Methods and Procedures: Transient expression of wild-type and K107R-PPARγ2 in the NIH 3T3 fibroblast cell line was carried out in conjunction with half-life studies, luciferase activity assays, and indirect immunofluorescence localization studies. Additional in vitro analysis was carried out using recombinant SUMOylation pathway proteins along with in vitro transcribed and translated wild-type or K107R-PPARγ2 to examine the SUMO-1 modification state of wild-type and SUMO-deficient K107R-PPARγ2. Results: While examining PPARγ2 for potential ubiquitylation sites, we identified …

Identifying Training Needs Of Tradeshow Exhibitors, Yonghee Kim Jan 2004

Identifying Training Needs Of Tradeshow Exhibitors, Yonghee Kim

UNLV Retrospective Theses & Dissertations

The purpose of this study was to identify training needs of tradeshow exhibitors by examining exhibitors' perceived importance and knowledge level of training issues using training needs analysis. This study also examined differences in training needs by exhibitors' past exhibiting experience and cultural background. A survey was conducted with 369 randomly sampled exhibitors attending a tradeshow in Las Vegas. Exhibitors considered meet and greet skills, following-up on customer leads, and creating attractive booth designs/displays the most important factors for better performance at tradeshows. Less experienced exhibitors were less knowledgeable of almost all training topics. Exhibitors who had non-American cultural backgrounds …

Belief In A Just World Among Undergraduates, Graduate Students, And Law Students, Joseph F Boetcher Jan 2004

Belief In A Just World Among Undergraduates, Graduate Students, And Law Students, Joseph F Boetcher

UNLV Retrospective Theses & Dissertations

Participants were 135 undergraduates, graduate students, and law students. They were compared on the strength of their belief in a just world. In addition, half the participants were primed with a word task that threatened their belief in a just world. It was hypothesized that the law students would exhibit a stronger belief in a just world than the other two educational groups, and that the primed participants would score higher in just world belief than the non-primed participants. Results failed to support the research hypotheses. Possible interpretations of the results are discussed, and recommendations for future research are offered.

Four nonlactating, mature, Holstein cows were fitted with ruminal cannula and used in a 4 x 4 Latin square-designed experiment to evaluate the impact of supplemental Zn and monensin on ruminal degradation of Lys and liquid 2-hydroxy-4-methylthiobutanoic acid (HMB). Cows were fed 4.54 kg (as fed) of alfalfa hay top-dressed with 4.54 kg (as fed) concentrate once daily. Concentrates were formulated to provide 0 or 500 mg/kg of Zn as ZnSO4 and 0 or 40 mg/kg of monensin in the total diet. Zinc supplementation provided approximately 22-fold greater dietary Zn than estimated by NRC requirements. On d 14 of each …

Toward An Understanding Of Judicial Diversity In American Courts, Barbara L. Graham Jan 2004

Toward An Understanding Of Judicial Diversity In American Courts, Barbara L. Graham

Michigan Journal of Race and Law

Part I of this Article explores the utility of descriptive representation as an important concept in understanding why judicial diversity matters from a political perspective. Part II begins an empirical examination of judicial diversity at the federal level while Part III presents an analysis of state court diversity. The data presented in Parts II and III indicate that judges of color are underrepresented at all levels of the federal and state court systems and that particular racial and ethnic groups are virtually excluded from federal and state benches. The conclusion argues that the data presented in this Article support a …

Wittgenstein And The Recovery Of Virtue, G. Scott Davis Jan 2004

Wittgenstein And The Recovery Of Virtue, G. Scott Davis

Religious Studies Faculty Publications

Modern, scientific, man doesn't see miracles, only odd phenomena that call out for more thorough study. Ethics, like the miraculous, doesn't defy scientific explanation; it just doesn't exist. In what follows I hope to do two things., On the one hand, I want to embrace Wittgenstein's rejection of ethics as theory, in the sense of a systematic body of knowledge about the world. On the other, I hope to suggest that this rejection opens up conceptual space for understanding ethics as a critical human enterprise.

A Center For Holistic Health, Beth Doane Jan 2004

A Center For Holistic Health, Beth Doane

Senior Honors Theses and Projects

One of the leading causes of death in the United States is also one of the most preventable: stress-related illnesses contribute to millions of fatalities every year. Facilitating better health outcomes requires overhauling how we think about health within our culture and how we approach healthcare, emphasizing prevention over treatment. My research investigates how Eastern cultures have embraced this view for centuries, utilizing alternative practices that reduce stress and promote longevity.

I propose developing a non-profit health center, The Center for Holistic Health, founded on preventative care and alternative medicines. Clients will receive autonomy over their health by learning how …
