Cultural Eclipse: The Effect On The Aboriginal Peoples In Manitoba, Kwesi Baffoe Jan 2004

Cultural Eclipse: The Effect On The Aboriginal Peoples In Manitoba, Kwesi Baffoe

Tribal Law Journal

Cultural eclipse is a phrase that I coined to describe the inter-relationship between the Aboriginal and European cultures as seen by an observer in space. It depicts the scene of two cultures initially rotating separately in time through the Universe. The European culture slowly drifts towards the Aboriginal culture and partially covers it without consuming it. This paper explores one of the ways indigenous culture is damaged during this "union".

Taking Back The Law School Classroom: Using Technology To Foster Active Student Learning , Rafael Gely, Paul L. Caron

Faculty Publications

Law schools (and indeed all of higher education) have witnessed an explosive growth in the use of technology in the classroom. Many law teachers now deploy a wide array of technological bells and whistles, including PowerPoint slides, Web-based course platforms, in-class Internet access, and the like. Students, in turn, increasingly come to class armed with laptop computers to harvest the fruits of the classroom experience. Yet in recent years there has been something of a backlash, with various law teachers arguing that this technology is interfering with, rather than improving, pedagogy in the classroom. According to the critics, the technology …

Experimental And Computational Modeling Of Granular Materials, Orlando Boscan Jan 2004

Experimental And Computational Modeling Of Granular Materials, Orlando Boscan

LSU Master's Theses

4-inch cubical sand specimens were been tested under drained conditions using a wide range of stress paths. The testing was performed by means of a true (cubical) triaxial device that has been conditioned for this study. This testing set-up consisted of a servo-controlled, single-boundary type apparatus, with six flexible membranes that create a center cavity surrounding the soil specimens. This thesis illustrates the functioning of the triaxial device, including detailed descriptions of the device components, sample preparation, and a practical application related to the mechanical characterization of granular materials using critical state soil mechanics. An experimental program, based on the …

Electronic Speckle Pattern Shearing Interferometer With A Photopolymer Holographyc Grating, Emilia Mihaylova, Izabela Naydenova, Suzanne Martin, Vincent Toal Jan 2004

Electronic Speckle Pattern Shearing Interferometer With A Photopolymer Holographyc Grating, Emilia Mihaylova, Izabela Naydenova, Suzanne Martin, Vincent Toal

Articles

A photopolymer holographic grating is used to produce the two sheared images in an electronic speckle pattern shearing interferometer. A ground glass screen following the grating serves the purpose of eliminating unwanted diffraction orders and to remove the requirement for the CCD camera to resolve the diffraction grating’s pitch. The sheared images on the ground glass are further imaged onto the CCD camera. The fringe pattern contrast was estimated to be above 90%. A validation of the system was done by comparing the theoretical phase difference distribution with the experimental data from the three point bending test.

A New Method Of Designing Forest Roads, Abdullah E. Akay Jan 2004

A New Method Of Designing Forest Roads, Abdullah E. Akay

Turkish Journal of Agriculture and Forestry

An unlimited number of alternative paths can be generated to connect 2 end points. Modern optimization techniques, which perform a systematic search for an optimum solution, can be used to solve such complex problems. In the field of highway design, various optimization techniques have been applied to locate a path between 2 known locations. However, there has been little optimization application in current forest road design systems. These systems are used as a tool to perform the mathematical calculations required to make basic manual road design. This study introduces a new method that integrates 2 optimization techniques for designing forest …

The Role Of Socioeconomics In Teaching Family Law, Margaret F. Brinig Jan 2004

The Role Of Socioeconomics In Teaching Family Law, Margaret F. Brinig

Journal Articles

Applying knowledge from other social sciences makes particular sense with the law and economics of the family. Much of the behavior we see and experience within families is difficult to see or understand as economically rational, that is, narrowly self-interested. Many of the legal changes we make that appear to be rational, at least from a cost-benefit perspective, turn out to be unsatisfying or even counterproductive. Though economists tend to view motivations or "utility functions" based upon "revealed preference," extended models like that of socioeconomics go below what is revealed to measure, as best we can, people's attitudes and feelings …

Blocs, Swarms, And Outliers: Conceptualizing Disagreement On The Modern Supreme Court Of Canada, Peter Mccormick Jan 2004

Blocs, Swarms, And Outliers: Conceptualizing Disagreement On The Modern Supreme Court Of Canada, Peter Mccormick

Osgoode Hall Law Journal

Almost half of the Supreme Court of Canada's decisions are not unanimous, but not all disagreement is of a kind. It makes a difference whether the panel's unanimity is broken by a single dissident, by several judges signing a single set of reasons, or by several judges each writing separately. This article examines the notion of disagreement, suggests a conceptual framework in which the various disagreement formats can be located, applies that framework to the Court's performance over the past thirty years, and concludes with some speculation as to why the Supreme Court of Canada and the United States Supreme …

Patent Law, The Federal Circuit, And The Supreme Court, A Quiet Revolution, Glynn S. Lunney Jr Jan 2004

Patent Law, The Federal Circuit, And The Supreme Court, A Quiet Revolution, Glynn S. Lunney Jr

Faculty Scholarship

Over the last twenty years, a quiet revolution has taken place in patent law. Traditionally, patents were rarely valid, but if valid, broadly enforced. Since Congress created the Federal Circuit in 1982 and vested it with exclusive intermediate appellate jurisdiction over patent appeals, patents have become routinely valid, but narrowly enforced. This article evaluates the economic consequences of this revolution. Focusing on the reasons for, and the costs of, uniformity in patent protection, this article shows that the revolution will tend to limit the patent system's ability to ensure the expected profitability, and hence the existence, of desirable, but high …

Uranium Oxide As A Highly Reflective Coating From 100-400 Ev, Richard L. Sandberg, David D. Allred, Luke J. Bissell, Jed E. Johnson, R. Steven Turley Jan 2004

Uranium Oxide As A Highly Reflective Coating From 100-400 Ev, Richard L. Sandberg, David D. Allred, Luke J. Bissell, Jed E. Johnson, R. Steven Turley

Faculty Publications

We present the measured reflectances (Beamline 6.3.2, ALS and LBNL) of naturally oxidized uranium and naturally oxidized nickel thin films from 100-460 eV (2.7 to 11.6 nm) at 5 and 15 degrees grazing incidence. These show that uranium as UO2, can fulfill its promise as the highest known single surface reflector for this portion of the soft x-ray region, being nearly twice as reflective as nickel in the 124-250 eV (5-10 nm) region. This is due to its large index of refraction coupled with low absorption. Nickel is commonly used in soft x-ray applications in astronomy and synchrotrons. (Its reflectance …

Microstructure Design Of A Two Phase Composite Using Two-Point Correlation Functions, Brent L. Adams, H. Garmestani, G. Saheli Jan 2004

Microstructure Design Of A Two Phase Composite Using Two-Point Correlation Functions, Brent L. Adams, H. Garmestani, G. Saheli

Faculty Publications

This work has been funded under the AFOSR Grant no. F49620-03-1-0011 and Army Research Lab contract no. DAAD17-02-P-0398 and DAAD 19-01-1-0742. Two-point distribution functions are used here as to introduce "Microstructure Sensitive Design" in two-phase composites. Statistical distribution functions are commonly used for the representation of microstructures and also for homogenization of materials properties. The use of two-point statistics allows the composite designer to include the morphology and distribution in addition to the properties of the individual phases and components. Statistical continuum mechanics is used to make a direct link between the microstructure and properties (elastic and plastic) in terms …

Optimal Shunt Capacitor Placement In Power Distribution System Using A Genetic Algorithm, Akram Fajer Bati, Nawfal M. Taher, Hazem Mohammed Jan 2004

Optimal Shunt Capacitor Placement In Power Distribution System Using A Genetic Algorithm, Akram Fajer Bati, Nawfal M. Taher, Hazem Mohammed

Iraqi Journal of Computers, Communications, Control and Systems Engineering

The problem of optimal placement of capacitors determines the size, type (fixed or switched), and locations of the capacitors to be installed in a radial distribution feeder that will reduce power loss while minimizing the costs of investment and installation of the capacitor banks. The present work is devoted to determine the optimal locations and sizes of capacitors in radial distribution system with different load levels using a genetic algorithm, taking in consideration the economic saving and cost of the capacitor. The optimal capacitor placement consists of problem formulations (based on the load flow equations in distribution system), genetic algorithms …

Arbitration And Litigation Of Employment Claims: An Empirical Comparison, Theodore Eisenberg, Elizabeth Hill Jan 2004

Arbitration And Litigation Of Employment Claims: An Empirical Comparison, Theodore Eisenberg, Elizabeth Hill

Cornell Law Faculty Publications

The authors conducted empirical research comparing court case and arbitrated outcomes for employment disputes. In cases not involving civil rights claims, they found little evidence that arbitrated outcomes materially differed from trial outcomes where the claimant was a higher-paid employee. Moreover, they found no statistically significant differences between employee win rates or in the median or mean awards in arbitration and litigation. They also reported evidence indicating that arbitrated disputes conclude more quickly than litigated disputes.

Anomaly-Free Component Adaptation With Class Overriding, Atanas Radenski Jan 2004

Anomaly-Free Component Adaptation With Class Overriding, Atanas Radenski

Mathematics, Physics, and Computer Science Faculty Articles and Research

Software components can be implemented and distributed as collections of classes, then adapted to the needs of specific applications by means of subclassing. Unfortunately, subclassing in collections of related classes may require re-implementation of otherwise valid classes just because they utilize outdated parent classes, a phenomenon that is referred to as the subclassing anomaly. The subclassing anomaly is a serious problem since it can void the benefits of component-based programming altogether. We propose a code adaptation language mechanism called class overriding that is intended to overcome the subclassing anomaly. Class overriding does not create new and isolated derived classes as …

Lean Product Development Flow, Bohdan W. Oppenheim Jan 2004

Lean Product Development Flow, Bohdan W. Oppenheim

Systems Engineering Faculty Works

A general holistic framework, also called a process—named “Lean Product Development Flow (LPDF)”—for organizing the engineering work of Product Development (PD), has been proposed as a contribution to the emerging field of Lean Systems Engineering. The framework is based on Lean Principles, with emphasis on PD value-pulling workflow pulsed by takt periods. The value is defined as (1) mission assurance/product quality, (the traditional goals of Systems Engineering) and (2) reduced program cost and schedule achieved by a radical reduction of waste. LPDF is recommended for smaller design programs based on a high degree of legacy knowledge, with technologies mature enough …

A Molecular Switch Created By In Vitro Recombination Of Nonhomologous Genes, Sarah F. Mitchell Jan 2004

A Molecular Switch Created By In Vitro Recombination Of Nonhomologous Genes, Sarah F. Mitchell

Chemistry and Biochemistry Faculty Works

We have created a molecular switch by the in vitro recombination of nonhomologous genes and subjecting the recombined genes to evolutionary pressure. The gene encoding TEM1 β-lactamase was circularly permuted in a random fashion and subsequently randomly inserted into the gene encoding Escherichia coli maltose binding protein. From this library, a switch (RG13) was identified in which its β-lactam hydrolysis activity was compromised in the absence of maltose but increased 25-fold in the presence of maltose. Upon removal of maltose, RG13's catalytic activity returned to its premaltose level, illustrating that the switching is reversible. The modularity of RG13 was demonstrated …

The Growth Of Valuations On Rational Function Fields In Two Variables, Edward Mosteig, Moss Sweedler Jan 2004

The Growth Of Valuations On Rational Function Fields In Two Variables, Edward Mosteig, Moss Sweedler

Mathematics, Statistics and Data Science Faculty Works

Given a valuation on the function field k( x; y), we examine the set of images of nonzero elements of the underlying polynomial ring k[ x; y] under this valuation. For an arbitrary field k, a Noetherian power series is a map z : Q --> k that has Noetherian (i.e., reverse well-ordered) support. Each Noetherian power series induces a natural valuation on k( x; y). Although the value groups corresponding to such valuations are well-understood, the restrictions of the valuations to underlying polynomial rings have yet to be characterized. Let Lambda(n) denote the images under the valuation v of …

Tree Diagrams For String Links Ii: Determining Chord Diagrams, Blake Mellor Jan 2004

Tree Diagrams For String Links Ii: Determining Chord Diagrams, Blake Mellor

Mathematics, Statistics and Data Science Faculty Works

In previous work, we defined the intersection graph of a chord diagram associated with a string link (as in the theory of finite type invariants). In this paper, we look at the case when this graph is a tree, and we show that in many cases these trees determine the chord diagram (modulo the usual 1-term and 4-term relations).

Higher Dimensional Algebra Vi: Lie 2-Algebra, John C. Baez, Alissa S. Crans Jan 2004

Higher Dimensional Algebra Vi: Lie 2-Algebra, John C. Baez, Alissa S. Crans

Mathematics, Statistics and Data Science Faculty Works

The theory of Lie algebras can be categorified starting from a new notion of `2-vector space', which we define as an internal category in Vect. There is a 2-category 2Vect having these 2-vector spaces as objects, `linear functors' as morphisms and `linear natural transformations' as 2-morphisms. We define a `semistrict Lie 2-algebra' to be a 2-vector space L equipped with a skew-symmetric bilinear functor [ . , . ] : L x L -> L satisfying the Jacobi identity up to a completely antisymmetric trilinear natural transformation called the `Jacobiator', which in turn must satisfy a certain law of its …

A New Proof Of A Theorem Of Phan, Curtis Bennett, Sergey Shpectorov

Mathematics, Statistics and Data Science Faculty Works

We apply diagram geometry and amalgam techniques to give a new proof of a theorem of K.-W. Phan, characterizing the special unitary group as a group generated by certain systems of subgroups SU(2, q(2)).

Renormalization-Group Analysis Of The Generalized Sine-Gordon Model And Of The Coulomb Gas For D > 3 Dimensions, I. Nandori, Ulrich D. Jentschura, Kornel Sailer, Gerhard Soff Jan 2004

Renormalization-Group Analysis Of The Generalized Sine-Gordon Model And Of The Coulomb Gas For D > 3 Dimensions, I. Nandori, Ulrich D. Jentschura, Kornel Sailer, Gerhard Soff

Physics Faculty Research & Creative Works

Renormalization-group (RG) flow equations have been derived for the generalized sine-Gordon model (GSGM) and the Coulomb gas (CG) in d ≥ 3 of dimensions by means of the Wegner-Houghton method, and by way of the real-space RG approach. The UV scaling laws determined by the leading-order terms of the flow equations are in qualitative agreement for all dimensions d ≥ 3, independent of the dimensionality, and in sharp contrast to the special case d=2. For the 4-dimensional GSGM it is demonstrated explicitly (by numerical calculations) that the blocked potential tends to a constant effective potential in the infrared limit, satisfying …

Hydrogeology And Ground-Water Flow In The Edwards-Trinity Aquifer System, West-Central Texas, Eve L. Kuniansky, Ann F. Ardis Jan 2004

Hydrogeology And Ground-Water Flow In The Edwards-Trinity Aquifer System, West-Central Texas, Eve L. Kuniansky, Ann F. Ardis

KIP Articles

Two finite-element ground-water flow models were developed for the Edwards–Trinity aquifer system, west-central Texas, to gain a better understanding of the flow system; one ground-water flow model was developed at a large scale to simulate the regional system and contiguous, hydraulically connected units, and one model was constructed at a smaller more detailed scale to simulate the most active areas of the system. The study area is divided into four geographic subareas: the Trans-Pecos (9,750 square miles), the Edwards Plateau (23,750 square miles), the Hill Country (5,500 square miles), and the Balcones fault zone (3,000 square miles). The major aquifers …
