In Australia there has been little research into the experiences and perceptions of education of parents from different minority groups whose young children attend school in this country. This study investigated the experiences that overseas born parents from non-English speaking backgrounds have of their own and their children's education in countries outside Australia, experiences of their children's early education in Australia, as well as those of their young children between 6 and 9 years of age attending school in this country. Health care professionals have debated the use and effects of electroconvulsive therapy (ECT) for more than 65 years. Yet, the attitudes towards, and knowledge about, ECT have not been thoroughly researched within the Australian community. There is also little empirical research documenting ECT recipient characteristics, the number of ECT administrations and the number of patients treated. The quintessential distinguishing feature of the American criminal justice system is the jury. Juries representative of their communities perform the interrelated functions in criminal trials of rendering verdicts that reflect a sense of community justice and giving normative content to the law. When those functions are successfully performed, the jury lends legitimacy to the criminal justice system, bolstering public confidence in the extant rule of law.

This essay begins, therefore, by briefly examining the question of what constitutes good lawyering. The essay acknowledges the difficulty of defining precisely what is good lawyering. In fact, scholar, judges, and lawyers often disagree markedly when they characterize lawyer behavior using the term. Not surprising, then, even though academic commentators routinely trumpet the importance of establishing a meaningful attorney-client relationship as an important aspect of good lawyering, not all in the legal profession embrace that view.

Judges As Film Critics: New Approaches To Filmic Evidence, Jessica Silbey

This Article exposes internal contradictions in case law concerning the use and admissibility of film as evidence. Based on a review of more than ninety state and federal cases dating from 1923 to the present, the Article explains how the source of these contradictions is the frequent miscategorization of film as “demonstrative evidence,” evidence that purports to illustrate other evidence, rather than to be directly probative of some fact at issue. The Article further demonstrates how these contradictions are based on two venerable jurisprudential anxieties. Trademark merchandising is big business. One marketing consultant estimated the global market for licensing and marketing sports-related merchandise at $17 billion in 2001. With this much money at stake, it's no surprise that trademark holders demand royalties for use of their marks on shirts, key chains, jewelry, and related consumer products. The purpose of this study was to identify elements present in effective literacy instruction, i.e., those elements that fostered reading, speaking, listening, thinking, writing, and metacognitive skills. By examining variables that promoted literacy acquisition and achievement, a detailed account resulted which described classroom practice as related to teacher beliefs, strategies, materials, and classroom climate. The primary method of qualitative analysis used for this study was the Developmental Research Sequence (DRS) Method (Spradley, 1980). Two classrooms with exemplary teachers were studied extensively. This article argues that better understanding of metaphor's cognitive role can help lawyers shape judicial decision-making. As a way of exploring metaphor's contribution to shaping the law, the article focuses on how a particular lawsuit was influenced by metaphor, in particular, by the primary metaphor that a corporation is a person within the more complex metaphorical system suggested by the marketplace of ideas model for First Amendment protection. The purpose of this study was to determine the written language skills of middle and high school students who were attending alternative programs in Southern California. The participants of this study were 114 students who were identified and served under Delinquency Prevention Program (DPP) and 83 students who were identified and served under Court Ordered Probation (COP). The Test of Written Language -3 (TOWL-3) (Hammill & Larsen, 1996) was administered to the participants in order to obtain written language measures. The America intelligence community in 1950, unprepared to perform its missions, failed to provide adequate indications and warning to U.S. national leaders and to the Commander, Far East Command (FEC), about the North Korean invasion of South Korea and Red Chinese intervention in the Korean War. Post-World War II policies that reduced the size of the military, cut systems and training, and reorganized intelligence services are responsible for that failure. Training deficiencies meant that intelligence soldiers deployed to Korea without required skills. The disjunction between the oral and the literate in the works of William Faulkner reveals the different ways these distinct modes of organization combine to structure a text. The oral in Faulkner's fiction makes its presence known not only as offset speech but also as a mode of action and narrative whose logic is conjunctive rather than disjunctive. This research aimed to provide some proof or refutation of the hypothesis that online communities develop specialized vocabularies, often technical jargon, and use elements of those vocabularies, here labeled “tokens,” to ascribe credibility and/or authority to other posters. The literature from a variety of communications fields relating to this topic was summarized as a progression from an early “limitations” model of computer-mediated communication (CMC) to a later “opportunities” model. This study of four 19th and 20th century colonial texts, as well as a later postcolonial novel exposes the cadres exotiques, or exotic frameworks, of literary exoticism. The thesis names and interprets the moods of and reactions to exoticism, including colonial exoticism, antiexoticism, and autoexoticism. Poetic and theoretical interpretations of exoticism, such as Victor Segalen’s Notion du Divers and Edouard Glissant’s Opacité and Poétique de la Relation challenge the prevalent assumptions that the literary practice was only an unfortunate byproduct of colonialism. This dissertation is based on a study of writing and identity set at Catholic High School in Pointe Coupee, Louisiana. For their senior English class, the six young women participating in the study produced a number of pieces of writing of various types, contrasting in genre, length, content, and register. This study uses Mikhail Bakhtin's chronotope, which is the informing principle of one's experience of space and time, to explore different relations among space, time, actors, and audience in medieval theatre. Relations between the material and spiritual worlds as understood in the Middle Ages are considered in the context of relations between performers and audience members with two goals. First, I explore how the ontological status of the metaworld created through performance changed in the context of specific chronotopes. This study examines variations in the performance of speech acts and additional discourse features in situational speech patterns of Peninsular Spanish. Based on studies by Blum-Kulka, et al. (1989), nine situations were created, varying from less severe to more severe, to elicit natural responses for apologies and requests. Forty participants from Castile and Andalusia were interviewed, and the data were coded to examine the differences in speech act realizations and the use of specific discourse features. Auditory processing disorders (APDs) have received considerable attention over the past few decades. Much of the attention has focused on the controversy surrounding the operational definition of APD, the heterogeneous nature of APD, and an appropriate test battery for APD assessment. Temporal processing deficits are one characteristic of APD and are the focus of the present investigation. This investigation reports behavioral and early electrophysiological measures in a group of children with specific temporal processing difficulties and an age-matched control group. This dissertation traces the development of the supernatural from the late eighteenth to the late nineteenth-century. Since supernatural elements are unknown and unfamiliar, they easily arouse anxiety, fear, and even result in terror. As such they produce the effect of the uncanny and introduce the psychological component into the selected literary corpus taken from the English Gothic novel, the German Schauerroman, and the French littérature fantastique. The analysis of the selected material is based on a psychoanalytical approach using Sigmund Freud’s understanding of the uncanny, his dream analysis, and his view of the conscious and unconscious, but also considers Carl …
