HIV prevention issues for Asian American and Pacific Islander (API) women are complex and multifaceted. Comprehending the risk enhancing/reducing responses of API women in heterosexual relationships requires an examination of various sociocultural influences, such as gender roles, cultural expectations, community, economic conditions, acculturation and public policies that shape API women's decision-making and HIV risk enhancing/reducing responses. In order to address these issues, a mixed method study (i.e., qualitative and quantitative) was conducted to elucidate these sociocultural factors. The persecution of Native Americans in the United States has not yet come to an end. There are many policies still in place that lead to the reduction of the unique culture of the Native Americans. This can have disastrous impacts for their own survival and well being. These policies reduce their language, culture, selfdetermination, their knowledge of the environment, and increases their poverty. In spite of their linguistic and cultural differences, William Faulkner’s The Sound and The Fury and Juan Rulfo’s Pedro Páramo offer striking structural similarities when analyzed within the framework of Comparative Literature. Not only do both novels treat the same fundamental and universal themes, but they also, each in its own right, signify a rupture with a traditional literary form by altering considerably the modalities of the narrative syntagm. Particular economic and socio-historical circumstances led Faulkner and Rulfo to portray their own social reality through two similar narrative currents, Southern Gothic and the Simbolismo mágico, and a comparative study of …

The Influence Of Legal Language Upon Supreme Court Voting In Civil Liberties Cases., Sean Wilson

Scholars such as Jeffrey Segal and Harold Spaeth contend that U.S. Supreme Court decisions are based primarily upon the ideological beliefs of the justices. However, in this work I show that this conclusion is exaggerated. The aggregation of votes into a summary statistic (the percent liberal rating) and its use by Segal and Spaeth in a regression having only 21 cases creates misleading results. The truth is that political ideology is a fluctuating influence upon the Court. In some areas of civil liberties voting, ideology is a poor explanation of how cases are decided (e.g., core political speech). But in …

In the aftermath of violent crime, survivors are confronted by questions of comprehension, healing, normalcy, accountability, and restoration. These same issues are communicated to audiences via mass media coverage of the crime and ensuing legal proceedings that focuses upon survivors while they are in the public eye - and while those suspected of the crime are in the defendant's chair. Such stories bring a human face to the innocents most affected by the outcome of the proceedings, relaying their involvement in and response to legal developments from arrest to execution. Faced with unacceptable failure rates in introductory mathematics courses, institutions of higher learning are incorporating methods of placing students into their math courses based upon the students' preexisting math knowledge or skills. West Virginia University is no exception and is currently incorporating a combination of ACT/SAT scores with an internal placement exam to properly place students in the appropriate math course. This method is not working in that failure rates continue to rise in spite of continual increases in placement requirements. This document represents the first comprehensive analysis of Joseph Schwantner's Aftertones of Infinity as an example of moment form. Exploring Stockhausen's description of moment form and its recent interpretations in Jonathan Kramer's discussion of moment time, this paper will investigate Schwantner's Aftertones by focusing on its eighteen moments. The analysis will define these moments by their underlying static harmonies, fixed tempos, and consistency of textures, melodies, and rhythmic materials. The role of the paraeducator in providing services to students with special needs has expanded to become part of a complex system of providing special education services. In order to meet the individualized needs of students with disabilities, educational agencies and school districts have increasingly relied on the services of paraeducators to facilitate the specialized instruction needed for students to participate in the least restrictive environment. Case studies were completed with three special education self-contained classrooms. This essay is one of a series destined to appear in a Foundation Press book, Administrative Law Stories, now set for publication in the fall of 2005. The decision in Citizens to Preserve Overton Park v. Volpe represents a transition from political to judicial controls over decisions broadly affecting a wide range of community interests. During the 1990s, standards-based reform became the predominant education reform inthe country. However, neither federal legislation nor state standards-based reform programshave focused much on addressing the needs of special groups. While, the explicit goal ofstandards-based reform was to raise academic achievement of all students, the implicit goal wasto change beliefs about specific groups of students, particularly students who traditionally havebeen perceived as "disadvantaged." The first substantive clause of the Constitution – providing that "[all legislative Powers herein granted shall be vested in a Congress" – is associated with two postulates about the allocation of legislative power. The first is the nondelegation doctrine, which says that Congress may not delegate legislative power. The second is the exclusive delegation doctrine, which says that only Congress may delegate legislative power. This Article explores the textual, historical, and judicial support for these two readings of Article I, Section 1, as well as the practical consequences of starting from one postulate as opposed to the other. Betrayal and disloyalty are grievous moral wrongs, yet today when the disloyal commit treason we seem reluctant to punish them. John Walker Lindh fought for the Taliban with full knowledge that it was engaged in hostilities against the United States. It should not have been so difficult to prove by two witnesses to the overt act, as the Constitution requires, that he adhered to the enemy giving them aid and comfort. I am aware that each individual will experience transcendence in art differently. This study attempts to organize the conglomerate of writing on Africans within Republican Cuba. Starting with an examination of the scientific stages of such writing, we will trace the assorted work of Fernando Ortiz (1881-1969), whose anthropological study of Afrocuba produced myriad readings of the heritage. The multiplicity of renderings of Cuba s Africans from the scientific arena including condemning, racially charged treatises and spiritual conceptualizations of the richness of Cuba s African heritage generated an air of inconstancy. This is a question that addresses the core function and purpose of visual communications design. The question is explored in this film thematically, narratively, and technically, by portraying a story about a person struggling to understand language and solve a unique, high stakes design problem: the library cataloging of an entire human life. Previous research (Daugherty, Murphy, & Puagh, 2001) has suggested that the Sulliman Scale of Social Interest (SSSI) is an effective predictor of recidivism in criminal offenders. The purpose of the present study was to extend the previous investigation and to examine the relationship between the concepts of social interest and psychopathy and how each are related to the prediction of criminal behavior. The SSSI is based on Adler's conceptualization of social interest as concern for others and optimism with regard to one's view of the world. The Psychopathic Personality Inventory Short Form (PPI-SF) is based on Cleckley's notion of psychopathy …

The impact of traditional and alternative teacher preparation programs on student achievement and the instructional delivery methods used in middle school and high school Algebra I classrooms was explored through a mixed method comparative design. The data analysis revealed that alternative teacher preparation programs are a viable avenue to explore in meeting the needs of public schools for providing qualified teachers in mathematics classrooms at the middle school and high school levels. Data from the standardized state test and district level quarterly assessments revealed no significant differences between groups on half of the achievement measures, but there was a significant …

Debate about teacher supply and demand has been renewed in recent years by an increased concern about the reduced numbers of students entering teacher education programs and the resulting teacher shortages. Thus, American schools are experiencing teacher shortages, especially in low-income urban areas, because of increased school enrollment, teacher retirement, reduction of class size, teacher attrition, and turnover related to low salaries, job dissatisfaction, lack of administrative support and influence over decision-making. From the standpoint of traditional legal thought, metaphor is at best a dash of poetry adorning lawyerly analysis, and at worst an unjustifiable distraction from what is actually at stake in a legal contest. By contrast, in the eyes of those who view law as a close relative of ordinary language, metaphor is a basic building block of human understanding. This article accepts that metaphor helps us to comprehend a court's decision. At the same time, it argues that metaphor plays a special role in the realm of constitutional discourse. The essay strives for a better understanding of the myths, symbols, categories of power, and images deployed by the Supreme Court to signal how we ought to think about its authority. Taking examples from free speech jurisprudence, the essay proceeds in three steps. First, I argue that the First Amendment constitutes a deep source of cultural authority for the Court. As a result, linguistic and doctrinal innovation in the free speech area have been at least as bold and imaginative as that in areas like the Commerce Clause. Sarcastic Family Climates: Self-Reported Evaluations Of Family Interaction, Effect Of Non-Literal Communication, And Attachment Style, Gary Alan Beck

The non-literal aspect of sarcastic utterance meaning opens up multiple perspectives regarding its interpretation, ultimately depending on the context and the relationship between those that use it. Self-reports from 151 young adults indicated that there was significant correlation between father's typical intensity of sarcasm use and subject verbal aggression, with significantly less father intensity of typical sarcasm use reported by subjects with low levels of verbal aggression. These findings suggested that sarcasm use is more prevalent in typical father young-adult directed communication with subjects that report themselves as being moderate and high verbally aggressive communicators. The little more than 300.000 Danes who emigrated to America between 1870 and World War II created a solid foundation for the cultural exchange between the United States and Denmark in many different ways. This exchange takes place on a family level as well as in a professionally managed way via a number of organizations which arrange longer visits in private homes for students, young farmers, and youth in general within the two countries.
