Lighting The Lantern: Visions Of A Virtual All-Women's Law School, Nancy E. Shurtz Jan 2004

Lighting The Lantern: Visions Of A Virtual All-Women's Law School, Nancy E. Shurtz

UC Law SF Journal on Gender and Justice

"Lighting the Lantern: Visions of a Virtual All-Women's Law School" is a fictional narrative of a hypothetical all women's law school. It is written in non-traditional form in the hope that it will prompt the reader to view the law, academic institutions and societal constructs in ways more consistent with an evolving society that should embrace all differences, whether those differences are gender or racially based.

The mission of the All Women's Law School is threefold: "First, to teach specific lawyering skills and disseminate knowledge in a context designed to help students function effectively in the existing culture while working …

A Hometown Dilemma: Addressing Th E Sexual Harassment Of Undocumented Women In Meatpacking Plants In Iowa And Nebraska, Amanda Clark

UC Law SF Journal on Gender and Justice

Sexual harassment of undocumented women workers continues to be a systemic problem within the meatpacking industry. In Iowa and Nebraska, the state legislature, the Equal Employment Opportunity Commission, labor unions, and local advocacy organizations are working to address the problem of sexual harassment within the meatpacking industry. This note addresses the ongoing issues facing women in the meatpacking industry in Iowa and Nebraska, in particular the unique concerns facing undocumented and immigrant women workers. Judicial Dialogue For Legal Multiculturalism, Charles H. Koch Jr. Jan 2004

Judicial Dialogue For Legal Multiculturalism, Charles H. Koch Jr.

Michigan Journal of International Law

This Article asserts that judicial exchange rather than dominance has inherent advantages as a technique for evolving a global legal culture. For insight into the global task, the Article looks first at an internecine struggle within the continental system. For further background, it describes how the U.S. Supreme Court has accommodated deviations from the basic legal model in U.S. administrative law as well as other internal U.S. legal systems. The supranational tribunals in the European setting and U.S. Supreme Court have shown the capacity to engage in dialogues over diverse legal philosophies. These experiences demonstrate the advantages of a mix …

Access Denied: The Problem Of Abused Men In Washington, Melody M. Crick Jan 2004

Access Denied: The Problem Of Abused Men In Washington, Melody M. Crick

Seattle University Law Review

This Comment explains how the Washington legislature and court system have failed to provide abused men with much needed protection, despite a law that is facially gender neutral. Following this Introduction, Part II explores the wording of Washington's domestic violence statutes and analyzes the current implementing regulations. Part III demonstrates that the problem of abused men is legitimate by examining increasing social awareness and the results of current studies. By examining the prevailing national viewpoint embodied in the Violence Against Women Act, Part IV discusses how such a viewpoint adversely affects the availability of resources for abused men. Part V …

Indian Policy And The Imagined Indian Woman, Bethany Berger Jan 2004

Indian Policy And The Imagined Indian Woman, Bethany Berger

Faculty Articles and Papers

In this contribution to the symposium on Santa Clara Pueblo v. Martinez held by the Tribal Law Center at the University of Kansas, I reflect (with pictures!) on the role of women in federal American Indian policy and tie this history to current debates about the Martinez decision. I argue that the perception by non-Indians that they were riding to the rescue of oppressed and exploited Indian women was always a powerful justification for Indian policy, but that the Indian women whose plight called out for European and American protection were not real women, but were instead imagined by the …

Fruits, Nuts, Cigarettes, And The Right To Remain Silent, Christine Esperanza Jan 2004

Fruits, Nuts, Cigarettes, And The Right To Remain Silent, Christine Esperanza

UC Law Constitutional Quarterly

The First Amendment not only protects against limitations on one's speech but against governmentally compelled speech as well. Although the Supreme Court afforded increasing protection to commercial speech, a majority later held that an analysis of compelled advertising in this context did not raise First Amendment issues. In United States v. United Foods. No. 00276 (June 25, 2001), the United States Supreme Court revisited this issue, holding that "the mandated support is contrary to the First Amendment principles set forth in cases involving expression by groups which include persons who object to speech, but who, nevertheless, must remain members of …

Celebrating A Diamond Anniversary: Pennsylvania Bar Association Quarterly Volumes 1-74 (1929-2003): A History, Joel Fishman

Law Faculty Publications

In celebrating the seventy-fifth year anniversary of the Pennsylvania Bar Association Quarterly, a description and some commentary upon this leading periodical of the state bar association deserve attention.1 The Quarterly’s publication history is fairly straightforward. The first issue was published in June 1929. In the first ten years, issues were numbered from one to forty until June 1939 and so for bibliographical purposes, volumes are not included in the citations.2 Beginning in 1939-40, the volume number (11 ) was added. In the first four years the Quarterly was published in June, September, December, and March and changed to …
