The Higher Calling: Regulation Of Lawyers Post-Enron, Keith R. Fisher

This Article discusses some of the inadequacies in the current ethical regulation of the legal system and proposes a new approach to crafting and contextualizing rules of legal ethics. The proliferation of specialties and subspecialties in law practice, together with the inadequacies of prevailing ethics regulation and the vagaries of ethics rules formulations from state to state have not served either the public or the legal profession well. Manipulation, motivated by politics and self-interest, of the ideology of the organized bar to adhere to ethical rules predicated on an antiquated and unrealistic model of a unified legal profession has likewise …

The CAN-SPAM Act of 2003 presents a compliance problem for law firms that issue periodic newsletters to clients or prospective clients. While the Act does not expressly include such newsletters, nor define commercial advertisement in a manner that suggests newsletters will be included, the advisory opinions from state ethics boards suggest that newsletters are advertisements. Arguments can be made that newsletters to current clients are not advertisements. However, given the low cost of compliance with the Act, firms should treat these newsletters as commercial advertisements and adhere to the provisions of the Act.

This thesis discusses the different fiduciary duties and standards of review imposed by Delaware laws on the directors to the minority shareholders in the going-private transactions structured either as a merger or as a tender offer voluntarily initiated by the controlling In the context of a merger, the disinterested and independent directors will face a duty of care and be subject to the business judgment rule. Although current case law is divided regarding when an accountant is practicing law, this Article will explore different approaches to this problem. Specifically, Part II of this Article explores which entities control the regulation of the legal profession. Next, Part III examines the impact of the state courts on the issue of unauthorized legal practice. Part IV touches on the related issue of privilege and the treatment of attorney-client privilege in the context of tax practice. The Relationship Between Religious Programs And Peer Relationships Of Adults With Mental Retardation, Cecilia D. Beasley

This research was intended to look at the relationship between attendance at religious programs on the peer relationships and spirituality of adults with mental retardation. The literature reviews the benefits of spirituality for all individuals, the characteristics of individuals with mental retardation, and the influences of peer relationships. Fifty-nine surveys about the individual's spiritual development, happiness, peer relationships and criminality as well as the importance of religious functions were completed by adults with and without mental retardation. The results indicate that attendance at religious activities does in fact impact spirituality and peer relationships of individuals with mental retardation. They also …

Responding to a request from the University of Alaska Anchorage (UAA) alumni, the UAA provost asked the Institute of Social and Economic Research (ISER) to investigate the need for a law school in Alaska. Alaska is the only state that does not have a law school. The question of whether to establish a law school in Alaska has been discussed for more than thirty years.
