In the last forty years federal courts have played a prominent role in reshaping our public institutions. And while some scholars question the efficacy of these structural injuctions, the authority of federal courts to order such relief is generally unquestioned. What is open to debate, however, is whether state officials can agree to a remedy they would not have had the authority to order themselves; and if so, to what extent must an underlying constitutional violation be proved so as to justify the remedy?

Jurisprudence can seem like a formidably esoteric field, with conceptual arguments carried on at a high level of abstraction, seemingly remote from the concerns of practicing lawyers. In fact, it is impossible to ignore jurisprudence when thinking about the role of lawyers in the wave of financial accounting scandals exemplified by the collapse of Enron. The Enron case is not about ethics so much as it is about the interpretation and application of a complex scheme of legal norms to innovative business transactions. The Supreme Court Limits Lawsuits Against Managed Care Organizations, Timothy Stoltzfus Jost

In Aetna Health Inc. v. Davila, the United States Supreme Court revisited the question of whether the Employee Retirement Income Security Act (ERISA) precludes state lawsuits against ERISA plans. The Court held that ERISA preempts damage actions brought against managed care organizations under the Texas Health Care Liability Act because ERISA itself provides the exclusive remedy for challenging ERISA plans' coverage decisions. The Court suggested, however, that health plans might be liable for treatment decisions made by employed physicians. It also volleyed back to Congress the question of whether ERISA beneficiaries should have any remedy for damages caused by coverage …

This thesis is discussed corporate governance issues in different legal schemes, mainly about the latest legal reforms in the United States, and Taiwan. And it is also talked about what kinds of impacts of the latest legal reforms of corporate governance in the United States on the foreign private issuers listed their securities in the NYSE or Nasdaq. An Introductory Lesson To Mexican Law: From Constitutions And Codes To Legal Culture And Nafta, Jorge A. Vargas
San Diego Law Review
This Article provides an introductory lesson to Mexican law, beginning with exploring the growing presence of Mexican law in the United States. He proceeds to explore the historical background of Mexican law, and looks at the relationship between "Aztec law" and Mexican law. Then, the author discusses the legal education of Mexican attorneys and the legal culture in Mexico. Finally, the author examines the "Americanization" of Mexican law by looking at NAFTA and it's effects.

Six Easy Pieces: Teaching Experientially, Steven Hartwell
San Diego Law Review
Steven Hartwell explores the growth and value of teaching experientially in this article. Experiential teaching emerged when clinical legal education grew in response to student demands for a more relevant education. The educational advantages of the field clinic model are substantial: students are more motivated to lean, the learning is direct and based on real experience, it entails both cognitive and affective domains, and raises ethical issues by working with real clients. The author examines David Kolb's theory of experiential learning; the basic premise of that theory is that effective learning takes place experientially in a continuous, circular four-stage sequence. …

The Organizational Analysis Of Non-Governmental Development Organizations (Ngdos), Urelmaa Tsolmon
Theses and Dissertations
This paper uses the current organizational ecology theory to clearly define organizational population ecology constructs of non-governmental development organizations, and offers specific terminology and understanding of main organizational forms and relational dynamics that define the population ecology of these organizations. The paper examines closely the significance of such interaction and interdependence through transactional relationship of obtaining and distributing of resources and forces of competition. Original organizational theory frameworks are offered for future NGDO organizational research.
