Global Changes In Regulating Corporate Auditors: A Comparative Assessment, Richard Thompson Ainsworth

Auditor independence was a global concern of financial regulators in the 1990's. Some observers saw this in a positive light, a natural development. Adjusting auditor independence rules was a manifestation of global convergence in corporate governance structures. New rules, especially rules leaning toward a harmonized system were welcome.

There was a more sobering view. This view held that global regulators were less concerned with convergence than they were with a sense of impending disaster. Things had gone too far. Significant, maybe even radical change was needed. The independence of corporate auditors had eroded; trust had been fundamentally compromised in the …

Defining Dicta, Michael Abramowicz, Maxwell Stearns

George Mason University School of Law Working Papers Series

In recent decades, legal scholars have devoted substantially greater attention to studying the origin and nature of stare decisis than to defining the distinction between holding and dicta. This appears counter-intuitive when one considers, first, that stare decisis applies only to holdings of announced precedents, and second, that beyond problematic and rudimentary intuitions, the legal system has failed to develop meaningful definitions of these terms. While lawyers, legal scholars, and jurists likely assume that they can identify dicta when they see it, a careful analysis that categorizes the range of judicial assertions in need of proper characterization reveals that defining …

Since the rapid rise in organizational forms for business associations, academics and practitioners have sought to explain the choice of form rationale. Each form contains its own set of default rules that inevitably get factored into this decision, including the extent to which each individual firm owner will be held personally liable for the collective debts and obligations of the firm. The significance of the differences in these default rules continues to be debated. Corporate Change And Integration As A Result Of A Merger : An Analysis Of Organizational Culture Within A Large Full-Service Law Firm., Ilker Huseyin Onen

Previous research on organizational mergers has found that such a business activity bears an effect upon the structural and cultural foundations of organizations. Whether combining intellectual resources or capital, mergers combine workforces that have operated within every unique historical settings. This research focused on a merger between two law firms and the subsequent acquisition of an additional firm. Interviews with a random stratified sample of employees were conducted to gain insight on the cultural aspects of workforce integration. Througout the research, culture and structure were used as interrelated aspects when addressing the merger. The main result of the research revealed …

Court Review: Journal of the American Judges Association

Attitudes toward the courts can affect the way individuals perceive their role in the justice system: their willingness to comply with laws, report crimes, file legal suits, serve as jurors, and so on. In short, a positive public perception of the courts is “critical to the maintenance and operation of the judicial system.” Given the import of these perceptions, a substantial body of research has examined the factors that explain differing levels of support for the court system. Although many of these studies examine national samples or examine attitudes toward the U.S. Supreme Court, it is beyond the scope of …

Juveniles' Attitudes Toward The Police As Affected By Prior Victimization., Joshua A. Hardin

Electronic Theses and Dissertations

The purpose of this study was to analyze juveniles' attitudes toward the police and how their attitudes were affected by prior victimization and delinquency, controlling for race, gender, and city of residence. All variables used in this study came from the Gang Resistance Education and Training (G.R.E.A.T.) data collected by Esbensen (1999). The analysis indicated that females held more favorable attitudes toward the police than males, Whites held more favorable attitudes toward the police than non-Whites, and juveniles living in small rural/suburban areas held more favorable attitudes than those living in large urban areas.
