Supreme Court Watch, Reginald Oh Jul 2004

Supreme Court Watch, Reginald Oh

Law Faculty Articles and Essays

Oh discusses how the U.S. Supreme Court, in General Dynamics Land Systems, Inc. v. Cline, 124 S. Ct. 1236 (2004), settled a circuit court conflict over the viability of "reverse age discriminations" claim under the Age Discrimination in Employment Act (ADEA). The Court, in a 6-3 decision, held that statutorily protected workers over the age of forty may not bring an ADEA claim alleging that their employer discriminated against them in favor of older employees.

The Logic And Experience Of Law: Lawrence V. Texas And The Politics Of Privacy, Danaya C. Wright

UF Law Faculty Publications

The U.S. Supreme Court's June 2003 decision in Lawrence v. Texas may prove to be one of the most important civil rights cases of the twenty-first century. It may do for gay and lesbian people what Brown v. Board of Education did for African-Americans and Roe v. Wade did for women. While I certainly hope so, my enthusiasm is tempered by the fact that discrimination on the basis of race or gender has not disappeared. Will Lawrence signal meaningful change, or will its revolutionary possibilities be stifled by endless cycles of excuse and redefinition? The case is important, but I …

Understanding Adolescent Intentions To Smoke: An Examination Of Relationships Among Social Influence, Prior Trial Behavior, And Antitobacco Campaign Advertising, J. Craig Andrews, Richard G. Netemeyer, Scot Burton, David Paul Moberg, Ann Christiansen

Marketing Faculty Research and Publications

Telephone interviews were conducted with more than 900 adolescents aged 12 to 18 as part of a multimillion dollar, statewide, antitobacco advertising campaign. The interviews addressed two primary questions: (1) Do counter-advertising campaign attitudes directly affect antismoking beliefs and intent in a manner similar to those of conventional advertisements? and (2) Can advertising campaign attitudes have a stronger effect on beliefs and intent for adolescents with prior smoking behavior and for adolescents exposed to social influence (i.e., friends, siblings, or adult smoker in the home)? The authors' findings show that advertising campaign attitudes, prior trial behavior, and social influence all …

United States Department of Commerce: Staff Publications

Research on the western gray whale (Eschrichtius robustus) population summering off northeastern Sakhalin Island, Russia, has been ongoing since 1995. This collaborative Russia-U.S. research program has produced important new information on the present day conservation status of this critically endangered population. This report reviews recent findings from 2003 research activities and combines such with data from previous years, in some cases ranging back to 1994. Photo-identification research conducted off Sakhalin Island in 2003 resulted in the identification of 75 whales, including 11 calves and two previously unidentified non-calves. When combined with data from 1994-2002, a catalog of 131 …

Relative Importance Of Heat-Labile Enterotoxin In The Causation Of Severe Diarrheal Disease In The Gnotobiotic Piglet Model By A Strain Of Enterotoxigenic Escherichia Coli That Produces Multiple Enterotoxins, Emil M. Berberov, You Zhou, David H. Francis, Michael A. Scott, Stephen D. Kachman, Rodney A. Moxley

School of Veterinary and Biomedical Sciences: Faculty Publications

Enterotoxigenic Escherichia coli (ETEC) strains that produce multiple enterotoxins are important causes of severe dehydrating diarrhea in human beings and animals, but the relative importance of these enterotoxins in the pathogenesis is poorly understood. Gnotobiotic piglets were used to study the importance of heat-labile enterotoxin (LT) in infection with an ETEC strain that produces multiple enterotoxins. LT- (ΔeltAB) and complemented mutants of an F4+ LT+ STb+ EAST1+ ETEC strain were constructed, and the virulence of these strains was compared in gnotobiotic piglets expressing receptors for F4+ fimbria. Sixty percent of the piglets …

Hard Numbers, Hard Times: Homeless Individuals In Massachusetts Emergency Shelters, 1999-2003, Tatjana Meschede, Brian Sokol, Jennifer Raymond

Center for Social Policy Publications

Hard Numbers, Hard Times is the fruit of five years of homeless management information systems data collected in homeless emergency shelters serving individuals across Massachusetts. For the first time, comprehensive, reliable statewide data are provided on how many people accessed the system, where people became homeless, what they attributed their homelessness to, how long they stayed in shelter, and where they went when they left. These data are combined with information on demographics, income, special needs and insurance status along with analysis and interviews to provide multiple perspectives on the Massachusetts shelter system.

Comparison Of Medical Subject Headings And Text-Word Searches In Medline To Retrieve Studies On Sleep In Healthy Individuals, Elizabeth Sergeevna Jenuwine, Judith A. Floyd

Nursing Faculty Research Publications

Objective: The objective was to investigate the performance of two search strategies in the retrieval of primary research papers containing descriptive information on the sleep of healthy people from MEDLINE.

Methodology: Two search strategies - one based on the use of only Medical Subject Headings (MeSH), the second based on text-word searching - were evaluated as to their specificity and sensitivity in retrieving a set of relevant research papers published in the journal Sleep from 1996 to 2001 that were preselected by a hand search.

Results: The subject search provided higher specificity than the text- word search …

From Discussion Leader To Consumer Guide: A Century Of Theater Criticism In Chicago Newspapers, Scott B. Fosdick

Faculty Publications

This article completes a three-part examination of theater critics working for Chicago newspapers during the twentieth century. The first article in the series covered the "boomtown" period leading up to World War I, and the second article addressed Chicago's rise after 1960 as a regional center for theater covered by fewer newspapers and fewer critics. This article reviews those periods but emphasizes the middle, "road town" period, which saw a gradually dwindling band of critics functioning as quality control experts, passing judgment on New York road shows. After examining that period, this article uses commodification to consider the changing role …
