The Quest For Housing, Leslie Moore Jul 2004

The Quest For Housing, Leslie Moore

Theses and Graduate Projects

What are the factors that affect the ability of a person with serious and persistent mental illness to maintain stable housing? People with serious and persistent mental illness face many challenges to find and/or maintain stable housing. Interviews were conducted with 12 individuals with serious and persistent mental illness. Structured individual interviews concentrated on each participant's ability to find housing, how the participant found current and past housing (past two years), if he or she was assisted in the process, and identified any difficulties encountered while seeking housing. A second aspect of the study focused on the challenges each individual …

Overview Of Prior Informed Consent From And International Perspective, Melanie Nakagawa Jul 2004

Overview Of Prior Informed Consent From And International Perspective, Melanie Nakagawa

PEEL Alumni Scholarship

Prior Informed Consent ("PIC") is an important and timely topic because it raises and melds significant issues in the international community beyond those that involve the protection of human health and the environment. PIC is considered by many as both arising from and being an extension of several United States laws, specifically the Toxic Substances Control Act ("TSCA") of 1976. This is because TSCA includes provisions on export notification and conditions requiring the United States Environmental Protection Agency ("EPA") to implement specific measures to control potential hazards associated with chemical substances or mixtures that present or will present an unreasonable …

Indigenous People's Right To Free, Prior And Informed Consent And The World Bank's Extractive Industries Review, Fergus Mackay

PEEL Faculty Scholarship

The World Bank Group (“WBG”) is a notable exception despite two major reviews, both commissioned by the WBG, which recommend incorporation of FPIC into WBG policy and practice with special reference to indigenous peoples. The first was the World Commission on Dams, which made detailed recommendations in relation to FPIC, all of which were rejected by the WBG. The second, and focus of this article, the World Bank’s Extractive Industries Review (“EIR”), is presently under consideration by WBG management prior to submission to the Board of Directors. In a leaked January 2004 WBG management response to the EIR’s Final Report, …

Of Gift Horses And Great Expectations: Remands Without Vacatur In Administrative Law, Daniel B. Rodriguez

University of San Diego Public Law and Legal Theory Research Paper Series

Administrative law has been shaped over the years by fundamentally practical considerations. Displacement of agency decisions by courts was rare; yet, the omnipresent threat of substantial judicial intrusion surely affected agency decisions. While the Administrative Procedure Act, adopted nearly 60 years ago, provides a comprehensive template for federal agency decisionmaking, what is striking about the APA is how much is left out and how much is left to the discretion of both agencies in implementing regulatory decisions and to the courts in superintending agency action. Given this history, it is hardly surprising that many doctrinal techniques represent the pragmatic effort …

Bilateral Internuclear Ophthalmoplegia As A Presenting Sign Of Multiple Sclerosis: An Interdisciplinary Approach To Diagnosis And Management, Sherrol A. Reynolds, Joseph Pizzimenti, Albert D. Woods Jul 2004

Bilateral Internuclear Ophthalmoplegia As A Presenting Sign Of Multiple Sclerosis: An Interdisciplinary Approach To Diagnosis And Management, Sherrol A. Reynolds, Joseph Pizzimenti, Albert D. Woods

Internet Journal of Allied Health Sciences and Practice

Multiple sclerosis (MS) is an inflammatory demyelinating disease of the central nervous system with various neurological and ocular manifestations. Ocular involvement occurs in approximately 80% of patients sometime during the course of the illness, and may be the presenting sign in about 50% of the patients with this disease. Bilateral internuclear ophthalmoplegia (BINO) is a common ocular complication of MS, occurring in up to one third of all MS patients. BINO is an ocular motility impairment characterized by a total or partial inability to adduct each eye accompanied by a concomitant nystagmus of the abducting eye on lateral gaze and …

Informing Discharge Plans. Assessments Of Elderly Patients In Australian Public Hospitals: A Field Study, Karen Grimmer, Esther May, Anna Dawson, Claudia Peoples

Internet Journal of Allied Health Sciences and Practice

This paper describes assessment practices related to discharging elderly patients from Australian acute public hospitals. Common assessments were of cognition, continence, wound care, hygiene needs, nutrition, mobility and self-care. Nurses and social workers commonly took non-standardised assessment approaches, whilst therapists were more likely to use published assessment instruments. Patients’ perspectives were rarely incorporated into assessments. The relationship between many common assessment items and patients’ ability to manage safely after discharge from hospital was unclear. The validity of assessment items, the reliability with which assessments were taken, ‘normal’ variability in responses, and interpretation of instrument ‘scores’ with respect to post-discharge independence …

Financial Planning For Postsecondary Education In Canada: A Comparison Of Savings And Savings Instruments Employed Across Aspiration Groups, Paul Anisef, Robert Sweet, Peggy Ng Jul 2004

Financial Planning For Postsecondary Education In Canada: A Comparison Of Savings And Savings Instruments Employed Across Aspiration Groups, Paul Anisef, Robert Sweet, Peggy Ng

Journal of Student Financial Aid

Canadians have experienced a reduction in government funding toward postsecondary education over the past ten years, as well as a shift in student-support policies. Historically, paying the costs of postsecondary education in Canada has been a responsibility shared by the state, and students and parents. Changes in government policy have forced families to assume a greater share of their children’s postsecondary costs and have required a shift in their educational planning priorities. There is a corresponding need on the part of policy researchers to better understand this reorientation. The purpose of this paper is to document how parents save for …

Constraints On Adaptive Evolution: The Functional Trade-Off Between Reproduction And Fast-Start Swimming Performance In The Trinidadian Guppy (Poecilia Reticulata), Cameron K. Ghalambor, David N. Reznick, Jeffrey A. Walker Phd Jul 2004

Walker Phd

Faculty Publications

The empirical study of natural selection reveals that adaptations often involve trade-offs between competing functions. Because natural selection acts on whole organisms rather than isolated traits, adaptive evolution may be constrained by the interaction between traits that are functionally integrated. Yet, few attempts have been made to characterize how and when such constraints are manifested or whether they limit the adaptive divergence of populations. Here we examine the consequences of adaptive life-history evolution on locomotor performance in the live-bearing guppy. In response to increased predation from piscivorous fish, Trinidadian guppies evolve an increased allocation of resources toward reproduction. These populations …

Reappraising T.L.O.'S Special Needs Doctrine In An Era Of School-Law Enforcement Entanglement, Josh Gupta-Kagan Jul 2004

Reappraising T.L.O.'S Special Needs Doctrine In An Era Of School-Law Enforcement Entanglement, Josh Gupta-Kagan

Faculty Publications

This essay presents one doctrinal method for lawyers to defend children accused of criminal charges in juvenile or adult court: attacking the applicability of the twenty-year old case, New Jersey v. T.L.O., to most school searches. T.L.O. based its application of a lower standard for searches of students by school officials on the presumption that firm gates separate public school from law enforcement and criminal justice institutions. Later administrative search cases inside and outside of the school context show that tee lower standard of T.L.O. depends entirely on programmatic purposes that distinguish school systems and ordinary law enforcement. Porous schoolhouse …
