The Supreme Court's Limitation Of Managed-Care Liability, Wendy K. Mariner Sep 2004

The Supreme Court's Limitation Of Managed-Care Liability, Wendy K. Mariner

Faculty Scholarship

This article summarizes and critiques the U.S. Supreme Court's decision in Aetna Health Inc. v. Davila, which limited managed care organizations' liability for negligent decisions about the care of patients in private employer-sponsored health plans governed by ERISA. It contrasts the Court's dichotomous view of health benefit plans, in which insurers administer contracts and treating physicians make medical judgments, with the more complicated relationships that affect decisions about both coverage and treatment.

An Agenda On Productive Aging: Research, Policy, And Practice, Nancy Morrow-Howell, Michael Sherraden, Amanda Moore Mcbride, Jim Hinterlong, Philip Rozario, Fengyan Tang

Center for Social Development Research

The Center for Social Development (CSD) at Washington University in St. Louis is advancing an agenda on productive aging, focusing on three primary forms of productive engagement: employment, volunteerism/civic engagement, and caregiving. These are activities that produce goods and services, whether paid for or not, and that have effects beyond individuals to families, communities, and society. Older adults who engage in these activities make important economic and social contributions, though these contributions are often undervalued. This agenda on productive aging builds on the results of a CSD-sponsored symposium where leading gerontologists from many academic disciplines discussed older adults as a …

Risk Factors Of Major Noncommunicable Diseases In Bahrain. The Need For A Surveillance System, Randah R. Hamadeh

Saudi Medical Journal

Noncommunicable diseases NCDs are the major cause of morbidity and mortality in Bahrain. The review examines the prevalence of risk factors of major NCDs from the available literature and determines the impact of the rapid socio economic changes on their burden. It further recommends ways of improving their reporting and monitoring. Smoking, obesity, diabetes, hypertension, hyperlipidemia, physical activity and nutrition are considered. The review points out that data on some of the factors is available but deficient for others. The call for the establishment of an integrated surveillance system using the World Health Organization STEPwise approach is stressed.

Cooperation Of Different Neuronal Systems During Hand Sign Recognition, A Nakamura, B Maess, Tr Knösche, Et Al Sep 2004

Cooperation Of Different Neuronal Systems During Hand Sign Recognition, A Nakamura, B Maess, Tr Knösche, Et Al

School of Psychology

Hand signs with symbolic meaning can often be utilized more successfully than words to communicate an intention; however, the underlying brain mechanisms are undefined. The present study using magnetoencephalography (MEG) demonstrates that the primary visual, mirror neuron, social recognition and object recognition systems are involved in hand sign recognition. MEG detected well-orchestrated multiple brain regional electrical activity among these neuronal systems. During the assessment of the meaning of hand signs, the inferior parietal, superior temporal sulcus (STS) and inferior occipitotemporal regions were simultaneously activated. These three regions showed similar time courses in their electrical activity, suggesting that they work together …

Reconstituting The Law Of The Workplace In An Era Of Self-Regulation, Cynthia L. Estlund Aug 2004

Reconstituting The Law Of The Workplace In An Era Of Self-Regulation, Cynthia L. Estlund

ExpressO

As the reach of collective bargaining has shrunk in recent decades, the domain of employment law – of judicially-enforceable individual rights and administratively-enforced regulatory standards – has expanded. Both branches of employment law have seen the rise of employer “self-regulation” – internal systems for enforcement of rights and regulatory standards – and of legal inducements to self-regulation in the form of reduced public oversight or sanctions. In the shift from “self-governance” to “self-regulation,” employees have lost their institutional voices and are losing the protective oversight of courts and public agencies. In this article Professor Estlund looks for ways not to …

The New Neurobiology Of Severe Psychiatric Disorders And Its Implications For Laws Governing Involuntary Commitment And Treatment, E Fuller Torrey, Ken Kress Aug 2004

The New Neurobiology Of Severe Psychiatric Disorders And Its Implications For Laws Governing Involuntary Commitment And Treatment, E Fuller Torrey, Ken Kress

ExpressO

Medical advances have led to statutory changes and common law overrulings. This paper argues that such changes are now needed for laws governing the involuntary commitment and treatment of individuals with severe psychiatric disorders. Recent advances in the understanding of the neurobiology of these disorders have rendered obsolete many assumptions underlying past statutes and legal decisions. This is illustrated by using schizophrenia as an example and examining two influential cases: California’s Lanterman-Petris-Short Act (1969) and Wisconsin’s Lessard decision (1972). It is concluded that laws governing involuntary commitment and treatment need to be updated to incorporate the current neurobiological understanding of …

Network Anomaly Detection Using Management Information Base (Mib) Network Traffic Variables, Jun Li Aug 2004

Network Anomaly Detection Using Management Information Base (Mib) Network Traffic Variables, Jun Li

Dissertations

In this dissertation, a hierarchical, multi-tier, multiple-observation-window, network anomaly detection system (NADS) is introduced, namely, the MIB Anomaly Detection (MAD) system, which is capable of detecting and diagnosing network anomalies (including network faults and Denial of Service computer network attacks) proactively and adaptively. The MAD system utilizes statistical models and neural network classifier to detect network anomalies through monitoring the subtle changes of network traffic patterns. The process of measuring network traffic pattern is achieved by monitoring the Management Information Base (Mifi) II variables, supplied by the Simple Network Management Protocol (SNMP) LI. The MAD system then converted each monitored …

Modeling Contaminant Transport And Fate And Subsequent Impacts On Ecosystems, Ming Fan Aug 2004

Modeling Contaminant Transport And Fate And Subsequent Impacts On Ecosystems, Ming Fan

Dissertations

Assessing risks associated with the release of metals into the environment and managing remedial activities requires simulation tools that depict speciation and risk with accurate mechanistic models and well-defined transport parameters. Such tools need to address the following processes: (1) aqueous speciation, (2) distribution mechanisms, (3) transport, and (4) ecological risk. The primary objective of this research is to develop a simulation tool that accounts for these processes. Speciation in the aqueous phase can be assessed with geochemical equilibrium models, such as MINEQL+. Furthermore, metal distribution can be addressed mechanistically. Studies with Pb sorption to amorphous aluminum (HAG), iron (HFO), …

The main purpose of this study is to understand how people behave in such communities, and to build and evaluate tools to stimulate engagement in a research community. These tools were designed based on a research framework of factors that influence online participation and relationship development.

There are two main objectives for people to join an online community, information sharing and interpersonal relationship development, such as friends or colleagues. The tools …

Toxicity Of Manufactured Particulate Materials On Plant Root Growth, Ling Yang Aug 2004

Toxicity Of Manufactured Particulate Materials On Plant Root Growth, Ling Yang

Dissertations

The rapid development of particle technology and the growing use of particulate materials in industries are bringing large amounts of manufactured particles into the environment. Epidemiological studies suggest that fine particles (particles with aerodynamic diameter smaller than 2.5 μm, i.e., PM2.5) have an association with various adverse health effects in humans. Mass studies have been performed on the toxicity and toxicological mechanisms of airborne particles such as PM2.5 and PM10, but there are very few investigations which contribute to the knowledge base on biological implications of manufactured particulate materials. Up to now, the published toxicity …

A Report From The Forum Session "Implementing The New Medicare Drug Benefit: Challenges And Opportunities For States", Judith D. Moore

National Health Policy Forum

The National Health Policy Forum convened a meeting on July 22, 2004 to discuss state-based challenges associated with implementing the Medicare Prescription Drug, Improvement, and Modernization Act (MMA). The meeting brought together an extremely insightful and experienced group of current and former state officials and other experts to discuss key issues. In keeping with its tradition of promoting a frank, off-the-record exchange on health policy issues, NHPF does not normally prepare written summaries or reports of meetings. However, because this meeting provided vivid illustrations of the importance of state-federal collaboration for the successful implementation of the new Medicare drug benefit, …
