The doctrine of stare decisis applies only to holdings of past cases, but scholars and courts have paid far more attention to stare decisis doctrine than to the distinction between holding and dicta, particularly in recent years. The lack of attention that the distinction receives may reflect a sense among legal analysts that they know dicta when they see it, but the problem is considerably more analytically complex than it may at first appear. People who are not white males may be at risk when their physicians prescribe medication. That is because funding, research, pharmacology and every benchmark for what represents quality health care have historically centered on one gender and one group: males of European origin. It is a critical flaw in the development of health care services and programs – in the United States and beyond.

In today’s health care environment, that historical focus has left its legacy: marked disparities in the type and quality of care culturally diverse groups receive when they seek medical attention.

Deminer [the Victim] used his rake in normal manner. He set off a P4 MK1 antipersonnel mine with his 2-tooth heavy rake. Heavy rake bended but remained in one piece in the blast. Deminer was in perfect health and didn’t get bruises nor other minor injuries.

Does The Job Matter? Comparing Correlates Of Stress Among Treatment And Correctional Staff In Prisons, Gaylene Armstrong, Marie L. Griffin

Criminology and Criminal Justice Faculty Publications

The wealth of literature on stress in the correctional workplace focused on correctional officers, frequently ignoring treatment personnel employed in these same institutions. This study advanced the literature on correctional workplace stress by: (1) testing for differences in workplace stress between correctional officers and treatment personnel, (2) examining personal and environmental factors to determine whether distinct precursors to stress existed for these two groups, and (3) utilizing multiple measures of stress. Self-report survey data from 3,794 employees in ten adult prisons in a southwestern state demonstrated that both groups of employees reported moderately high levels of job stress and stress-related …
