A New Corps Of Discovery For Missouri River Management, Sandra B. Zellmer Jan 2004

A New Corps Of Discovery For Missouri River Management, Sandra B. Zellmer

Nebraska Law Review

On the Missouri River, tensions have run high ever since the Corps of Discovery explored the river’s furthest reaches in the early 1800s, with conflict between navigation and ecological protection in the Missouri River basin. Upper basin states are pitted against lower basin states, and both have had their run-ins with federal agencies. The U.S. Army Corps of Engineers stands at the vortex of the controversy while the states as well as environmental and commercial associations demand contradictory and even mutually exclusive responses in river operations. The objective of this article is two-fold: first, to show that the Master Manual …

Multiple-Use Water Resources Development Versus Natural River Functions: Can The Wsra And Wrda Coexist On The Missouri River?, John H. Davidson Jan 2004

Multiple-Use Water Resources Development Versus Natural River Functions: Can The Wsra And Wrda Coexist On The Missouri River?, John H. Davidson

Nebraska Law Review

In 1986 the United States Congress designated the Upper Mississippi River System as both a “nationally significant ecosystem” and a “nationally significant commercial navigation system.” This ambivalence in river legislation results in Congress investing heavily in the engineering of a river while also declaring its desire to protect, in some way, the same river’s natural features. The conflicts inherent in the water resources development process have been made more intense by the Clean Water Act, the National Environmental Policy Act of 1969, and the Endangered Species Act of 1973. Congress frequently authorizes development projects and protection projects on the same …

The Potential For State Labor Law: The New York Greengrocer Code Of Conduct, Matthew T. Bodie Jan 2004

The Potential For State Labor Law: The New York Greengrocer Code Of Conduct, Matthew T. Bodie

All Faculty Scholarship

While labor law academics bemoan the ossification of federal labor law, the potential for state labor law has just begun to be explored. This Article takes a closer look at the New York Greengrocer Code of Conduct, a unique approach to the problem of industry-wide employment law violations. The Code, negotiated by the New York Attorney General's Office in conjunction with groups representing workers and greengrocers, provides a set of minimum terms and conditions for grocers which to some extent go beyond statutory requirements. In return for agreeing to the Code, grocers can avoid liability for past state employment law …

Disentitlement? The Threats Facing Our Public Health-Care Programs And A Rights Based Response, Sidney D. Watson Jan 2004

Disentitlement? The Threats Facing Our Public Health-Care Programs And A Rights Based Response, Sidney D. Watson

All Faculty Scholarship

In the battle over the future of American health policy, the lines are drawn. On one side are those who seek to turn health care financing and delivery over to private markets that are individualized—where patients strike their own bargains rather than relying on employers or government insurers—and free from governmental mandates. On the other side are those who support a continuing role for government in assuring access to health insurance and health services and in controlling costs and monitoring the quality of care. The lines are hard, fast, and ideological.

The most recent skirmish ended November 24, 2003, when …

Images Of Health Insurance In Popular Film: The Dissolving Critique, Elizabeth Pendo Jan 2004

Images Of Health Insurance In Popular Film: The Dissolving Critique, Elizabeth Pendo

All Faculty Scholarship

Several recent films have villainized the health insurance industry as central elements of their plots. This Article examines three of those films: Critical Care, The Rainmaker, and John Q. It analyzes these films through the context of the consumer backlash against managed care that began in the 1990s and shows how these films reflect the consumer sentiment regarding health insurance companies and the cost controlling strategies they employ. In addition, the Article identifies three key premises about health insurance in the films that, although exaggerated and incomplete, have significant factual support. Ultimately, the author argues that, despite their passionately critical …

Whistling In The Dark? Corporate Fraud, Whistleblowers, And The Implications Of The Sarbanes-Oxley Act For Employment Law, Miriam A. Cherry

All Faculty Scholarship

Passed in 2002 in the wake of the accounting scandals that resulted in billions of dollars of lost value to shareholders, the Sarbanes-Oxley Act has as its major goal the prevention of corporate corruption. This Article analyzes the impact of Section 806, the portion of the Sarbanes-Oxley Act that provides protections for employees who report securities fraud, and describes the effect that Sarbanes-Oxley has on existing employment law. In addition, this Article contributes to the debate over the general effectiveness of the Sarbanes-Oxley Act, a topic of contention among both academics and press commentators. This Article argues that the Act …

How To Succeed In Business Without Really Trying (Cases): Gender Stereotypes And Sexual Harassment Since The Passage Of Title Vii, Miriam A. Cherry

All Faculty Scholarship

This Article, which is part of a symposium on the 40th Anniversary of Title VII appearing in the Hofstra Labor and Employment Law Journal, evaluates the progress of women in the workforce by critically analyzing the musical "How to Succeed in Business Without Really Trying." Written in the early 1960s and made into a 1967 movie, How to Succeed follows the adventures of J. Pierrepont Finch, a window washer who, with the aid of a sarcastic self-help book, schemes his way up the corporate ladder. It also includes the sexual exploits of the exclusively male executive corps among the female …

Beyond Bakke: Grutter-Gratz And The Promise Of Brown, Joel K. Goldstein Jan 2004

Beyond Bakke: Grutter-Gratz And The Promise Of Brown, Joel K. Goldstein

The Supreme Court’s long-awaited decisions this past summer in the Michigan affirmative action cases provided yet another landmark in the continuing controversy regarding race and education. A quarter century, almost to the day, after the Court handed down its badly splintered decision in Regents of the University of California v. Bakke,[1] the Court again concluded that universities may sometimes, but not always, give some preference to racial and ethnic minorities in deciding whom to admit. The Court, in a 5-4 decision in Grutter v. Bollinger, upheld the constitutionality of the University of Michigan Law School’s admission policy that considered race …

The Wisconsin Fetal Alcohol Syndrome Screening Project, Marianne E. Weiss, Christine E. Cronk, Sandra Mahkorn, Randall Glysch, Sara Zirbel

College of Nursing Faculty Research and Publications

Problem: Fetal Alcohol Syndrome (FAS) is preventable, under-diagnosed, and under-reported. Wisconsin rates for alcohol use and binge drinking in childbearing-age women exceed the national average. FAS prevalence in Wisconsin has not previously been systematically evaluated. Methods: The Wisconsin Fetal Alcohol Syndrome Screening Project (WFASSP) used a multi-stage, multi-source prospective population-based screening methodology to identify children born in 1998-1999 in Southeast Wisconsin who met a surveillance case definition for FAS. The 4-stage methodology used screening of electronic birth files, abstraction of neonatal medical records, and direct assessment of facial features, growth, and development at age 2 to 3 years. Results: The …

Opportunities In The Broadcast News Media: A Case Study In Gender Equity, Derek R. Lumsden Jan 2004

Opportunities In The Broadcast News Media: A Case Study In Gender Equity, Derek R. Lumsden

Seton Hall University Dissertations and Theses (ETDs)

When one thinks of gender equity, some people would tend to get a picture of women crusading for rights, burning their bras and men in effigy, and complaining about the unfairness of life. However, this paper deals with the silent crusade towards women's right in the broadcast news industry. It revolves around a case study done in a small Midwestern town that shows how 'liberal' ideas can be forwarded in a 'conservative' environment, especially in regards to the promotion and equity of women in the broadcast news industry.

An Analysis Of The Relationship Between Organizational Culture And Occupational Stress: Perceptions Of Employees Following A Merger, Brent J. Pasula Jan 2004

An Analysis Of The Relationship Between Organizational Culture And Occupational Stress: Perceptions Of Employees Following A Merger, Brent J. Pasula

Theses: Doctorates and Masters

There is a growing body of literature regarding the physiological and psychological effects of stress resulting from the increasing concern about occupational stress. This study attempts to fill an identified gap within epidemiologic literature by examining whether organizational culture has an influence on the level of occupational stress, perceived by employees, following the merger of their company with another. To explore this relationship, five research questions were examined using a data gathering process that consisted of a self-administered survey to measure psychosomatic strain, stress-inducing work demands, and organizational culture.

The Young School-Age Assessment Of Attachment (Ysaa): Development And Preliminary Validation, Lynn E. Priddis Jan 2004

The Young School-Age Assessment Of Attachment (Ysaa): Development And Preliminary Validation, Lynn E. Priddis

Theses: Doctorates and Masters

This manuscript describes the development and preliminary validation of a new assessment procedure called the Young School-age Assessment of Attachment (YSAA). The tool has clinical as well as research relevance in that it identifies the attachment strategies of children aged 5-7 years as well as recognising attachment related problems for this age group. The YSAA is a representational procedure that uses line drawings of a child teddy in attachment-related situations. The stimulus cards, probes, and administration procedures were piloted and refined in the initial stages of this study. The children's narratives that were generated from this procedure were examined for …

Occupational Awareness Of Singapore Primary School Children, Joy S. Ang Jan 2004

Occupational Awareness Of Singapore Primary School Children, Joy S. Ang

Theses: Doctorates and Masters

The introduction of career guidance programmes in Singapore schools had tended to predominantly focus on secondary pupils. The lack of proactive career guidance programmes for the primary school had been due to the misguided belief that children in the primary school still have an extremely long way to go before they enter the workforce, and that their career development had not yet begun. Studies have shown that children have a natural tendency to form firm impressions of occupations early in life. This has resulted in their adopting certain occupations and discarding others before they have fully explored and understood the …

Formative Study Of Aggression Prevention And Reduction In Junior Primary School: Final Report Presented To The Western Australian Health Promotion Foundation: Book 1 Of 2, Donna Cross, Greg Hamilton, Clare Roberts, Margaret Hall

Research outputs pre 2011

This one year formative study aimed to conduct a feasibility trial of current evidencebased practice to reduce and prevent aggression among junior primary school age children. The project comprised three stages: assessing the types of direct and indirect aggression among junior primary school students and the current practices of teachers and schools to address this behaviour and linking successful current practices to evidence-based research to inform the development of a classroom teaching and behaviour management intervention.

Aggression is broadly defined as negative acts which are used intentionally to harm others, and may be classified as proactive, reactive or instrumental aggression. …
