Applying The Transtheoretical Model Of Change To Consumer Debt Behavior, Jing Jian Xiao, Barbara M. Newman, Janice M. Prochaska, Berta Leon, Robert L. Bassett, Janet L. Johnson

Human Development and Family Science Faculty Publications

The Transtheoretical Model of Change (TMM) provided the framework for developing a measure to assess readiness to get out of credit card debt with consumers who are having credit card debt troubles. Key constructs of TTM include stages of change, decisional balance, self-efficacy, and processes of change. The items for the measure were developed by qualitative interviews with experts in credit counseling and consumers with debt troubles. A survey was then completed with a reliability and validity of the measure. The results have potential for use by counseling practitioners, educators and researchers.

Detecting Spatiotemporal Clusters Of Accidental Poisoning Mortality Among Texas Counties, Us, 1980 – 2001, Ella T. Nkhoma, Chiehwen E. Hsu, Victoria I. Hunt, Ann M. Harris

Faculty, Staff and Student Publications

Background Accidental poisoning is one of the leading causes of injury in the United States, second only to motor vehicle accidents. According to the Centers for Disease Control and Prevention, the rates of accidental poisoning mortality have been increasing in the past fourteen years nationally. In Texas, mortality rates from accidental poisoning have mirrored national trends, increasing linearly from 1981 to 2001. The purpose of this study was to determine if there are spatiotemporal clusters of accidental poisoning mortality among Texas counties, and if so, whether there are variations in clustering and risk according to gender and race/ethnicity. The Spatial …

The Illusion Of Law: The Legitimating Schemas Of Modern Policy And Corporate Law, Ronald Chen, Jon Hanson Jan 2004

The Illusion Of Law: The Legitimating Schemas Of Modern Policy And Corporate Law, Ronald Chen, Jon Hanson

Michigan Law Review

This Article is about some of the schemas and scripts that form and define our lives. It is about the knowledge structures that shape how we view the world and how we understand the limitless information with which we are always confronted. This Article is also about the "evolution of ideas" underlying corporate law and all of modern policymaking. It is about the ways in which schemas and scripts have influenced how policy theorists, policymakers, lawyers, and many others (particularly in the West) understand and approach policymaking generally and corporate law specifically. It is about both the invisibility and blinding …

Satirical Legal Studies: From The Legists To The Lizard, Peter Goodrich Jan 2004

Satirical Legal Studies: From The Legists To The Lizard, Peter Goodrich

Michigan Law Review

In Part I, I expand on the distinction between the Horatian and the Menippean forms of satire and then suggest that a similarly bold division can be used to map satirical legal studies. In support of that argument, I use the example of the earliest surviving satirical legal poem within the Western tradition. My analysis of this exemplary satirical legal artifact delineates four principal modes of legal satire that will organize the ensuing discussion of more contemporary examples of the genre. In Part II, I will address the currently popular and yet somewhat novel mode of ad hominem or nominate …

Transnational Labor Mobilizing In Two Mexican Maquiladoras: The Struggle For Democratic Globalization, Victoria Carty Jan 2004

Transnational Labor Mobilizing In Two Mexican Maquiladoras: The Struggle For Democratic Globalization, Victoria Carty

Sociology Faculty Articles and Research

The struggle to improve workers' rights in Mexican maquiladoras and export processing zones elsewhere in the world is central to the politics of global economic integration. State-centered development is increasingly compromised by supranational institutions and trade agreements. Meanwhile, multinational corporations are relocating at an unprecedented rate to overseas locations. Export processing zones are notorious for poor working conditions and result in a "race to the bottom." The maquila sector in Mexico is a prime example of this phenomenon. This article uses two case studies to examine ways in which grassroots organizing has successfully resisted low wages and poor working conditions …

Business As Usual? Brown And The Continuing Conundrum Of Race In America, Robert S. Chang, Jerome M. Culp Jr. Jan 2004

Business As Usual? Brown And The Continuing Conundrum Of Race In America, Robert S. Chang, Jerome M. Culp Jr.

Faculty Articles

In this article, Professors Robert Chang and Jerome Culp examine the state of race in America in the aftermath of the landmark Supreme Court decision of Brown v. Board of Education, focusing on the ten-year window preceding its fiftieth anniversary. Their findings reveal that while Brown established fundamental precedent in the area of race relations, racial inequality remains entrenched in a number of modern social institutions. Chang and Culp analyze this dilemma by focusing on three distinct trends. First, a cycle of inequality is driven by racial disparities in wealth and perpetuated by interlocking systems of education, housing, family, healthcare, …

Beyond Lane: Who Is Protected By The Americans With Disabilities Act, Who Should Be?, Russell Powell Jan 2004

Beyond Lane: Who Is Protected By The Americans With Disabilities Act, Who Should Be?, Russell Powell

Faculty Articles

This article reviews the state of disability law under the Americans with Disabilities Act ("ADA"), with particular attention paid to Lane and other recent Supreme Court cases. In Lane, the Court affirmed that Congress validly exercised its power when it made states subject to suits under the ADA, at least with regard to limitations on access to courts. While the decision addresses Title II of the ADA (restrictions on state discrimination), it does have broader implications for the Act as a whole. Lane reflects a significant shift in the ethical paradigm used by the court to decide ADA cases and …

Trade Liberalization, Food Security And The Environment: The Neoliberal Threat To Sustainable Rural Development, Carmen G. Gonzalez Jan 2004

Trade Liberalization, Food Security And The Environment: The Neoliberal Threat To Sustainable Rural Development, Carmen G. Gonzalez

Faculty Articles

This article examines the historic and contemporary roots of chronic malnutrition and environmental degradation in the developing world. It chronicles the patterns of trade and production that contribute to this problem from the colonial period until the present, and analyzes the role of contemporary trade, aid and development practices in ameliorating or exacerbating the problem. The article argues that the neoliberal economic reforms imposed on developing countries through the International Monetary Fund (IMF), the World Bank, and the World Trade Organization (WTO) exacerbate hunger and environmental degradation by reinforcing pre-existing inequities in the global trading system that relegate many developing …

Preemptive War: Is It Constitutional, John B. Mitchell Jan 2004

Preemptive War: Is It Constitutional, John B. Mitchell

Faculty Articles

When America attacked Iraq in 2002, it was the first preemptive war in the history of our nation. While there is daily debate over the wisdom and consequences of that action, the question whether the federal government even possessed the power under the Constitution to wage preemptive war does not seem to have been raised. Although the legal literature abounds with discussion about whether the President may authorize significant military operations without the explicit authorization of Congress, the author could not find a single work written in legal cases or commentary about preemptive war. This article considers this heretofore unanswered …

Letters To The Editors Of Health Matrix, Ken Wing Jan 2004

Letters To The Editors Of Health Matrix, Ken Wing

Faculty Articles

Professor Wing presents this letter to the editor concerning the health law in the U.S. He argues that there is no severable body of principles, or even a set of issues, defined by either circumstances or type of controversy in the teaching of health law. Would health law involve the legal issues that arise in the delivery of patient care? Well, that begins to define the subject, but that is only part of what's called health law. Legal issues related to health care? To health? Those definitions may work, but what is the point of such a broad and meaningless …

The Tobacco-Related Behavioral Risks Of A Nationally Representative Sample Of Adolescents, Dolores W. Maney, Joseph J. Vasey, Beverly S. Mahoney, Sarah C. Gates, D. A. Higham-Gardill

Faculty Publications and Presentations

The study's purpose was to determine which factors were the strongest predictors of tobacco smoking behaviors among U.S. adolescents. The population included a nationally representative sample of 6,504 adolescents residing in the U.S. Data were collected in respondents 'homes using trained interviewers. Weighted population estimates showed that over half (55.6%) of adolescents had "ever tried smoking," nearly half of whom (48.2%) reported "regular smoking." Those whose closest friends smoked were twice as likely to "ever smoke " (OR = 2.24, p<.001), twice as likely to be a "regular smoker" (OK = 2.28, p <.OO1), and more likely (b = 5.15p <.OO1) to have smoked daily than those whose friends do not smoke. Results show the very strong influence of friendships on tobacco initiation and continuance among this national sample of adolescents. Recommendations for primary and secondary prevention are noted.

Presidents, Profits, Productivity, & Poverty: A Great Divide Between The Pre- & Post-Reagan U.S. Economy?, Richard K. Caputo Jan 2004

Presidents, Profits, Productivity, & Poverty: A Great Divide Between The Pre- & Post-Reagan U.S. Economy?, Richard K. Caputo

The Journal of Sociology & Social Welfare

This paper examined profits, productivity, and poverty in the United States from 1961 through 2002. Results indicated that the "great divide" thesis regarding the U.S. economy before and after the Reagan administration depends on which measure of the economy is the focus of attention. In addition, on some measures where before and after differences were detected, the nature of those differences was paradoxical. Corporate profits as a share of national income, for example, were highest in Democratic rather than Republican administrations and despite the increased income inequality of the post-Reagan years, individual and family poverty rates remained relatively constant after …

Noninvasive Assessment Of Diffusion Hypoxia Following Administration Of Nitrous Oxide-Oxygen, Arthur H. Jeske, Clark W. Whitmire, Chris Freels, Mike Fuentes Jan 2004

Noninvasive Assessment Of Diffusion Hypoxia Following Administration Of Nitrous Oxide-Oxygen, Arthur H. Jeske, Clark W. Whitmire, Chris Freels, Mike Fuentes

Faculty, Staff and Student Publications

The phenomenon of diffusion hypoxia is commonly believed to occur unless nitrous oxide-oxygen inhalation sedation is followed by "washout" with 100% oxygen for 5 minutes upon termination of the flow of nitrous oxide. When systematically studied, however, this phenomenon generally appears to be unfounded. The present study evaluated the effect of breathing room air instead of 100% oxygen in healthy (ASA 1) human volunteers following administration of sedative concentrations of nitrous oxide. The occurrence of hypoxia was determined objectively, using pulse oximetry and a standardized psychomotor skills test (Trieger test). Diffusion hypoxia was not observed using these criteria.

The Demand For Information Technology Knowledge And Skills: An Exploratory Investigation, Stuart D. Galup, Ronald Dattero, Jim J. Quan Jan 2004

The Demand For Information Technology Knowledge And Skills: An Exploratory Investigation, Stuart D. Galup, Ronald Dattero, Jim J. Quan

Journal of International Technology and Information Management

Organizations are always in search of appropriate information technology knowledge and skills to carry out normal business operations. Such demand is directly impacted by the overall economic conditions. During stressful economic times, managers, facing tough budgetary pressure, are forced to examine more thoroughly what knowledge and skills are needed to survive. This paper investigates the desired information technology knowledge and skills that employers are searching for in these turbulent times. We examine the content of job advertisements for information technology professionals placed in an online job placement website over a 2 year period, 2001-2002.
